The owners of the fonner Jolly Rancher site, IBC, have requested that the City Council
set a public hearing pursuant to statute for consideration of the service plan for three
proposed metropolitan districts intended to serve certain needs of the proposed
development of the site. By statute, the City Council is the reviewing body for this
proposed service plan, and upon request must set a public hearing to consider it.
PRIOR ACTION:
None
FINANCIAL IMPACT:
The proposed service plan primarily places financing obligations on the property owners; staff
will have a recommendation concerning the impact on the City at the time of the public hearing.
BACKGROUND:
The special district statute, CRS 32-1-201 et seq, governs the procedure for the creation of
special districts, including metropolitan districts. This is the initial step in the process, which
simply requires the Council to set a date for a public hearing on the service plan for the proposed
districts . The service plan describes the services and facilities proposed to be provided to the
property via the use of the metropolitan districts, and the financing plan by which the proposed

districts will accomplish these tasks. After the public hearing, the Council may approve.
conditionally approve, or disapprove the proposed service plan .
RECOMMENDATIONS:
Staff recommends that the Council set the following date for the special hearing on the
service plan: April 9, 2012.
RECOMMENDED MOTION:
"I move to set the following date, time and place for a public hearing on the service plan
for the proposed Ward TOO Metropolitan Districts: 7:00pm, April 9, 2012. City Council
Chambers, Wheat Ridge Municipal Building. 7500 West 291h Avenue, Wheat Ridge
Colorado. I further direct staff to serve and publish notice of the hearing as required by
statute."
