CALL THE MEETING TO ORDER
The regular meeting of the Wheat Ridge Planning Commission was called to
order by Chair WESLEY at 7:00 P.M. in the City Council Chambers of the
Municipal Building, 7500 West 29`h Avenue, Wheat Ridge, Colorado.

It was moved by Commissioner McNIILLIN and seconded by Commissioner
STEWART to approve the minutes of June 15, 2006 as presented. The
motion carried 8-0.

7. PUBLIC HEARING
A. Case No. WZ-06-02 - An application filed by Wilson Community
Development for approval of a rezoning from Agricultural-One (A-1) to
Planned Residential Development (PRD) and approval of an Outline
Development Plan for property located at 5220 Quail Street.
The case was presented by Travis Crane. He entered all pertinent documents into
the record and advised the Commission there was jurisdiction to hear the case.
He reviewed the staff report and digital presentation. Staff recommended
approval of the application for reasons and with one condition as outlined in the
staff report.
In response to a question from Commissioner PLUMMER, Mr. Crane stated that
the lot sizes in the subject development were similar to adjacent lots in the
Skyline Estates Subdivision in Arvada and Wheat Ridge.
In response to a question from Commissioner McMillin, Mr. Crane stated thai
Street "A" would function as a two-way street and allow adequate fire access.
Coxnmissioner SCEZNEY asked if Arvada residents were notified of this hearing.
Mr. Crane replied that all neighbors within 600 feet of the proposed development
were notified of the neighborhood meeting, 300 foot notification far this hearing,
both of which included Arvada and Wheat Ridge. Commissioner SCEZNEY
expressed some concem about density issues.
In response to a question from Commissioner BRINKMAN, Mr. Crane stated that
the Public Works Department has had preliminazy discussions with the ditch
company. Final engineering issues will be addressed during the final
development phase.
In response to a question from Commissioner SPANIEL, Mr. Crane stated that the
proposed lot sizes for the development aze 7320 squaze feet.
In response to a question from Commissioner WESLEY, Mr. Crane stated that, to
his knowledge, none of the existing stnzctures are designated historical structures.
Steve Wilson
162 S. Corona Street, Denver
Mr. Wilson, representing the present owners (Chazles and Jill Richazdson) of the
property was swom in by Chair WESLEY. Mr. Wilson will be purchasing the
property. He stated that the rezone request is strongly supported by the change in
conditions since the azea was originally zoned agriculture. He cited the Skyline
development to the north and east, commercial development at SOth and Kipling,
as well as future light rail with stations within a half-mile of the site. Arvada has
recently revised their comprehensive plan that calls for a hundred homes to the I I

east of the property. A development of 40 condominium units is planned
unmediately adjacent to Ridge Road. Single-family residential lots will be
developed to the west of the property. He commented that he originally planned
to ask for a rezone to allow multi-family structures on this properiy but was
encouraged by staff to construct single-fasnily structures similar to Skyline. Thh
infill site is unique in that it will have little nnpact, especially in regazd to traffic,
on neighbors. He stated that there were no historic structures on the site and all
existing structures would be removed prior to development.
Commissioner BRIN~ asked about plans for park azeas other than retention
ponds. He stated that there would be the same percentage of open space in this
development as there is in Skyline Estates. Skyline Estates has no developed
parks within its development.
Mark Walinder
11001 Ridge Road
Mr. Walinder was swom in by Chair WESLEY. His property is adjacent to
subject property at the end of Parfet Street. There are two houses in his tract and
he asked if rezoning would put his property in its own little island of agriculhual
property. Mr. Crane stated that this rezone would not create an island of
agricultural property in the middle of residential zoning.
Greg Skalla
5290 Quail Street
Mr. Skalla was sworn in by Chair WESLEY. He wanted to know how much of
Quail Street would be widened. Mr. Crane explained that Quail Street would be
widened to a width of 40 feet for the length of the subject property.
Commissioner PLUNIIvIER, CHILVERS, SCEZNY and SPANIEL stated they
would support the rezone because it is compatible with surrounding development.
Commissioner McMILLIN expressed regret in going against the comprehensive
plan, but supported the rezone in light of significant changes that have taken place
in the area and the future plans for light rail through the area. Further, the rezone
will not impact settled neighborhoods.
Commissioner STEWART agreed that the rezone fits in with surrounding
development and she liked the idea of single family rather than higher density
development.
Commissioner WESLEY agreed that the rezone is appropriate in light of
surrounding development and will serve to protect property values.
It was moved by Commissioner PLUMMER and seconded by Commissioner
STEWART to recommend approval of Case No. WZ-06-02, a request for
approval of a rezoning from Agriculture-One to Planned Residential

Development, and an Outline Development Plan for property located at 5220
Quail Street, for the following reasons:
1. A change in character has recently occurred in the area. Adjacent
properties have been rezoned and developed with single-family
residential homes. A large retail center has been constructed within %Z
mile of the subject property. A proposed light rail line will be located
just south of Ridge Road. These changes create a favorable climate
for additional residences.
2. The change in zone is compatible with new development to the east
and the proposed Arvada Comprehensive Plan update directly to the
west.
3. Adequate infrastructure will be constructed as a result of the
development. Two existing roads will be widened and improved, and
two new streets will be constructed. Sidewalks will be constructed
adjacent to the new public streets to serve the neighborhood. These
additions and alterations will improve the vehicular and pedestrian
traffic in the area.
4. The change in zone will not adversely affect the public health, safety
or welfare, nor will it create an isolated or spot zone district.
5. The change in zone will be in conformance with several goals of the
Comprehensive Plan, specifically providing quality aesthetically
pleasing housing, providing a variety of housing and development that
is a contribution to and compatible with the surrounding
neighborhood.
With the following condition:
1. The note on the ODP in Character ofDevelopment shall be amended to
read: Accessory structures larger than 120 square feet in area shall be
constructed of materials and painted in a manner similar to and
compatible with the primary structure.
The motion passed 8-0.
B. Case No. ZOA-06-01- An ordinance amending Chapter 26 of the Wheat
Ridge Code of Laws concerning Temporary Sales and Events.
This case was presented by Travis Crane. He entered all pertinent documents into
the record and advised the Comxnission there was jurisdiction to hear the case.
He reviewed the staff report and digital presentation. Staff recommended
approval for reasons outlined in the staff report.
Commissioner PLUNIMER suggested changing 60 days to 90 for farmers markets
and Christmas tree lots and plant stands to 60 from 30.

Commissioner BRiNKMAN expressed concern that auto sales could take place at
auto shows. Mr. Crane replied that this could possibly happen from time to time
and would be an enforcement issue.
Comxnissioner BRINKMAN commented that there has been a predominance of
antique flea markets in the area and suggested that these events be allowed.
Commissioner SCEZNEY asked about the sale of alcoholic beverages. Mr. Crane
suggested that liquor sales should be excluded from the temporary food category.
If liquor sales are to take place at an event, the city clerk's office should be
contacted in order to obtain a permit. He also explained that the intent of luniting
food sales to that which could be consumed on the premises was to prevent the
sale of groceries to be taken home at temporary events.
Commissioner STEWART expressed concem about requiring pernuts and fees
for fundraisers such as car washes. Mr. Crane suggested that fees be waived for
such events.
Chair WESLEY asked if there were any individuals present who wished to
address this matter. There was no response.
It was moved by Commissioner CHILVERS and seconded by Commissioner
STEWART to recommend approval of the ordinance amending Chapter 26
of the Zoning Code which will establish regulations for temporary sales and
events as presented by staff.
Commissioner PLUMMER offered a friendly amendment to allow holiday
tree sales to occur for 60 days rather than 30, that bedding plant sales be
allowed for 60 days rather than 30, and that farmers markets be allowed for
90 days rather than 60. This amendment was accepted by Commissioners
CEiILVERS and STEWART.
Commissioner STEWART offered a friendly amendment to give staff
discretion to waive fees for fundraising events. This amendment was
accepted by Commissioners CHILVERS and STEWART.
Commissioner BRINKMAN offered a friendly amendment to add the word
"sales" to paragraph "E" under Section 26-627 to read "The following
temporary sales events shall not be allowed This
amendment was accepted by Commissioners CHILVERS and STEWART.
Commissioner BRINKIVIAN oFfered a friendly amendment to add an
additional standard under Section 26-627 that would read: "Liquor sales
must have a valid liquor license where applicable." This amendment was
acceptedby Commissioners CHiLVERS and STEWART.

Coinmissioner SCEZNEY offered a friendly amendment to remove L-4
which states that only one food merchant is allowed per principal
commercial use. The amendment was not accepted by the maker of the
motion.
The amended motion passed 8-0.
8. OLD BUSINESS
• There was a consensus to add Dark Skies discussion as a fixture agenda item.
• Coxnmissioner PLUIvIMER commented that he believed the Commission
should not have yielded to the 25' pole height for Cabela's.
9. NEW BUSINESS
A. Amendment to Planning Commission Bylaws
The primary change to the bylaws is to paragraph 10 dealing with quorums.
Under the proposed change, items scheduled for the meeting at which no quorum
is present would automatically be continued to the next regular meeting.
There was a consensus to change paragraph 2, Special Meetings to read: "Special
meetings may be established by motion and a favorable vote of the Commission at
a regular meeting or may be called by the Commission Secretary upon written
request of the chairman or any two members of the Commission "
It was moved by Commissioner PLUMMER and seconded by Commissioner
SCEZNEY to approve the proposed bylaws changes with the suggested
changes and direct that they be forwarded to City Council for ratification.
The motion passed 8-0.

I. REQUEST
This application is a three-fold request for property located in and adjacent to the Coors
Glass Plant facility at 10619 W. 50th Avenue. Sepazate motions will be required for each
component of the request. The specific requests are as follows:
1. Establishment of zoning on property located in unincorporated Jefferson County
and approval of an amended Outline Development Plan for the existing Coors
Glass Plant facility and the unincorporated property.
2. Approval of a Final Development Plan for the existing Coors Bottling Plant
facility and the unincorporated property.
3. Approval of a Final Plat for the existing Coors Glass Plant facility and the
unincorparated property with a right-of-way vacation for "oid" Miller Street.
The intent of these actions will a11ow the assemblage of the new pazcel with the existing
facility parcel to enhance circulation and delivery for the plant which previously occurred
on Miller Street. There is also a small building expansion of around 1000 s.f. being
provided for by the amended development plans.
The property between old and new Miller Street is currently in the process of being
annexed into the City of Wheat Ridge. Planning Commission does not have jurisdiction
to give a recommendation on the merits of the annexation but is required to give
recommendation on the other land use requests.

U. CASE HISTORY
The Coors glass plant property was originally brought into the City when Wheat Ridge
was incorporated in 1969. There were a series of amended development plan approvals
from 1977 through 2002, the most recent of which allowed for reconfiguration of the
entrance and Parking azea off W. SOth Avenue.
To the east is property located in the City of Arvada developed as the "Arvada Ridge"
project, a regional mixed-use development containing 56 acres. The development
improvements included the relocation and construction of new Miller Street and W. 50ffi
Avenue extending from Kipling to Miller. The area located between old Miller and the
eastern side of new Miller Street was disconnected from the City of Arvada in August of
2005. The property was platted as part of the Arvada Ridge development approval and
Coors purchased the area disconnected by Arvada. In an intergovernmental agreement
with Arvada, Wheat Ridge agreed to annex this disconnected parcel and incorporate it
into the exisring glass plant development.

IV. OUTLINE DEVELOPMENT PLAN
The Outline Development Plan typically accompanies a zone change request on a
property and set allowable uses and development standards. It is typically general in
nature and serves as a basic blueprint for development of the property. In this case, the
applicant is requesting Outline Development Plan approval to incorporate the new parcel

Uses permitted in the planned development are glass manufacturing, wazehousing and
other ancillary uses to the manufacturing.
The outline development plan is also used to establish design pazameters including
masimuxn building height, minimum landscaped coverage and minimum perimeter
setbacks as depicted in the table below.

The existing zoning and development code requires commercial properties to have 20%
landscaped coverage. This ODP proposes no change to that standard. The building
height maximum for new structures is 50'. Setbacks required are consistent with
commercial zone districts in the zoning and development code. The ODP refers back to
the Code of Laws for all other standards such as fencing, parking, and signage.
All requirements for a Planned Commercial Development Outline Development Plan
have been met.
ZONING EVALUATION CRITERIA

Staff has the following comments regarding the criteria used to evaluate establishxnent of
a zoning district on the property:
1. That the existing zone classification currently recorded on the official zoning
maps of the City of Wheat Ridge is an error.
The official zoning map is not in error. The parcel is not shown within the city limit of
the City of Wheat Ridge. Once all required actions are completed, the zoning maps will
have to be amended to reflect the new alignment for Miller Street, the zoning on the
property and the new city boundary.
2. That a change in character in the area has occurred due to installation of
public facilities, other zone changes, new growth trends, deterioration, or
development transitions, and that the evidence supports the fmding of the following.
The general trend in this immediate neighborhood is towards more commercialization of
properties. The properties to the north, west and south are either manufacturing facilities
or office/warehouse uses. While the Arvada Ridge development to the east is primarily
retail sales, office and restaurant uses, the portion of the structure which faces Miller
Street is the delivery area with numerous loading docks. The proposed zone change will
be compatible with development and growth trends in the immediate area.
3. That the change of zone is in conformance, or will bring the property into
conformance, with the City of Wheat Ridge comprehensive plan goals, objectives
and policies, and other related policies, and other related policies or plans for the
area.
The Comprehensive Plan was recently amended to include this area as part of the City's
urban growth area. On the Future Land Use Map the property is designated as Planned
Business/Indusirial Parks. Planned Business/Industrial Parks is defined as land located
north of I-70 with easy access to the interstate or other transportation modes. These
developments require shipping or deliveries by semi-trucks and should be well planned.
Desirable uses include light manufacturing, assembly research and development facilities
and offices and supporting uses. Staff concludes that the proposed zone district of
Planned Industrial Development is supported by the Comprehensive Plan. RM~h~i
4. That the proposed change of zone is compatible with the surrounding area
and there will be tninimal adverse impacts considering the benefits to be derived.
The property is surrounded on all sides by industrial, office/warehouse and commercial
uses. The expanded property boundaries of the Coors glass plant will be compatible with
the surrounding development. Reconfiguration of the eastern loading area of the glass
plant is a much needed traffic safety improvement.

5. That there will be social, recreational, physical and/or economic benefits to
the community derived by the change of zone.
There will be physical benefits to the traveling public as circulation and loading on the
plant site will be improved. The site is being enhanced on the east side by a landscaped
buffer adjacent to new Miller Street.
6. That adequate infrastructure/facilities are available to serve the type of uses
allowed by the change of zone, or that the applicant will upgrade and provide such
where they do not exist or are under capacity.
All responding agencies have indicated that they can serve the property. Any additional
upgrades to infrashucture will be at the cost of the applicant.
7. That the change of zone will not adversely affect public health, safety or
welfare by creating excessive traffic congestion, creating drainage problems, or
seriously reducing light and air to the adjacent properties.
The health, safety and welfaze of the traveling public and employees and customers of the
glass plant and the Arvada Ridge development to the east will be positively impacted
with the new loading configuration. There should be no impact on drainage, or the
amount of light and air to adjacent property.
8. That the change of zone will not create an isolated or spot zone district
unrelated to adjacent or nearby areas.
Spot zoning is not a concern as the adjacent properties aze zoned commercial and
industrial. The zone change is in conformance with the Comprehensive Plan.
V. FINAL DEVELOPMENT PLAN
Attached is a Final Development Plan which addresses both the loading area
reconfiguration and a small addition to building 25 orosedffia

Page 3 of the planset best depicts the modification to building 25. This addition is
comprised of 1092 square feet of floor area and is shown as "Area 1" at the southeast
comer of the structure. Page 5 shows the elevations of the addition which are consistent
with the conshuction style and materials used on the existing plant building.

The addition of a portion of Lot 8 of Arvada Ridge increases the total lot area by 2.55
acres. The improvements on Lot 8 are existing and function as the main loading azea for
the glass plant on the east side of the Miller Street wazehouse. The improvements are
comprised of asphalt pavement, curbing and landscaping. To access the loading area,
vehicular traffic moves north along Miller Street until just past W. 50`h Avenue where the
street branches into a"Y" configuration. Traffic either veers to the east to continue north
on "new" Miller Street or turns left into the new curb cut that transitions into "old" Miller
Street, now the loading azea for the eastern wazehouse. Traffic exiting the loading area
must follow the same path out.
The loading area and "new" Miller are separated by a large landscaped island. The
landscape plan for this new azea is shown on page 6 of the planset. Accoxding to the
development agreement for Arvada Ridge, a total of the equivalent of 104 inches of tree
caliper is to be maintained on this property. This would include the preservation of a
large willow tree on the south end of the "island". The landscape plan presented in the
planset meets Arvada's requirements. However, a visual inspection of the property has
revealed ttiat much of the plant material has died and will have to be replaced. A
perimeter fence is shown on the FDP but the architectural materials are not specified.
Staff concurs with the City of Arvada that any new fencing should be of an upgraded
material (solid wood or wrought iron) and has included this as a condition of approval.

Staff concludes that the proposed Final Development Plan complies with all minimum
standards of the proposed Outline Development Plan. All requirements for a Planned
Commercial Development Final Development Plan have been met.

VI. FINAL PLAT
The applicant is requesting approval of a Final Plat which consolidates the existing
bottling plant site with Lot 8 of the Arvada Ridge development and vacates the "old"
Miller Street right-of-way which is 30' in width. Pursuant to Section 26-118 of the
zoning and development code, right-of-way vacations can occur by plat document
without the need for a separate vacation ordinance.
An additional tract has been created, the ownership of which will be transferred to the
property owner to the north. This unbuildable iract is contiguous to the Esco pazcel and
has been incorporated into their entrance drive/pazking area a%'M0u-M-~,~;,~lao.
The plat establishes typical utility easements around the perimeter. There are numerous
utility lines located in "old" Miller Street. A blanket utility easement will be required for
maintenance of these facilities.
New Miller Street was previously dedicated to the City of Wheat Ridge by separate
document.
Public Works has reviewed the most recent version of the plat document and is requiring
changes to the tecfinicaT confent of the document including easement identification and
legal description work. These corrections must occur prior to the City Council public
hearing.
All other regulations and standards of Article IV of the Code of Laws have been met.
RIGHT-OF-WAY VACATION CRITERIA
Before a street right-of-way vacation is approved, the following findings of fact must be
made:
1. That the proposed vacation will not leave any adjoining land without access to
an established public right-of-way.
Access to the properties impacted by the vacation is not compromised as new Miller
Street has been built and dedicated to the City of Wheat Ridge. Both impacted properties
(Coors Bottling plan and Esco) have access to new Miller Street with connection
improvements already completed.
2. That the proposed vacation is in conformiTy with the most recently enacted
goals and policies of the transportation section of the current comprehensive
plan of the City of Wheat Ridge.

As part of the Arvada Ridge Development, 50"' Avenue was constructed from Kipling
west where it transitions into Miller Street to the south. The connection with Miller
continuing south will provide a continuous route for frontage road traffic between Ward
and Kipling. Miller is a collector and has been realigned to the east to provide additional
room for truck maneuvering far the glass plant. These movements previously occurred in
the Miller Street right-of-way. Vacation of the old Miller Street r-o-w does not
negatively impact the goals of the Comprehensive Plan.
3. That the proposed vacation will not have a negative impact on the
infrastructure of the City of Wheat Ridge.
All existing utility lines will remain in the azea being vacated as right-of-way.
4. That adequate easements have been reserved for use and/or maintenance by
the city or other utility agencies.
Adequate easements will be reserved for existing utilities if the staff recommended
condition is included in the motion for approval.
VII. AGENCY REFERRAI.S
All existing agencies and utility companies are currently serving the property. Any
required upgrades will be at the expense of the property owner.
Ditch Companies: The affected ditch companies have reviewed changes to the proposed
documents relative to the current ditch configurations. The applicant must continue
working with them to resolve any issues.
Xcel Energy: Has indicated no problems with the zoning, development plans or plat.
Any facility relocations would need new easements. Their standard language has been
included on page one of the plat document.
Valley Water District: Currently has a looped water main located in W. SO'h Avenue
and "old" Miller Street. A 30' wide easement will be required for the line in vacated
Miller Street.
Public Works Department: Has reviewed and approved the ODP and FDP documents.
The Final Plat needs content and technical corrections which must occur priar to City
Council public hearing.
City of Arvada: The FDP approved by Arvada for Arvada Ridge included a tree
preservation and replacement plan for Lot 8. The requirement was reflected in the
recorded development agreement for the Arvada Ridge Subdivision. Any fencing
adjacent to new Miller should be of an upgraded variety such as solid wood or decorative
wrought iron.

Jefferson County: The proposal is consistent with the North Plains Community Plan.
VIII. STAFF CONCLUSION AND RECOMMENDATION
ZONING AND OUTLINE DEVELOPMENT PLAN
The proposed zoning on the property is consistent with zoning and land uses in the area
and with the designation on the addendum to the Comprehensive Plan. There will be a
public benefit derived from the reconfiguration to the glass plant loading azea. Because
all requirements for a Planned Indushial Development Outline Development Plan have
been met, a recommendation of approval is given for the zoning and Outline
Development Plan document.
FINAL DEVELOPMENT PLAN
The proposed improvements to the bottling plant will have positive impact on site
efficiency and vehicular safety in the area. The FDP is consistent with the standards
established in the ODP and all requirements for a Final Development Plan have been met.
Therefare, a recommendation of approval with conditions is given as outlined in the
recommended motion.
FINAL PLAT
A Final Plat'is required to consolidate the existing Coors Glass plant pazcel with the azea
obtained from the Arvada Ridge development. Old Miller is no longer needed for public
circulation purposes. Because the vacation criteria are supportive of the request, a
recommendation of approval with conditions is given as outlined in the recommended
motion.
IX. RECOMMENDED MOTIONS
There are three requests, and each will require a separate motion.
ESTABLISHMENT OF ZONING AND OUTLINE DEVELOPMENT PLAN
Option A:

Coors Brewing Company (Coors) is submitting this Application with respect to a pazcel
of land adjacent to the Coors Glass Plant:property (I4619 W.,50`h Avenue, Wheat Ridge).
Coors is seeking to annex a land pa,reel (kteteinafter zefeiied ta. as "Lot 8"), together with
a"abandoned" portion of 1Vliller StteeY, into Wheat Itidge, and _to include Lot 8 and that-
portion of Miller Street within the Coors GIass Plantp'roperty.
Coors intent and purpose in acquiring Lot 8 and a portion of the former Miller Street
alignment, is to create a buffer zoue betcveen vehicle operatioris on the east side of its
Glass Plant Wazehouse anci the general vahicle,traffic on MiiJer Sh-eet, as realigned. The
development of the Arvada Itidge complex (immediately East of the Coors Glass Plant
property) provided a unique opporhuiity to resolve what has been a long-standing traffic
concern; trucks accessing the Glass Plant Warehouse dock doors were forced to pull onto
Miller Street, blocking traffic and creating a hazard as they maneuvered to align with the
docks. With the anticipation of additional traffic on Miller Street resulting.from the
Arvada Ridge development, vehicle acciderits were only a rnatter of fime. The
acquisition of Lot 8 and the relocation of Miller Street now allow for the unimpeded
movement of traffic on Miller Street, and at the same time an unrestricted trucking
operation within the Glass Plant property.
To reach this objective Coors has purchased Lot 8, paid for its portion of the realignment
costs for Miller Street, sought the de-annexation of Lot 8 and the appropriate portions of
Miller Street (old and new) from the City of Arvada, and now wishes to annex those
same parcels into the City of Wheat Ridge. Coors also seeks the approval of an Outline
Development Plan, a Final Development Plan, and Amendment No. 7 to Filing No. 1
Coors Planned Indushial Development. (Please note that included witYiin this
Amendment No. 7 is a new building addition as well as the Miller Street re-alignment.)

This Case is ❑ Quasi-Judicial El Legislative
Section 26-623 of the Code of Laws addresses the requirements for obtaining approval for
excavation and deposition of fill material. Major operations, defined as involving more than 20,000
cubic yards, require a special use. This particulaz section was not amended when the special use
process was amended in 2003 and still refers to Planning Commission and City Council hearings.
The changes in 2003 eliminated the Planning Commission hearing and required the Council hearing
only if there were obj ections to the request; otherwise the request could be approved
administratively.
The proposed ordinance eliminates this inconsistency by deleting reference to the Planning
Commission and City Council hearings and simply references Section 26-114 where the
requirements and process for special uses are established. Other references to "the City Council" are
changed to simply "the City." No other changes aze involved.

TITLE: AN ORDINANCE AMENDING SECTION 26-623 OF THE
WHEAT RIDGE CODE OF LAWS CONCERNING
EXCAVATION AND DEPOSIT CONTROL
WHEREAS, the City Council of the City of Wheat Ridge is authorized pursuant to
Article XX of the Colorado Constitution, the Wheat Ridge Home Rule Charter and
Section 31-23-101, et sec. of the Colorado Revised Statutes to adopt and amend from
time to time regulations concerning the control of land development; and
WHEREAS, the scope of such regulations includes excavation and deposit
control; and
WHEREAS, the Wheat Ridge City Council has previously exercised this authority
by the enactment of Wheat Ridge Code of Laws Section 26-623; and
WHEREAS, the City Council has provided in Wheat Ridge Code of Laws Section
26-114, a procedure for a review of uses classified as "special uses;" and
WHEREAS, major land fill and excavation control operations, as defined by Code
Section 26-623.C are permitted as special uses; and
WHEREAS, it is necessary to amend Code Section 26-623.C to bring the
procedure for review of major landfill and excavation control operations as a special use
within the uniform procedure for review of special uses set forth in Section 26-114.
NOW, THEREFORE, BE IT ORDAINED by the Wheat Ridge City Council, that:
Section 1. Code Section 26-623.C. Amended
The introductory paragraph and subparagraph 7 of Section 26-623.C of the Code
of Laws are amended to read as foilows:
C. Major landfill and excavation control operations:
Dumping, landfiil and/or extraction operations which
exceed twenty thousand (20,000) cubic yards may be
allowed in any zone district only by special use permit
and-siEy GGLIRsi4 under section 26-114. Such deposit or
extraction of earth, sand, gravel, rock, minerals, broken ~
concrete or broken asphalt or other similar resources,
and/or storage thereof, are subject to the foilowing
conditions. (In cases of isolated or unusual
characteristics of the operation or the location thereof,
partial waiver of these requirements may be made by4qe
Gity GE)URsi4.) A special use permit may be issued for a
period of time not to exceed one (1) year and may be
renewed §y Gity ssWnsil upon written request:

otherwise invalid, the validity of the remaining sections, subsections and clauses shall
not be affected thereby. All other ordinances or parts of ordinances in conflict with the
provisions of this ordinance are hereby repealed.
Section 3. Effective Date. This ordinance shall take effect immediately upon final
adoption.

The City's current code concerning massage parlors and massage therapy practice is based on State
statute which was written when massage was a novelty often associated with prostitution. The
massage therapy profession has since emerged as a valid form of alternative health care promoted by
traditional medical providers. Massage therapy professionals are recognized as caregivers who
contribute to the health and well-being of individuals. Massage therapy is recognized as a legitimate
business with formal education and professional organizations similaz to those for other professions.
Licensing requirements have been adopted recently by Council in a new Article X of Chapter 11 of
the Code of Laws.
In Chapter 26 massage therapy is not listed in the table of uses for commercial zone districts. The
use has been interpreted to be similar (in impact, chazacter, etc.) to "hair, nail, and cosmetic
services." Adoption of new licensing requirements should be accompanied by inclusion in Chapter
26 to eliminate any confusion about the use being allowed or not.
The proposed changes to Chapter 26 do two things: 1) list massage therapy and massage therapy
centers in the use chart for commercial zone districts, and 2) include massage therapy as a permitted
home occupation. Both changes refer to Chapter 11 for additional requirements.

Section 2. Code Section 26-613 amended.
Subsection 26-613.A.11 of the Code of Laws Section 26-613 is hereby amended
by re-numbering subparagraph "I" as "m" and by inserting new subparagraph "I," to read
as follows:
Massage therapist, restricted to one practitioner, subject to
the restrictions of Chapter11, Article X of the Code of Laws.
Section 3. Severabilitv: Conflictinq Ordinances Repealed. If any section,
subsection or clause of this ordinance shall be deemed to be unconstitutional or
othervvise invalid, the validity of the remaining sections, subsections and clauses shall
not be affected thereby. All other ordinances or parts of ordinances in conflict with the
provisions of this ordinance are hereby repealed.
Section 4. Effective Date. This Ordinance shall take effect fifteen days after final
publication, as provided by Section 5.11 of the Charter.
