CALL THE MEETING TO ORDER The meeting was called to order by Chair SCEZNEY at 7:00 Pm. in the City Council Chambers of the Municipal Building, 7500 West 29' Avenue, Wheat Ridge, Colarado. 2. APPROVAL OF 1VIINUTES - August 16, 2007 It was moved by Commissioner BRINKMAN and seconded by Commissioner MATTHEWS to approve the minutes of August 16, 2007. The motion passed 7-1 with Commissioner McMILLIN abstaining. 6. PUBLIC FORUM (This is the time for any person to speak on any subject not appearing on the agenda.) There was no one to appear before the Commission at this time. Planning Commission Minutes 1 November 1, 2007 PUBLIC HEARING Prior to presentation of the following case, Commissioner REINHART disclosed that he is a consultant for a real estate developer with property interests in close proximity to, but not in the area of, the Arvada transit station framework plan. His client owns no property in Wheat Ridge and has no financial interest or preferred outcome of this hearing. He stated that he met with the City Attorney who advised that there would be no conflict of interest in his hearing of the case. A. Case No. WPA-07-03: A resolution adopting Arvada's Kipling TOD Station Plan as an amendment to the Wheat Ridge Comprehensive Plan. Sally Payne introduced this case. The City of Arvada has been working on transit station planning for the RTD FasTracks Gold Line stations. One of the proposed stations in Arvada is the Kipling Station located in close proximity to the Super Target at Kipling and Sls`. Transit oriented development (TOD) consisting of mixed uses and higher densities is being proposed for the Kipling Station. The City of Arvada has requested the City of Wheat Ridge adopt their Transit Station Framework Plan as it relates to the lands within the City of Wheat Ridge. The Framework Plan is proposed to supersede the Wheat Ridge Comprehensive Plan for the area within the Wheat Ridge city limits. By adopting this plan, the City of Wheat Ridge would be supporting cooperative land use planning ensuring that compatible land uses are being proposed in areas adjacent to sunounding jurisdictions. City staff supports the resolution for reasons outlined in the staff report. Ms. Payne introduced KeVin Nichols with the Arvada Community Development Department. He presented Arvada's goals and principles for TOD. Arvada believes it is important`to have inter-jurisdictional coordination in development of the transit station. He reviewed the details of the Plan. Gommissioner McMILLIN agreed with the breakdown of housing in the Plan. However, he expressed coiicem that 200 parking spaces for the Kipling station seems to be extremely inadequate. Also, structured parking would be preferable over surface parking: Mr. Nichols explained that RTD has indicated it would only fund surface parking. Commissioner CHILVERS commented that many light rail customers would probably end up using the Target parking lot. Mr. Nichols stated that shared parking with Target is something to be considered. Commissioner STEWART asked about building height restrictions in the Plan. Mr. Nichols stated that Arvada's present zoning allows for 35-feet for building height, however, the height can be varied and taller heights will be allowed in the zoning for the TOD areas. Commissioner STEWART asked if Arvada would Planning Commission Minutes 2 November 1, 2007 expect Wheat Ridge to change its height restrictions. Mr. Nichols replied that Arvada would ask Wheat Ridge to consider that. Sally Payne reminded Commissioners fliat the city charter sets height liinits at 35 feet and density at 21 units per acre. Commissioner STEWART asked how many residents are envisioned for the area. Mr. Nichols estimated about 2,000. Commissioner STEWART expressed concern about bringing more traffic into an already congested area. Commissioner BRINKMAN asked what Arvada's vision was for the character of the Kipling transit station. Mr. Nichols stated that Red Rocks College and residential use would play a big part in the character of the station. Commissioner BRINKMAN favored keeping the parking where it is shown in the mixed use and she highly recommended going up with multi-level puking rather than out with more surface parking. She agreed that 200 spaces did not seem sufficient. Commissioner SCEZNEY asked Mr. Nichols to explain the market survey recommendations and bus service in connection with the transit station. Mr. Nichols stated that the survey difln't show strong retail use for the area. He explained that RTD plans to link the transit stations with bus service. Commissioner REINHART expressed concern about access to I-25 from Kipling. In response tp his questions, Mr. Nichols stated that RTD would be responsible for building a platform and surface parking. If RTD believes a new road is necessary to access their parking facility and far bus circulation, the road would be part of their budget.; A pedestrian bridge may also be needed but the need has not been determined at this time. There was discussion about changing the height and density provisions of the city charter. Commissioner STEWART commented that citizens have shown over and over that they do not want a change in these provisions. Increased density will bring more vehicle traffic. Commissioner McMILLIN commented that changing the Comprehensive Plan is done occasionally, however changing the charter is a matter than caruiot be taken lightly. Commissioner REINHART suggested that if these limits should ever be waived, transit oriented development would be the place to do it. Commissioner MATTHEWS stated that he would support a bonus in height and / density along light rail corridors. \ Planning Commission Minutes 3 November 1, 2007 It was moved bv Couimissioner R1i1NFIAI2T and secondecl bv Commissioner MATTHE«S to adopt Resolution 04-2007, a resolution recominending adoption of the Arvada Transit Station Framewor(e Plan as it applies to land within the City of Wheat Ridge and forwarcting this recommendatiou along with the Resolution to City Council for their consideraYion. It was moved by Couunissioner McD11I,.LIN and secondecl by Commissioner STEWART that because the sense of the Commission is that 200 spaces, as currently envisioned, is not sufficient to serve velticle trips from Wheat Ridge and Arvada, planners should lobb,y for mare parking by three possible sohitions: (a) preferably building a multi-stary garage; (b) using undeveloped tand in thc interim until the garabe is built, and (c) seeking shared parking arrangements with the eiisting large parking IoY of Yhe 'I'arget store. CASE ANALYSIS The applicant (owner) is requesting approval of a three-lot subdivision plat. The property is currently zoned Residential Two (R-2). The applicant wishes to subdivide the property and create three lots. The R-2 zone district allows single- and two-family residential structures (depending on lot size) and accessory buildings. The property is 40,440 square feet in size and slopes from south to north. The applicant is in the process of constructing a two-family structure on the northern portion of the property. A building permit was reviewed and approved in October of this year. Placement of the structure was designed in anticipafion of the subdivision; all setbacks and lot coverage requirements will be met if the subdivision is approved. II. SUBDIVISION PLAT The plat will subdivide the property into three lots (Exhibit 1, Plat). Lot 1 will have direct frontage on W. 30th Avenue. I,ots 2 and 3 will be located directly south of Lot 1 and will be accessed by a private drive. The Code of Laws allows a maximum of four dwelling units to be accessed by a private drive. The private drive will be located on the western side of the property, and will be 20 feet in width. When subdividing one parcel into multiple parcels, each newly created parcel should meet the district standards for minimum lot size and width. The minimum size and width of an R-21ot is based upon type of residential structure located on the lot. A single family structure in the R-2 zone district requires minimum lot size of at least 9,000 squaze feet and a minimum lot width of at least 75 feet. A two-family structure in the R-2 zone district requires minimum lot size of at least 12,500 squaze feet and a minimum lot width of at least 100 feet. The applicant is currendy constructing a duplex on the northern portion of the property. Therefore, Lot 1 must meet the minimum lot size standazds for a two-family dwelling. Lot 1 will be 12,535 square feet in size. Lot 2 will be 13,800 squaze feet in size. Lot 3 will be 14,105 square feet in size. All of the lots will be 115 feet in width. Because all lots wIll gain access from the north, the lot width is measured at the northern property line, which is considered the front yard. All three lots will be large enough and wide enough for a two-family shucture. Easements Typical utility easements are being established around the perimeter of each lot. There is an existing water easement located in the northwest corner of the property. A main water line is located within the easement. The duplex currently being constructed on what will be Lot 1 does noY encroach upon this easement. There is an existing lateral ditch which bisects what will become Lot 3. An easement has been established on this plat which runs east to west on the lower third of Lot 3. This easement as shown on the plat is the proposed locauon of the lateral, not the actual location. Staff recommends that as a condition of approval, the easement be shown at the actual location of the lateral. The applicant may negotiate with the owners of the lateral to relocate the lateral. The i applicant has indicated that conversations regazding moving this lateral have begun; however, an agreement has not been reached to date. Planning Commission MS-07-05/Hyland If the lateral and easement aze relocated, an administrative plat amendment will be required. Aaencv Referral All responding agencies have indicated that they can serve the property, and the applicant will beaz the cost of upgrading any service to the property. Water service will be provided by the Wheat Ridge Water District. The Wheat Ridge Fire District indicated that the width of the private drive was acceptable. An approved turn-around will be required at time of building permit for Lot 3. The Fire District has indicated that this can be accomplished by constructing a larger driveway which accesses L.ot 3. The Subdivision Regulations require that pazkland dedication is required for any residential subdivision. Typically, this takes the form of a fee in lieu of land dedication. The applicant will be required to pay the fee in lieu prior to recordation of the plat. The Public Works Department has indicated that an escrow will be required in lieu of installation of curb, gutter and sidewalk adjacent to W. 3& Avenue. Because the adjacent properties do not have any of these public improvements installed, the escrow will be retained until such time that it is feasible to install the public improvements. III. STAFF CONCLUSION & RECONIMENDED MOTION (S): Because this is a three-lot minor subdivision, Planning Commission is the final deciding authority. Staff concludes that the proposed subdivision meets all of the requirements of Article IV of the Code of Laws. Therefore, staff recommends APPROVAL of the subdivision plat. OPTION A: "I move to APPROVE Case No. MS-07-05, a request for approval of a three lot subdivision plat for property located at approximately 6330 W. 3& Avenue, for the following reasons: l. All requirements of the Subdivision Regulations have been met. 2. All required utility easements are being provided. 3. Adequate infrastructure will be constructed with the development to serve the proposed use." With the following condition: 1. The lateral easement shown on I.ot 3 shall be moved to encompass the actual location of the lateral."
