A set of these minutes is retained both in the office of the City Clerk and in the Department of Planning and Development of the City of Wheat Ridge. 4. APPROVAL OF ORDER OF THE AGENDA Commissioner SNOW requested a discussion regarding the amount of paving required for driveways (Section 26-3 1 (C)(6) • the code) • added under Old Business. It was moved by Commissioner SNOW and seconded by Commissioner COOPER to approve the order of the agenda as amended. The motion passed 6-0 with Commissioners COLLINS and DOYLE absent. Case No.,,!CUP Conditional use permit to allow expansion of a Jefferson County School in an A- I zone and a 10-foot side yard setback variance from the required 30 -foot side yard setback to construct an entryway vestibule. The case was presented by Mary Austin. She reviewed the staff report and presented slides overheads, of the subject property. She entered all pertinent documents into the record and advised the Commission that there was jurisdiction to hear the case. Staff recommended approval of the application with conditions outlined in the staff report. I In response to a question from Commissioner GOK-EY, Ms. Austin stated building coverage on the property is 26%. He expressed concern about increased traffic on Miller which would result from the proposed development. Greg Knudson stated that the proposed pullout lane in front of the school should alleviate traffic congestion on Miller. Further, parking would not be facilitated along that portion of Miller Street due to the design of the left turn lane. Commissioner SNOW commented that there were probably more students associated with the old Fruitdale school than there will be with the Compass Montessori school, Commissioner THOMPSON pointed out that Fruitdale involved walk-in students whereas the present school usually involves parents driving the children to school. She also commented that the former Garramone's Market generated a lot of traffic, especially during the fall season. Commissioner GOKEY expressed concern about having two different zonings on one propert Mary Austin noted that these types of situations are very common throughout the city. Mr. White stated that if the lots are not consolidated, the lots could possibly be sold separately at some time in the future. I ress Truls matter. There was • response. Commissioner McNAMEE indicated she would support the motion as it allows the current A- I zoning to stand. She believed the school use would be preferable over planned residential use M s shown on the Comprehensive Plan. She commented that the city would have more control over the use of the land under a CUP than it would under residential or commercial zoning. Access to Public Streets - Nancy Snow stated that when amendments to Section 26- 30(N) were considered at the Council meeting regarding access to public streets, City Council directed the matter back • Planning Commission for discussion. The question concerned the width of a private drive off of a paved public street. buildings also. There was a general feeling among the Commissioners that these requirements would be reasonable for situations where more than one dwelling unit shares the driveway; however, the requirements should not be applied to single family dwellings. May 5, 2000 Planning Commission Page 5 M Alan White commented that this regulation could be addressed at such time as the zoning ordinance is reconsidered. It was moved by Commissioner GOKEY and seconded by Commissioner SNOW that the ordinance be kept in its original context as presented to the Planning Commission and be forwarded to City Council. The motion carried 5-1 with Commissioner THOMPSON voting no and Commissioners COLLINS and DOYLE absent. Commissioner THOMPSON indicated that she didn't support the motion because it is in conflict with the other ordinance. 10. NEW BUSINESS There was no new business to come before the Commission. It. Im 1. REQUEST The applicant is requesting approval of a two lot minor subdivision for property located at 2651 and 2661 Kendall Street. The property is zoned R-2, Residential-Two (Exhibit 1, Zoning Map) and is currently vacant. CASE HISTORY / SUBDIVISION DESIGN The property was rezoned in 1984 from R-1, Residential-One to R-2, Residential-Two. R-2 remains as the current zoning on the property. Pursuant to Section 26-14 of the Wheat Ridge Code of Laws, the R-2 zone district allows the permitted principles uses of single family dwellings and duplexes, The current lot area of the parcels would permit a maximum development of 3 housing units. The configuration of the parcels is such that a duplex structure would be permitted on the northern parcel and a single family home on the southern parcel. The minor subdivision will move an existing lot line to create two uniform lots. Lot I and Lot 2 will be rectangular shaped parcels of equal size at 17,341.5 square feet each. Each new lot with this minor subdivision plat will contain enough land area to allow for the construction of a duplex structure. Easements have been reserved adjacent to the property lines as required by the City's Subdivision Regulations for utilities and access. Minor subdivisions without public street dedication require Planning Commission action only. All requirements of the Subdivision Regulations have been met. i 1111q111111 • 1111 III. AGENCY REFERRALS All service agencies can serve the property when developed. Public Service Company can serve the property with requested utility easements adjacent to the front and rear lot lines for the installation and maintenance of utilities. These easements are depicted graphically on the plat document. 111118 11111111 1 1 IN The existing right-of-way for Kendall St. is within Edgewater city limits. The City of Edgewater Public Works Department has commented that construction of public improvements (curb, gutter, sidewalk) along the property's frontage are not required, The City Surveyor has reviewed the final plat document for completeness and has indicated that it is in compliance with the City's Subdivision Regulations. The drainage improvements shall be constructed in conformance with the approved drainage plan and will be inspected and approved prior to issuance of a Certificate of Occupancy. IV, STAFF CONCLUSIONS AND RECOMMENDATION Upon review of the above request, staff concludes that the applicant is subdividing two unequal parcels into two parcels of equal size. The requirements of the Subdivision Regulations have been met and the parcels exceed the lot area requirements of the R-2 zoning district. Therefore, staff recommends APPROVAL for the following reasons: 1. All requirements of the City's Subdivision Regulations have been met. 2. The minimum lot size requirements of the R-2 zoning district have been exceeded. V1. RECOMMENDED MOTIONS Option A. "I move that Case No. MS-00-02, a request for a two lot minor subdivision for property located at 2651 and 2661 Kendall Street be APPROVED for the following reasons: 1. The City Attorney concluded that this ability is already included in the Code and was not needed in the proposed Ordinance.
