1. CALL THE MEETING TO ORDER: The meeting was called to order by Chair
THOMPSON at 7:30 p.m. on May 21, 1998, in the Council Chambers of the Municipal
Building, 7500 West 29th Avenue, Wheat Ridge, Colorado.
Commission Members Present:
The following is the official set of Planning Commission minutes for the public hearing of May 21,
1998. A set of these minutes is retained both in the office of the City Clerk and in the Department of
Planning and Development of the City of Wheat Ridge.
4. APPROVAL OF AGENDA
Commissioner SNOW requested the following amendment:

A. Case No. ZOA-98-01: Review and discussion of the City of Wheat Ridge Animal
Regulations.
There was a consensus of the Commission to receive public comment even though the case
was being presented as a study session item rather than a public hearing.
Gerald Dahl reviewed his memorandum of May 15, 1998 to the Planning Commission and
City Council as well as an outline for possible revision of the large animal ordinance, noting
that lot size restrictions, setbacks, etc. will have to be determined.
Discussion followed. Commissioner GOKEY suggested that wording in Section 15-23 such
as "unsatisfactory condition "offensive odors "deemed a nuisance etc. need to be more

more definitive guidelines are necessary. She also noted that the municipal court is not
equipped to prosecute an odor case unless there is assistance from the Health Department
which has technical equipment that can measure odors. I
There was discussion concerning the problems of manure accumulation and flies.

Commissioner B• INKMAN suggested the placement of fly catch buckets similar to those
used for fruit flies in California, to measure the number of flies present at different times •
the day in order to determine what amount would constitute a nuisance.
In response to a request from Commissioner, Mr. Dahl stated that he would look into nuisance
regulations from other communities. He also commented that if the City of Wheat Ridge is
going to have animals, the City is obligated to come up with a very precise system to address
neighborhood complaints.
Ms. Reckert commented that there are still some subjective issues to work through as far as
manure accumulation is concerned.
Mr. White commented that he believed regulations also need to apply to agricultural zoning.
Chair THOMPSON invited public comment and the following individuals addressed the
Commission:
that although she removes manure every other day, her neighbors still complain. She also
thought the fly catchers were a good idea. She suggested instituting a time limit for horse
owners to remove manure because she felt measuring, would be very difficult.

Ms. Reckert informed that the minimum lot size for R- I zone property is one acre and 140
feet lot width, and that there are many substandard A- I lots in the city for which the staff wfl I
be recommending the 9000-6000 square feet requirements. Code enforcement pointed out
that some entities rely on the Department of Health for enforcement proceedings when the
public health, safety and welfare are affected; however, this is not a high priority for the
Department of Health.

There was discussion concerning the location of Mr. Craig's barn. Ms. Reckert explained
to be destroyed and rebuilt for some reason. The new structure would then have to conform to
the present code.

Commissioner BRINKMAN responded to Mr. Craig's concerns stating that the City is only
attempting to refine language and clear up vague areas in the code in order to address nuisance
properties, and not to get rid of horse properties, Commissioner GOKEY assured Mr. Craig
that the City has no intention to make him get rid of his barn or his horse.
Commissioner SNOW suggested that the horse equivalent units include one horse, one co
one burrow, one mule, one llama, four sheep and two goats and noted that there have been
numerous complaints about goats in past years. She was also concerned that the ordinanc
doesn't result in allowing even more animals to be kept in the city. . I
Commissioners BRINKMAN and SHOCKLEY felt that the Animal Control Commission's
recommendations should be followed.
Commissioner SNOW requested that- Section I -A of the proposed ordinance be incorporated
into Section I -C.
Mr. Dalil suggested that the section concerning the removal of horses to summer pastures
needs to be clarified and a time limit determined.

seconded that Case No. ZOA-98-4, an amendment to Section 26-6 of the Wheat Ridge Code
of Laws - Legislative and Administrative Process and procedures, be recommended for
APPROVAL to the City Council for the following reasons:
I . The City has no existing legislation in place.
2. It is consistent with State Law
3. The City Attorney has reviewed the proposed language and his comments have
been incorporated.
With the following conditions:
a. That the language in item #1 and item #4 under the "Criteria for Review"
section be reworded to be consistent with the state statute.
C. Case No., ZOA-98-02: The Planning and Development Department is proposing to amend
Sections 26-20 (B) and (E), and 26-22 (B) of the code of Laws concerning counseling and
treatment clinics in the R-C I and R-C and C- I zone districts.
Commissioner BRINKMAN expressed concern about the use of the word "problem" in the
ordinance and offered an amendment that the word "problem" be replaced with the word
"condition" throughout the entire ordinance. This amendment was accepted by
Commissioners SNOW and SHOCKLEY.

Chair THOMPSON declared the public hearing portion of the meeting closed.
A. Brewer Property at 44th and Tabor: Chair THOMPSON inquired about the status of this
property. Following discussion, Alan White advised the Commission that he would
investigate the situation to make sure proper permits have been applied for and the use
complies with zoning.
B. Time Limit on Planning Commission.and Ci!y Council Decisions: Commissioner
BRINKMAN asked if there were a time limitation • Planning Commission and City Council
decisions concerning land use if a parcel of land remains vacant for a certain period of time.

C. Project at 35th and Wadsworth: Commissioner COLLINS inquired about the status of the
wholesale beauty supply operation which seems to have come to a standstill. Alan White

In reviewing requests for rezoning, the Planning Commission and City Council consider the following

1. That the zoning is in conformance, or will bring the property into conformance with the City
of Wheat Ridge Comprehensive Plan goals, objectives and policies, comprehensive land use
plan and other related policies or plans for the area.

an outdated and non-conforming zone designation of a portion of a legally created lot. Therefore,

6. That the property cannot reasonably be developed under the existing zoning conditions.
The property is developed as a commercial use at this time. The portion of the lot currently zoned
Residential-Three can not be reasonably developed for residential use due to its' small size and non-
conformance with the Comprehensive Plan.
7. That the zoning will not create an isolated or spot zone district unrelated to adjacent or nearby
areas.

8. That there is a void in an area or community need that the change of zone will fill by providing
for necessary services, products or facilities especially appropriate at the location, considering
available alternatives.
The overall lot is currently developed as a commercial use which use is in conformance with the
Comprehensive Plan. Staff believes that the current use of the property fills a community need since
it remains in operation, and since the applicant has initiated and paid the appropriate fees for this
re-zoning application.
V. AGENCY REFERRALS
Responding With Concerns:
City of Wheat Ridge Police Department: In memorandum dated May 13, 1998, the Police Department
recommends landscaping and lighting treatments designed to aid in crime deterrence. The Planning
Department has incorporated the Police Department recommendations as Recommended Conditions of
Approval.

I have reviewed the plans for the above listed site. I have the following recommendations
LANDSCAPE
1. All mature trees to be trimmed of branches up 6'-8from the ground to allow for natural visual
*bservation from surrounding areas to the parking lots, deck and building.
2. All shrub's and bushes mature height to not exceed 36". This height reduces the risk of
persons hiding. It also allows for natural visual observation onto the property both for the
parking lot and building.
3. Plants/landscape immediately next to the building should be low-growing ground cover, not
to exceed 18" mature height to allow for maximum natural visual observation and eliminate
concealment for potential offenders.

4, There should be minimal landscaping immediately next to parking areas and sidewalks.
La,ndscaping near vehicles and pedestrian areas often raises the perception of criminal activity,
5. Ground cover should not include rock material, Rocks can be used to break windows in the
buildings and cars.
From these plans, I have no further recommendations at this time. Revisions in the plans, may after
my recommendations.
While. my recommendations do not guarantee a crime-free environment, it has been experienced that
application of the concept of Crime Prevention Through Environmental Design (CPTED) will reduce
the opportunity for crime to occur and will enhance the quality of life.

The Public Works Department has reviewed the Planning Department referral dated May 5, 1998 for the
above referenced site. The purpose described is to rezone a portion of the lot from R-3 residential to C- I
Commercial. Also, a 620 square foot deck is proposed. Based it this information, this department has
the following comment(s):
An erosion control plan may be required depending upon tile quantity of material to be removed/added
to the site.
2. A revised improvement location certificate (ILC) will need to be submitted reflecting tile wood deck
proposed on the plot plan submitted.

The property was rezoned from Agricultural-One and platted pursuant to the Craig Chevrolet Minor
Subdon (Case Nos. WZ-86-10 and MS-86-3). See attached Exhibit 'A' which is a reduced copy •
the platting document. At the time of zoning and subdivision, the West 50th Avenue corridor between
Kipling and Ward Road was classified as an arterial requiring a half-width roadway section of 40' to
centerline.
Case No. WPA-90-1, approved a Comprehensive Plan amendment which removed the arterial
classification from West 50th Avenue. This amendment allowed for circulation and connection in tfl
City's northwest area by local streets including reclassification of 50th Avenue as a collector street.
Public Works concurs with the request for vacation with the condition that the property being vacatei,
have an easement on it for slope and utilities. (See attached Exhibit
Arvada Fire Protection District has no objection to the vacation as long as 20' of access lane with an all-
weather surface is provided.

Upon vacation approval, 30'of right-of-way will remain which is consistent with the section for a
Class 5 street (minor industrial collector).
3. That the proposed vacation will not have a negative impact on the infrastructure of t
City of Wheat Ridge. I
There should be no negative affect on the City infrastructure as adequate right-of-way will
remain for street circulation and utty installation, if needed.
4. That adequate casements have been reserved for use and/or maintenance by the City of
other utility agencies.

The property is zoned Commercial-One and pursuant to rezoning conditions, site plan review by
Planning Commission and City Council is required prior to any construction. The applicant is
attempting to address both short-term and long-term development of the property with this application.
111. SITE PLAN
The applicant has proposed a plan showing three buildings with a total of 106,200 square feet of area.
Buildings A and B would be new car dealerships with 48,000 and 49,000 square feet, respectively.
Building C , 9000 square feet in size, would • an on-site day care center for employees. The existing
used car trailer will be moved upon full build-out,
The building envelope for Building A is shown as extending over an existing water line easement. The
,zpplicant is working with the water district to move the line off-site to the west. If the line is not
relocated, the portion • the building envelope covering the line must be removed.
A one-way in/one-way out drive configuration is existing to provide access to the service road on either
side • the Public Service Company transmission tower. Another curb cut on the western edge of the
r perty is for emergency vehicles only. The applicant is pursuing conversion of the curb cut to a full
movement access with the Colorado Department of Transportation. Until full access is granted by
CDOT, this curb cut must remain gated.

Access • West 50th Avenue will be provided to the day care center (towards the western property line)
and ajoint curb cut for loading and unloading with the building to the east. Internal accesses have been
provided between the two lots (I 100 1 and 11201 W. 1-70 Frontage Road North) to the north and south
of the new dealership buildings.
Landscaping on-site is shown as being not less than 20%, which exceeds the 10% minimum for
commercial developments in the City. The landscape plan will be reviewed by Staff for sizes, quantities

All minimum requirements of the C- I zone district regulations have been met or exceeded. The front
setback for the day care structure (building Q is being shown from the new southern right-of-way line

Public Works is in the process of reviewing a revised drainage report for the proposed improvements. A
"street width designation"' process must be completed prior to review by City Council. A grading plan
and NPDS permit will be required prior to issuance • a building permit. The improvements to West
50th Avenue must be completed with the first building permit. The construction plans are in the process
of being reviewed.
Arvada Fire Protection District will require additional water lines and fire hydrants with the new
dealerships and day care building.

Staff concludes that while the proposed plan is not industrial in nature ' it has many attributes
described above and will allow for the expansion of a very successful, freeway-oriented business.
2. Whether there are provided an adequate amount and proper location of pedestrian walks,
malls and landscaped spaces to prevent pedestrian use of vehicular ways and parking
spaces, and to separate pedestrian walks, malls and public transportation and loading
places from general vehicular circulation facilities.
At a minimum,

been made for internal cross-access between sales lots. Loading and unloading will take'place

Signage on the property is not being addressed as a part of this submittal. The applicant has
pursued signage for the entire complex (I 100 1 and 11201 West 1-70 Frontage Road North) as a
master sign plan application reviewed separately.

10. Whether necessary public improvements, including, but not limited to, curb, gutter,
sidewalk, roadway and drainage facilities as required, are provided for in the plan for
construction and dedication.
With the first building permit issued, the applicant will be responsible for half-width street
construction including curb, gutter and sidewalk for 50th Avenue. The road installation will
complete the portion between Robb and Parfet. Public improvements are already in place along
and north frontage road and along the frontages (frontage road and Parfet ) • the parcel to the
east.
11. Whether the proposed density (if residential) and character of development is compatible
with the predominant character of surrounding uses and development.
Although • details have been given regarding the design and architecture • the proposed
structures, a note has been added specifying that future buildings will be consistent with the
materials used in the Autoplex building to the east (lots of glass, tan stucco-like walls with red
tiled roof).
Staff concludes that an amendment to the existing planned building group is required to achieve efficient
and orderly development • the Medved Autoplex. Staff further concludes that all requirements of the
C- I zone district regulations have been met • exceeded and that the proposed use of the property is
consistent with adjacent zoning and land use. Therefore, a recommendation of approval is given with
the following conditions:
