The company is not responsible for any damage below the roof, due to leaks by winds in excess of 45 mph, ice dams, hail, pre-existing or future construction defects caused by storms or lack of maintenance during the period of the warranty or depressions in driveway caused by trailers or dumpsters. The company is also not responsible for nail pops. 9. The company will take appropriate means necessary to protect the roof during the repair of the roof and during the entire duration of the work, the homeowner's insurance will be responsible for ANY interior damages. 10. The dollar amount of the contract is the amount approved by the Insurance Company for the scope of loss, plus overhead and profit (if applicable) and any agreed to upgrades and deductible. ANY replacement of damaged or deteriorated decking, flashing, roof jacks, fascia boards, vents or other materials unless included in this contract, are considered NOT INCLUDED and will be charged for material and labor. 11. The final payment in full shall not be held up while waiting for the city to inspect the work the company agrees to meet or exceed all city inspection requirements. 12. First payment is to be one half of contract price or balance of first check from insurance company (No Cash). Additional payments will be paid in full upon completion of each segment. Any unpaid balance shall be due upon final completion. Any balance unpaid after thirty (30) days of completion will be deemed in breach of contract and Homeowners held in default. 13. Should Homeowners default on this contract, charges shall be added from date thereof at a rate of eighteen percent per annum (18% PER ANNUM); and if placed in the hands of an attorney for collection, all attorney fees, costs, and legal filing fees shall be paid by customer accepting said contract. 14. Title to job shall remain in contractor's titles until such a time homeowner shall pay for job in full. Homeowner does hereby authorize contractor or its designated representative to enter upon the premises of the homeowner and remove the job in the event of default of payment of any of the installment of the contract price when due. Contractor shall be responsible for any damages that may be caused to the premises of the homeowner of the result of the installation or the removal of said job and equipment in the event of default as herein set forth. 15. These conditions shall be considered as part of any contract entered into, including the contingent agreement when the work is approved and will be paid for by the Insurance Company, the same as if they were included herein. 16. The company is not responsible satellite dish removal, resetting, or damage on the house. Homeowner's insurance company will pay to have the satellite dish removed and reset properly. The company does not take responsibility for damage to solar panels on the roof during repair; homeowner agrees to take necessary means in removing, protecting, and re -installation of solar panels at homeowner's expense. 17. The company will not take responsibility for construction problems on your home. The company will point out and inform the homeowner on correcting the problem on a materials and labor basis. 18. Homeowner's agreement to the contingency statement on the front of this contract holds the entire contract as valid and binding as long as the Insurance Company approves to pay homeowner for the loss. 19. Roof replacement warranty is for 5 years, 2 years siding replacement, and I year on gutter installation. 20. You, the buyer, may cancel this transaction at any time prior to midnight of the third working day after the date of this transaction.
