Very often. vehicles are stacked at this drive to exit onto W, 38 1 Avenue. If inadequate stacking is provided for the ATM, there could be additional congestion at this drive which may result in accidents. It is recommended that if the AT N4 is located actiacent to 38' Avenue,, it should be shifted to the east to minimize potential traffic movement conflicts at the Nvestern drive. 2. It is recommended by Chase that two-three stacking spaces be provided for the ATM. Three stacking spaces are required by the City of: Wheat Ridge code of laws. It does not appear that three full stacking spaces are provided, 3. At the May 1 3 , 201 pre-application meeting, it was requested that a parking analysis for the shopping center be submitted with the SUP application so that the displacement of parking for the ATM can be analyzed. This information was never provided. 4. The City does not allow rooftop signage. The proposed sign located oil top oil' the kiosk cover must be removed. 5. Planning comments: M The Process This request will require a special use permit. The first step in the Special Use Permit process began with the pre-application meeting on May 13, 2010. The meeting should be coordinated with the assigned staff member who will also review the notification letter for content. A fee of $100 is required for staff to be present at this meeting. a Meetings can be held at city hall or any location the applicant desires. All costs associated with meeting, its location, and mailings will be paid by the applicant. The meeting will be led by the applicant and should inform those who are in attendance what is being proposed. After the neighborhood meeting is held, the applicant may submit their application for the request. Upon the submittal of the application for the Special Use Permit, the application will be reviewed by the case manager and sent to outside agencies for review. A 15 day time period is given for the agencies to respond with and corrections or revisions to the application. Once the review of the application is complete, the property must be posted for a minimum of 10 consecutive days. If no legitimate complaints are received regarding the request within the 10 day period the application for a Special Use Permit will be reviewed administratively. If a complaint is received by the Community Development Department, then the request for the Special Use Permit will be decided upon, at a public hearing before the City Council. If the application is reviewed administratively and denied, the applicant can be appeal the decision to the City Council, If a hearing before City Council is required for any reason, staff will present evidence to recommend the approval, approval with conditions, or denial of the Special Use Permit. The public will also be allowed to present evidence or give testimony in support or in opposition of the project. The City Council will approve, approve with conditions, or deny the project based on the testimonies given by staff., applicant and the public.
