I. REQUEST The applicant, Norman Stoneback, is requesting approval of the temporary permit as the tenant of 3555 Kline Street and the owner of six (6) dogs. The request is for approval of a 30-day temporary permit to allow six (6) dogs on property located at 3555 Kline Street and zoned Residential-Two (R-2). The purpose of the request is to allow the dogs to remain on the property while the applicant makes arrangements either to move out of the property or to reduce the number of dogs in conformance with zoning regulations. Section 26-115.13 (Temporary permit for uses, buildings, signs and nonoperative vehicles) of the Wheat Ridge City Code empowers the Director of Community Development to decide upon applications for thirty (30) day temporary permits without requirement of a public hearing. 11. CASE ANALYSIS The property located at 3545-3555 Kline Street is zoned Residential-Two (R-2) and contains a two- family dwelling. The area of the property is 13 ),514 square feet (0.31 acres). The applicant occupies the northern unit at 3555 Kline Street with his family and six (6) dogs. This unit includes two stories of finished living space and half of the property's yard space Ookk*i* Case 1-1istory The applicant has expressed that he, his l4mily, and his dogs have been living at 3555 Kline for more Haan three (3) years ,W . In March 2009, a complaint was received by the Wheat Police Department regarding barking dogs at the subject property. Police records indicate that a Community Service Officer responded and documented that the applicant had six (6) dogs and were in violation of city code based on the number of dogs in the home. In October 2011, Wheat Ridge Police responded to a similar complaint regarding barking dogs on the subject lot. Following the complaint, the applicant submitted a kennel license request to the Wheat Ridge Police Department to permit the keeping of more than three (3) dogs. Local kennels are also required to be licensed through the Colorado Department of Agriculture. The applicant allegedly submitted a request to the state, but conveyed in January 2012 that they were ineligible to receive a state license for a kennel. Having been denied a state kennel license, the Community Service Officers stated that the number of dogs at the home must be reduced to three (3); if the number of dogs was not reduced, a court summons would be issued. On January 28, 2012 a court summons was issued. The applicant appeared in court on March 1, 2012 and subsequently appealed to City Council for relief during the "Citizens' Right to Speak" at the March 26, 2012 City Council meeting. On March 29, 2012 the City Attorney's office clarified that the keeping of more than three (3) dogs is not only a violation of Chapter 4 of the city code, but also a violation of Chapter 26. At this time, the Community Development Department became involved in addressing the violation. 2 Case No. TUP- 12-01 / Stoneback, Code Analysis—Chapier 26 Section 26-204 of the city code establishes permitted uses in residential zone districts. Permitted as an accessory use are "household pets, limited to no more than 3 dogs and 4 cats, plus their unweaned offispring," Per section 26-204.A, any use that is not expressly permitted or expressly allowed as a special or accessory use, is considered not permitted. Because the code explicitly limits the number of household dogs, the keeping of four or more dogs is prohibited. The code does not allow for variances as to a use or activity which is prohibited, therefore the applicant may not request a variance from the three (3) dog limitation. The keeping of six (6) dogs as household pets on the subject property is, therefore, a violation of the zoning code. The applicant has expressed that all of the dogs are registered. It should be noted, however, that the registration of household pets occurs through the Animal Control Section of the Jefferson County Sheriff's Office. The purpose of registration is, in part, to help reunite lost pets with their owners; the successful registration of animals through Jefferson County does not imply or supercede conformance with municipal codes. The applicant has submitted a separate application to the Chief of Police requesting a variance from the kennel license requirement of Chapter 4. The request is to allow the keeping of up to six (6) dogs without a kennel license, and is scheduled to be heard by the Animal Commission on May 15, 2012. Regardless of the outcome of the kennel variance application, the zoning code will not allow the six (6) dogs to remain long -tern at the subject property. Even if a variance fi - orn Chapter 4 is approved, the number of dogs kept on the property must be reduced to three (3) or fewer by tile time the temporary permit expires. Public Noti flcalion During the public notification period three phone calls were received regarding the temporary pen request. A woman who owns adjacent property but does not live in the neighborhood stated no objection to the dogs or the temporary permit. A second neighbor has filed complaints regarding the dogs, but has no objection to the temporary pen as a short term solution. A third neighbor also objected to the number of dogs on the property. It was explained that the original request is for a 30-day pennit with the option of two, 30-day renewals. Four letters of support were subinitted by the applicant with the temporary pennit application. The letters are from neighbors who express no objection to the keeping of the dogs on the subject property. 111. FINDINGS OF FACT In order to approve a 30-day temporary pen the Community Development Director must determine that the request is in substantial compliance with the "findings of fact" listed in Section 26-115.D.4. Staff provides the following comments regarding the findings of fact. 1. The proposed temporary use will not have a detrimental effect upon the general health, welfare, safety and convenience of persons residing or working in, the neighborhood of the proposed use. The temporary keeping of six (6) dogs will not have a detrimental effect upon the general health, welfare, safety and convenience of persons in the surrounding area. The dogs are small- to medium -size dogs (five schnauzers and a sheltie). The applicant has expressed that the rear of the property provides a fenced area for the animals and that a family member usually accompanies the dogs outside to minimize barking The applicant's veterinarian has testified that the animals are in good health. 2. The proposed temporary use will not adversely affect the adequate light and air, nor cause significant air, water or noise pollution, or cause drainage problems for the general area. The temporary keeping of six (6) dogs kwill not adversely affect the adequate light and air to adjacent properties, nor will the animals cause air or water pollution or drainage problems. It is possible that the animals could contribute to noise in the neighborhood, but the applicant has testified that the animals are usually accompanied outside to minimize barking. 3. The proposed temporary use will not result in undue traffic congestion or traffic hazards, or unsafe parking, loading, service or internal traffic conflicts to the detriment of persons whether on or off the site. The temporary keeping of six (6) dogs will not result in traffic congestion or traffic hazards. The applicant has expressed that the dogs are not kept in the front yard and therefore are not in conflict with traffic or off-street parking. 4. The proposed temporary use will be appropriately designed, including setbacks, heights, parking, bulk, buffering ., screening and landscaping, so as to be in harmony and compatible with character of the surrounding areas and neighborhood, especially with a4jacent properties. The request will not require any physical improvements and will therefore have no change on the character of the area and no impact on setback, height, parking, bulk, buffering, screening or landscaping. 4 Case No. TUP42-01 ISIoneback 5. We found this out because someone mentioned to Animal Control that there could be more than 3 dogs at my residence. OVERPOPULATION Pet overpopulation is a serious problem. It costs the lives of millions of pets and costs communities millions of dollars a year. Nationwide, the number of pets entering animal shelters is estimated to be 6 to 8 million. Only about 30 percent of dogs and 2 — 5 percent of cats are reclaimed by owners. Only about half of those remaining are adopted to new homes. The number of pets euthanized in shelters across the country is 3 to 4 million. (Estimates provided by The Humane Society of the United States.) In Colorado alone, 166,153 cats and dogs entered shelters and rescue groups in 2009. In the metro - Denver area, 62,890 were received at 10 shelters. Seventy -five percent of these pets were placed in homes or reunited with owners, but 17,712 were euthanized (10,320 cats; 7,392 dogs). If you force us to place our babies in the system, what are their chances? We provide them with a wonderful home with love! Please do not force us to make them another statistic. Fitzsimmons Shelton Schmitz (Fitz) Born: October 30, 2004 Mr. Fitz, we got him from a pet store January 6, 2006, and he was such a cute little puppy how could we say no? Well, had we said no he would have died less than a day later, what we found out was that he had pneumonia and it wouldn't have been treated by the store. So, we rushed him to the vet, and he had to stay 3 nights getting high doses of antibiotics. He got better, to a degree, only one of his lungs works at full capacity. Fitz loves to play games, and he is more independent than the other dogs. Sometimes he'll go sun himself alone for a bit, only to be disturbed by one of the others. They love to get on his nerves, so he has the threatening growl down, but would never bite anyone. In fact, when we put him in training, during one of the social events where you unleash your dog, he didn't see other dogs; he went right to other people. Fitz has had many of his teeth taken out, so even if he wanted to bite someone, he would sooner gum them to death than anything else. Chelsea Louise Schmitz Born: June 30, 2005 Chelsea, the biggest of our Miniature Schnauzers. She is on a diet to lose a few pounds. She is the first one to go for toys. She will get a squeaker and just abuse the heck out of it, but she loves to play, so it usually is only a couple of minutes before she ropes someone else into playing with her. Chelsea Lou loves to sleep at the bottom of our bed. She loves attention, and will even nudge your arm until you give her attention. And she will let YOU know when you are done. She gives so much love. Sheena Leigh of Silver Lake Born: October 17, 2005 Sheena is the odd one out. She showed up after a trip to Southwest Plaza's pet store. It was April 2, 2006; she was in a bin with other dogs that were marked down in price because of their age. She was so cute and gave me a look of "please, just pick me up ". I did and instantly feel in love with her. She gave me a big kiss on my cheek. She was a little expensive, but due to her age and me talking with the Manager, I got her.. She is the black Sheltie as you see in the pictures you have. She also loves to play with toys, but more so with the others. She can be incredibly vocal, and you'll know it's her because she doesn't have the high pitched bark the others have. Emma Ann Schmitz Born: October 30, 2007 She is our smallest. She was not growing like her brothers. We took her to the vet and the diagnosis was that she had Mega- esophagus. This means that the muscles in her throat never developed. The solution was that we have to prop her up on our laps like a baby to feed her. She has become use to it and will run at the person who has her red bowl. Emma is fierce, she may be the runt, but she'll get up on her brothers' shoulders and start trying to play with them. She'll go for their throats (all in play of course) or anything else to get their attention. It's funny to watch because, the instant they decide enough is enough, she's on the defensive. They can easily flip her on her back and nip at her for revenge.She also likes to talk back to you when you tell her to be quiet or tell her she has done something wrong. She will walk away from you while you are talking and stop, turn just her head, say something and keep walking, this will continue until you stop talking and she always has to have the last word. Emma Ann always sleeps in front of me in bed. When it is cold, she likes to be covered up. Frederick Spencer Schmitz "Spencer" Born: October 30, 2007 Frederick Spence was named after my father. My parents have 26 grandchildren, 19 are boys and not one is named after him. So, I gave the honor to one of my puppies. We call him Spencer instead of Fred or Frederick, because it just would not be right yelling my father's name if he did something wrong. Spencer is a solid wall of muscle. A brick wall if you will. Trying to get him to do something is fairly easy most of the time, but if he feels like playing dead weight, he becomes dead weight. He's a big goofball, and he loves to play with toys, but would rather attack his sister most of the time. He's one of the twins, the other being Sheldon. It's easy to tell them apart because of the way their ears fall, and the way their hair lays all over their bodies. Sheldon Fitzsimmons Schmitz Born: October 30, 2007 He's the most serious of the bunch. He'll play with toys, but he would rather lounge around and help type on a laptop. He's become quite adept at using the caps lock key, and even now typing this out he's done it a couple of times. He's a protector of the house, and is the first to verify someone isn't here to hurt anyone. If Sheldon approves, by way to a sniff and walks away, you're in and the rest will more than likely leave you alone. He's the other twin, and his ears droop down while Spencer's do not. He also loves lots and lots of attention. He will lay his head beside me on my pillow. He follows me around all day. Usually sitting next to me on the couch. He likes to play with toys and will challenge his brother for a toy. He usually just lets Spence have the toy. Other things to consider: -They each have their own food bowls. We monitor the amount of food each of them gets. A few need to lose a couple pounds. -They each have their own bed or place to lie that is when they're not on the couch with someone.
