WHEREAS, City staff found basis for approval of the Special Use PenTift, relying on criteria listed in Section 26-
114 of the Wheat Ridge Code of Laws and on information submitted in the case file; and
WHEREAS, the Community Development Department has properly notified pursuant to Section 26-109 of the
Wheat Ridge Code of Laws; and
WHEREAS, there were no registered objections regarding the application;

met, therefore, there is jurisdiction to make a decision regarding this case.

The applicant, David Dye, is requesting approval of a Special Use Permit (SUP) as the new
tenant of 4855 Miller Street. The request is for approval of a SUP to legitimize the use of the
property as a vehicle display and sales lot. The property in question is located at 4855 Miller
Street and is zoned Commercial -One, C- 1.
Pursuant to Ordinance No. 1291, the Community Development Director has the ability to decide
upon applications for administrative special use approval, without a public hearing, provided the
following conditions are met:

H. PROPERTY HISTORY
The property is approximately .78 acres in size. It is zoned C -1 and contains an 1800 square foot
metal office building. A single access point is provided from the West 1-70 Frontage Road North.
The remainder of the property is used for vehicle display (Exhibit, 1, Aerialphotq).
Use: Vehicle sales lots are special uses in the C- I zone di stfict. A special use pen was never
granted for the car lot use. The commercial vehicles sales standards also require a 1500'

separation between adjacent vehicles sales lots. The closest display lot is part of the Medved
Autoplex, on the west side of Parfet, approximately 1600' from the subject parcel.
Paving: All vehicle sales lots are required to be bard surfaced. The property was paved in 2008
as a part of code enforcement negotiations.
Architectural and Site Design Manual (ASDM): The existing structure is 1800 s.f in size and
is made of metal. It was built prior to the adoption of the ASDM and is not required to comply
with the architectural standards.
111. CASE ANALYSIS
This application is intended to allow the new tenant to take over operation of the property with
certain improvements including installation of perimeter landscaping and other cosmetic
improvements including repainting of the structure from red to an earth tone. The intent of these
improvements is to bring the property closer into compliance with Section 26-628 of the zoning
and development code regulating vehicle display lot standards.
The owner also owns the properties immediately to the north and east. While staff would not
normally encourage the "piecemeal" approach by addressing just the subject property, the

current application will be beneficial to the city in numerous ways. By approval of the TUP's
and SUP, there will economic and physical benefits and, foremost, an illegal use has the potential
to be brought into compliance with the zoning code.
The property is surrounded by a variety of zoning and land uses. To the immediate north is an
A- I zoned parcel which is currently vacant and owned by the same property owner. Beyond that
is an office/warehouse facility zoned PID. Property to the east is zoned C- I and contains the
American Motel, Land to the west is also owned by the property owner. It contains a 20,000 sf
vehicle repair facility. The facades of this structure were recently upgraded.
Before an administrative special use is approved, the applicant shall show and the Community
Development Director shall find that the majority of the proposed special use criteria have been
met. Staff provides the following review and analysis of the SUP criteria.
1. The special use will not have a detrimental effect upon the general health, welfare,
safety and convenience of persons residing or working in th , e neighborhood.

existing zoning for the property.
The property has been utilized as vehicle sales lot for almost ten years. Continuation of
this use will not create adverse impacts. Property improvements have occurred which
will be a benefit to the neighborhood.

4. The special use will not result in undue traffic congestion or traffic hazards, or
unsafe parking, loading, service of internal traffic conflicts to the detriment of
persons whether on or off the site.
No substantial changes are proposed so there should be no traffic hazards on or off site.

5. The property is appropriately designed, including setbacks, heights, parking, bulk,
buffering, screening and landscaping, so as to be in harmony and compatible with
the character of the surrounding areas and neighborhood, especially with adjacent

All improvements are already in place. Newly installed landscape improvements will
improve the appearance of the property.

parks, schools and other public facilities and services.
All utility agencies are currently serving the property and based on referral responses
received, will continue to do so, There will be no impact on parks, schools or other

The former tenant and current property owner have had numerous dealings with code
enforcement over the past ten years including citations for use of illegal storage
containers, paving violations and illegal signage. Approval of the Special Use Pen
with property improvements will legitimize the use and eliminate code enforcement
monitoring and interactions by staff.

8. The application is in substantial compliance with the applicable standards set
forth in the Architectural and Site Design Manual.
The proposed improvements do not exceed the threshold for application of the ASDM'
commercial design standards; however, the proposed improvements are an upgrade to
the aesthetics of the property and structure.

A meeting for neighborhood input was held on October 24, 2012. Other than staff, the owners
and the applicants, there were no persons in attendance.

Applicant /Owner Preliminary Proposal
Staff met with the applicant and property owner on October 4, 2012 to discuss required landscaping
associated with vehicle sales lots. Staff requested a 1tl -foot landscaped buffer on private property
along the southern and eastern property lines.
After surveying and confirming the location of property lines, the applicant submitted a preliminary
landscape playa which proposed locating landscaping in the right-of-way between the back of sidewalk
and the property lines. The purpose of the November 16 follow -up meeting was to discuss the
proposed site plant.
Along Miller Street, the landscape buffer may be located between the back of sidewalk and the
property Bate. This area is approximately 13 feet: in width, and this entire width shall be
landscaped. The applicant is aware. that this will require the removal of some existing asphalt
in this area.
Process
The next steps are as follows:

landscape and irrigation improvements)
f. Site/landscape plan (this should indicate at a minimum the location, species, and size of
all plant material; also indicate the location of fencing and any boulders to be retained)

Based on Jefferson County Assessor records, the subject property is about 34,195 square feet (0.78
acres) in size. The subject property is almost entirely paved with the exception of a 1,800 square foot
office building on the west side of the lot.
Applicant/Owner Preliminary Proposal:
The applicant, Dye Enterprises, Inc, is proposing to locate a new auto sales business on the subject lot.

What is a Special Use?
Special uses are discretionary uses which, if properly
designed, developed, operated, and maintained may be
approved in a zone district where the special use is
permitted. The primary issues to be addressed are those
related to the justification of need and special design, as
well as operational considerations which mitigate the
potential detrimental impacts on surrounding land uses,
the street system, and public services or facilities. A
special use permit can be granted administratively by the
Community Development Director or by City Council.
Special use approvals can be vested with the land in
perpetuity, can be granted only to the applicant, or can be
for a specific period of time. Obtaining a special use
approval can take as little as two months or as long as
four months depending on the nature of the request and
whether an administrative approval occurs.
Special Use Permit Criteria
Before a special use permit is approved, the applicant will
demonstrate that the following criteria have been met:
• Will not have a detrimental effect upon the general
health, welfare, safety and convenience of persons
residing or working in the neighborhood.
• Will not create or contribute to blight in the
neighborhood by virtue of physical or operational
characteristics.

Based on Jefferson County Assessor records, the subject property is about 34,195 square feet (0.7
acres) its size. The subject property is almost entirely paved with the exception of a 1,800 square foot
office building on the west side of the lot.
Applicant/Owner Preliminary Proposal:
The applicant, Dye Enterprises, Inc, is proposing to locate a new auto sales business on the subject lot.
Proposed improvements on the site include landscaping, perimeter fencing, a new sign, and
improvements to the existing building.
Will a neighborhood meeting need to be held prior to application submittal?

The following items were discussed based on the proposal:
Zoning of S
1)ecial Uses
The subject property is zoned Commercial-One (C-1), a zone district which provides for a wide range,
of commercial land uses including office, general business, and retail sales and service establishments.
In the C-I zone district automobile and light-duty truck sales are allowed as a special use.
The one-month temporary permit may be renewed twice. Please submit a renewal request in writing
prior to the October 20, 2012 expiration date. As long as the applicant continues to work towards
achieving SUP approval, staff anticipates being able to approve a TUP renewal request. You may
submit the renewal via email, regular mail or hand delivery to Lauren Mikulak, Planner I
(Imikulak(�i,?ci.wlieatridge.co.us).

The property is currently nonconforming because it does not ►neet site design requirements for a
commercial business or auto sales lot. As part of the submittal for the special use pen the applicant
is required to submit a site plan to demonstrate that on-site improvements are being made to bring the
property into conformance with the zoning code. The site plan should include the following:
Landscaping: Commercial properties in Wheat Ridge are supposed to have 20% of the lot
covered in landscaping. At a minimum the property needs to comply with the buffering

requirements for auto sales lots (per section 26-628 of the code). This entails a I 0 -foot wide
landscaped area along the southern and western property lines. This landscape area needs to be
irrigated and should include one street tree for every 30 feet of street frontage (per section 26-
N
502). Based on having 400 feet of frontage (excluding the driveway) on Miller Street and the
1-70 Frontage Road, twelve (12) trees will be required. These trees may be ornamental and do
not need to be placed 30 feet on center. They can be placed in the perimeter landscape buffer
or, if parking lot islands are incorporated, they may be located there as well. See example
image below.

Enclosed is one of the City's standard forms. an Acknowledgement of Roadway Reservation. Staff
will complete the front page and provide a diagram and description of the reservation area. The
property owner will need to provide a legal description of the property. The property owner may sign
the completed form prior to the issuance of an approved special use permit.

Purpose of this letter is to explain the proposed landscape additions to the property located at 4855
Miller Street Wheat Ridge, CO 80033 to achieve the Permanent Special Use Permit for Dye
Enterprises, We are working with the City of Wheat Ridge to Provide adequate landscaping for our
property and to provide future roadway expansion for the City of Wheat Ridge. We have
developed a plan of planting oftrees, scrubs and rock from the back ofthe Miller Street side walk
and the 170 frontage road sidewalk near the perimeter ofthe property. We have attached a site plan
that shows the proposed additions to the property that would start soon after the approval date and
to be finished in the spring of 2013. We have discussed that planting vegetation should be delayed
because ofthe coming Winter season. Proper irrigation will be installed to keep the vegetation
alive for years to come.
