I. REQUEST Case No. SUP -13 -02 is an application by Joel Lammers on behalf of Eternal Life Care Centers, LLC requesting the approval of an administrative Special Use Permit (SUP) to allow a residential group home for nine (9) residents on property zoned Residential -Two (R -2) and located at 4370 Ingalls Street (Exhibit 1, Letter of Request). All group homes with nine or more residents require a Special Use Permit in residential zone districts. Pursuant to Section 26 -114 (special uses) of the Municipal Code, the Community Development Director has the ability to decide upon applications for administrative special use approval, without a public hearing, provided the following conditions have been met: 1. A completed application package has been submitted and fee paid. 2. The Community Development Department has notified adjacent property owners by letter and the site has been posted for at least ten (10) days. 3. No written objections have been received in such ten -day period. 4. The Community Development Director concludes that the criteria for approval, as set forth below, are substantially complied with and support the request. The Community Development Director can impose conditions or stipulations upon the approval, which may address physical design, business operations, and /or maintenance considerations to ensure compliance with the criteria for review. The Community Development Director shall also decide the following: 1. Whether the SUP runs with the land in perpetuity; 2. Whether the SUP is personal to the applicant and may or may not be inherited; and /or, 3. Whether the SUP is granted only for a defined period, after which time the special use shall expire unless renewed subject to all of the requirements of this section. II. CASE ANALYSIS The property is located at 4370 Ingalls Street, on the east side of the street and one lot south of W. 44'" Avenue. The subject property is zoned Residential -Two (R -2), a zone district that provides for high quality, safe, quiet and stable low to moderate - density residential neighborhoods; and prohibits activities of any nature which are incompatible with the residential character. Surrounding properties include a variety of commercial and residential uses. Directly to the north is a Planned Commercial Development (PCD ith a Family Dollar store. To the west and south are properties zoned R -2 and R -3 contaimn and Ingle- and two - family homes. Behind the subject lot to the east is a property which was recently rezoned to MU -N and is being used as a single family home (Exhibit 2, Zoning Map). Case No. SUP -13 -02 / Eternal Life Care Based on county records, the subject site has an area of 12,440 square feet (0.29 acres). A single story residential structure on the property is 2,310 square feet in size and was originally built as a duplex in 1965. In 2008, the home was legally converted to a single family home for an assisted living facility. A paved driveway along the south side of the property provides off -street parking (Exhibit 3, Aerial). The applicant is proposing to expand the existing group home facility. Currently, the facility uses five (5) bedrooms which accommodate eight (8) residents. Group homes with up to 8 residents are a permitted use in residential zone districts, so the applicant has not required an SUP up to this point. The applicant would like to add an additional person for a total of nine (9) elderly residents. Three bedrooms in the facility would be double occupancy, and the other three bedrooms would be single occupancy. The applicant is not proposing any structural changes, additions, or changes in the number of bathroom or kitchen facilities. The Building Division has asked the applicant to confirm that the window in bedroom #6 meets minimum egress standards with an opening of at least 5 square feet in size. The zoning code establishes off -street parking requirements based on land use. For elderly group homes, the ratio is 0.5 spaces per elderly occupant, plus the standard residential dwelling requirement. Based on the proposed number of residents and the availability of parking on Ingalls Street, the requirement is seven (7) off - street parking spaces. The applicant has provided a site plan that fulfills this requirement, with two parking spaces in an attached garage and five spaces in the driveway (Exhibit 4, Site & Floor Plans). III. SPECIAL USE PERMIT CRITERIA Staff uses the following criteria from Section 26 -114.13 of the City Code to evaluate requests for special use permit. The Community Development Director shall base a decision in consideration of the extent to which the following criteria have been met. Staff provides the following analysis of the review criteria. 1. The special use will not have a detrimental effect upon the general health, welfare, safety and convenience of persons residing or working in the neighborhood. The proposed special use will not affect the health, welfare, safety, or convenience of any person working or residing in the area. The site has been operating as a residential group home for the past five years with up to eight residents and no detrimental effect on the neighborhood. The property appears to be well maintained, and the facility provides housing options for the elderly which is of value to the community (Exhibit 5, Site Photos). Staff finds this criterion has been met. 2. The special use will not create or contribute to blight in the neighborhood by virtue of physical or operational characteristics. As with all group homes, the facility's operations are regulated by the Colorado Department of Public Health and Environment. The facility on Ingalls Street is licensed through the Health Facilities Division under the name Hearts and Hands Assisted Senior Care. The state agency conducts routine inspections for compliance with state regulations and with Case No. SUP -13 -02 /Eternal Life Care life safety and health codes. The addition of a ninth resident may require that the state license be updated, and the applicant has been made aware of this. AD The physal characteristics of the site are not proposed to change, and the use is not expected contribute to blight in the neighborhood. Staff finds this criterion has been met. 3. The special use will not create adverse impacts greater than allowed under existing zoning for the property. Staff has not identified any adverse impacts greater than what are allowed under the existing zoning. A residential group home for the elderly is a permitted use in residential zone districts for up to eight residents. Because there is no physical change proposed for the property, the addition of a ninth resident is unlikely to result in any additional impact to the neighborhood. There is the potential for additional parking needs associated with the new resident or his visitors, but the site is able to absorb this impact. The driveway and garage provide sufficient space for the seven required off - street parking spaces. Staff finds this criterion has been met. 4. The special use will not result in undue traffic congestion or traffic hazards, or unsafe parking, loading, service or internal traffic conflicts to the detriment of persons whether on or off the site. The proposed use will not create undue traffic congestion or hazards. Sufficient parking and loading areas are provided on the property. Staff finds this criterion has been met. 5. The property is appropriately designed, including setbacks, heights, parking, bulk, buffering, screening and landscaping, so as to be in harmony and compatible with the character of the surrounding areas and neighborhood, especially with adjacent properties. The adjacent properties will be minimally impacted by the proposed special use and addition of a ninth resident. The property is already developed and is in harmony with the surrounding area. No changes to the footprint or the exterior of the building are being proposed. The setback and height of the structure will remain unchanged, and the impervious surfaces will not be increased. Staff finds this criterion has been met. 6. The special use will not over burden the capacities of the existing streets, utilities, parks, schools, and other public facilities and services. Case No. SUP -13 -02 /Eternal Life Care Parks, schools, and other public facilities will not be negatively impacted by the proposed use. The existing network of streets has the ability to handle the capacity of traffic, and no significant increase to traffic is expected to be generated by this use. Utility agencies have expressed that they can serve the property, and the Wheat Ridge Fire District reviewed the proposal and has no concerns. Staff finds this criterion has been met. 7. There is a history of compliance by the applicant and/or property owner with Code requirements and prior conditions, if any, regarding the subject property. There is no history of code enforcement action against the applicant or the property. Staff finds this criterion has been met. 8. The application is in substantial compliance with the applicable standards set forth in the Architectural and Site Design Manuah There are no additions or expansions associated with the proposal, therefore the Architectural and Site Design Manual (ASDM) does not apply. Staff finds this criterion is not applicable IV. NEIGHBORHOOD MEETING & PUBLIC COMMENT Prior to submittal of an application for a Special Use Permit, the applicant was required to hold a neighborhood meeting in accordance with the requirements set in City Code, Section 26 -109. A meeting for neighborhood input was held on May 7, 2013. Staff and the applicant attended the meeting, but no other members of the public were in attendance. No comments or objections were filed during the 10 -day public noticing period. V. AGENCY REFERRAL All affected service agencies were contacted for comment on the proposed use and regarding the ability to serve the proposed site development. Specific referral responses follow: Wheat Ridge Public Works: No concerns. Wheat Ridge Building Division: No comments received. Wheat Ridge Fire District: No concerns; can serve. STAFF RECOMMENDATIONS /FINDINGS OF FACT Having found the application for Case No. SUP -13 -02 / Eternal Life Care —a Special Use Permit (SUP) to allow a residential group home for 9 residents on property zoned Residential -Two (R -2) and located at 4370 Ingalls Street —to be complete and in compliance with the majority of the applicable review criteria, staff recommends APPROVAL of the special use request with the following findings of fact: 1. This request for an administrative Special Use Permit meets all applicable conditions as required by Section 26 -114 of the City of Wheat Ridge Code of Laws. 2. There will be no detrimental effect on health, safety, welfare, or convenience to the public in the area. 3. The facility provides long -term managed care for at risk individuals requiring 24 hour daily supervised care. The facility is located in an R -2 district of Wheat Ridge currently allowing eight long -term residents. We are requesting an allowance increase to nine residents. The facility is licensed by Colorado Department of Public Health and Environment and is fitted with the appropriate fire alarm and sprinkler systems. The structure is designed for six bedrooms. Three of the bedrooms are compliant with the Health Department square footage regulations allowing two occupants and three of the bedrooms are single occupancy size, in total, this will allow us to provide the care for nine residents. The facility was approved for the present use in the fall of 2008. We have been in compliance with the City of Wheat Ridge building codes, the Wheat Ridge Fire District policies and the requirements of the Colorado Department of Public Health and Environment and have passed all inspections by the respective entities since opening in 2008. Special uses are discretionary uses which, if properly designed, developed, operated, and maintained may be approved in a zone district where the special use is permitted. The primary issues to be addressed are those related to the justification of need and special design, as well as operational considerations which mitigate the potential detrimental impacts on surrounding land uses, the street system, and public services or facilities. A special use permit can be granted administratively by the Community Development Director or by City Council. Special use approvals can be vested with the land in perpetuity, can be granted only to the applicant, or can be for a specific period of time.
