REGARDING ROOF VENTILATION: Roof ventilation shall comply with IBC Sec. 1203.2 or IRC Sec. R806. The installation of ridge venting requires the installation or existence of soffit venting. For calculation purposes, one hat or turtle vent equal to one-half of one square foot of opening. Effective December 1, 2014, asphalt shingle installations require an approved midroof inspection, conducted when 25-75 percent of the roof covering is installed, prior to final approval. Installation of roof sheathing (new or overlay) is required on the entire roof when spaced or board sheathing with ANY gap exceeding one half inch exists. Sheathing and mid -roofs may be called in at the same time, one hundred percent of the sheathing must.be complete and 25-75 percent of the mid -roof may be complete. Asphalt shingles are required to be fastened to the roof deck with a minimum of 6 nails per shingle. Ice and water shield is required. Eave and rake metal is required. A ladder extending 3 feet above the roof eave and secured in place is required to be provided for all roof inspections. Roof ventilation is required to comply with applicable codes and/or manufacturer installation instructions, whichever is more stringent. Employment Practices. No Liens. Insurance. The foregoing warranty shall be against any and all defects in labor, md/or equipment, violations of applicable laws, codes, statutes, ordinances, regulations an requirements and provisions set forth in this Contract. The materials will be warrani ed by the manufacturer for a period of time set forth in their warranty information specified il Exhibit A. Contractor shall not be held liable for any defects in workmanship arising from mat rials. Contractor shall not be obligated to perform any corrections arising from Client's galigence, 17. Client's Remedies. Contractor shall be liable to Client for any dama�es sustained by the Client as a result of Contractor's breach of this Contract. IIII 18. Contractor's Remedies. Client shall be liable to Contractor for any ages sustained by Contractor as a result of Client's breach of this Contract. Contractorshr haven right against Client for any inconsequential damages. 19. Termination. (a) In General. This Contract shall terminate upon satisfaction 010, requirements contained herein by both parties, or in any othinanneras provided herein. (i) Client shall notify Contractor of said breach inwri ' andshall give Contractor fifteen days to remedy such breach, rovided, however, if it is or becomes impossible or commere lyre impracticable for Contractor to cusuch breach wi ' 15 days through no fault of Contractor, then Contractor shall ve such additional time as is necessary to cure the breach unt the impossibility or commercial impracticability ceases exist. (ii) In the event Contractor fails to timely correct said ch in a manner satisfactorily to Client, Client may notify Co tractor that this Contract is terminated and Contractor shall be ' le to Client for all damages and/or costs sustained by Client as a sult of said breach, including all legal fees and costs. Upon Breach by Client. (i) Contractor shall notify Client of said breach and shal give Client 15 days from its receipt of such notice to remedy the h, provided, however, if it is or becomes impossible or mmerciall, impracticable for Client to cure such breach within 1 days, then Client shall have such additional time as is necessary Pcure the breach until the impossibility or commercial impractiability ceases to exist (ii) In the event Client fails to timely correct said breach a manner satisfactorily to Contractor, then Contractor Umay no ' Chentthat this Contract is terminated and Client shall be liable Contractor for all damages and/or costs sustained by Contractor s a result of said breach including all legal fees and costs. (ii) As further discussed herein below, The Client may a o rescind this Contract pursuant to section CICS 6-22-104. �:Plientmay rescind this Contract within seventy-two hours a a Client receives written notice from its property and casual insurer that the claim for payment for the Work which is the subj of this Contract is denied, in whole or in part, Client's right f rescission under this subsection (ii) does not apply when the p rty and casualty insurer denies, in whole or in part, a claim r( laced to a request for supplemental roofing services if. 1) the dW mage requiring the supplemental roofing services could not have been reasonably foreseen as a necessary and related roofin service at the time of the initial roofing inspection or the exeeu on of this Contract; 2) the supplemental roofing services is by building code; or, 3) the supplemental roofing servic amrequired to meet roofing material manufacturer install specific 'ons, (iii) As to subsection (ii) above, the Client shall give n notice of rescission of this Contract to the Contractor at the ph3 sicaladdress provided herein within seventy-two hours after the Cl ent is notified of the denial. The Client may give notice of scission of this Contract; (a) In an electronic form, which is effective on th� date of the electronic transmission; (b) By mail, which is effective upon deposit in th United States mail, postage prepaid, sent to the physic l address stated in the contract; or (c) By personal delivery to the Contractor, which s effective upon delivery. (iv) Within ten days after rescission of this Contract per s section (ii) above, the Contractor shall return to the Client any palments or Page 7 of 14 itials (..,r deposits made by, or evidence of indebtedness of, th Client in connection with this Contract for Work on the Aron _ (v) The Client's rescission of this Contract per subsectio (ii) above does not preclude the Contractor from retaining all o a portion of any payments or deposits made by the Client to coin ensate the Contractor for Work actually performed on the Pro in , in a workmanlike manner consistent with standard roofin this Contract for Work before the Client rescinded practices, but the Contractor may retain only an amo t required to compensate the Contractor for the actual work perfo ed. (vi) The Client's rescission of this Contract per subsectio (ii) above does not abrogate the Contractor's right to pursue co n law remedies for the reasonable value of goofing material ordered and actually installed on the subject residential property rsuant to this Contract for Work before the Client rescinded Contract, as long as the Contractor performed the roofing service consistent with roofing industry standards for workmanlike pe rmance of roofing services_ (vii) The Client's rescission of this Contract per subsection (ii) above does not abrogate a property and casualty insurer's du jes, responsibilities, or liability under sections 10-3-1115 md 10-3- 1116, Colorado Revised Statutes. (viii) This Section 20 also constitutes satisfaction of the irementsof Sections 6-22-103(f) (1) and (1I), Colorado Revised S Lutes. Section 20 constitutes Contractor's policy regardinge cancellation of the Contract and the refunding of any eposit. Payment No Release. Remedies Not Exclusive. The options and remedies provided her ' shall be neither exclusive, nor deemed as limiting Client's or Contractor's rights and rem s under -this Contract, or under applicable law. Client or Contractor shall be entitled to exercise 11 of its rights and remedies under this Contract or under applicable law, concurrently, and such order as Client or Contractor in its sole discretion determines. 22. Successors and Assigns. This Contract shall inure to the benefitof d be binding upon any permitted successors and assigns of the parties hereto. This Contract sha not be assigned without the prior written consent of the otherparty. 23. Notice.
