SECTION 301 - GENERAL For the pwpose of this code, certain terms, phrases, words and their derivatives shall be construed as specified in either this chapter or as specified in the Building Code or the Housing Code. Where terms are not defined, they shall have their ordinary accepted meanings within the context with which they are used, Webster's Third new International Dictionary of the English Language, Unabridge, copyright 1986, shall be construed as providing ordinary accepted meanings, Words used in the singular masculine gender include the feminine and the feminine the masculine, BmLDING CODE is the International Code Council, as adopted by this jurisdiction. DANGEROUS BmLDING is any building or structure deemed to be dangerous under the provisions of Section 302 of this code. HOUSING CODE is the Uniform Housing Code promulgated by the International Conference of building Officials, as adopted by this jurisdiction, INTERNATIONAL PROPERTY MAINTENANCE CODE is the 2003 International Property Maintenance Code promulgated by the International Code Council, as adopted by this jurisdiction. SECTION 302 - DANGEROUS BmLDING For the pwpose of this code, any building or structure which has any or all of the conditions or defects hereinafter described shall be deemed to be a dangerous bnilding, provided that such conditions or defects exist to the extent that the life, health, property or safety ofthe public or its occupants are endangered, I. Whenever any door, aisle, passageway, stairway or other means of exit is not of sufficient width or size or is not so arranged as to provide safe and adequate means of exit in case of fire or panic, 2. Whenever the walking surface of any aisle, passageway, stairway or other means of exit is so warped, worn. Loose, torn or otherwise unsafe as to not provide safe and adequate means of exit in case of fire or panic. 3, Whenever the stress in any materials, member or portion thereof, due to all dead and life loads, is more than one and one half times the working stress or stresses allowed in the Bnilding Code for new buildings of similar structure, purpose or location. 4, Whenever any portion thereof has been damaged by fire, earthquake, wind, flood or by any other cause, to such an extent that the structural strength or stability thereof is materially less than it was before such catastrophe and is less than the minimum requirements of the Building Code for new buildings of similar structure, pwpose or location, 5, Whenever any portion or member or appurtenance thereof is likely to fail, or to become detached or dislodged, or to collapse and thereby injure persons or damage property, 6. Whenever any portion of a building, or any member, appurtenance or ornamentation on the exterior thereof is not of sufficient strength or stability, or is not so anchored, attached or fastened in place so as to be capable of resisting a wind pressure of one half of that specified in the building Code for new buildings of similar structure, pwpose or location without exceeding the working stressed permitted in the Building Code for such buildings. 7. Whenever any portion thereof has wracked, WllIped, buckled or settled to such an extent that walls or other structural portions have rnaterially less resistance to winds or earthquakes than is required in the case of similar new construction. 8, Whenever the building or structure, or any portion thereof, because of (i) dilapidation, deterioration or decay; (ii)faulty construction; (iii) the removal, movement or instability of any portion of the ground necessary for the pwpose of supporting such buildings; (iv) the deterioration, decay or inadequacy of its foundation; or (v) any other cause, is likely to partially or completely collapse. 9, Whenever, for any reason, the building or structure, or any portion thereof, is manifestly unsafe for purpose of which it is being used, 10, Whenever the exterior walls or other vertical structural members list, lean or buckle to such an extent that a plumb line passing through the center of gravity does not fall inside the middle on third of the base, I L Whenever the building or structure, exclusive of the foundation, shows 33 percent or more damage or deterioration of its supporting member or members, or 50 percent damage or deterioration of its non-supporting members, enclosing or outside walls or coverings, 12. Any building or portion thereof that is determined to be an unsafe building in accordance with Section 102 of the Building Code, or any building or portion thereof, including any dwelling unit, guest room or suite or rooms, or the premises on which the same is located, in which there exists any of the conditions referenced in this section to an extent that endangers the life, limb, health, property, safety or welfare of the public or the occupants thereof, shall be deemed and hereby are declared to be substandard buildings, 1001.2 Inadequate Sanitation, Buildings or portions thereof shall be deemed substandard when they are when they are in sanitary, Inadequate sanitation shall include, but not be limited to, the following: I, Lack of or improper water closet, lavatory, bathtub or shower in a dwelling unit or lodging house, 2. IS, Lack of adequate garbage and rubbish storage and removal facilities as determined by the health officer. 1001.3 Structnral Hazards. Buildings or portions thereof shall be deemed substandard when they are or contain structural hazards. Structural hazards shall include, but not be limited to, the following: I. Deteriorated or inadequate foundations, 2. Defective or deteriorated flooring or floor supports, 3, Flooring or floor supports of insufficient size to carry imposed loads with safety, 4. Members of walls, partitions or other vertical supports that split, lean, list or buckle do to defective material or deteriorations. 5, Members of walls, partitions or other vertical supports that are of insufficient size to carry imposed loads with safety, 6. Members of ceilings, roofs, ceiling and roof supports, or other horizontal members that sag, split or buckle due to defective material or deterioration, 7, Members of ceilings, roofs, ceiling and roof supports, or other horizontal members that are of insufficient size to carry imposed lads with safety. 8, Fireplaces or chimneys that list, bulge 0 settle due to defective material or deterioration, 9, Fireplaces or chimneys that are of insufficient size or strength to carry imposed loads with safety, 1001.4 Nuisance. Buildings or portions thereof in which there exists any nuisance as defIned in this code are deemed substandard buildings, 1001.5 Hazardous Electrical Wiring. Electrical wmng that was installed in violation of code requirements in effect at the time of installation or electrical wiring not installed in accordance with generally accepted construction practices in areas where no codes were in effect or that has not been maintained in good condition or that is not being used in a safe manner shall be considered substandard, 1001.6 Hazardous Plumbing. Plumbing that was installed in violation of code requirements in effect at the time of installation or plumbing not installed in accordance with generally accepted construction practices in areas where no codes were in effect or that has not been maintained in good condition or that is not being used in a safe manner shall be considered substandard, 1001.7 Hazardous Mechanical. Mechanical equipment that was installed in violation of code requirements in effect at the time of installation or mecbanical equipment not installed in accordance with generally accepted construction practices in areas where no codes were in effect or that has not been maintained in good condition or that is not being used in a safe manner shall be considered substandard. 1001.8 Faulty Weather Protections. Bnildings or portions tbereof shall be considered substandard when they have faulty weather protections, which shall include, but not be limited to, the following: 1. Deteriorated, crumbling or loose piaster. 2. Deteriorated or ineffective waterproofing or exterior walls, roof, foundations or Ooors, including broken windows or doors. 3. Defective or lack of weather protection for exterior wall coverings, inclnding lack of paint, or weathering due to lack of paint or other approved protective covering. 4. Broken, rotted, split or buckled exterior wall coverings or roof coverings. 1001.9 Fire Hazard, Any building or portion thereof, device, apparatus, equipment, combustible waste, or vegetation that, in the opinion of the chief of the fire department, is in such a condition as to cause a fire or explosion or provide a ready fuel to augment the spread and intensity of fire or explosion arising from any cause shall be considered substandard, 1001.10 Faulty Materials of Construction, The use of materials of construction, except those that are specifically allowed or approved by this code and the Building Code, and that have been adequately maintained in good and safe conditions, shall cause a building to be substandard, 1001.11 Hazardous or Insanitary Premises. N \,]"'-l ~' ~)C:::J ,.0 (/) '.0 I~J' ~ '" m March 10, 1997 Dear Mr, Gaspar, I am sending you this letter because there are serious deficiencies in the house I rent at 3114 Teller Street When I moved in, I agreed to a very high rent--$1200 a month, because I was told that the house had been "completely remodeled" and was in perfect condition, Also, it was a horse property, and that increased its value, What I did not realize was that the landlord did this "total remodel" using scavenged materials, the house wiring is in deplorable condition and proper inspections were not done, Also, the landlord then blocked me from using the pasture or barns, turned off the outside water so my garden died, and refused to make any kind of reasonable repairs, After I moved in on May 1,1996, there was no hot water because the water heater was so old and rusted that the water was unusable, The landlord reluctantly agreed to fix this, but only after telling me to "just run the water for a long time to get rid of the rust" The kitchen stove was unusable because the landlord had painted it with regular spray paint and the oven door wouldn't close, I bought another stove, The landlord paid me back the next month, When I moved in, the windows were all painted shut, the glass in the front of the house had bullet holes and the plumbing was very problematic--for example, the hot and cold were reversed, There were no smoke detectors, During the summer, conditions were terrible because there are many windows with no screens, Finally, the landlord made one screen. The other windows remain without screens, The basement bedroom windows were painted shut When I've tried to force them open and then re-c1ose them, they are now jammed and do not open, My son's bathroom is unusable due to leaking plumbing and peeling paint My daughter's bedroom had such severe mold on the walls that the plaster fell off, The landlord put up some drywall, never painted it and never returned to finish the job, There are so many insects the basement that the bathroom tub usually has many spiders in it. There is an open sewage clean out in the bathroom wall, and that may be where the insects come from, The electrical wiring is so faulty that three computers have failed, If! try to cook in the kitchen, the power often kicks off, The kitchen, living room, and master bedroom are all on the same circuit The "remodeled" bedrooms have only one plug in and there are only 2 in the kitchen, There is a great deal of sediment in the water pipes, Also, the landlords turned off the water to the yard due to leaks, They refuse to repair that The landlord also insists on storing all of his construction company equipment, including a large tractor, on the premises, in spite of the neighbors' frequent complaints, The landlord locked me out of the storage buildings on the premises, There are problems with the old furnace, It had such a bad smell, that I though we were being "gassed," I think that the low position of the flu on the roof causes fumes to be blown back into the house, Also, the furnace blows out frequently, Last week, the house was 40 degrees because the furnace stopped and wouldn't relight. Also, the furnace is so inadequate that water was freezing in the master bedroom. When I tried to use an electrical heater, all the power went out. I have been very good about paying the rent on time, but these slum lords have been trying to evict me just to keep from making any repairs, They strong-armed this house away from Helen Weston, a very elderly woman who was ill at the time, They paid about half off air market value for the property and didn't even start making payment to her until long after they bought the property, They pay Helen Weston $600 a month, I pay $1200 a month, but they "don't have the money" to make any repairs, The landlords want to develop the back lot on this property, which is next to the Happy Landing property that is also being targeted for development. On my own, I replaced broken glass, built window boxes, cleaned filthy wood work and window blinds, pried open painted shut windows and generally worked very hard at trying to maintain this residence, The landlords want $1200 a month without having to supply a decent place to live for that sum, They come to get the rent early in the morning of the first of every month, but are "too busy" to make any repairs.
