The inspection of the property revealed that two ofthe previously cited violations in my letter of July 11, 1997 have not been corrected. Therefore, the existing violations constitute substandard and dangerous conditions as defined by the Uniform Housing Code(1994). Specific violations are as follows: 1. Mold growing on walls. U.H.C. Seciton 1001.12. 2. Pressure relief valve on water heater is missing drain pipe. UP.C. Section 608.5 Each of the above mentioned violations is considered to be a dangerous health nuisance under the Uniform Housing Code. Abatement of the violations is hereby ordered to be within 24 hours ofreceipt of this letter. Abatement may be by repair or vacation. All rights of administrative hearing have been waived in this matter by failure to appeal. If you have any questions in this matter, feel free to call me at 235-2850. Fax # 235-2949 July ll, 1997 Bergan & Company Attention: Don Bray 8000 East Prentice Avenue, Suite B7 Greenwood Village, Colorado 80 III Dear Mr. Bray: On July 7, 1997 the apartment at 3220 Fenton Street was inspected. The inspection of the property was by the request of the current tenant and was done in the presence of the tenant. The inspection was initiated by a complaint regarding improper housing conditions. The inspection showed that there exist violations to the Uniform Housing Code causing the building to be substandard and dangerous. Specific violations are as follows: 1. Electrical outlet and cable outlet over electric baseboard heater. u.H.c. Section 1001.5 2. Mold growing on walls. U.H.c. Section 100 l.l 2. 3. Hazardous or faulty thermostat control of electrical baseboard heat. U,H.c. Section 1001.5. 4. Pressure relief valve on water heater is missing drain pipe u.P.c. Section 608.5. Each of the above mentioned violations is considered to be a nuisance under the Uniform Housing Code, As a nuisance, each violation may be punishable by a $999.00 fine or imprisonment not to exceed one hundred eighty days. Please regard this letter as official notice to commence abatement of the above mentioned violations within seven (7) days from receipt of this notice. Completion of the abatement shall be within fourteen (14) days from the receipt of the notice. Abatement of the violations shall be by repair and all required permits shall be secured before beginning work. If abatement of the work is not commenced within the time specified above the building official will order abatement of the violations, Abatement may involve vacation of the property and may cause the work to be done and charge the costs thereof against the property or its owner. o I-1ECYCLtD PAF'ER Any person having any record title or legal interest in the building may appeal from the notice and order or any action of the building official to the housing advisory and appeals board, provided the appeal is made in writing as provided by the code, and filed with the building official within 30 days from the date of service ofthis notice and order. Failure to appeal will constitute a waiver of all right to an administrative hearing and determination of the matter.
