The City overtime has recognized all three dwelling units on the property in some capacity. If you purchase the property you would be able to continue to rent those units out long-term as -is. However, due to the C-1 zoning, you would not be able to add additional dwelling units or expand them further, and if you decommissioned any/all units, they could not be rebuilt. If you wanted to rezone the property to R-3 to allow redevelopment, staff could support it, but based on the property size, the R-3 zoning would only allow two dwelling units (a duplex), or one single unit home+ one ADU. For the back unit, which is the converted garage apartment the listing is calling the ADU, we show a Stop Work Orderfrom 2009 that says the remodel was done without permits. Although we have continued to recognize this dwelling unit, I wanted to make you aware that this means that no permits were obtained or inspections were performed on this space. The front building or "duplex" appears to be fully separate dwelling units. However, based on our conversation, I recommend reaching out to the Building Division (oermits(@ci.wheatridge.co.us or 303-235-2855) to understand what may need to be done to ensure the existing units are fully separate and what to do with the staircase. New duplex units need to be fire separated and my concern would be the temporary wall at the end of the staircase is not sufficient separation. There is a 2018 permitfor an egress window in the basementwhich was inspected and completed. You need to ensure that both units have independent entrances to the outside and thatyou don't have to pass through one unit to gain access to the other. The property is eligible for one "whole home" short-term rental (STR) license, but District 1 has a long waitlist, so an STIR is likely not an option here. A "partial home' STIR license would not be valid here since each dwelling unit is distinct from each other and that would require you to live in one of the units full time and rent out a bedroom only. I didn't mention this on the phone but STRs are actively enforced on in Wheat Ridge and licenses are required. Lastly, I would highly recommend obtaining individual unit addresses so that each unit can get its own mail and be identifiable by emergency responders. Please email todean(@ci.wheatridge.co.us to initiate that process, which is $25. You must be the owner of the property to apply for the address. Getting each unit its own address will also allow separate Xcel meters if you want to individually bill tenants for electric/gas. Let me know if you have any questions. As I told you on the phone, Doug Weiland of Performance Paving on 7/23/03 filled out an application for a permit. However, he did not complete the permit process, although he told me he had obtained a permit and would begin paving, I believe it was the next day. Your office put a stop work order on my property that next day. I came down to your office and it was explained to me that Performance Paving had not secured a permit. Further, it was explained to me by your office that had he gone through with the process, he would have understood that he must follow the prints from the drainage engineer at Baseline Engineering and maintain a 6' buffer between property lines. As I told you, they paved onto the setback up to 3 feet in various places. Additionally, I told you that it turns out that the pavers did not follow the elevations indicated on the prints either, causing huge puddles of dangerous ice. Therefore, I am going to either let Mr. Weiland attempt to foreclose on the lien, or I will sue him in small claims court for the problems he has caused me. I am requesting that you please document in a letter the sequence of events regarding the paving permit process followed by myself, Baseline Engineering and Performance Paving and any other comments you care to make.
