Dear Elaine Huffman :
On August 6, 1997, the property at 3175 & 3185 Jay St. was inspected. The inspection
was initiated by a phone complaint regarding potential health hazards. This inspection
revealed that there exist violations to the 1994 Uniform Building Code and the Wheat
Ridge Code of Laws.
Specific violations are as follows:
1. No current certificate of occupancy exists
2. Improper grading and landscaping resulting in water damage to lower level
3. Illegal installation of potable water backflow prevention
These items are considered a code violation under the Uniform Building Code and/or the
Wheat Ridge Code of Laws. As a violation, each item may be punishable by a fine of
$999.00 and/or imprisonment not to exceed one hundred eighty days. Please regard this
letter as official notice to commence abatement of these violations within seven (7) days
from receipt of this notice. Compliance of the abatement shall be within fourteen (14)
days from receipt of this notice.
Abatement of the violations will be by repair, and be within parameters set forth by a
drainage engineer to be secured by the contractor, and approved by the City of Wheat
Ridge. All required permits shall be secured before begiuning work.
If abatement of the work is not commenced within the time specified above, the Building
Official will order abatement ofthe violations. Abatement may involve vacation of the
property and may cause the work to be done and charge the cost against the property or
its owner.
Any person having any record title or legal interest in this building may appeal from the
notice and order or any action of the Building Official to the housing advisory and
appeals board, provided the appeal is made in writing as provided by the code, and filed
with the Building Official within 30 days from the date of service of this notice and
order. Failure to appeal will constitute a waiver of all rights to an abatement hearing and
determination of the matter. If there are any questions regarding this matter, feel free to
