TUP-93-3 Page 2 REQUEST The applicant requests approval of a Temporary Use Permit to allow a bedding plant stand in a Residential-Two zone district for property located at 3502 Wadsworth Boulevard. On May 7th, the application was approved as a 30-day Administrative Temporary Use Permit as per Section 26-6(3). Because the applicant would like to remain in business longer than 30 days, approval by the Board of Adjustment must be granted. DESCRIPTION The property is zoned Residential-Two and is 130 feet deep and 190 feet wide. The current City of Wheat Ridge Comprehensive Development Plan has the proposed bedding plant sales location. under the category of medium to high density residential within an Activity Center.. _The applicant has submitted a site plan of the property which depicts a structure which would be used to shade the bedding plants. The structure will be set a minimum of fifty (50) feet from Wadsworth Boulevard and West 35th Avenue. There will be two entrances onto the site; one on West 35th Avenue and the other on Wadsworth Boulevard at the northwest corner of the property. Parking is to be located. to the north and south of the shade structure. The proposed plan shows a 30 foot-area of existing natural grasses and trees along Wadsworth Boulevard and West 35th Avenue. The site plan shows one freestanding sign set back a minimum of ten (10) feet from Wadsworth Boulevard and out of the required sight distance triangle for the north exit. The proposed sign will be approximately 32 square feet and be constructed of wood. FINDINGS OF FACT Regarding the findings of fact, staff-has the following comments: 1. Will this request have a detrimental effect upon the general health, welfare, safety and convenience of persons residing or working in the neighborhood of the proposed use? Staff feels that the_use will not be detrimental to the neighborhood since the use will-only be seasonal and that all signage will be removed after the use has ended. 2. Will this request adversely affect the adequate light and air, or cause significant air, water or_noise pollution, or cause drainage problems for the general area? TUP-93-3 Page 3 This request will not adversely affect the adequate light and air, nor cause significant air,-water or noise pollution or cause drainage problems for the general area. 3. Will this request result in undue traffic congestion or traffic hazards, or unsafe parking, loading, service or internal traffic conflicts to the detriment of persons whether on or off the site? This request will not result in undue traffic congestion or traffic hazards, or unsafe parking, loading, service or internal traffic conflicts to the detriment of persons whether on or off the site. 4. Will this request be appropriately designed, including setbacks, heights, parking bulk, buffering, screening and landscaping, so as to be in harmony and compatible with character of the surrounding areas and neighborhood, especially with adjacent properties? Staff has concerns that_the applicant has not allowed for enough buffering between the proposed use and the residence to the east. However, a use of this type has been located there before and no`complaints have been recieved by the Department of Planning and Development. 5. Wi11--this request overburden the capacities of the existing streets, utilities, parks, schools, and other public facilities and services? This request will not overburden the capacities of the existing streets, utilities, parks, schools, and other public facilities and services. CONCLUSIONS AND RECOMMENDATION The applicant has submitted a fairly descriptive site plan that depicts the design of his property to be used for the sale of bedding plants. The current City of Wheat Ridge Comprehensive Development Plan calls for the property to be developed as a medium to high density residential use. The Comprehensive Plan is designed to promote long term development and staff feels that this proposed use is a temporary seasonal use, not designed or intended to be of a permanent nature. Staff feels that granting this Temporary Use Permit should not adversely affect the characteristics of the neighborhood. Staff also notes that approving this request is not grounds for rezoning the property to a commercial zone at a later date. BOARD OF ADJUSTMENT STAFF REPORT CASE NO. TUP-93-3 Page 4 Therefore, staff recommends APPROVAL for Case No. TUP-93-4, with the following conditions: 1. The use be limited to bedding plant sales during the spring -- and summer months. 2. All structures and signs shall be removed upon termination of the use.
