This is to inform you that Case No.
WA-92-3
is a_ request
for a 3' minor variance to-the required 30` front yard setback as
required by Section 26-15 (F)
for property located at 4585 Field Street
The applicant is requesting an administrative variance review
which allows no more than a ten percent (10~) variance to be
granted by the Zoning Administrator without need for a public
hearing. -Prior to the rendering of a decision, all adjacent
property owners are required to be notified of the request by
certified letter.

RE: Staff findings for Case No. WA-92-3
DATE: March 30, 1992
Case No. WA-92-3 is a request for a three (3') foot variance to
the required thirty (30') foot front yard setback for property
located at 4585 Field Street. The property is currently zoned
Residential-Two.
Based on the following conditions a recommendation of APPROVAL is
given for Case No. WA-92-3.
1. The variance or waiver does not exceed ten (10) percent of
the minimum or maximum standard.
The required setback is thirty (30') feet, the applicant has
requested a three (3') foot variance which is ten (10~)
percent of the maximum standard; and
2. That the zoning administrator finds that the "Findings of
Fact," as set forth in subsection (2)(c) herof, are
substantially complied with and support the request.
Based on the "Findings of Fact", Staff has reached the
following conclusions:
a. The applicant has not created any_hardship; and
b. The granting of this variance would not be detrimental
or injurious to property or improvements within the
neighborhood and will not impair the adequate supply of
light or air to adjacent properties nor increase
traffic congestion or endanger public safety; and
c. The granting of this variance will not impair the
adequate supply of light and air to adjacent property
or substantially increase the congestion in the public
streets or increase the danger of fire o_r endanger the
public safety or substantially diminish or impair
property values within the neighborhood.
3. The zoning administrator has notified adjacent property
owners by letter notice and posting of the site at least ten
(10) days prior to rendering his decision, and that no
protests have been received during such ten-day period.
The property was posted on March 12, 1992 and certified
letters were mailed on March 11, 1992. No protests were
received during the ten (10) day waiting period; and
4. That no additional dwelling units would result from approval
of such variance.. -
The request of this variance is to add a sun-room entry to
the front of the existing residence. The variance will not
add an additional unit.-

DATE: March 31, 1992
After reviewing the file, all evidence presented by the
applicant, and the staff findings per memo from Greg Moberg,
dated March 30, 1992, I conclude that ail requirements of Wheat
Ridge Code of Laws, Section 26-06(D)(2)(a) have been met. I
further conclude that the facts in this case support approval,
therefore, the requested minor variance of 3 feet to the required
30 feet front yard setback for structures in the Residential-Two
zone district is hereby APPROVED.
