I have reviewed the plans for the above listed site. I have the following recommendations:
FENCING:
1. The proposed 6' brick fence around the Kindergarten play area should be avoided as it
provides cover and concealment, raising the risk and fear of crime. Fencing should be
constructed of a material or in a manner that allow s for observation through. Material or a
design such as wrought iron provides visibility and discourageslprevents climbing over.
From these plans, I have no further recommendations at this time. Revisions in the plans, may alter
my recommendations.
While my recommendations do not guarantee acrime-free environment, it has been experienced that
application of the concept of Crime Prevention Through Environmental Design (OPTED) will reduce
the opportunity for crime to occur and will enhance the quality of life.

d. REQUEST
Pursuant Wheat Ridge Code of Laws, Section 26-6(A) Conditional Uses are "Permitted Uses" which are
subject to review to ensure the use is properly designed so as to mitigate potential negative impacts to
the neighborhood. In accordance with these provisions, the applicant requests approval of a conditional
use permit to allow the expansion of a church and private school in Residential-Two and Residential-
Three zone districts. The applicant in this case is the Saints Peter and Paul Catholic School and Church
for theArchdiocese of Denver at 3900 Pierce Street.
II. SITE PLAN
Current development on the property includes a church, chapel and rectory on the southern portion of the
property with the existing parochial school building for grades kindergarten through eighth in the center
of the property. The discernment house, formally a convent, is located on the north end of the site.
The applicant has requested the conditional use review to allow expansion of the school in two phases to
meet their increasing enrollment. This application includes a request for a fence height variance and a
rear setback variance which will require separate actions. Included under Exhibit `A' is a site plan, with
a narrative explaining the request for expansions Exhibit `B'.
The first phase will comprise two additional classrooms on the main floor with a library media azea on
the second floor. Construction in this phase will consist of roughly 3400 square feet of new building
coverage with all construction occurring between the existing school building and the discernment
house. The required reaz setback is 20° where only 5' is provided. Please see Section V of this report.
Phase II construction includes roughly 6500 square feet of new floor area for both the first and second
floors with 4789 square feet of remodeled area on the west side of the building. This phase will include
a new kindergarten play area with a 6' high enclosure. The fence will require a variance discussed
further under Section IV.
No other changes are proposed for the properly. Staff would note that several existing, mature trees on
the west side of the building will be removed with the second phase. The City Arborist has been
working with the architect concerning removal, relocation and replacement of existing trees.
Pierce Street is classified as a collector street and meets the half-width standard of 30'. Otis is local
street and is 25' wide from centerline. No right-of--way dedications will be required for either street,
however, based on concerns from the neighborhood meeting, the east side of Pierce will be designated
by the City for passenger loading and unloading only. This would prohibit vehicles from being parked
in front of the school for long periods of. time. There is existing curb, gutter and sidewalk along both the
Otis and Pierce Street frontages.

The following concerns were expressed:
-The location of the new play area along Pierce Street and the type of fencing being proposed
-The fact that adjacent property owners (especially to the north) have inadequate sight distance for the
driveway because of cars parked along Pierce. Could there be a street constructed pull-off or could
parking be disallowed along the east side of Pierce?
IV, VARIANCE CRITERIA -FENCE
Pursuant to Section 26-30(I) of the Wheat Ridge code of Laws, fences in tlae front yazds of buildings
(whether a single family residence or a church) are limited to a height of 48". However, the City
Council recently adopted legislation allowing fences higher than 48" in the front yard if they are
decorative and at least 80% open (i.e., wrought iron). The proposed fence enclosing the new
kindergarten playground, will be 6' high and built of brick, although design details have not been
finalized. Since the proposed fence will be less than 80% open, a fence height variance is required.
The existing building wall adjacent to the new playground is setback from the Pierce Street right-o£ way
line 30'. The new fence will be roughly 13' from the western property line.
Staff has the following comments regarding the criteria used to evaluate a variance.

1. Can the property in question yield a reasonable return in use, service or income if
permitted to be used only under the conditions allowed by regulation for the district in
which it is located?
'The property could still be used as a church and pazochial school if the vaziance is denied and a four foot
high fence built. Many existing school playgrounds are surrounded by four foot high fences.
2. Ys the plight of the owner due to unique circumstances?
Circumstances aze not unique except perhaps that Pierce Street is designated as a collector street and has
a fair amount of traffic volume. The fence could be designed using wrought iron above the four foot
height and wouldn't need a variance.
3. If the variation was granted, would it alter the essential character of the locality?
There aze no other 6' high front yard fences in the immediate neighborhood which may have an affect on
the chazacter of the area.
4, Would the particular physical surrounding shape or topographical condition of the specific
property involved result in a particular hardship (upon the owner) as distinguished from a
mere inconvenience, if the strict letter of the regulations were carried out?
There are no unusual characteristics of the property such as topography or irregular lot shape which
constitute a hazdship.
5. Would the conditions upon which the petition for a variation is based be applicable,
generally, to the other property within the same zoning classification?
If the variance is approved without a finding of unique circumstances or hardship, a precedent could be
set for similar requests.
6. Is the purpose of the variation based exclusively upon a desire to make money out of the
property?
This request is not economically motivated.
7. I3as the alleged difficulty or hardship been created by any person presently having an
interest in the property?

8. Would the granting of the variations be detrimental to the public welfare or injurious to
other property or improvements in the neighborhood in which the property is located?
The granting of the variance should not negatively affect adjacent property or improvements in the area.
The City of Wheat Ridge Police Department commented that a 6' solid fence should be avoided as it
allows opportunity for cover and concealment'as activity would not visible through the fence.
9. Would the proposed variation impair the adequate supply of light and air to adjacent
property or substantially increase the congestion in the public streets or increase the
danger of fire or endanger the public safety or substantially diminish or impair property
values within the neighborhood?
The fence height variance would not impair the amount of light or air to adjacent properties because it is
in the center portion of the property. There will be no impact on the public streets. There could be a
negative effect on public safety if the fence is solid relating to the Police Department's concerns.
10. If it is found in criteria 8 and 9 above, that granting of the variation would not be
detrimental or injurious to other property or improvements in the neighborhood, and it is
also found that public health and safety, public facilities and surrounding property values
would not be diminished or impaired, then, would the granting of the variance result in a
benefit or contribution to the neighborhood or community, as distinguished from an
individual benefit on the part of the applicant, or would granting of the variance result in a
reasonable accommodation of a person with disabilities.
The playground azea will be accessible to persons with disabilities regardless of the fence height.
VARIANCE CRITERIA -SETBACK
Section 26-16 of the Wheat Ridge code of Laws requires that the rear setback for churches, schools and
other quasi-public uses be 20'. The rear setback shown on the proposed site plan is only 5', requiring a
15' setback variance.
Staff has the following comments regazding the criteria used to evaluate a variance.
1. Can the property in question yield a reasonable return in use, service or income if
permitted to be used only under the conditions allowed by regulation for the district in
which it is located?
The azchitect has indicated that if the variance is not granted, that the interior space of the classrooms
and library media area will become nonfunctional. Staff would note that the existing eastern (rear)
setback of the discernment house and the northern (side) setback of the existing school building aze both
azound 20'. If this variance is not granted, the property could still be used as a private school and

church, however, the addition would have to be redesigned.
2. Is the plight of the owner due to unique circumstances?
Circumstances aze not unique. These setback requirements are applied consistently to public and quasi-
public buildings in the residential zone districts of the city of Wheat Ridge.
3. If the variation was granted, would it alter the essential character of the locality?
If the variance is granted, the character of the area in general would not be affected since the
construction would occur on the interior of the property. However, there could be a detrimental affect
on the residence located directly to the east.
4. Would the particular physical surrounding shape or topographical condition of the specific
property involved result in a particular hardship (upon the owner) as distinguished from a
mere inconvenience, if the strict letter of the regulations were carried out?
There aze no physical attributes to the property in regard to shape or topography which constitute a
hardship.
5. Would the conditions upon which the petition for a variation is based be applicable,
generally, to the other property within the same zoning classification?
If the variance is approved without a finding of unique circumstances or hazdship, a precedent could be
established for similaz requests.
6. Is the purpose of the variation based exclusively upon a desire to make money out of the
property?
The variance request is not based exclusively with the desire to make money, however, the expansion is
being requested to accommodate increased enrollment.
7. Has the alleged difficulty or hardship been created by any person presently having an
interest in the property?
The hardship has been self-imposed.
8. Would the granting of the variations be detrimental to the public welfare or injurious to
other property or improvements in the neighborhood in which the property is located?
If the variance were granted, there should not be a negative impact on the neighborhood in general.

There could be a negative affect on the aesthetics and livability of the property to the east. If the
additional were single story instead of two-story, the affect would be less.
9. Would the proposed variation impair the adequate supply of light and air to adjacent
property or substantially increase the congestion in the public streets or increase the
danger of fire or endanger the public safety or substantially diminish or impair property
values within the neighborhood?
If the variance is granted, the proposed addition would decrease the amount of light and air to the
adjacent property. There would be a minor impact on the pubic streets due to increased enrollment.
The building will be built of anon-combustible construction, therefore, the Wheat Ridge Fire District is
not overly concerned about the reduced setback alleviating the issue of fire danger and the potential
hazard to public safety. There could be a negative impact on the adjacent property value.
10. If it is found in criteria 8 and 9 above, that granting of the variation would not be
detrimental or injurious to other property or improvements int he neighborhood, and it is
also found that public health and safety, public facilities and surrounding property values
would not be diminished or impaired, then, would the granting of the variance result in a
benefit or contribution to the neighborhood or community, as distinguished from an
individual benefit on the part of the applicant, or would granting of the variance result in a
reasonable accommodation of a person with disabilities.
At this point with the information available, it is impossible for Staff to ascertain whether granting or
denial of the variance will preclude the accessibility of physically challenged individuals.
Ii'. CONDITIONAL 1JSE CRITERIA
Staff has the following comments regarding the criteria used to evaluate a Conditional Use Permit.
1. Will not have a detrimental effect upon the general health, welfare, safety and convenience
of persons residing or working nn the neighborhood of the proposed use.
The proposed conditional use will allow the expansion of an existing use. The impact from Phase I
should be ininiuial as the new building addition will occur on the interior of the property, although only
a five foot rear setback is being shown. There is an existing 6' solid fence which provides buffering for
the neighbor to the east. Denial of the setback variance will reduce the impact on this property owner.
Phase II construction will have a visual impact on the area because of the reduction of the amount of
landscaping in the yard adjacent to Pierce Street. By limiting parking on the east side of Pierce should
have a positive affect by increasing sight distance for adjacent residences to the north.

2. Will not adversely affect the adequate light and air, nor cause significant air, water or noise
pollution.
The phase I addition may have an impact on the amount of light and air to the property located directly
to the east, especially if the variance is allowed. If the variance is not approved and the setback is
increased to 20', there would be enough room for vertical landscaping installed along this rear setback.
Air and water pollution should not be a factor. There will be a noise impact for those residences along
Pierce because of the new playground.
3. Is consistent with the Comprehensive Plan.
The Comprehensive Plan designates this properly as Low Density Residential. A church and associated
ancillary uses are typically thought as being consistent with and complementary to a low density
residential neighborhood. Staff concludes that because the R-2 and R-3 zoning remains, there is
consistency with the Comprehensive Plan.
4. Will not result in undue traffic congestion or traffic hazards, or unsafe parking, loading,
service or internal traffic conflicts to the detriment of persons whether on or off the site.
The property is abutted by Otis Street on the east and Pierce Street on the west. There are no formal
vehicular drop-off areas for the school. Striping and signing the east side of Pierce Street to allow only
short term parking for passenger drop-off and pick-up will help traffic flow on Pierce.
$, Will be appropriately designed, including setbacks, heights, parking, bulk, buffering,
screening and landscaping, so as to be in harmony and compatible with the character of the
surrounding areas and neighborhood, especially with adjacent properties.
Except for the playground fence and 5° rear setback, all minimum requirements of the Zoning Ordinance
have been met. Because of the mass of the Phase I addition, Staff would recommend that the rear
setback variance be denied and the rear yard be increased to at least 20° with landscaped buffering
installed along the existing fence. Where possible, mature trees on the property should be saved.
6. Will not overburden the capacities of the existing streets, utilities, parks, schools and other
public facilities and services.l.
All responding agencies can provide service to the property. Striping of the eastern side of Pierce to
prohibit long-term parking should help mitigate traffic impacts for adjacent residences. There should be
no negative impact on parks as the church is providing their own recreation amenity with the
playground.

VII. AGENCY REFERRALS
All responding agencies can serve the property.
Wheat Ridge Fire Protection Distract has no immediate concerns. They are worlting with the applicant
to resolve fire rating issues.
Wheat Ridge Building Department is working with the applicant to resolve fire rating and building code
issues. _ _
Wheat Ridge Police Department has commented that a 6' solid fence around the play area should be
avoided as it "provides cover and concealment, raising the risk and fear of crime." The fence should be
at least partially open for visibility purposes. A wrought iron fence would discourage climbing over.
The Public Works Department need a revised drainage report. The existing improvements along Otis
and Pierce are acceptable. They would support restricting long-term pazking along the east side of
Pierce Street.
VIII. STAFF CONCLUSIONS AND RECOMMENDATIONS
Staff has concluded that a conditional use approval is required to allow expansion of a church and
private school. Staff concludes that the criteria use to evaluate a CUP support approval of the request.
However, Staff concludes that the evaluation criteria for vaziance support neither the fence height
variance nor the building setback vaziance.
For these reasons, a recommendation of approval is given for the conditional use permit with the
condition that the east side of Pierce Street be striped and signed to allow passenger pick-up and drop-
offonly and the architect continue working with the City Arborist regarding saving existing trees. A
recommendation of Denial is given for the fence height variance and 15' rear setback variance.

The Catholic Parish of St's. Peter and Paul Church is proposing a new school addition to
its existing, school building in order to meet the needs of their increasing enrollment. The
additions are to be built in two phases. Phase I includes two homeroom classrooms on
the lower level and a library media center on the upper level. The Phase I addition is to
be built on the north side of the existing building and will consist of 3,400 square feet.
The Phase II addition consists of new administration offices, enlarged kindergarten
classrooms, and remodeled music room all on the main level. 'The lower level will
include a new art room, storage rooms, special education room, and conference room.
Both levels will consist of 6,496 sq. ft. of new construction and 4,789 sq. ft. of interior
remodeled areas. Phase II will be added on the west side of the existing building facing
Pierce St.
The new additions will be compatible in appearance with the existing building. The use
of brick to match the existing brick will be incorporated into the new design. Phase I is
slated to begin construction by the middle of May, 1997. Phase II is not planned until
1999, after a fundraising drive has been successfully completed.
The parish community looks forward to working with the City of Wheat Ridge and the
neighborhood in achieving a building we can all be proud of.

I. REQUEST
The applicant requests approval of a 15' rear setback variance to allow expansion of a private school at,
3900 Pierce Street. This case is being heazd on appeal from a decision made by Planning Commission
on May 1, 1997. Please refer to Exhibit `A' which is the applicant's request for appeal.
The original request which was presented to Planning Commission was three-fold:
1. Approval of a conditional use permit with a site plan for atwo-phase expansion of
the parochial school,
2. Approval of a fence height variance, and,
3. Approval of a 15' rear setback vaziance.
At the May 1, 1997, Planning Commission public heazing, the following occurred:
A. The fence height variance request was withdrawn as it was concluded that Staff
could work with the applicant to achieve a design which is within the new fence
height standards.
B. The conditional use permit was approved for the following reasons:
1. It will allow for the expansion of an existing use,
2. The evaluation criteria support approval of the request.,
3. Staff recommends approval of the request.
With the following conditions:
1. Monday through Friday no parking be allowed on the east side of
Pierce Street from the north side of the church past the discernment house,
2. This area will be reserved for pull-up lane only,
3. Saturday and Sunday no parking be allowed in front of the discernment
house a distance from the north property line of the satisfaction of the
Public Works Department,
4. The azchitect continue working with the City azborist regazding saving the
existing trees.
C. The request for approval a~5' reaz setback vaziance was denied for the following
reasons:
1. There is no hardship or unique circumstances.
2. There are potential negative impacts on the residence directly to the east,
3. The evaluation criteria does not support approval,

4. Staff recommends denial.
A request for approval of a 7' rear setback vaziance resulting in a 13' reaz yazd setback
was approved for the following reasons:
1. It would make it possible to build two new classrooms,
2. The adjacent neighbor has indicated that he does not object to the vaziance.
With the following condition:
1. The applicant supply a Power of Attorney from the legal owner of the property
to the east stating that he does not object to this request.
At the time of this writing, this documentation has not been submitted for review
Pursuant to Exhibit `A', the applicant is appealing the variance approved by Planning
Commission to ask for the original request fora 15' variance. The applicant contends that if the Phase I
addition is moved forward (to the west) in accordance with the Planning
Commission recommendation ,there is not enough separation between the building addition and an
existing chapel located the southwest corner of the discernment house. Thus, the request for appeal.
The rear setback variance is the only aspect of the original request which is being appealed to City
Council.
Staff would note that the applicant is attempting to purchase the property to the east which is most
directly impacted (4045 Otis). They have indicated that the property owner does not object to the full
15' variance but have not submitted anything in writing to substantiate this.
II. VARIANCE CRITERIA
The portion of the building needing the variance is the area shown as "Phase P' just south of the
discernment house.
Section 26-16 of the Wheat Ridge Code of Laws requires that the rear setback for churches, schools and
other quasi-public uses be 20'. The reaz setback shown on the proposed site plan is only 5', requiring a
15' setback variance.
Staff has the following comments regarding the criteria used to evaluate a variance.
1. Can the property in question yield a reasonable return in use, service or income if
permitted to be used only under the conditions allowed by regulation for the district in
which it is located?

The azchitect has indicated that if the vaziance is not granted, that the interior space of the classrooms
and library media area will become nonfunctional. Staff would note that the existing eastern (reaz)
setback of the discernment house and the northern (side) setback of the existing school building aze both
azound 20'. If this variance is not granted, the property could still be used as a private school and
church, however, the addition would have to be redesigned. Staff would support a 7' variance which
would result in a 13' setback as approved by Planning Commission..
2. Is the plight of the owner due to unique circumstances?
Circumstances are not unique. These setback requirements are applied consistently to public and quasi-
public buildings in the residential zone districts of the city of Wheat Ridge.
3. If the variation was granted, would it alter the essential character of the locality?
If the variance is granted,, the character of the area in general would not be affected since the
construction would occur on the interior of the property. However, there could be a detrimental affect
on the residence located duectly to the east. If the church purchases this property, the small setback
would be of lesser concern unless the house is leased for residential use. The 7' vaziance approved by
Planning Commission would have a reduced impact.
4. Would the particular physical surrounding shape or topographical condition of the specific
property involved result in a particular hardship (upon the owner) as distinguished from a
mere inconvenience, if the strict letter of the regulations were carried out?
There are no physical attributes to the property in regazd to shape or topography which constitute a
hazdship.
5. Would the conditions upon which the petition for a variation is based be applicable,
generally, to the other property within the same zoning classification?
If the vaziance is approved without a finding of unique circumstances or hazdship, a precedent could be
established for snnilaz requests.
6. Is the purpose of the variation based exclusively upon a desire to make money out of the
property?
The vaziance request is not based exclusively with the desire to make money, however, the expansion is
being requested to accommodate increased enrollment.
Has the alleged difficulty or hardship been created by any person presently having an
interest in the property?

The hardship has been self-imposed.
8. Would the granting of the variations be detrimental to the public welfare or injurious to
other property or improvements in the neighborhood in which the property is located?
If the vaziance were granted, there should not be a negative impact on the neighborhood in general.
There could be a negative affect on the aesthetics and livability of the property to the east. If the
addition were single story instead of two-story, the affect would be less.
9. Would the proposed variation impair the adequate supply of light and air to adjacent
property or substantially increase the congestion in the public streets or increase the
danger of fire or endanger the public safety or substantially diminish or impair property
values within the neighborhood?
If the vaziance is granted, the proposed addition would decrease the amount of light and air to the
adjacent property. The building will be built of anon-combustible construction, therefore, the Wheat
Ridge Fire District is not overly concerned about the reduced setback alleviating the issue of fire danger
and the potential hazazd to public safety. There could be a negative impact on the adjacent property
value, although there would be a lesser impact if only a 7' variance was approved.
10. If it is found in criteria 8 and 9 above, that granting of the variation would not be
detrimental or injurious to other property or improvements int he neighborhood, and it is
also found that public health and safety, public facilities and surrounding property values
would not be diminished or impaired, then, would the granting of the variance result in a
benefit or contribution to the neighborhood or community, as distinguished from an
individual benefit on the part of the applicant, or would granting of the variance result in
a reasonable accommodation of a person with disabilities.
At this point with the information available, it is impossible for Staff to ascertain whether granting or
denial of the vaziance will preclude the accessibility of physically challenged individuals.
III. AGENCY REFERRALS
All responding agencies can serve the property.
Wheat Ridge Fire Protection District has no immediate concerns. They aze working with the applicant
to resolve fse rating issues. They can serve the property with a 5' rear setback.
Wheat Ridge Building Department is working with the applicant to resolve fire rating and building code
issues.

IV. STAFF CONCLUSIONS AND RECOMMENDATIONS
Staff has concluded that the criteria used to evaluate a variance do not support approval of a 15' setback
vaziance, but that a reduced request as approved by Planning Commission would have less of an impact.
Based on this, a recommendation of denial is given for the 15' vaziance. A recommendation of approval
is given for the 7' variance.
V. RECOMMENDED MOTIONS
Option A: "I move that the request for approval of a 15' reaz setback variance for property located at
3900 Pierce Street, be denied for the following reasons:
1. There is no hazdship or unique circumstances.,

As a representative and on behalf of the Catholic parish of St's. Peter and Paul, I would
like to schedule a hearing to appeal a decision by the Planning Commission to the City
Council.
The Planning Commission voted to allow an encroachment of 7 ft. into the 20 ft. rear
yard setback. However, this decision necessitates that the building addition be shifted an
additional 8 ft. further to the west. This move creates new problems due to its closer
proximity to another existing building.
The Catholic Archdiocese of Denver, owner of the property, requests a variance from the
20 ft. setback to a 5 ft. rearyard setback. I wish to present and address the concerns at the
next meeting of the City Council.

Ms. Reckert presented this case and pointed out that this application includes a request for two
variances. Slides and aerial photos were provided and Ms. Reckert pointed out the various
buildings. She submitted to the record the comprehensive plan, zoning ordinance, case file and
packet materials, and exhibits. Discussion was held regazding a "drop offl' area, fence height and
materials, landscaping, set back concerns, church/school growth, kindergarten play area, right-of-
way, the neighborhood meeting, street parking, traffic on Pierce Street, and distances from
adjoining property lines.
Chairperson WILLIAMS swore in Dan Muldoon, architect for the project, 1890 Kipling St.,
Lakewood. Mr. Muldoon stated that with him were representatives from the church Father John
Hilton, Pastor, Mr. Patrick Williams, Asst. Principal, Ms. Kathy Burns, Principal, and Jerry
Clark, Business Manager. He stated that the church is anticipating significant growth and are
planning fur two additional class grades in the next school year. He addressed the parking issues
on Pierce Street and stated that the church has agreed to stripping the curb and install "no
parking" signs to disallow parking during the school week Monday through Friday the full extent
of the church property. The church is requesting that parking be allowed on Saturday and
Sunday. Mr. Muldoon shared drawing concepts and slides with the Commission and audience.
He stated that he felt that there would be a hardship if the setback variance is not granted in that
two additional classes have already been established for the next school year The closest
neighbor does not have any difficulties regarding the addition being as close to his garage as is
being proposed. After discussion regarding the fence variance, the request was withdrawn.
Chairperson WILLIAMS swore in Helen Lay, 4080 Pierce. Ms. Lay's concern related to
parking on Pierce. She stated that she lives in the second house from the discernment center
where the addition will be built. She said that when people park on Pierce, she as well as other
members of the neighborhood cannot see to safely pull out of their driveways. She would prefer
no pazking be allowed at any time next to the discernment center. Chairperson WILLIAMS
asked that the Traffic Engineer be contacted to review the situation. However, the church stated
that they would agree to no pazking at any time in this area and this met with Ms. Lay's approval
as well as the Commission's. .

Request was withdrawn.
Setback Variance
Commissioner SNOW motioned, Commissioner RASPLICKA seconded, "that the request for
approval of a 15 foot rear setback variance for property located at 3900 Pierce Street be denied
for the following reasons:
1. There is no hardship or unique circumstances,
2. There are potential negative impacts on the residence directly to the east,
3. The evaluation criteria does not support approval,
4. Staff recommends denial."
Motion carried 5-0.
Commissioner SNOW motioned, Commissioner BRINKMAN seconded, "that the City of Wheat
Ridge allow a 7 foot rear setback vaziance for property located at 3900 Pierce Street be approved
for the following reasons:
1. , It would make it possible to build two new classrooms,

No. WZ-97-3, a request for approval of an amendment to a Planned Industrial Development final
development plan for property located at 4990 Iris Street be approved for the following reasons:
1. A plan amendment is required to allow building expansion,
2. All requirements for a final development plan have been met,
3. Staff recommends approval.
With the following conditions:
1. The applicant be allowed to place the trees requested by the Staff along Iris and a
watering system be added to that area,
2. Sidewalks be installed along street frontages where there aze none now or a development
agreement if approved by Public Works with across-walk,
3. Pazking areas that are indicated as reserved on the plan shall be developed upon an order
by the Wheat Ridge Planning and Development Director where such parking is needed to
meet pazking demand,

(baseball field and volleyball courts) in a Residential-One zone district.
Property is located at 11225 West 32nd Avenue, City of Wheat Ridge,
County of Jefferson, State of Colorado.
Ms. Reckert advised the Commission that additional correspondence had been received regarding
this case. There was a letter of support from members of the church who live in Wheat Ridge
and two other letters from citizens who oppose the proposal. Ms. Reckert passed out copies of

Per your request, I have inspected existing plant material within the construction zone at Sts.
Peter and Paul School on Pierce St. During my visit, I met with the lead custodian who outlines
the proposed development.
Within the courtyard, on the north side of the school, there are two trees impacted by
construction. The first, a crabapple is in poor condition and not worth remedial actions to save.
The second, a small green ash is going to be moved to another location on the property.
Plant materials within the construction zone on the west side (front) of the school are larger and
cannot be moved The first, a Colorado Blue Spruce on the south side of the entry sidewalk is a
double stem, and a poor candidate for moving. This is a memorial tree for a former student and
the school has checked into moving the tree to another location. I told the school they would be
better off taking the money slated for moving and put towards a replacement tree.
A large Silver Maple on the north side of the entry walk is actually outside the construction
zone, but the large root system in the zone. This particular species of tree does not tolerate root
disruption and needs to be removed. The school also plans to remove a large ovemrature
Colorado Blue Spruce on the southwest corner of the old convent.
The foundation plantings in front of the school as well as the old hedge along Pierce St. are also
going to be removed. As of date, I have not seen any plans for future landscaping. If you have

Item 1. Request for rear setback variance at 3900 Pierce Street.
(Case No. CUP-97-2) (Sts. Peter & Paul Catholic Church).
Mr. Siler introduced this item; title was read by the Clerk.
Dan Muldoon, 1890 Kipling Street, Lakewood, architect for the project, representing Sts.
Peter and Paul Catholic Church, stated that they hope to construct a 3400 square foot
classroom addition to their existing school building; it will consist of two classrooms on the
lower level and a library on the upper level. Planning Commission has recommended
approval with a stipulation to move the building addition 8' from the rear property line; it's
currently planned at 5' from the rear property line; they are asking Council to be allowed to
construct the school as it was originally planned, with the 5' rear setback.
Meredith Reckert, representing the Wheat Ridge Planning Department, gave the staff report.
Motion by Mr. Siler that the request for approval of a i 5' variance that results in a 5' rear
setback for property located at 3900 Pierce Street, be approved for the following reasons: 1.
There are unique hardships due to drainage structure and location. There will be no major
impact on property located to the east. The existing school already has a 5' setback on the
original school to the northeast of the building. Before any construction be approved and
started that a Power of Attorney must be filed with the City with sufficient power to bind the
property owners with the understanding that there is to be a 5' setback; seconded by Mr.
5olano.
Mr. DiTullio asked to abstain because his children attend school at Sts. Peter and Paul; failed
1-7 with Mr. DiTullio voting yes.
Motion carried 7-1 with Mrs., Shaver voting no.
Item 2. Resolution 1607 -initiating rezoning procedures for a large area
located in the 38tH Avenue and Parfet Street neighborhood.
Resolution i 607 was introduced by Mrs. Shaver; title read by the Clerk.
