I. REQUEST
The applicant requests approval of a Special Use Permit to allow psychic advisement on Restricted-
Commercial (Re) zoned property located at 7323 W. 38th Avenue.
The Zoning and Development code prescribes that businesses which offer psychic advisement services
must receive approval of Special Use Permit to be located in an RC zone district.
Pursuant to Section 26-615, the Community Development Director has the ability to decide upon
applications for administrative Special Use approval, without requirement for a public hearing,
provided the following conditions are met:
I. A completed application package has been submitted and fee paid;
2. The Community Development Department has notified adjacent property owners by letter
notice and the site has been posted for at least ten (10) days;
3. No written objections have been received in such ten-day period;
4. The Community Development Director concludes that the criteria for approval, as set forth
below, are substantially complied with and support the request.
The Community Development Director can impose conditions or stipulations upon the approval,
which may include physical design, operational, and maintenance considerations to ensure compliance
with the criteria for review.
The Commuoity Development Director shall also decide the following:
1. Whether the SUP runs with the land in perpetuity; or,
2. Whether the SUP is personal to the applicant and mayor may not be inherited; and lor,
3. Whether the SUP is granted only for a defined period, after which time the special use
shall expire unless renewed subject to all of the requirements of this section
II. PROPERTY DESCRIPTION
The property is 1.24 acres in size. Located on it are two structures, the smaller of which is a
residential structure built in 1927. The other structure was originally built as a house in 1925 but was
converted to a commercial building. This structure has footprint of 1630 square feet and is where the
Ix Chel Healing Arts Center is located. The rest of the property is comprised of parking and
landscaping. Access is by way of a single curb cut to W. 38th Avenue. No changes to the site are
proposed. The other house structure is not a part ofthe Special Use request.
III. SPECIAL USE PERMIT CRITERIA
Before an administrative Special Use is approved, the applicant shall show and the Commuoity
Development Director shall fmd that the proposed Special Use:
1. Will not have a detrimental effect upon the general health, welfare, safety and
convenience of persons residing or working in the neighborhood of the proposed use.

The larger house on the property in question been utilized commercially for quite sometime. No
changes are proposed; therefore, there will be no detrimental effect on the health, welfare, safety
and convenience of persons residing or working in the area.
2. Will not create or contribute to blight in the neighborhood by virtue of physical or
operational characteristics of the proposed plan.
There will be no blight in the neighborhood as a result of the Special Use Permit.
3. Will not adversely affect the adequate light and air, nor cause significant air, water or
noise pollution.
The property is bouoded on the north and west by commercially zoned and used property. The
property to the east is the Wheat Ridge Middle School parking area. The site conditions are not
changing, therefore, there should be no impact on light, air, or water to adjacent properties.
4. Will not result in undue traffic congestion or traffic hazards, or unsafe parking,
loading, service of internal traffic conflicts to the detriment of persons whether on or off
the site.
The traffic generated by the psychic advisement component of the business should not
substantially increase the amouot of traffic to the property. All parking requirements have been
met based on the proposed use of the interior of the building.
5. Will be appropriately designed, including setbacks, heights, parking, bulk, buffering,
screening and landscaping, so as to be in harmony and compatible with the character of
the surrounding areas and neighborhood, especially with adjacent properties.
Adjacent properties are commercial in nature and will experience minimal impact from the
proposed Special Use. As there are no changes proposed to the property, there should be no
associated negative impacts.
6. Will not overburden the capacities of the existing streets, utilities, parks, schools and
other public facilities and services.
All responding utility agencies are able to serve the property. There will be no impact to streets,
utilities, parks or schools as a result of the psychic advisement service offered by the business.
The applicant has been working with the property owner and the City building department to
resolve handicapped accessibility issues.
7. History of compliance by the applicant with Code requirements and prior conditions, if
any, regarding the subject property.
A search of the City's code enforcement records has shown that there have been no zoning
violations in the past.
8. Ability of the applicant or any permitted-in-interest to continuously meet the conditions
of the proposed permit.

If conditions of an approved Special Use Permit are violated, the permit can be revoked. If the
permit is revoked, then the psychic advisement component ofthe business must cease. It is in the
applicant's best interest to follow the terms and conditions of any approval received from the city.
9. Other factors relevant to the specific application.
There are no other relevant factors.
IV. NEIGHBORHOOD MEETING
A meeting for neighborhood input was held on December 5, 2006. There was one area property
owner in attendance who submitted comments in writing. Her comments pertained to the vesting
of the permit; that it be issued to the applicants and not run with the property.
V. AGENCY REFERRAL
All affected service agencies were contacted regarding the ability to serve the property. Specific
referral responses follow.
Wheat Ridge Fire Protection District: Can serve.
Wheat Ridge Water District: Can serve.
Xcel Energy: Can serve.
Wheat Ridge Building Division: Is working with the property owner and the applicant regarding
installation of accessibility improvements.
Public Works Department: No comments.
VI. STAFF RECOMMENDATION/FINDINGS OF FACT
Staff recommends approval of Case No. SUP-07-02, a request for approval of a Special Use Permit
for property located at 7323 W. 38th Avenue to allow psychic advisement in an RC zone district,
with the following findings offact:
1. This request for an administrative Special Use meets all applicable conditions as
required by Section 26-114 of the City of Wheat Ridge Code of Laws.
2. Staffhas not received written comments in opposition to this request from the adjacent
property owners.
3. There will be no changes to the property itself therefore; there will be no detrimental
effect on the health, safety and welfare ofthe area.
4. There should be no impact on light, air, or water to adjacent properties and minimal
impact on traffic in the area.
5. The proposed use of the building meets the City's parking requirements based on
interior use of the structure.
6. All agencies can serve the property.

7. There has been a history of compliance of the property with the provisions of the
Zoning and Development Code.
Therefore, Case No. SUP-07-02 is hereby APPROVED with the following conditions:
1. The Special Use Permit shall be a grant of use to the applicants, Carol Tedesco and Lisa
Y slas, and may not be inherited.
2. The Special Use Permit be appurtenant to the front structure only.

At the WRURA meeting on February 6, 2007, the board made the following finding
regarding the above-referenced case:
The proposed use is not in conformance with the Town Center Urban Renewal Plan in
several areas, notably the future land use, improved parking, and improved landscaping.
The proposed use essentially perpetuates the use of the existing building for office space
in substantially the same manner as it has in the past. The continued use of the existing
building without substantial modifications at this time does not seriously hinder the
ability to redevelop the property in the future, either individually or in combination with
adjacent properties, consistent with the goals of the Town Center Urban Renewal Plan.

Existing Use/Site Conditions: The healing arts center is located in an existing structure on the
property with roughly 1600 S.f. of main floor area. An existing gravel parking lot is located on the
west side of the property. Access to the site is from W. 38th Avenue. A small detached single
family home is located to the west on the same property. It is being used residentially and is not
part of this request.
In 2003, the existing zoning and development code was revised to include a definition for psychic
advisors and the use was listed in the commercial use chart. Psychic advisors are a special use in
the RC, C-l and C-2 zone districts. They are a permitted use in the Light Industrial zone district.
They are not permitted in the NC, Neighborhood Commercial, zone district.
Applicant's Proposal: Apply for a Special Use Permit to offer psychic advising services such as
oracle readings, tarot cards, runes, palm readings, animal totem cards, astrology readings, etc.
Issues Discussed:
. One person was in attendance from the neighborhood. She indicated that she does not
object to this specific proposal but would hope that a condition of approval would be that
the SUP runs with business owner and not vest with the property.

. She indicated that she hoped the SUP application would be referred to both Wheat Ridge
2020 and the Wheat Ridge Merchants Association. Although she doesn't object to this
application, she would like the SUP request to go to hearing in front City Council. It was
explained that this case will only go to public hearing is a legitimate, written complaint is
filed during the 10-day administrative review period.

I was recently notified that Ix Chel Healing Arts Inc., through its owners, is requesting a Special
Use Permit to allow various "intuitive arts" services, such as tarot card reading, as well as the
sale of tools used in the practice of the intuitive arts, at its business located at 7323 W. 38th
Avenue.
It is my hope that if a Special Use Permit is granted, it be granted only to the applicants, and not
be vested with the land in perpetuity. I also request that this SUP application go through the
public hearing process, as opposed to being issued "administratively" by the City's Planning
Department. I think that it's important that the views of the 38th Avenue Business District,
Wheat Ridge 2020, and our elected and appointed officials regarding this Special Use Permit
become part of a permanent record.

NOTICE OF NEIGHBORHOOD INPUT MEETING
Ix Chel Healing Arts, Inc. is proposing a Special Use Permit on property located at 7323 W. 38" Avenue,
Wheat Ridge, CO 80033. A neighborhood meeting will be held on December 7, 2006 at 6:30pm at Ix Chel
Healing Arts, Inc. The purpose of the request is to allow our center to offer the following additional
services: Oracle Readings: Tarot Cards, Runes, Palm, Animal Totem Cards, Astrology Readings,
Numerology Readings, Angel Readings, Aura Readings, Psychic Readings, Chakra Reading/Scanning,
Handwriting Analysis, and Iridology. The zoning in the property is R.C., Residential Commercial. Psychic
advisement is special uses in the R. C. zone district. It is our intention to operate our business with the
utmost integrity and we hold that each clieut is of free will to choose which service(s) will best serve their
highest good. We invite you to attend this neighborhood forum to express any concerns, issues, or desires
that you may have. We are here to address those and answer any questions you may have.
The City of Wheat Ridge has adopted a requirement that prior to any application for Rezoning of property
and for Special Use Permits an applicant must notify all residents and property owners within 600 feet and
invite then to a Neighborhood Input Meeting. The purpose of this meeting is to allow the applicant to
present his proposal to the neighborhood and to give the neighborhood a forum to express their concerns,
issues and desires.
A Staff Planner will attend the meeting to discuss City policies and regulations and the process involved
however the Planner will remain impartial regarding viability of the project.
Keep in mind that this is not a public hearing. Although a synopsis of the meeting will be entered as
testimony, it is the public hearings in front of the Planning Commission and City Council where decisions
are rendered. If you want input in the decision-making process, it is imperative that you attend the public
hearings.
The kinds of concerns residents normally have include the following:
. Is the proposal compatible with surrounding land uses and zoning?
. Are there adequate utilities and services in place or proposed to serve the project?
. What is the impact on our streets?
. How will this proposal affect my property?
. Where will the storm drainage go?
. How will the project be desigued to enhance rather than detract from the neighborhood?
. What specific changes can be made in the proposal to make it more acceptable to me?

Applicant/Owner Preliminary Proposal:
The property on which the action is requested is currently zoned R-C. There is an
existing structure on the property with roughly 1600 sJ. of main floor area. An existing
gravel parking lot is located on the west side of the property. The applicants are currently
occupying the building as a "healing center". The applicants are wishing to offer services
such as, oracle readings, tarot cards, runes, palms, animal totem cards, astrology
readings numerology readings, angel readings, aura readings, psychic readings, chakra
reading/scanning, handwriting analysis, and iridology. They are requesting a special use
permit which is necessary for these services within the City of Wheat Ridge.
Will a neighborhood meeting need to be held prior to application submittal?
A neighborhood meeting will be required for this request.
Planning comments:
The parcel on which the structure sits is zoned Restricted Commercial, R-C. This district
was established to accommodate various types of office uses to perform administrative,
professional and personal services, and to provide for a limited range of retail uses which
are neighborhood oriented. It is the intent that the general retail uses that serve the
community or region, wholesaling, warehousing, industrial, and uses which require
outside storage of display be prohibited. This being said, after meeting with the

applicants it was determined that this type of use would fit in with services allowed in an
R-C zone.
The R-C zone district does require a special permit for psychic advisors and similar
services as do all other commercial zones except for the neighborhood commercial zone
district where it is not allowed.
Among the services not included above, the applicants did express that they would also
have massages, acupuncture, and hold classes and workshops. The front of the structure
would be used to sell retail items associated with this type of business. This area will also
hold small classes during "off retail" hours. Classes in the past have been no larger then
12 people and the applicants intend to keep classes at or around that number. The other
rooms in the structure will also be used for small group and individual consultation.
All massage therapists are required to be licensed with the City of Wheat Ridge.
The size and scope of the classes raised some concern because it is also a takes a
special use permit to teach classes within the city. It was determined that the applicants
will not need to apply for a separate special use permit to hold classes in their
establishment as it can be processed concurrently with the request for special use
approval for a psychic advisement facility. The teaching of classes may impact the
occupancy of the structure. The applicant should contact the building division to discuss
classroom size and occupant load in the building.
Currently the building is being brought up to the codes and compliance of the American
Disabilities Act by the owner of the property. The Community Development Department
will check with the chief building inspector to see where the owner currently is, in that
process.
The special use permit (SUP) process has two options. The first process requiring
submission of a site plan is used more for applications on vacant land that is being
developed. The second option, request for special use without a site plan, is more suited
to the needs to the applicant as all existing site improvements are currently in place.
The first step in the process began with the pre-application meeting in which the
applicants met with staff to talk about initial concerns, answer questions the applicants
may have had, and inform the applicants the processes that they are required to go
through.
The second step that is required by the community development department will be to
conduct a neighborhood meeting. For this meeting, the applicants must inform all
property owners via mail within a 600 foot radius of the property in which the action is
being taken. The community development department will supply the applicant with a list
of the all property owners within the radius. The meeting should be coordinated with the
assigned staff member at a fee of $100 required for staff time at the meeting. A sample
of this letter is found in the pre-application meeting packet and can be used as a
template. However, changes to the letter should be made to suit the applicant, including
the letterhead. The meeting will be led by the applicants and should inform those who
attend what is being proposed.

After the neighborhood meeting is held, the applicant may submit their application for their
special use permit. Upon submittal, the assigned staff will review and comment on the
project. The project will simultaneously be referred to other departments and utilities for
their comments and then sent back to the staff planner. The staff planner will then inform
the applicant if further changes need to be made or if they meet all requirements. When
the project does meet all requirements, the applicant will be required to post a sign on the
property for ten days informing citizens of the action being proposed on the property. If
legitimate objections are raised, the SUP will go to a hearing before the city council. If no
objections are received about the action on the property the project can be approved or
denied administratively.
