Re: Case # SUP -07-05 / Roger Loecher for George Graul, 7610 West 44th
Ave. Property.
This response is made under the Code requirements adopted by the Fire
Board of the Wheat Ridge Fire Protection District and the City Council of
the City of Wheat Ridge, Colorado.
The Site plan submitted to the Fire Marshal shows a free standing building
and which is stated a "Heavy Automotive Repair" will take place within the
building.
He building as been inspected within the last year and had several Fire
Code Violations as well as Building Code Violations which were to be
addressed. No resolution was been achieved to date.
Under the 2003 LF.C. Section 2211 Repair Garages, which has several
section referred to for storage of Hazardous materials, "HOT WORK
OPERATIONS" which may make the building an "H" (HIGH HAZARD)
classification.
The full scope and operation plan for the site shall be submitted to the Fire
District for review and approval.

All notification and posting requirements have been met; therefore, there is jurisdiction to make a
determination regarding this request.
I. REQUEST
The applicant requests approval of a Special Use Permit to allow heavy automotive repair
(transmissions) in an existing building located at 7650 W. 44th Avenue and zoned Commercial-One.
Section 26-204 (zone district use schedule) of the Zoning and Development code requires that heavy
automotive repair facilities in the C-1 zone district receive special use approvals.
The property owner is desirous of leasing the space which is in an existing building previously used
for automotive repair. The structure has a dry cleaning facility in the eastern side. The transmission
repair shop would occupy the western half of the building which already has single bay door. There
are no modifications proposed to the property.
The building is part of a multi-use development on southwest corner of 44th and Wadsworth which
consists of three separate buildings. The building for which the action is being requested is on the
northwest corner of the lot. Directly to the east is a larger building that has multiple tenants and is
situated directly on the corner ofW. 44th and Wadsworth. The final building is on the southeast
comer of the property and is significantly smaller then the other two buildings on the lot. All three
buildings provide roughly 30,000 square feet of commercial space.
In 2001, the zoning code was amended and one of the changes made was that auto service or repair
shops are required to screen the vehicles that are on site for repairs. This would require fencing off or
using some other method of screening part of the rear parking lot for their storage. All required
documents for a fence permit must be approved before a fence can be erected at any location in the
City of Wheat Ridge. The applicant has indicated that he will only be working on one car at a time
and doesn't have the need for screening as no vehicles will be left over night.
Pursuant to Section 26-114 (special uses), the Community Development Director has the ability to
decide upon applications for administrative special use approval, without requirement for a public
hearing, provided the following conditions are met:
1. A completed application package has been submitted and fee paid.
2. The Community Development Department has notified adjacent property owners by letter
notice and the site has been posted for at least ten (10) days,
3. No written objections have been received in such ten-day period;
4. The Community Development Director concludes that the criteria for approval, as set forth
below, are substantially complied with and support the request.
The Community Development Director can impose conditions or stipulations upon the approval,
which may include physical design, operational, and maintenance considerations to ensure compliance
with the criteria for review.
The Community Development Director shall also decide the following:
1. Whether the SUP runs with the land in perpetuity; or,

2. Whether the SUP is personal to the applicant and mayor may not be inherited; and lor,
3. Whether the SUP is granted only for a defined period, after which time the special use
shall expire unless renewed subject to all of the requirements of this section.
II. AGENCY REFERRALS
Wheat Ridge Fire Protection District: The structure has been inspected and there are several fire
code violations and building code violations which have not been addressed. A full scope and
operation plan must be submitted for review prior to building occupation. (Exhibit 1, referral response)
Wheat Ridge Water District: The water district is currently serving with a % inch tap. If usage is
increased, additional taps may be required.
Wheat Ridge Sanitation District: An oil/sand separator may be required on the sewer connection to
the main line. The applicant will need to supply a layout of the flood drains and sewer lines for the
building and property to the point of connection to the sewer main. (Exhibit 2, referral response)
Public Works: No response.
III. SPECIAL USE PERMIT CRITERIA
For an administrative approval, the community development director shall base the decision in
consideration of the extent to which the applicant demonstrates the following criteria have been met:
1. The special use will not have. a detrimental effect upon the general health, welfare, safety
and convenience of persons residing or working in the neighborhood.
The property in question has been previously utilized for automotive use. No changes to site
conditions are proposed.
2. The special use will not create or contribute to blight in the neighborhood by virtue of
physical or operational characteristics.
There should be no blight issues associated with the use if cars are not kept overnight. If they are,
screening of these vehicles will be required.
3. The special use will not adversely affect the adequate light and air, nor cause significant
air, water or noise pollution.
The site conditions are not changing, therefore, there should be no impact on light, air, or water to
adjacent properties. The property is surrounded on all sides by general commercial uses. Wadsworth
Blvd. to the east is a major regional arterial and carries over 45,000 vehicle trips per day. There
should be no concern for increased noise, air or water pollution in light of the surrounding commercial
uses immediate area.
4. The special use will not result in undue traffic congestion or traffic hazards, or unsafe
parking, loading, service or internal traffic conflicts to the detriment of persons whether on or
off the site.

There is adequate parking for the three buildings on the property. Public Works has expressed no
concern regarding traffic on-site and on surrounding streets.
S. The property is appropriately designed, including setbacks, heights, parking, bulk,
buffering, screening and landscaping, so as to be in harmony and compatible with the character
of the surrounding areas and neighborhood, especially with adjacent properties.
Adjacent properties are commercial in nature and will experience minimal impact from the proposed
transmission repair.
6. The special use will not overburden the capacities of the existing streets, utilities, parks,
schools and other public facilities and services.
There will be no impact to parks or schools. All utility agencies are currently serving the property;
however, there appear to be upgrades required in regards to fire protection, building codes and sanitary
sewer service. A Certificate of Occupancy will not be issued until the requirements of the utility
districts have been met.
7. There is a history of compliance by the applicant andlor property owner with Code
requirements and prior conditions, if any, regarding the subject property.
If conditions of an approved special use are violated, the permit can be revoked. If the permit is
revoked, then the use of the property for transmission repairs. In 2004, the property owner was issued
a citation for an unscreened dumpster. The violation appears to have been taken care of in a timely
marmer.
8. The application is in substantial compliance with the applicable standards set forth in
the Architectural and Site Design Manual.
No physical improvements are proposed to the property therefore this criterion is not relevant.
IV. NEIGHBORHOOD MEETING
A meeting for neighborhood input was held on June 12,2007. There were no neighborhood attendees
present. (Exhibit 3, Neighborhood meeting recap).
V. STAFF RECOMMENDATION/FINDINGS OF FACT
Staff recommends approval of Case No. SUP-07-05, a request for approval of a Special Use Permit to
allow heavy automotive repair (transmission) for property located at 7650 W. 44ili A venue with the
following fmdings of fact:
1. This request for an administrative special use meets all applicable conditions as required by
Section 26-114 of the City of Wheat Ridge Code of Laws.
2. Staff has not received written comments in opposition to this request from the noticed property
owners.
3. The building was previously used for automotive repair.

4. There is no change in site conditions so the special use will not impact adjacent properties or
endanger the general health, safety welfare and convenience of persons residing or working in the
neighborhood.
With the following conditions:
1. The special use shall be a grant of use to the tenants of Roger Loecher for George Graul,
property owner. The grant of special use carmot be inherited.
2. The special use can continue until such time that the property is sold or a legitimate
redevelopment plan is submitted
3. The grantee must comply with all required improvements as dictated by the Wheat Ridge Fire
Protection District, the Wheat Ridge Building Division and the Wheat Ridge Sanitation District with
appropriate permits.
4. The structure shall not be occupied until a Certificate of Occupancy is issued for the tenant
space.

This response is made under the Code requirements adopted by the Fire
Board of the Wheat Ridge Fire Protection District and the City Council of
the City of Wheat Ridge, Colorado.
The Site plan submitted to the Fire Marshal shows a free standing building
and which is stated a "Heavy Automotive Repair" will take place within the
building.
He building as been inspected within the last year and had several Fire
Code Violations as well as Building Code Violations which were to be
addressed. No resolution was been achieved to date.
Under the 2003 LF.C. Section 2211 Repair Garages, which has several
section referred to for storage of Hazardous materials, "HOT WORK
OPERATIONS" which may make the building an "H' (ffiGH HAZARD)
classification.

NOTICE OF NEIGHBORHOOD INPUT MEETING
E George Graul is proposing a special use permit on the property located at 7650 W 44th. A
neighborhood meeting will be held on June 12, 2007 at 6:00pm at City Hall, 7500 W 29th Ave.
Wheat Ridge, CO on the 1st floor lobby conference room.
The purpose ofthis meeting is to allow a Transmission, Gear, Brake & Repair Facility, in a
building that was once used in that capacity. A heavy auto repair facility is a special use in C-1
zoning. No changes to the property are proposed.
The City of Wheat Ridge has adopted a requirement that prior to any application for Rezoning of
property and for Special Use Permits an applicant must notifY all residents and property owners
within 600 feet and invite them to a neighborhood Input Meeting. The purpose of this meeting is
to allow the applicant to present his proposal to the neighborhood and to give the neighborhood a
forum to express their concerns, issues and desires.
A staff planner will attend the meeting to discuss City policies and regulations and the process
involved, however, the Planner will remain impartial regarding the viability ofthe project.
Keep in mind that this is not a public hearing. Although a synopsis of the meeting will be entered
as testimony, it is the public hearings in front of the Planning Commission and City Council where
decisions are rendered. If you want input in the decision making process, it is imperative that you
attend the public hearings.
The kinds of concerns residents normally have included the following:
. Is the proposal compatible with surrounding land use and zoning?
. Are there adequate utilities and services in place or proposed to serve the project?
. What is the impact on our streets?
. How will this proposal affect my property?

Applicant/Owner Preliminary Proposal:
The applicant is proposing to allow a tenant to use the building at the address above as a
transmission repair shop. The building has been used as a transmission repair shop in
the past but has been vacant for the last several years. The building has one overhead
door and one hoist. There is the possibility that tenant will install more hoists and a small
office area as well.
Will a neighborhood meeting need to be held prior to application submittal?
A neighborhood meeting will be required prior to submitting an application for a Special
Use Permit.
Planning comments:
The parcel on which the action is being requested is zoned Commercial One, C-1. The
intent of this district is to provide for areas of the city with a range of commercial land
uses which include office, general business, and retail sales and service establishments.
The surrounding properties also have C-1 zoning with a mix of general commercial land
uses. An R-3, Residential-Three zone district does exist immediately to the southwest of
this property as well.
Under the C-1 zone district regulations, major auto service, repair and maintenance
shops are allowed as a special use. Major auto service, repair, and maintenance shops
are defined as; tire recapping, major mechanical repair shops, body work and painting,
engine repair, and transmission repair. Upon such a request, a special use permit is
required to be obtained before the property is allowed to be used as requested.
The property is located at the northwest corner of W. 44th and Wadsworth Blvd in a highly
commercial area. The building is part of a multi-use development on that corner which
consists of three separate buildings. The building for which the action is being requested
is on the northwest corner of the lot. Directly to the east is a larger building that has
multiple tenants and is situated on the corner of W. 44th and Wadsworth. The final
building is on the southeast corner of the property and is significantly smaller then the
other two buildings on the lot. All three buildings provide roughly 30,000 square feet of
commercial space.
This area has been designated an urban renewal area. Properties designated as being in
an urban renewal area are required a review of the application by the Wheat Ridge Urban
Renewal Authority (WRURA). WRURA will make an additional recommendation to the
final decision making body, in this case, city council, based on its compatibility to the
Wadsworth Boulevard Corridor Redevelopment Plan.
This property is also located within the Wadsworth sub-area plan boundaries. The
Wadsworth sub-area plan was created as a response to a study done in 2005. The
study, the Neighborhood Revitalization Strategy (N.R.S), identifies several key goals and
objectives that the City of Wheat Ridge needs to achieve in order to remain a desirable
community for residents and businesses within the Denver Metro Region. As a result of
the Wadsworth Plan the corridor could see significant changes that will directly affect
development.
COOT will widen Wadsworth Blvd; however, the funding for the widening is not in COOT's
constrained budget and the amount of right-of-way required and the when the project will
take place is yet to be determined. The widening could result in some property
acquisition in the corridor. When the road is widened, the Wadsworth Sub-area plan will
suggest that COOT construct and design the road to the City of Wheat Ridge's preferred
alternative It should be noted that the sub-area plan, along with the preferred alternative,
have not been approved by the City Council to date.
In 2001, the zoning code was amended to reflect some of the changes that needed to be
made in order to mitigate undesirable impacts from certain commercial. One of the
changes made was, auto service or repair shops are required to screen the vehicles that
are on site for repairs. This would require fencing off or using some other method of
screening part of the rear parking lot for their storage. All required documents for a fence
permit must be approved before a fence can be erected at any location in the City of
Wheat Ridge
The current number of parking spaces will be reduced because the required screening.
The transmission shop will require 1 parking space per employee on a maximum shift
plus 1 space per baylhoist. To make sure that adequate parking is provided for the rest
of the development after the screened area has been constructed, the applicant should
submit a list of the uses in the rest of the development along with their sizes. This will
determine how large the screened area can be without impacting the overall parking of
the entire development.
There is no landscaping on the site at the present time. Some sort of landscaping should
be provided to soften the visual impacts of the development. No significant investment in
permanent landscaping is required as the area is in a redevelopment area and will see
major changes. Suggested landscaping should include planters, potted plants, and other
similar landscape materials, plants, shrubs, and trees.
Process:
The first step in the process began with the pre-application meeting in which the applicant
met with staff to talk about initial concerns, answer questions the applicants rnay have
had, and inform the applicants the processes that they are required to go through.
The second step that is required by the community development department will be to
conduct a neighborhood meeting. For this meeting, the applicants must inform all
property owners, via mail or hand delivery, within a 600 foot radius of the property in
which the action is being taken. The Community Development Department will supply the
applicant with a list of the all property owners in the radius. The meeting should be
coordinated with the assigned staff member at a fee of $100 required for staff time at the
meeting. A sample of this letter is found in the pre-application meeting packet and can be
used as a template. However, changes to the letter should be made to suit the applicant,
including the letterhead. The meeting will be led by the applicants and should inform
those who attend what is being proposed.
After the neighborhood meeting is held, the applicant may submit their application for a
special use permit. Upon submittal, the assigned staff will review and comment on the
project. The project will simultaneously be referred to other departments and utility
companies for their comments. The staff planner will inform the applicant if further
changes need to be made based on comments of others or their own, or if they meet all
requirements.
When all requirements are met, the applicant will be required to post a sign on the
property for ten days informing citizens of the action being proposed. Normally, if no
legitimate objections are received regarding the action on the property the Special Use
Permit could be approved administratively. If there are objections that are received in the
ten day posting period a hearing will be set before city council.
If a is hearing required before City Council the case planner will present evidence to
support their recommendation of approval, approval with conditions, or denial. The public
will also be allowed to give testimony in support of or against the request for the special
use permit. The City Council make the final decision on the request by making a motion
for approval, approval with conditions, or denial.
