Commissioner McMILLIN offered an amendment to include his
comments on the Zarlengo property as follows: He observed 4-5 foot high
weeds on the day of the hearing that appeared not to have been cut all year.
It was moved by Commissioner McMILLIN and seconded by
Collllllissioner STEWART to approve the minutes of October 5, 2006
with amendments stated by Commissioner PLUMMER and McMILLIN.
The motion carried 6-0 with Commissioners WESLEY and SCEZNEY
abstaining.

Case No. MS-06-07: An application filed by Applewood Baptist
Church for approval of a 2-lot minor subdivision plat for property
located at 11225 West 32nd Avenue.
Commissioner SCEZNEY disclosed that he lives next door to the applicant;
however, he has no financial interest in the property and he believed he could
act with impartiality on this case. It was determined that Commissioner
SCEZNEY could hear the case.
The case was presented by Meredith Reckert. She entered all pertinent
documents into the record and advised the Commission there was jurisdiction
to hear the case. She reviewed the staff report and digital presentation. Staff
recommended approval with a condition that park land dedication be assessed
at the time of future subdivision of Lot 2.

Mr. Theander, President of Mountain State Engineering Associates, was
sworn in by Chair WESLEY.
In response to questions from Commissioner SCEZNEY, Mr. Theander stated
that Urban Drainage and the City of Wheat Ridge are working on a new
floodplain study verifying the 100-year floodplain that should be coming forth
within the next year that includes this property. He also stated that he could
fmd no record of any drainage easement on Lot 2.

Commissioner SCEZNEY asked Mr. Theander to comment on the northeast
comer of the property as it relates to the adjacency of Lena Gulch. Mr.
Theander replied that this comer is in the Lena Gulch floodplain and there is
an easement for maintenance ofthe Lena Gulch channel. He stated there is no
need for retention in the northeast corner because that area is not being
developed. There are plans for a detention pond to be located on the property
line between Lots 1 and 2.
Louise Turner

Ms. Turner was sworn in by Chair WESLEY. She expressed concern that the
developer appears to be selling lots for a subdivision that had not yet been
approved. There is a sign that says "Quail Hollow Subdivision" and the
neighbors have heard earth-moving equipment in the area. She also expressed
concern about flooding and noted that there was a raging river through the
drain under 32nd Avenue in 1973. She was concerned about the houses facing
Quail on the east side of the church property. Meredith Reckert commented
that Public Works and a civil engineering firm attempted research through
Lakewood regarding drainage information but could find no plans for the
construction of 32nd Avenue and the storm drainage facilities incorporated into
the design.
Steve McKendry
907 Cole Street, Golden
Mr. McKendry was sworn in by Chair WESLEY. He stated that he and Pat
McKendry are developing the subject parcel and they are in the process of
studying the drainage issues mentioned by Ms. Turner. He also stated that
they are not selling lots at this time but are taking reservations as indicated on
their sign.
Commissioner McMILLIN asked if any earth moving work had been done.
Mr. McKendry explained that Urban Drainage had punctured a Northwest
Lakewood Sanitation District sewer line when building a stone retaining wall
in the Lena Gulch easement. As a result, it was necessary to remove the stone
wall, replace the punctured sewer line and rebuild the retaining wall. This
was the source of noise heard by neighbors and had nothing to do with the
development.
George Hock
3294 Quail
Mr. Hock was sworn in by Chair WESLEY. He expressed concern about
traffic impacts from new development on Lot 2, especially as they would
affect Prospect Valley School. He asked if a new street would be built. Alan
White replied that traffic information is not available at this time but would be
if Lot 2 were to be subdivided. Any future subdivision would be subject to
future public hearings.

It was moved by Commissioner STEWART and seconded by
Commissioner SPANIEL to approve Case No MS-06-07, a request for

All notification and posting requirements have been met; therefore, there is jurisdiction to hear this
case.
I. REQUEST
The applicant is requesting approval of a two-lot minor subdivision on property zoned Residential-One
located at 11225 W. 32nd Avenue.
The property is comprised of three parcels platted in 1892 as part ofthe Brookside Subdivision with a
combined total size of 14.73 acres. There is a three-story education building on the southern portion
with associated drives, parking areas, landscaping and detention areas.
The applicant has expressed that the intent ofthe subdivision request is to allow the sale of the rear lot
to a private individual.
II. ANALYSIS
The request is only for the subdivision of the property and does not include any site plan approval,
variances or subsequent subdivision of the rear parcel. Any future division of either the rear or front
piece will require another subdivision process.
The new, rear lot (Lot 2) will be roughly 7.9 acres in size with the front lot (Lot 1) retaining 6.8 acres.
The front property is currently used by the Applewood Baptist Church for education purposes and
parking for the main church structure which is located on the south side of the street in the City of
Lakewood. The church intends on maintaining ownership of Lot 1.
A church is a special use in the R-l zone district. Government and quasi-government buildings and
uses require a minimum of one acre of lot area with 200' of lot width. Proposed new Lot 1 will meet
these development standards. The church currently has an application submitted for approval of a
special use permit to expand the education building. The SUP application is not a subject ofthis
subdivision request and should be not germane to discussion regarding the subdivision approval.
The plat establishes typical utility easements around the perimeter. A storm water detention easement
is being shown along the common property line. Notes regarding these easements have been added to
the front page.
Lena Gulch traverses the rear ofthe property and encumbers Lot 2 with IOO-year flood plain on the
northwestern one-third of the lot. The limit of the IOO-year flood plain is depicted on the plat drawing.

No additional right-of-way is needed for West 32nd Avenue. Access for Lot 2 will be by-way of a 25'
wide access easement through the church's eastern parking lot. This access easement aligns with an
existing drive aisle and curb cut to 32nd Avenue. Staffhad originally considered a public street
dedication for Robb Circle along the western line ofthe subdivision aligning with Robb Circle to the
south ofW. 3Znd Avenue. However, there are grade complications between the church property and
the adjacent property to the west. There would also be the requirement for the relocation of a sizable
storm water pipe which runs under W. 3Znd Avenue and down the western property line. The Wheat
Ridge Fire Protection District has approved this access through the church's parking lot. If future
alternate access to a public street is provided for Lot 2, this easement could be vacated.
All regulations and standards of Article IV of the Code of Laws have been met.
III. AGENCY REFERRALS
All agencies are currently able to serve the property and can continue to do so with the proposed minor
subdivision. Any service upgrades required by the referral agencies will be addressed if and when
future development occurs on the property.
Wheat Ridge Fire Protection District: Has approved the 25' wide access easement across Lot 1.
Any development on Lot 2 will be evaluated for fire issues at the time of submission.
Pnblic Works: Has reviewed a preliminary drainage report and a traffic impact report. Has approved
the plat document.
Xcel Energy: Has requested standard easement language be included on the plat.
City of Lakewood: Has commented regarding the detention area and the access.
Consolidated Mutual Water Company: Is currently serving the property. Any new construction
will require upgrades to the existing service.
Northwest Lakewood Sanitation District: There is an existing sanitary sewer line in 32nd Avenue.
Any new construction will require separate sanitary sewer lines.
Staff would note that this subdivision was not reviewed by the Parks and Recreation Commission for a
parkland dedication recommendation. Section 26-42I.D. ofthe zoning and development code specifies
that parkland dedication is assessed only for residential development and is based on a per unit
calculation. Parkland dedication requirements will be assessed at the time that either ofthe lots is
further subdivided for residential development.

IV. STAFF CONCLUSIONS AND RECOMMENDATION
The requirements ofthe Subdivision Regulations have been met and both parcels meet the minimum
development standards for the R-l, Residential-One zone district. For these reasons, a
recommendation of approval is given with the following conditions:
1. The dedication for parkland be assessed at the time of future subdivision of Lot 2.

Dear Ms. Reckert,
On behalf of the Northwest Lakewood Sanitation District, Martin/Martin Inc. acting as the District
Engineer, offers the following in response to the referenced Community Development Referral dated May
15, 2006:
. The existing building is currently provided with sanitary sewer service by the mainline within West 32'0
Avenue along the south side of the property.
. If the new building is ,separate from the existing building, the new building will require a separate sanitary
sewer service line to the existing sanitary sewer main within West 32'0 Avenue. The sanitary sewer
service requires a cleanout be constructed 5 feet outside of the new building and every 100 feet of
service length. The sanUary sewer service (private) will not require an easement. If the new building is in
fact an addition to the existing building (expansion to the existing building). a separate sanitary sewer
service is not required but may be necessary to facilitate building plumbing.
. The owner is responsible for verifying sanitary sewer main elevations to determine if the development can
be serviced with gravity flow or if a private sewage ejector is required.
. The owner is responsible for construction and maintenance of the sanitary sewer service from building to
main.
. A grease trap will be required if a kitchen/cafeteria is incorporated within the new building. The Northwest
Lakewood Sanitation District must review and approve construction plans that involve food service.
. Owner shall provide sanitary sewer flow calculations to the District prior to final acceptance.
. Appropriate development fees and tap fees based on the final design are the responsibility of the
Developer (Owner).
