Jurisdiction
All notification and posting requirements have been met; therefore, there is jurisdiction to make an
administrative decision on this matter.
I. REQUEST
The applicants are requesting approval of a special use permit to allow for excavation and deposition of fill
material (Exhibit 1, Letter of Request). This request is related to case number SUP-05-04, a request for major
grading and deposition on the same property. The property is currently vacant, and is located west ofI-70, south
of Highway 58 and north of West 32nd Avenue. The property is approximately 178 acres in size.
Pursuant to Section 26-114 of the Code of Laws, the Community Development Director has the ability to decide
upon applications for administrative special use approval, without requirement for a public hearing, provided
the following conditions are met:
1. A completed application package has been submitted and fee paid;
2. A neighborhood meeting has been held in accordance with Section 26-114;
3. The Community Development Department has notified adjacent property owners by letter notice
and the site has been posted for at least ten (10) days;
4. No written objections have been received in such ten-<lay period;
5. The Community Development Director concludes that the criteria for approval, as set forth below,
are substantially complied with and support the request.
The Community Development Director can impose conditions or stipulations upon the approval, which may
include physical design, operational, and maintenance considerations to ensure compliance with the criteria for
review.
The Community Development Director shall also decide the following:
1. Whether the SUP runs with the land in perpetuity; or,
2. Whether the SUP is personal to the applicant and mayor may not be inherited; and lor,
3. Whether the SUP is granted only for a defined period, after which time the special use shall
expire unless renewed subject to all of the requirements of this section.
II. PROPERTY HISTORY
The applicants received approval of case number SUP-05-04 in May of 2005 for major grading and deposition
on the subject parcel. City Council granted approval with a number of conditions. Under this approval, the
applicant requested that work be allowed on Sundays for a period oftime during spring 2005.
The Code of Laws states that special use permits for grading and deposition shall be valid for a period of one
year, however the applicant may request an extension to the permit. The applicants have requested an extension
to allow the continuation of grading and deposition until November 2006 (Exhibit 2, Letters of Extension). This
extension was granted.
m. CASE ANALYSIS
The applicants are requesting that Sunday operations be allowed until July 2, 2006. Because of this request, a
new special use permit must be processed. The applicants can continue to work Monday-Saturday until
November 2006 under the approval of SUP-05-04.
The Code of Laws states that any deposition or excavation in excess of 20,000 cubic yards shall require a
special use permit. The applicants wish to excavate and deposit approximately 1.5 million cubic yards. The SUP
process starts with a neighborhood meeting and an administrative review. Once the referral and staff review
period has been completed, a ten-day public notice period begins. During this ten day period, the public is given

an opportunity to submit written objections regarding the request. If any relevant objections are received, or if
the Community Development Director does not approve the request based upon specific criteria in the Code of
Laws, the application must be forwarded to City Council for consideration. There were no letters of objection
received during the ten-day posting period.
Additionally, the Code of Laws requires a neighborhood meeting to be held. A neighborhood meeting was held
on May 10, 2006. There were no attendees.
IV. SITE PLAN REVIEW
The deposition and excavation will be in conformance with the previously approved civil documents associated
with SUP_05-04 and SUP-05-01.
V. AGENCY REFERRALS
The proposal was referred to all adjacent jurisdictions. The Community Development Department has not
received any comment from the jurisdictions. The drainage plan will not be altered from the originally approved
plan.
VI. SPECIAL USE PERMIT REVIEW
Staff has the following comments regarding the criteria used to evaluate a special use permit request:
Per the Code of Laws Sec. 26-114 (D) before a special use permit is approved, the applicant shall show, and the
community development director or city council shall find, the proposed special use:
With proper controls, detrimental effects on the general health, safety or welfare of persons in the
neighborhood should be mitigated. There will be minimal traffic on and off the site, and the applicants
are proposing best management practices to ensure effects on the neighborhood are minimal.
1. Will not have a detrimental effect upon the general health, welfare, safety and convenience of
persons residing or working in the neighborhood of the proposed use.
2. Will uot create or contribute to blight in the neighborhood by virtue of physical or operational
characteristics of the proposed use.
The proposed use should not contribute to blight in the neighborhood. The excavation and deposition
will be a temporary operation.
3. Will not adversely affect the adequate light aud air, nor cause significant air, water or uoise
pollution.
With proper controls in place, the proposed special use should not affect adequate light, air or water
pollution. There will be noise generated as a result of the excavation. A condition is recommended that
operations within 200 feet of the residential structures will be allowed only between the hours of 7 a.m.
and 7 p.m. The applicants will be responsible for instilling best management practices to ensure
airborne dust and debris is kept to a minimum, as required by state permits that must be obtained.
4. Will not result in uudue traffic cougestiou or traffic hazards, or uusafe parking, loading, service
or iuternal traffic conflicts to the detrimeut of persons whether on or off the site.
The proposed special use should not result in undue traffic congestion. The applicants have indicated
that the fill dirt to be distributed will be generated by excavating a portion of the site. For this reason,
there will not be large numbers of dirt-hauling vehicles coming to and going from the site. All

equipment will be brought onto the site and will remain onsite until completion of the excavation and
grading. Except for initial mobilization, all traffic will be required to access the site from McIntyre.
5. Will be appropriately designed, including setbacks, heights, parking, bulk, buffering, screeniug
aud landscaping, so as to be iu harmony and compatible with the character of the surroundiug
areas aud neighborhood, especially with adjacent properties.
There is no building proposed as a result of this special use request. The applicants will be required to
maintain a 30 foot "setback" from the property lines. This setback will ensure that the grading and
excavation vehicles and equipment are at least thirty feet from the nearest property line.
6. Will not overburdeu the capacities of the existing streets, utilities, parks, schools and other public
facilities and services.
The applicants have indicated that there will be minimal traffic generated by this special use request.
All of the fill material to be excavated and moved will come from onsite; that is, there will not be trucks
bringing the dirt onto the site to be distributed. There should be no effect on utilities, parks, schools or
public facilities.
7. History of compliance by the applicant with Code requirements and prior conditions, if auy,
regarding the subject property.
The applicants have no history of compliance or noncompliance with the City of Wheat Ridge code
requirements.
8. Ability ofthe applicant or any permitted successor-in-interest to continuously meet the conditions
of the proposed permit.
If conditions of an approved special use permit are violated, the permit can be revoked.
9. Other factors relevant to the specific application.
There are no other relevant factors.
VII. STAFF CONCLUSIONS AND RECOMMENDATIONS
In recognition that the property was properly posted, adjacent landowners were notified and no objections were
received, the Community Development Director has the authority to grant the special use permit
administratively. Staff concludes that the applicants should not create an adverse effect on the neighborhood.
Additionally, the applicants will take measures to ensure dust, debris and runoff are minimal and non-intrusive.
Therefore, staff recommends APPROVAL of Case No. SUP-06-05 with the following findings of fact:
1. The special use permit will not have a detrimental effect on the health, safety or welfare of
surrounding properties.
2. The special use will not contribute to blight in the neighborhood.
3. With proper controls in place, the proposed special use should not affect adequate light, air
or water pollution.
4. The special use will not result in undue traffic congestion or traffic hazard.
With the following conditions:
I. The applicants shall adhere to the performance standards as listed in Section 26-623
(C)(2)ofthe Zoning and Development Code, with the following exceptions:
a. Hours of operation shall be limited to 7:00 a.m. to 9 p.m., Monday through Saturday,

except for June 1 to July 2, 2006 where work will be allowed on Sundays.
b. For areas within 200 feet of residential properties, the hours of operation shall be
limited to 7 a.m. to 7 p.m.
c. Fencing at a height of 48 inches shall be permitted.
d. The 30-foot setback shall not apply to the west, north and east property lines of the
added area. The 30-foot setback shall remain a requirement along the south property
line of the previously approved area.
2. A community notification process established for questions and complaints regarding the
operation shall continue to be maintained.
3. There shall be no explosive devices used for the demolition or excavation of material.
4. The applicants shall comply with the conditions of state permits regarding water and air
quality, and mining and reclamation.
5. The applicants shall continue to implement the City-approved noise abatement plan.
6. All access to the site shall be from McIntyre Street.
7. The grant of use shall be to the applicants and may not be inherited.
8. Violations of any of the above conditions may be grounds for revocation of the special use
permit.
9. The applicant shall make every effort to promptly notifY the City and County of any
problems in the areas adjacent to County property or the access road to County property.
10. The applicant shall make every effort to promptly notifY the City and County if field
conditions differ from what was stated in the geotechnical engineering study in a way that
may impact the safety of the project.
11. The applicant shall expose the cut slope for the shortest period oftime practical and shall
recompact the new fill as quickly as practicable.
12. Should damage occur to the County's property, the applicant will make the necessary
repairs to bring the property back to the condition prior to the damage occurring.
13. The applicant shall make every effort to promptly notifY the City and County if events
warrant barricading either the Y oungfield Service Road or the TMAC parking lot. The
decision to barricade the TMAC parking lot shall be the County's decision.
14. The applicant shall notifY the County when a request for extended hours of operation is
submitted to the City if the operation is adjacent to County property.

Dear Ms. Newman:
Per your request, I have included several items for your review regarding SUP-06-05, a request for
a special use permit for the property generally located west ofI-70, north of West 32nd Avenue, east
of Eldridge Street and south of Highway 58.
The applicants have requested that major grading operations be allowed on Sundays until July 2,
2006. In May 2005, the Wheat Ridge City Council approved SUP-05-04, a request for major
grading activity on the subject property. SUP-05-04 allowed major grading activity Monday
through Saturday, with a one month window for Sunday operations. This one month window has

I have received a request for amendment to the SUP granted in May of 2005 (SUP-05-04) for the
Coors/Cabela's parcel. SUP-05-04 allowed major grading activity on a parcel ofland west ofI-70,
south of Highway 58, north ofW. 32nd Avenue and east of Eldridge Street. City Council approved
this request for special use permit on May 9, 2005 with a number of conditions.
The applicants have requested and received an extension to SUP-05-04. Pursuant to the Code of
Laws, a special use permit for major grading activity shall be valid for a period of one year. The
extension to SUP-05-04 has been granted until November 9, 2006, with the same conditions as
originally stipulated by City CounciL
This latest amendment (SUP-06-05) is a request to operate on Sundays until July 2, 2006. The
grading operations will follow the originally approved civil documents. A letter from Bill Willis,
P.E. of Martin and Martin engineers has been included for your review.

Earthwork modifications to Non-Profit and North Clear Creek area.
Dear Mr. Brossman,
Coors is requesting a minor modification to the close-out grading plan within the 15 acre non-
profit parcel of the Development to accommodate general maintenance of their storage lake west
of the site. The modification is an average increase in ~ade elevation of2 feet within the 15 acre
non-profit parcel (north of the new Coors Lake and south west of the proposed Cabela Drive.
The additional fill material will continue to be located at an elevation below Cabela Drive and the
interceptor ditch to the west. Therefore, drainage considerations will not modifY from the
original submittals.
Standard erosion control methods will be used during the earthwork operations including silt
fencing around the newly placed material and re-seedinglmulching of the area upon completion
of the operation. On-going BMP's will be maintained and updated by the contractor in
conformance with the SWMP.

Dear Alan,
This letter is to request an amendment to the Special Use Permit SUP-OS-Ol to allow for
Sunday operations within part of the permit area. Sunday operations would begin as soon
as possible and continue through July 2, 2006.
This Special Use Permit, issued to Cabela's Retail, Inc. and Coors Brewing Company,
was issued on March 7,2005 and subsequently amended to expire in early May, 2006.
We have a current request before you to extend that SUP through early November, 2006.
The original SUP permit deals with grading uses and standards on proEerty owned by
Cabela's and Coors on an approximate 200-acre area west of West 40 Avenue (as
extended) and the Youngfield Service Road.
The area of proposed Sunday operations is only on Coors-owned property, containing an
approximate 6S-acre area lying within the northwestern-most part of the SUP area. The
area includes a former gravel mine area, in the process of being backfilled and reclaimed,
which lies north of Clear Creek (the "40-Acre Parcel"), and an approximate IS-Acre
. Parcel lying south of Clear Creek (the "IS-Acre Parcel "), and a small connection ofland
between the two parcels. These parcels are shown on the attached sketch.

The placement of fill originally approved in the SUP began on the Coors-owned 40-Acre
Parcel in late 2005. A change of source areas for the fill and contractors has occurred and
the fill operation is resuming this week. Approximately 830,000 cubic yards of material
is plarmed to be placed in the 40-Acre Parcel. That material is being excavated from the
floor of an existing reservoir (Lake B- 3) located about 12 mile west of the SUP area, on
lands owned by Coors, but laying outside of the City of Wheat Ridge.
A relatively small amount of wet material from Lake B-3 will be spread on the IS-Acre
Parcel for drying. That material will either be spread and incorporated in place, or
relocated to the 40-Acre Parcel after drying. In either case, the disturbed area on the 15-
Acre Parcel will be reseeded.
Our goal is to complete removal of the material from the floor of Lake B-3 and placement
ofthat material to reclaim the 40-Acre Parcel prior to the time oflarge Clear Creek
stream flows this year. Those high volume flows occur from early June through July.
Given the volume of material to be moved and the timing of peak stream flows, which
will allow us to refill the Lake B-3 this summer, we desire to run 7 days a week
beginning immediately until completion of the earth fill project in early July.
We anticipate Sunday operations hours to be from 9 AM through 7 PM. On other days of
the week we will continue to operate under the hours contained in the original SUP,
which are from 7 AM to 9 PM. The machines which will accomplish the material
transportation are off-road, heavy construction scrappers and trucks, with graders, dozers
and compactors completing the material placement.
As a matter of information, the 40- Acre Parcel is bounded on the north by Colorado
Highway 58. North ofthat roadway lay several small-lot industrial properties. To the
east and south are properties owned by Jefferson County and Cabela's. The County
property is vacant, containing stockpiles of recycle concrete and asphalt. The County
property hosts the Table Mountain Animal Center, which lays about 800 feet east ofthe
40-Acre Parcel. The Cabela's property is also vacant. To the west lays a railroad track,
beyond which is vacant property owned by Coors.
The construction traffic will cross the Clear Creek trail, just west of the trails bridge
crossing of Clear Creek. A traffic control plan has been approved by Jefferson County
Open Space concerning this trail crossing. The plan consists of signage on both the trail
and haul road. Flag people are on hand to halt trail traffic when off-road equipment
crosses the path. This system was in place during the latter half of 2005 when similar
traffic situations existed.
After the hauling of earth to the 40-Acre and I5-Arce Parcels is complete by early July,
Sunday operations will be suspended.
I am discussing this matter with Cabela's Retail, Inc. I will be endeavoring to have them
send you a letter indicating their consent to make this request to amend the SUP.

expiration date of May 9, 2006 for six months to November 9, 2006.
This Special Use Permit, issued to Cabela's Retail, Inc. and Coors Brewing Company,
was issued on March 7,2005 and subsequently amended to expire in early May, 2006.
The permit dealt with grading uses and standards on pro~erty owned by Cabela's and
Coors on an approximate 200 acre area west of West 40 Avenue (as extended) and the
Y oungfield Service Road.
Cabela's has completed most of their grading work on property owned by themselves and
Coors south of Clear Creek, including backfill of a former gravel pit to ground surface
and creation of a new water storage reservoir on Coors land in the extreme southwest
portion of the project area, known as Lake B-S.
The SUP allows for us to complete backfill that former gravel mined area north of Clear
Creek with material excavated from either Area One, as defined in the SUP (the
excavation for B-S reservoir), or from Area Two, which are lands owned by Coors. but
located outside of the City of Wheat Ridge.
Some backfill materials were placed in the area north of Clear Creek from Area One this
past December I January. A contractor for Coors recently began the backfill of the
former gravel mine, north of Clear Creek, by removing material from Area Two. Given
the magnitude of the earth moving yet to be completed, about 800,000 cubic yards, it will
not be completed by the current expiration date within the Amended SUP.
It is also likely that Cabela's may need to modify drainage on their property, located
south of Clear Creek, during the upcoming storm season in order to adequately collect,
treat and dispose of storm water from their property.
All factors regarding the original SUP we request to be left inplace. The only change
requested is to extend the expiration of the SUP (as amended) to November 9, 2006.

Special Use Permit to allow major grading activity on Sundays for parcels located
west ofI-70, south of Highway 58 and north ofW. 32nd Avenue.
Pursuant to Ordinance No. 1291, an administrative special use review can be granted
by the Community Development Director without need for a public hearing. Prior to
the rendering of a decision, all adj acent property owners are required to be notified of
the request by certified mail.

This letter is to provide notice of a neighborhood meeting concerning a proposed
amendment to an existing Special Use Permit allowing ongoing grading on property
located at approximately 13500 Colorado Highway 58 Service Road, Wheat Ridge,
Colorado. The specifics of the meeting and the proposed amendment to the Special Use
Permit are:

amendment request is to allow
Sunday grading operations from 8
AM through 8 PM, commencing as
soon as possible and continuing
through July 2, 2006. The hours of
operation under the existing Special
Use Permit are 7 AM through 9 PM,
Monday through Saturday.
Property Location:
Approximately 45-acres of vacant
land owned by Coors which lays
generally east of Eldridge Street (as
extended) and between Colorado
Highway 58 and Clear Creek. Also
Sunday operations are proposed to
on another -17 -acre Coors-owned
parcel immediately south of the
previously described land tract, but
south of Clear Creek.

The City of Wheat Ridge has adopted a requirement that prior to any application for land
use or modification to existing land entitlements an applicant must notifY all residents
and property owners within 600 feet of the affected property and invite them to a
Neighborhood Input Meeting. The purpose of this meeting is to allow the applicant to
present their proposal to the neighborhood and to give the neighborhood a forum to
express their. concerns, issues and desires.
A Staff Plan:ner will attend the meeting to discuss City policies and regulations and the
process involved, however the Planner will remain impartial regarding viability of the
proposal.
Keep in mind that this is not a public hearing. Although a synopsis of the meeting will be
entered as testimony, it is the public hearings in front of the Planning Commission and
City Council where decisions are rendered. If you want input in the decision-making
process, it is imperative that you attend the public hearing.
The kinds of concerns residents nonnally have include the following:
· Is the proposal compatible with surrounding land uses?
· What is the impact on our streets?
· How will this proposal affect my property?
· How will the proposal be implemented to enhance rather than detract from the
neighborhood?
· What specific changes can be made in the proposal to make it more acceptable to
me?

Applicant/Owner Preliminary Proposal:
Request amendment to special use permit (SUP) for case no. SUP-05-04 to allow for Sunday
operations, and to extend the time limit piaced on the original approval from May 2006 to
November 2006. The area of proposed Sunday operations will only be for Coors owned property,
on an approximately 65 acre site on the northwest portion of the approved SUP area.
Will a neighborhood meeting need to be held prior to application submittal? YES
Planning comments:
The new fill brought in as part of this request will not alter the originally approved drainage plans.
The original plans with regards to drainage will be complied with.
Erosion control is of concern for the southern parcel. This needs to be addressed in writing from
the engineering firm working on the project.
A written request must be submitted to the Community Development Department regarding the
extension of the special use permit.
Now that a pre-application meeting has been held, the applicant can work with staff to schedule
the required neighborhood meeting. The Community Development Department will initiate the
600' radius property owner search for the neighborhood meeting notice. There is a $100 fee for
the neighborhood meeting that needs to be received on or before the date of the meeting. After
the neighborhood meeting is held, a formal application for a special use permit may be submitted.
Upon receipt of the application the proposal will be referred to the necessary outside agencies for
review and comment.
After the review process is complete, the Community Development Department shall notify
adjacent property owners by certified letter and posting of the site for 10 days. If no written
objections directly related to the special use request are received within this 10-day period, the
Community Development Director can approve, approve with conditions or deny the special use.
Upon receipt of any relevant written objections by an adjacent property owner or upon appeal by
an applicant of a decision by the Community Development Director, the special use request will
be scheduled for public hearing in front of City Council. If approved, either by the Community
Developm"ent Director or by the City Council at a public hearing, the special use will become
effective immediately.
Public Works comments:
Erosion control must be addressed as part of this request. The approved drainage plan for the
project must be complied with.

support of the request to extend hours of operation, for the Coors site only, to include

Dear Alan,
This letter is to request an extension of Special Use Permit SUP-05-01 from its scheduled
expiration date of May 9, 2006 for six months to November 9, 2006.
This Special Use Permit, issued to Cabela's Retail, Inc. and Coors Brewing Company,
was issued on March 7, 2005 and subsequently amended to expire in early May, 2006.
The permit dealt with grading uses and standards on proEerty owned by Cabela's and
Coors on an approximate 200 acre area west of West 40 Avenue (as extended) and the
Y oungfield Service Road.
Cabela's has completed most of their grading work on property owned by themselves and
Coors south of Clear Creek, including backfill of a former gravel pit to ground surface
and creation of a new water storage reservoir on Coors land in the extreme southwest
portion of the project area, known as Lake B-5.
The SUP allows for us to complete backfill that former gravel mined area north of Clear
Creek with material excavated from either Area One, as defined in the SUP (the
ex~avation for B-5 reservoir), or from Area Two, ""hich are landspwned by COQlJ>, but
located outside of the City of Wheat Ridge.
Some backfill materials were placed in the area north of Clear Creek from Area One this
past December / January. A contractor for Coors recently began the backfill of the
former gravel mine, north of Clear Creek, by removing material from Area Two. Given
the magnitude of the earth moving yet to be completed, about 800,000 cubic yards, it will
not be completed by the current expiration date within the Amended SUP.
It is also likely that Cabela's may need to modifY drainage on their property, located
south of Clear Creek, during the upcoming storm season in order to adequately collect,
treat and dispose of storm water from their property.
All factors regarding the original SUP we request to be left inplace. The only change
requested is to extend the expiration of the SUP (as amended) to November 9, 2006.

The placement offill originally approved in the SUP began on the Coors-owned 40-Acre
Parcel in late 2005. A change of source areas for the fill and contractors has occurred and
the fill operation is resuming this week. Approximately 830,000 cubic yards of material

lands owned by Coors, but laying outside of the City of Wheat Ridge.
A relatively small amount of wet material from Lake B-3 will be spread on the IS-Acre
Parcel for drying. That material will either be spread and incorporated in place, or
relocated to the 40-Acre Parcel after drying. In either case, the disturbed area on the 15-
Acre Parcel will be reseeded.
Our goal is to complete removal of the material from the floor of Lake B-3 and placement
of that material to reclaim the 40-Acre Parcel prior to the time oflarge Clear Creek
stream flows this year. Those high volume flows occur from early June through July.
Given the volume of material to be moved and the timing of peak stream flows, which
will allow us to refill the Lake B-3 this summer, we desire to run 7 days a week
beginning immediately until completion ofthe earth fill project in early July.
We anticipate Sunday operations hours to be from 9 AM through 7 PM. On other days of
the week we will continue to operate under the hours contained in the original SUP,
which are from 7 AM to 9 PM. The machines which will accomplish the material
transportation are off-road, heavy construction scrappers and trucks, with graders, dozers
and compactors completing the material placement.
As a matter of information, the 40-Acre Parcel is bounded on the north by Colorado
Highway 58. North of that roadway lay several small-lot industrial properties. To the
east and south are properties owned by Jefferson County and Cabela's. The County
property is vacant, containing stockpiles of recycle concrete and asphalt. The County
property hosts the Table Mountain Animal Center, which lays about 800 feet east of the
40-Acre Parcel. The Cabela's property is also vacant. To the west lays a railroad track,
beyond which is vacant property owned by Coors.
The construction traffic will cross the Clear Creek trail,just west of the trails bridge
crossing of Clear Creek. A traffic control plan has been approved by Jefferson County
Open Space concerning this trail crossing. The plan consists of signage on both the trail
and haul road. Flag people are on hand to halt trail traffic when off-road equipment
crosses the path. This system was in place during the latter half of 2005 when similar
traffic situations existed.
After the hauling of earth to the 40-Acre and 15-Arce Parcels is complete by early July,
Sunday operations will be suspended.
I am discussing this matter with Cabela's Retail, Inc. 1 will be endeavoring to have them
send you a letter indicating their consent to make this request to amend the SUP.
