Please be advised that at its meeting of June 22, 2006, the Board of Adjustment APPROVED
your request for a variance of 5 feet from the 10-foot side yard setback requirement resulting in a 5-foot side
yard setback and a variance of 5 feet from the 10-foot rear yard setback requirement resulting in a 5-foot rear
yard setback for property zoned Residential One B and located at 3892 Nelson Street for the following reasons:
I. Compliance with 10-foot side and rear yard setbacks would result in difficult turning
movements into the garage for vehicles if the garage were placed in the location shown on
the site plan.
2. Alternative placement would eliminate a significant portion of usable backyard space for
the property owner.
3. The request is consistent with the existing conditions in the surrounding area, as the
majority of the detached garages in the vicinity were constructed under prior regulations,
specifically a 5-foot side and rear yard setback requirement.
4. Multiple property owners in the vicinity have signed a petition in support of the request.
Enclosed is a copy of the Certificate of Resolution, as well as a draft copy of the minutes, stating the Board's
decision which became effective the date of the meeting, June 22, 2006. This variance shall automatically
expire within one hundred eighty (180) days of the date it was granted, December 19, 2006, unless a building
permit has been obtained.

the following Resolution was duly adopted in the City of Wheat Ridge, County of Jefferson,

WHEREAS, Board of Adjustment Application Case No. W A-06-08 is an appeal to this Board
from the decision of an administrative officer; and
WHEREAS, the applicant was denied permission by an administrative officer; and
WHEREAS, the property has been posted the fifteen days required by law, and in recognition
that there WERE NO protests registered against it; and
NOW, THEREFORE, BE IT RESOLVED that Board of Adjustment Application Case No.
W A-06-08 be, and hereby is, APPROVED.
WHEREAS, the relief applied for may be granted without detriment to the public welfare and
without substantially impairing the intent and purpose of the regulations governing the City of
Wheat Ridge.

The following is the official set of Board of Adjustment minutes for the public hearing of
June 22, 2006. A set of these minutes is retained both in the office of the City Clerk and
in the Community Development Department of the City QfWheat Ridge.

There were no individuals present who wished to address the Board.

Case No. W A-06-08: An application filed by Walter Mackie for approval
of a 5-foot side yard setback variance from the 10-foot side yard setback
requirement resulting in a 5-foot side yard setback and a 5-foot rear yard
setback variance from the 10- foot rear yard setback requirement resulting
in a 5- foot rear yard setback for property zoned Residential One B and
located at 3892 Nelson Street.
The case was presented by J effHirt. He entered all pertinent documents into the
record and advised the Board there was jurisdiction to hear the case. He reviewed
the staff report and digital presentation. Staff recommended approval for reasons
and with conditions as outlined in the staffreport.

Mr. Mackie, the applicant, was sworn in by Chair BELL. He stated that he would
like to build a freestanding garage in the back yard and be able to get comfortably
in and out.

Board Member ABBOTT asked why the neighbor to the back of his property
didn't sign the petition. Mr. Mackie stated that there was a death in the family of
the owner of the property and he was unable to contact them. He had adequate
signatures on the petition and did not approach the neighbors across the street.
There was also a language barrier issue with those neighbors.
Upon a motion by Board Member BLAIR and second by Board Member
REINHART, the following resolution was stated:
Whereas, the applicant was denied permission by an administrative officer;

All notification and posting requirements have been met; therefore, there is jurisdiction to hear this case.
I. REQUEST
The property in question is located at 3892 Nelson Street, and is approximately .14 acres in size
S:&-yjj. The property has Residential-One B (R-IB) zoning and currently has a single family residential
structure on it.
The applicant, Walter Mackie, is requesting this variance as the property owner ~~~~';;gIi~.
The request is for approval of 5 foot side and rear yard setback variances from the 10 foot side and rear yard
setback requirements resulting in 5 foot side and rear yard setbacks for the purposes of constructing a detached
garage.
The development standards for detached garages in the R-IB zone district can be summarized as follows:
o Front Yard Setback: 30 feet
o Side Yard Setback: 5 feet if the structure is less than 8 feet in height; 10 feet if the structure is
greater than 8 feet in height.
oRear Yard Setback: 5 feet ifthe structure is less than 8 feet in height; 10 feet if the structure is
greater than 8 feet in height,
The applicant is proposing a detached garage setback 5 feet from both the side (south) and the rear
property lines. The detached garage is approximately 22 feet wide by 20 feet deep (440 square feet)
~~~~~~.
II. CASE ANALYSIS
The property is 7,585 square feet in size, or .14 acres. The property measures 63.85 feet wide with a depth of
118.8 feet. The property currently has a single family residential structure on it of approximately 1008 square
feet in size.
The applicant has expressed that conforming to the required 10 foot side and rear yard setbacks would be
problematic because of turning radii given the location of the house and the size of the lot. The applicant has
also expressed that allowance for the garage with 5 foot setbacks would be consistent with the existing built
environment in the neighborhood, as this particular regulation for 10 foot setbacks compared to 5 foot setbacks
was enacted recently.
It is correct that in 2003, the setback requirement which is applicable to this variance was changed. Prior to the
current regulation, adopted by City Council in 2003, the setback requirement was 5 feet in the R-IB zone
district for detached garages, regardless of height. Therefore the proposed garage would have been allowed
under the previous setback requirements.
The applicant is also proposing a standard sized two car detached garage. A typical dimension for a two car
garage is 22' X 22'. The proposed garage will be 22' X 20'.
There appears to be multiple detached garages in the vicinity that are less than 10 feet from either side or rear
property lines _~~~~~lil'l. Two permits found indicate structures built with less than 10
foot side and/or rear yard setbacks. A permit was issued in 1994 for a 1200 square foot detached garage on the
property located at 4000 Nelson Street, with a conforming 5 foot rear yard setback. A permit was also issued
for a 600 square foot detached garage with a 5'6" rear yard setback for the property located at 3862 Nelson

Street. There have been several variance cases in the vicinity of this request, however none were found that
were specifically comparable to this case.
The applicant has also submitted a petition from surrounding property owners in support of the request r~'i!:1m

Analysis and calculations have been done regarding all other development standards with this request, such as
lot coverage requirements and size requirements for detached garages. All other development standards have
been met with this request.
II, VARIANCE CRITERIA
Staff has the following comments regarding the criteria used to evaluate a variance request:
1. Can the property in question yield a reasonable return in use, service or income if permitted to be
used only under the conditions allowed by regulation for the district iu which it is located?
If the request is denied, the property may still receive a reasonable return in use. The property may still be
used as a single-family residence without the need for any variances.
The request would have a minimal on the essential character of the locality. The majority of the physical
improvements done in the vicinity were under prior regulations, specifically a 5 foot rear and side yard
setback requirement prior to 2003. There are multiple detached garages in the vicinity that appear to be
closer than the current 10 foot side and rear yard setbacks, however none immediately adjacent to the
subject property.
2, If the variance were granted, would it alter the essential character of the locality?
3. Does the particular physical surrounding, shape or topographical conditiou of the specific property
involved result in a particular and unique hardship (upon the owner) as distiuguished from a mere
incouveuience if the strict letter of the regulatious were carried out?
There are no unique conditions related to shape or topography that render any portion of the property in
question unbuildable.
4. Has the alleged difficulty or hardship been created by any person presently having an interest in the
property?
The applicant has created his own hardship by requesting a garage in this location. There may be other
alternatives for placement of the garage to be more in compliance with setback requirements.
5. Would the granting of the variance be detrimental to the public welfare or injurious to other
property or improvements in the neighborhood in which the property is located, by, among other
things, impairing the adequate supply of light and air to adjacent property, substantially increasing
the congestion in public streets or increasing the danger of fire or endangering the public safety, or
substantially diminishing or impairing property values within the neighborhood?
Approval of the variance would not be detrimental to the public welfare or injurious to other property in
the area. There may be a slight decrease in the supply of light and air to the properties to the east and
south, given that approval of the variance would result in a structure closer to the property lines than is
allowed under current development standards. The request would not substantially increase the
congestion in public streets, increase the danger of fire or endanger the public safety. Property values
should not be impacted as a result of this request.

6. If criteria 1 through 5 are fouud, theu, would the granting of the variauce result in a benefit or
contribution to the ueighborhood or the community, as distinguished from au iudividual beuefit on
the part of the applicant, or would granting of the variauce result iu a reasouable accommodation
of a person with disabilities?
The request would not result in a substantial benefit or contribution to the neighborhood distinguished
from an individual benefit on the part of the applicant.
The request would not result in a reasonable accommodation of a person with disabilities.
m. STAFF CONCLUSIONS AND RECOMMENDATIONS
Upon review of the above request, staff concludes that the above criteria are supportive of the variance request.
Staff has found that there are unique circumstances attributed to these requests that would warrant approval of a
variance. Therefore, staff recommends APPROVAL for the following reasons:
I) Compliance with 10 foot side and rear yard setbacks would result in difficult turning movements into
the garage for vehicles if the garage were placed in the location shown on the site plan.
2) Alternative placement would eliminate a significant portion of usable backyard space for the property
owner.
3) The request is consistent with the existing conditions in the surrounding area, as the majority of the
detached garages in the vicinity were constructed under prior regulations, specifically a 5 foot side and
rear yard setback requirement.
4) Multiple property owners in the vicinity have signed a petition in support of the request.

I would like to request a variance in lot setback from 10ft.
to 5 ft. to build a 2 car garage, 22 ft. wide by 20 ft. deep.
When I bought the house in 2001 the setback was 5 ft.
Under the current setback of 10 ft., It would be extremely
Difficult to turn into the proposed garage from the existing
Driveway, as there is a support post holding up the comer
of the patio.
