The case was presented by Travis Crane. He entered all pertinent documents into the record and advised the Board there was jurisdiction to hear the case. He reviewed the staff report and digital presentation, Staff recommended approval for reasons outlined in the staff report, In response to a question from Board Member DRDA, Travis Crane explained that the variance, if granted, would be specific to the greenhouse structure only, Those individuals wishing to speak regarding this case stood at this time and were sworn in by Chair BELL, Board of Adjustment September 28, 2006 - 1 - DRAFT Barbara Shively 9653 Meade Ct., Westminster Ms. Shively was appearing on behalf of the applicant, her brother Mark, who is unable to speak for himself due to effects of a stroke, She stated that her brother would like to have a greenhouse on his property. The greenhouse would be wheelchair accessible and built oflumber with translucent sides, The sides could easily be removed, if necessary, for access to any easements on the property. Board Member REINHART asked why the greenhouse could not be built 10-14 feet straight east of the proposed location resulting in a smaller variance. Travis Crane explained that the existing garage would hinder the eastern side of the greenhouse. Ms. Shively stated that building the greenhouse 10-14 feet further east would prevent any sunlight to the greenhouse until about 11 :00 a,m. due to shadows from the garage. Board Member REINHART commented that the greenhouse would be closer to the street than the house directly behind it on Pierce. Travis Crane explained that the house does not meet the 30-foot setback requirement and there is a house on the corner to the north that has the same setback as the proposed greenhouse. Board Member HOVLAND commented that perhaps the greenhouse could be pushed further to the east because neighboring trees would seem to block more sun than the garage. Ms. Shively stated that Mark's calculation for the proposed location was based on his. previous experience with a greenhouse. ' There were no other members of the public who wished to address the case, Chair BELL closed the public testimony portion of the meeting. Board Member REINHART expressed concern about the structure being only 12 feet away from the street. He was in favor of having the greenhouse setback match the setback for the house. Board Member HOVLAND commented that while he would like to see less of a variance, he would not want the request to be denied. Board MemberDRDA favored a variance in the range of 10-12 feet rather than IS feet. Board Member HOWARD stated that he would vote in favor of the variance because the greenhouse would be an asset to the well established neighborhood and the placement would not present a hindrance, Board Member ABBOTT stated that he would vote in favor of the variance because a large portion of the greenhouse would be translucent and set back far Board of Adjustment September 2S, 2006 -2- DR....A'..!!""T -7': " t' enough that it would not be obtrusive to the neighborhood. He also expressed his trust of the applicant's experience with greenhouses and his judgment that this location is the only one that would work. He could find no rationale to move the location of the greenhouse further east. Board Member BLAIR stated that he would vote in favor ofthe variance because . he felt it would fit in with the neighborhood. Further, several neighbors indicated they were in favor ofthe variance. Board Member BELL asked about setbacks for other houses in the neighborhood. Travis Crane replied that not all of the primary structures in the neighborhood have 30-foot setbacks. Board Member BELL stated that she would vote for the variance because it is not too far off from the setbacks down the street and the neighbors support the variance. Further, the applicant is experienced with greenhouses and has determined this to be the only practical location. Upon a motion by Board Member ABBOTT and second by Board Member BLAIR the following resolution was stated: Whereas, the applicant was denied permission by an administrative officer; and . REQUEST The applicant is requesting approval of an 18- foot side yard setback variance for a greenhouse, resulting in a 12 foot side yard setback (Exhibit 1, Letter of Request). II. CASE ANALYSIS The property is 9,588 square feet in size, has a rectangular shape, and contains an existing single family structure. The property is located on the corner of West 44th Place and Pierce Street. The applicant wishes to construct a 192 square foot greenhouse 12 feet from the western property line (Exhibit 2, Site Plan). The R-2 zone district requires a minimum front yard (southern property line) setback of30 feet, a minimum 5-foot rear yard setback and a minimum 5- foot side (eastern property line) setback. Because the western property line is adjacent to Pierce Street, a 30 foot side yard setback is required. The site contains an existing 1,161 square foot house and a 480 square foot detached garage. The R-2 zone district allows a maximum lot coverage of 40%. Based on a lot size of9,588 square feet, 3,835.2 square feet of structures are allowed. The Zoning Code does not specify a maximum size for a greenhouse; however staff has determined that the greenhouse functions much like a shed. Therefore, the structure may be 400 square feet in size and 10 feet tall. The applicant is proposing a 192 square foot greenhouse which will be 8 feet talL The greenhouse will comply with all other standards outlined in Article II of the Zoning Code. The applicant would like to locate the greenhouse 12 feet from the western property line to capture direct sunlight. The existing detached garage is located in the northeastern comer of the property. Given the angle of the sun, it is difficult if not impossible to locate the greenhouse in a conforming location to capture natural sunlight. An existing tree is located in the southwest corner of the lot which further restricts direct sunlight to the property. Simply put, the greenhouse would not fully function if it were located in a conforming location. A letter of support has been included as Exhibit 3. III. V ARlANCE CRlTERlA Staffhas the following criteria to evaluate variance requests: 1. Can the property in question yield a reasonable return in use, service or income if permitted to be used only under the conditions allowed by regulation for the district in which it is located? If the request were denied, the property can yield a return in use. The property currently contains an existing single-family structure, and this use may remain regardless ofthe outcome of the variance request. The applicant would not be able to locate a functioning greenhouse on the property if the request were denied. 2. If the variance were granted, would it alter the essential character of the locality? If the request were granted, the character of the locality would not be altered. It appears that there are some existing primary structures which do not meet the minimum 5-foot side yard setback. Additionally, there appear to be a few structures located on corner lots Board of Adjustment W A-06-14/Shively 2 which do not meet the required 30-foot side yard setback. The proposed greenhouse would be 8 feet tall, and should not be out of character with the neighborhood. 3. Does the particular physical surrounding, shape or topographical condition of the specific property involved result in a particular and unique hardship (upon the owner) as distinguished from a mere inconvenience if the strict letter of the regulations were carried out? While rectangular in shape, the property does have public right-of-way located on the southern and western property lines. Any structure located adjacent to right-of-way must have a minimum setback of30 feet. rfthis lot were not located on a comer, only as-foot setback would be required on the western property line. 4. Has the alleged difficulty or hardship been created by any person presently having an interest in the property? A person who has interest in the property has not caused the hardship. The applicant wishes to construct a greenhouse, which is dependant on direct sunlight. There is a very small window on this property to construct a conforming structure. Unfortunately, this small area does not receive direct sunlight, given the existing structures and mature landscaping. If the applicant were to construct the greenhouse in a conforming location, the greenhouse would not be fully functionaL s. Would the granting ofthe variance be detrimental to the public welfare or injurious to other property or improvements in the neighborhood in which the property is located, by, among other things, impairing the adequate supply of light and air to adjacent property, substantially increasing the congestion in public streets or increasing the danger of fire or endangering the public safety, or substantially diminishing or impairing property values within the neighborhood? The request would not be detrimental to the public welfare. The adequate supply oflight and air would not be compromised as a result of the request. The request would not increase congestion in the streets, nor increase the danger of fire. The request would most likely not have an effect on property values in the neighborhood. The greenhouse would not cause an obstruction to motorists on the adjacent streets, not would it impede the sight distance triangle. 6. If criteria 1 through 5 are found, then, would the granting of the variance result in a benefit or contribution to the neighborhood or the community, as distinguished from an individual benefit on the part of the applicant, or would granting of the variance result in a reasonable accommodation of a person with disabilities? The request would not result a benefit or contribution to the neighborhood, only the property owner. The request would result in a reasonable accommodation of a person with disabilities, as the applicant is confined to a wheelchair. Board of Adjustment W A-06-14/Shively 3 IV. STAFF CONCLUSION & RECOMMENDED MOTION (S) Staff concludes that the hardship has not been created by the property owner, and that unique circumstances warrant the approval of the variance request. Upon review of the above request, staff concludes that the criteria are supportive of the request. Therefore, staff recommends APPROVAL for the following reasons: 1. There are limited options to place a functional greenhouse in a conforming location on the property. Existing structures and large mature trees obstruct the supply of direct sunlight to many areas on the property. 2. The hardship has not been caused by the applicant. 3. The proposed greenhouse will not be out of character with the neighborhood. I am requesting the variance on behalf of my disabled brother, Mark Shively, the homeowner. Mark suffered a stroke three years ago and is confined to a wheelchair. He is paralyzed on his right side and has an amputated left foot. The stroke also left him with aphasia, meaning he is unable to speak or write on his own behalf. We are requesting the setback variance to build a small greenhouse in his side yard. Gardening is an important part of Mark's life and the greenhouse will enable him to continue his pursuits in his current condition. It is important for Mark's physical and psychological wellbeing. The greenhouse will be l6'Wxl2'Dx8'H and handicapped accessible. We need a setback variance of 12' instead of the standard 30' to position the greenhouse to take maximum advantage of sun angles while accommodating the existing detached garage, mature trees in the yard, and handicap accessibility.
