On March 22, 2007, the Wheat Ridge Rotary Club was granted a variance by the Board of Adjustment to allow a
semi-public sign on the recreation center site announcing the Club's meeting date and time. The current
ordinance allows two semi-public signs. With the variance, the rotary will have three.
A condition of the BOA approval was that the Rotary Club approach City Council to consider allowing additional
semi-public signs. More specifically, that "The Rotary Club will approach city council to consider modifying this
ordinance toward the benefit of all other organizations affected by this ordinance".
This letter is intended to fulfill the condition of approval. Therefore, we would encourage City Council to consider
increasing the permitted number of semi-public signs from two to three.

Please be advised that at its meeting of March 22,2007, the Board of Adjustment APPROVED your
request for a variance to Section 26-709,K.2 (semi-public signs) to allow an additional semi-public
sign on property zoned Commercial-One and located at 4005 Kipling Street for the following reasons:
1. The proposed semi -public sign will not impact the essential character of the neighborhood.
2. Granting ofthe variance would not be detrimental to the public welfare or injurious to other
properties or improvements in the neighborhood.
3. The additional sign would not impact the adequate supply oflight and air to adjacent
properties and would not increase the chance of fire or endanger the public safety.
4. There may be a benefit to the applicant and the community due to increased exposure for a
Wheat Ridge service club.
5. Toward recommendations from the NRS, this sign may promote additional civic involvement.
6. The request was approved by the planning staff and a letter of permission was submitted by
the city as property owner.
With the following condition:
1. The Rotary Club will approach city council to consider modifying this ordinance toward the
benefit of all other organizations affected by this ordinance.
Enclosed is a copy of the Certificate of Resolution, as well as a draft copy of the minutes, stating the
Board's decision which became effective the date ofthe meeting, March 22, 2007. This variance
shall automatically expire within one hundred eighty (180) days of the date it was granted, September
18, 2007, unless a building permit has been obtained.

1. CALL THE MEETING TO ORDER
The regular meeting of the Wheat Ridge Board of Adjustment was called to
order by Chair BELL at 7:00 p.m. in the City Council Chambers of the
Municipal Building, 7500 West 29th Avenue, Wheat Colorado.

documen to the record and advised the Board there was jurisdiction to hear
the case. "She reviewed the staff report and digital presentation. City code
allows two signs per activity. Since there are going to be two mu1ti-
organizational signs at the entrances ofthe city on Wadsworth which will
include the Rotary Club's name, a variance is necessary to allow a third sign.
Staff recommended approval of the variance for reasons outlined in the staff
report.
Board Member ABBOTT commented that the unique thing about the subject
sign is that it would indicate where and at what time the Rotary Club meets,

Board Member HOVLAND commented that since there are signs at the north
and south ends of the city, it might open the door for other organizations to
request signs.

Mr. Pettit was sworn in by Chair BELL. He showed the two proposed signs,
The first was a round IS-inch Rotary Club sign with the second being a
smaller rectangular sign indicating meeting place and time, Mr. Pettit stated
that the Rotary Club will pay for the sign and the instal!;:ttion. He stated that
Joyce Manwaring, Director of Parks and Recreatiol},,:!fas"Written a letter
stating she has no objection to the sign being p1as.~!'Il.\m the northeast comer of
the recreation center property.
Board Member ABBOTT commented t1l~tj,theClnly uniq 't)1ation is that the

Mr. Pettit stated that there is a unique sit iththe Rotary Club in that it

Board Member BLAIR stated that he would support a motion to approve the
variance. He could see no problem with placing a sign on that stretch of

Upon a motion by Board Member ABBOTT and second by Board
Member LINKER, the following resolution was stated:

JURISDICTION:
The property is within the City of Wheat Ridge, and all notification and posting requirements have been
met, therefore, there is jurisdiction to hear this case.
I. REQUEST /EXISTING CONDITIONS
The City of Wheat Ridge has been approached by the Wheat Ridge Rotary Club to erect three
signs announcing the date and time oftheir meetings. The Wheat Ridge Rotary Club is a service
organization that meets each Wednesday at the City's recreation center at 4005 Kipling. (Exhibit
1, Rotary PampWet)
This type of sign is classified as a semi-public sign. Per the definitions section in the sign code,
a semi-public sign is described as follows: "A sign giving information as to church location,
educational institutions or service club locations." The following are the specific regulations for
semi-public signs as detailed in Section 26-709.K. ofthe zoning and development code:
. Maximum area: six square feet per sign.
. Maximum number: two per activity.
. May be located off-premises with approval of the property owner.
. May be located within public right-of-way if approved by either the city public works
director, if a city street, and by an appropriate State of Colorado official, if a state
highway; provided, however, that such proposed sign will not pose a potential hazard to
motorists or pedestrians and that such signs will not block then view of any official
public streets.
The proposed signs would be located at "entrances" to the City on Wadsworth Blvd. north ofW.
48th Avenue near the Johnson Park entrance and on Wadsworth north of 26th Avenue on the
Wheat Ridge municipal building property (7500 W. 29th Avenue). Placement ofthe signs would
be on private property owned by the City of Wheat Ridge. A third sign is being proposed on the
City of Wheat Ridge recreation center site. Because this will exceed the maximum oftwo signs
per activity, a variance to allow the additional sign is required.
The proposed sign will encompass a total of 3.3 7 square feet combined (Exhibit 2, Sign plan) and will
be located 50' south of the north property line of the rec center property behind the sidewalk on Kipling
Street (Exhibit 3, Site plan). The Director Parks and Recreation supports the application (Exhibit 4,
Manwaring letter).
The recreation center site is comprised of 11 acres. The center which opened in 2000 is 70,000 s.f. in
size. The primary recreation building and "bam" are located in the middle of the site with a large
drainage pond on the south and facility parking and a football practice field to the north. The sign will
be located adjacent to the northerly parking area.
There is one freestanding sign (monument sign) for the rec center located between the two entrances on
Kipling Street. The proposed semi-public sign will not count toward the allowed signage for the
recreation center.

II. ADJACENT PROPERTIES AND ZONING
The property is abutted on the north by a kitchen remodeling business zoned RC. Cambridge
Park Planned Residential Development abuts the rec center property to the west and is over 500'
away from the proposed sign. Across Kipling to the east are the Lena Gulch open space
improvements as the gulch approaches the confluence with Clear Creek to the north.
Staffhas the following comments regarding the criteria used to evaluate a variance request:
III. VARIANCE CRITERIA
1. Can the property in question yield a reasonable return in use, service or income if
permitted to be used only under the conditions allowed by regulation for the district
in which it is located?
If the request is denied, the property may still receive a reasonable return in use. The
property is currently being used as the municipal recreation center, the use of which may
continue if the sign variance is denied. The applicant believes that the sign on the rec
center site will increase exposure and possibly membership to the club.
2. If the variance were granted, would it alter the essential character of the locality?
The proposed semi-public sign will not impact the essential character ofthe area. There
are numerous commercial freestanding signs to the north and south of the recreation
center property. There are no other semi-public signs on Kipling Street in this vicinity.
3. Does the particular physical surrounding, shape or topographical condition of the
specific property involved result in a particular and unique hardship (upon the
owner) as distinguished from a mere inconvenience if the strict letter of the
regulations were carried out?
No, the lot is question has a typical rectangular shape and is relatively flat.
4. Has the alleged difficulty or hardship been created by any person presently having
an interest in the property?
The hardship is based on the two sign limitation for semi-public signs in the sign code.
S. Would the granting of the variance be detrimental to the public welfare or injurious
to other property or improvements in the neighborhood in which the property is
located, by, among other things, impairing the adequate supply of light and air to
adjacent property, substantially increasing the congestion in public streets or
increasing the danger of fire or endangering the public safety, or substantially
diminishing or impairing property values within the neighborhood?

Granting of the variance would not be detrimental to the public welfare or injurious to
other properties or improvements in the neighborhood. The additional sign would not
impact the adequate supply of light and air to adjacent properties, and would not increase
the chance of fue or endanger the public safety.
6. If criteria 1 through 5 are found, then, would the granting of the variance result in a
benefit or contribution to the neighborhood or the community, as distinguished
from an individual benefit on the part of the applicant, or would granting of the
variance result in a reasonable accommodation of a person with disabilities?
The requested variance would not result in an individual benefit for the property owner.
There may be a benefit to the applicant and the community due to exposure and possible
increase in membership for the Wheat Ridge Rotary club. Approval of the variance
would not result in the accommodation of a person with disabilities.
IV. STAFF CONCLUSIONS AND RECOMMENDATIONS
Upon review of the request, staff concludes that the above criteria are supportive of the variance
to Section 26-709.K. to allow an additional semi-public sign at 4005 Kipling Street. Therefore,
staff recommends approval for the following reasons:
1. The proposed semi-public sign will not impact the essential character ofthe area.
2. Granting of the variance would not be detrimental to the public welfare or
injurious to other properties or improvements in the neighborhood.
3. The additional sign would not impact the adequate supply of light and air to
adjacent properties, would not increase the chance of fire or endanger the public
safety.
4. There may be a benefit to the applicant and the community due to increased
exposure for the Wheat Ridge Rotary club.

Dear Mr. Pettit and Dr. Trefz:
In mid-December I was approached by Mr. Pettit regarding the erection of signs advertising the
meeting time and place for the Wheat Ridge Rotary. He produced a sample of the signage
which was comprised of two parts: a round emblem measuring 18 inches across and a
rectangular sign measuring 24" by 8". Mr. Pettit indicated that the Rotary wanted to erect at
least 12 of these signs, all of which would be located at major intersection gateways into the city
(38th and Sheridan, 48th and Wadsworth, etc).
This type of sign is designated as a semi-public sign. Per our definitions section in the sign code,
a semi-public sign is defined as follows: "A sign giving information as to church location,
educational institutions or service club locations." The following are the specific regulations for
semi-public signs:
. Maximum area: six square feet per sign.
. Maximum number: two per activity.
. May be located off-premises with approval of the property owner.
. May be located within public right-of-way if approved by either the city public works
director, if a city street, and by an appropriate State of Colorado official, if a state
highway; provided, however, that such proposed sign will not pose a potential hazard to
motorists or pedestrians and that such signs will not block then view of any official
public streets.
The signs being proposed by the Wheat Ridge Rotary measure a total of 3.1 square feet; the
circle portion containing 1.77 square feet and the rectangular portion measuring to 1.3 square
feet. 'Based on these figures, it appears that size is not a problem. However, your proposal
exceeds the two sign maximum per activity. It may be possible to pursue a variance to this
standard. Attached is a copy of the variance package.
Another complication is that most of the major streets coming into Wheat Ridge are state
highways, requiring the approval ofCDOT to place the signs in their rights-of-way. Staff has no
indication how CDOT will react to such a proposal. The signs can be located on private

property, with the property owners' permission. Permits are not required for the erection of the
signs, but staff would like to coordinate with you prior to the signs being put up.
