I. REQUEST
The property in question is located at 3261 Routt Street and has Residential One (R-I) zoning.
II. CASE ANALYSIS
The applicant, Duane Chesley, is requesting this variance as the property owner ~m~r~jtM!iW~I~rQ'f

requirement for detached garages over 8 feet in height(1&;~plt1~jf$I,I~~litit. The purpose ofthe
variance request is to allow for the construction of a detached garage of approximately 576 square feet
in the northwest corner of the property. The R-I zone district allows single family uses and accessory
buildings.
Because the requests are for 50 percent variances, they can be approved administratively. All other
development standards have been met with this request.
The property is 15,000 square feet. The property measures 100 feet wide with a depth of 150 feet. The
R -I zone district has a minimum lot size of 12,500 square feet and a minimum lot width of 100 feet.
The property currently has a single family residence on it. There is an existing attached garage on the
north side of the property. The proposed detached garage will utilize the existing driveway which
provides access to the garage already in place and continues along the north side of the existing
structure. The garage is proposed to be sided with lap siding with brick wainscoting consistent with the
architecture of the house. 1J.1m'i]!'!l~J~t~~lji(~~i\lllgt~~[!!R~1 The applicant intends on using the
detached garage for the storage of classic automobiles.
The remainder of the yard is heavily landscaped. Existing planted berm areas would need to be
removed to accommodate a garage with 15' setbacks.
III. VARIANCE CRITERIA
Staff has the following comments regarding the criteria used to evaluate a variance request:
A. The property in question would not yield a reasonable return in use, service or income
if permitted to be used only under the conditions allowed by regulation for the district in
which it is located.
If the request is denied, the property may still receive a reasonable return in use. The property may still be
used as a single family residence without the need for any variances.
B. The variance would not alter the essential character of the locality.

If approved, the request should not have a negative effect on the essential character of the
locality.
C. The applicant is proposing a substantial investment in the property with this
application, which would not be possible without the variance.
If the variances are approved, the applicant would be investing a good deal of money into the
property with construction of a detached garage.
D. The particular physical surrounding, shape or topographical condition of the specific
property involved results in a particular and unique hardship (upon the owner) as
distinguished from a mere inconvenience if the strict letter of the regulations were carried
out.
There are no unique conditions related to shape or topography that render any portion of the
property in question unbuildable. The property is rectangular in shape and flat. There are
limited alternatives for placement of the garage due to existing mature landscaping on the
property.
E. The alleged difficulty or hardship has not been created by any person presently having
an interest in the property.
The applicant has created his own hardship by requesting the variances.
F. The granting of the variance would not be detrimental to the public welfare or injurious
to other property or improvements in the neighborhood in which the property is located,
by, among other things, substantially or permanently impairing the appropriate use or
development of adjacent property, impairing the adequate supply of light and air to
adjacent property, substantially increasing the congestion in public streets or increasing
the danger of fire or endangering the public safety, or substantially diminishing or
impairing property values within the neighborhood.
Approval of the variances would not be detrimental to the public welfare or injurious to other
property in the area. There may be a small decrease in the supply of light and air to adjacent
properties if the variances are approved. The requests would not substantially increase the
congestion in public streets, increase the danger of fire or endanger the public safety. Property
values should not be impacted as a result of this request.
G. The unusual circumstances or conditions necessitating the variance request are present
in the neighborhood and are not unique to the property.
There have been other similar variances granted in the vicinity but no garage setback variances
granted on Routt.
H. Granting of the variance would result in a reasonable accommodation of a person with
disabilities.
Approval of the variances would not result in the accommodation of a person with disabilities.

I. The application is in substantial compliance with the applicable standards set forth in
the Architectural and Site Design Manual.
Low density residential development is not subject to the requirements of the Architectural and
Site Design Manual.
IV. STAFF CONCLUSIONS AND RECOMMENDATIONS
Upon review of the above requests, staff concludes that the above criteria are supportive of the
variances. Therefore, staff recommends APPROVAL for the following reasons:
1. There are limited alternatives for placement of the garage due to the location of mature
landscaping on the property.
3. There will be no negative impact to the public welfare or other properties in the area.
4. The request would not substantially increase the congestion in public streets, increase
the danger of fire or endanger the public safety.
5. There have been no protests submitted during the ten-day public notification period.
With the following condition:
I. The design and architecture of the proposed garage be similar in character to the
existing house as represented in Exhibit 3.

Letter of Request.
Enclosed is my completed Land Use Case Processing Application.
I am requesting an administrative variance of 50% from Section 26 which
will allow me to construct a basic 2-car storage garage in my back yard.
The garage needs to be located in such a manner so that it is both accessible
and enhances the look and character of not only my property but that of the
adjacent neighborhood.

This is to inform you of Case No. W A-07-08, a request for approval of 7.5 foot side yard
and rear yard setback variances from the 15 foot side yard and rear yard setback
requirement to construct a detached two-car garage on property zoned Residential-One
(R-I) and located at 3261 Routt Street.
The applicant is requesting an administrative variance review which allows no more than
a ten percent (10%) variance to be granted by the Zoning Administrator without need for
a public hearing. Prior to the rendering of a decision, all adjacent property owners are
required to be notified of the request by certified mail.

Access Notes
For one and two-family dwellings, the first 25' of driveway area from the existing edge of pavement into the site
shall be surfaced with concrete, asphalt, brick pavers or similar materials.
For all uses other than one and two family dwellings, no vehicle entrances or exits may be closer than 25' to any
property line, except when used as joint access for two or more lots.
In residential zone districts, curb cuts shall be at least 10 feet and not more than 24 feet in width.
One and two-family dwellings may have horseshoe driveways, provided that the street accesses are at least 30 feet
apart, measured from the interior edges.
For all uses, one access point per property is permitted.
