The City of Wheat Ridge was informed sometime in August oF 2000 that the garage was being built with a storage area or second floor. The City made contact with the owner and required him to submit engineering stating the foundation and the second floor are structurally sound. This information was submitted and has been accepted. This change to the plans did not require that an additional permit be issued for this address. This is what the Building Department considers as a structural change, which only requires that additional information be submitted and approved under the original permit. The Cookes have not consulted in good faith with the neighbors in the Protective Covenants for Pazamount Heights. The Cookes violated the terms of their first building permit for a single-story detached garage by actually framing in a two-story detached garage with a planned additional 30 inches. Now I understand they aze requesting a permit for a one and one-half story plus 30 inches detached gazage which is still a problem. I understand from Rep. Moe Keller that I have a legal right of protest if the permit has not been issued yet. As of Sept. 11, 2000 at 9:15 a.m. Mr. Bob Gaspaz informed me the second permit has not been approved. Therefore, please send or call me with the forms and procedures necessary for a legal protest and I ask that no permit be granted until there is a heazing on this matter. I realize the City does not enforce the Covenants but I understand the City is undertaking a study of all building codes to preserve the quality of space and azchitecture in VJheat Ridge. This situation might be a test case to inform your decisions about planning, and I thank you for undertaking this much-needed project. The facts of this situation are: With a permit, the Cookes erected a one-story building in July, 1999, and then in July, 2000, without a permit, they framed in a second level with the intent of adding another 30 inches to the unapproved two-level structure. On Aug. 29, 2000 seventy teachers attending a meeting in my back yard informed me this new building is "illegaP" so I started talking wiYh the Cookes, the City, and the homeowners on Hillside Dr. 2. On Aug. 311 talked face to face with the Cookes in their home and asked them to take down the second story and to paint the structure green or brown or some color compatible with the landscape. Mr. Cooke said he wanted a barn and might paint it red. He reassured me it would be quality workmanship. Mr. Cooke said he couldn't deconstruct the second story becausae he had invested $1500.00 in materials. 3. The main problems are: visual obstruction in a beautiful historic neighborhood; the proposed building violating the 25 foot rule from my lot line as specified in the Covenant the building not being a"detached garage" as there is no driveway; and the structure was never discussed or approved by the Architecture Committee of the Covenant. 4. This visual obstruction will be more pronounced in the fall, winter and spring when leaves are off the trees. On Sept. 6 I offered to pay the Cookes $1500. 00 or the cost of their materials if they would deconstruct the second level. I also suggested they could deconstruct the second level and donate the materials to their favorite chazity for a tax deduction (WR homeless shelter, church etc.). 6. The intended use of the detached garage/"barn" is a first floor storage for old cars and a second floor for a workshop according to Mr. Cooke. The homeowners aze also concerned about possible noise annoyance in violation of the Covenant. 7. Other neighbors on Hillside are worried this structure could set a precedent of other lazge obstnxctions and bad-faith (violating the Covenant) building in the historic district of Pazamount Heights. The neighbors on Hillside Dr. concerned about this aze Betsy Downing, Barbara Walkosz, Ron and Lisa Abo, and Sylvia and Tony Friedrich. All aze concerned about the aesthetic appeal and resale value of our homes if large obstructions are permitted to be constructed. The co-owner of my home (Barbara Nash) and I did not protest the original permit for a single-story workshop as it is a reasonable small building that does not alter the beauty of the landscape. However, since the Cookes have taken an unreasonable step in framing a two-story "barn" plus another 30 inches we must formally protest this action and ask for an examination of the code, zoning and Covenant before any permit is issued.
