Dear Mr. Gault and Mrs. Gault: Thank you for your letter of concern regarding the rainstorm and flooding which occurred on July 16. This letter is a follow up to the phone conversation I had with Mr. Gault on July 26, 2000. In that conversation I had indicated that the city will be taking steps to construct a storm sewer system within the immediate area of the problem. At the July 24' Public Works Advisory Committee meeting, the committee discussed Capital Projects for the coming year. This committee is made up of one City Council member from each of the city's four council districts. We discussed the area of concern and the committee had no problem with moving this forward in the coming year's budget. I am confident that the full City Council will also approve the construction of this project in light of the problems we've experienced recently. We've also spoken with Mr. Kuntz, owner of the vacant lot to the southeast of you, regarding drainage from his site. I've also received more information from you from our phone conversation regarding the drainage from the landscaping rock along 32nd Avenue. The following will occur: Mr. Kuntz has already agreed to construct a wall with a small drainage channel to direct the flows to Oak Street rather than to the west onto your property. The city will construct a sidewalk chase to direct the flows under the walk and to the gutter on Oak Street. The flow will then go north to the existing storm sewer at the north end of Oak Street. We will also have Mr. Kuntz provide a silt fence where appropriate for the time being. We will construct a diversion structure on 32nd Avenue to divert flows which accumulate along the brick fence on the north side of 32nd Avenue into the gutter of 32"d Avenue so that flows will not enter the driveway at the property directly south of you. We will construct a storm sewer extension from an existing system which presently terminates at Parfet Street approximately 300 feet north of 32"d Avenue. A contributing factor to the ponding in the Cressman driveway i5 the flow of storm wateralong W. 32' Street and then down her driveway. Addidonal attendees included Michael Gazcia (Development Review Engineer) and Damien from R.A. Frank Constructioq Inc. As we discussed, issues of concem for the Ciry of Wheat Ridge include a reported belief tLat the recently constructed swale was improperly located such that it would not provide drainage to the northeast comer of 10825 West 32nd Avenue. Issues of concern for the Gault family include a firm belief that 3231 Oak cannot handle the amount of s[ormwater conveyed to it from: • 10825 Wes[ 32nd Avenne (13,000 ft2) • 3211 Oak Street (12,813 ft2 of currently undeveloped land); and • the Ciry's easement along 32nd Avenue from Nelson flowing to 10825 West 32nd Avenue and down the asphal[ driveway This belief is based upon the amount of s[ormwater conveyed to the beckyard and basement at 3231 Oak Sueet from the storm event on July 16, 2000. The amount of water conveyed to the properly from this storm event also indicate that the analysis and cerdfication of the werlot grading and road construction provided to the City of Wheat Ridge by R&R Engineers (May 19, 1996) is seriously flawed and wrrective actions beyond a simple swale relocation must be completed. Failure to do so will most certainly result in basement flooding and properly damage. In my July 1 Sth, telephone conversation with you, you characterized the rain fall on July 16 as a"5-year" storm event. This essentially means that the basement of 3231 Oak SVeet stands a 20 percent chance of being flooded evety year. I think that you would agree that if your house faced such odds you tao would ckmand corrective action. Based on my observations, the amount of water comeyed to the backyard and basement suggest that the swale was functioning as intended and substantiate ow claim that ffie grading plan is flawed. During the July 20th meeting I asked several questions, some were answered, some were not. These ques[ions included: • When will the Ciry begin work to eliminate the drainage from the 32nd Avenue easement? • Dces the Ciry's stormwater and flood cades prottibit the conveyance of stormwater to private propenies/residences? • Does We Ciry's stormwater and flood codes cequire that the City Manager update the plans for t6e city, including s[ormwater drainage facilities? • Were stormwater easements and drainage faciliUes included in the original plan for the development as approved by the City? • If these facilities were originally included, why was the developer allowed to omit them from the development7 • If these facilities were not included in the original submittal, why did the City not require stormwater drainage? • What methods did the City use to verify the estimated stormwater conveyance to the "Collec[ion basin" prior to approval of the grading plan? • Did the analysis performed by the developer, which was subsequently apprwed by the city, consider the shallow watertable present in the area? • Now that the City has Imowledge that the analysis and certificarion are most likely flawed, what actions will be taken by the City to correct problems that exis[? • The majoriry of the rain gutters for the roof on 10825 West 32nd Avenue drain to the faz northeas[ corner of the properiy via the asphalt driveway. What obligaUons do individual homeowners have for mitigating stormwater pooling on their own property? • Does the City have specifications for dry wells that are in compliance with Colorado Department of Public Health and Environment and U. S. Environmental Protection Agency rules for communicating stormwater to shallow aquifers? • Will the City require silt fences atong the western exposure of 3211 Oak Street so that the relocated swale will not be clogged? I would like written responses to each of t6ese ques[ions as soon as possible as each has a bearing on protec[ing the 3231 Oak Street. Additlonally, I would like to request copies of the original submittals from the developer (or agents of the developer), relevant correspondence to and from the Ciry relative to the stormwater drainage facilities, resiilts of permeation and/or percolation tests, and azry analysis pecformed by either party relative to stormwater drainage in the development. In closing, I would like to point out that in developing 3231 Oak Street my Mother has worked diligeMly to meet or exceed the City's specifications. I would also like ro reiterate that tttis issue is bigger than jus[ the requested swale relocaUon and that a comprehensive review of the current stormwater drainage conditions in the development must be performed by a qualified and impartial entlty. Failure to do so may jeopardize 3231 Oak Street and additional properties within the comeyance described by the developer and approved by the City. If mistakes were made in the past, it does not mean that they cannot be fixed in the present. If the swale is to be relocated, then we are requesdng that the final acceptance issued by the City be in writing and clearly state that Hll conditions have been mei and no fur[her work will be required. (Address: 3231 Oak Street•) Dear Mr. & Mrs. Gault: As requested, we conducted a soil and foundatirnn investigation at the subject site on August 8, 1998. The foundation investigation was performed by drilling two test botings to depths of 30'-0" and 12'-0" witlun the planned construction area. Th¢ locaHons of the test bonings and the logs oE subsurface materiais are enc(osed. The discussion and cecommendations presented below are based on the results oE data gathered duting the site investigation, observation of general field conditions, and previous experience in the ama with similar materials. As we uaderstand, a conventional wood-hame residence will be built at the site. The proposed structure is planned to contain a basement level and an attached gazage. Accoxdingly, the foundation excavation will probabiq range in depth from about 3 feet to about 8 feet below the existing ground surface, Foundation Ioadings for the proposed structue should be telatively light. 'Fhe site of the proposed construction is a sioping lot in a residential area. The structure will be built over the aiea of our two foundatian test botings, whose locations are shown on Figure 1. In addition, Field Penetration Tests were performed at selected depths to assist in evaluating the allowable bearing value of the soils and to provide undisturbed samples for precise examination and for testing in a one-dimensional consolidation unut. Based on the results of the investigation combined with previous exp¢rience with similar subsoil conditions, the most pertinent foundation engineedng characteristics and considerations at the site are as follows: 1. The borings encountered medium to stiff clay soils from groundlevel to a minimum depth ot 6'-6" and to a mattimum depth of 12'-0". Field obsecvationa and laboratory results indicate that somc of these clayey materials have a low to moderate sweli rating. 2. Below the previously described materials, the bofrings encountered claystoine bedrock materfals. Test results indicate that the swe11 properties of the bedrock near and below the deepest portion of the proposed excavation are at least in the medium range. 3. RECOMM~NnATIONS FOR A GRAI?E BEAM AND D IL.LFD P1ER FOt1NDAT10N SYSTEM In view of the geotechnical considerations given above and in order to provide a high safety factor for the foundation system of the propased structure, we xecommend that the structute be founded on an adequately designed system of grade beams and drilled piers. 7he piers should be designed for a maximum ez►d pressure of 15,000 psf, for a side shear of 1,500 psf for the minimum specifred penenation of the piets in bedicock, and foz a minimum dead load pressuRe of 15,000 psf based on the aoss-s¢ctional area of the piers. AU piers should be a minimum of 18 feet in length. In addition, all piecs should penetrate a nninimum distance of 10 feet into the underlying bedrock. In the event that the designer has difficuity obtaining the minimunt dead load pcessure, he can specify that the piers be drilled beyond the mininnum bedrock penetratIon given above and assume that 50 percent of the additional skin friction provided acts in the direction to resist uplih. we recommend that the drilling contractor have a rig with a hole depth capacity of at least 23 feet and a high torque rating capable of penetrating any well cemented bedrock areas. The presence of free water in one of the foundation test borings indicates that casing muld be needed to prevent water infiItration into or caviztg of the pier holes. If the contractor desires to avoid the use of casing in holes which are found to wntain Iess than 3 inches of water at the time of caisson drilling, it may be feasible to do so if the rnncrete and reinEorcement are placed immediately after the drIlling of each hole and if the bottom of each hole is carefully observed to make sure that no disturbed materiats are present, no caving has occurrecL and the conerete is not diluted as it is placed by the presence of the water in the properly cleaned and prepared holes. Atl future owners of the structure should be advised of the presence of the underlying expansive materials, their potentiat detrimental effects to the stntcture, and the need for keeping moisture away from the foundation and slab-on-ground areas. In no event should an automatic sprinkler system be instaUed next to the foundation walls. There should be no watering or 'urigation within 7 feet of the foundarion walls. The ground surface in the area may be lined with a suitable geotextile fabr3c to control plant growth. The area next to the stnicture may then be covered with gravel, bazk chips, oc other materials requiring absolutely no rainfaU or irrigation. The resuits of dte investigation indicate that an underdrain system should be placed during comstiuc6on as a safety measure for all 8oor systems placed below finai exterior grades.
