Effective December 1, 2014, asphalt shingle installations require an approved midroof
inspection, conducted when 25-75 percent of the roof covering is installed, prior to final
approval. Installation of roof sheathing (new or overlay) is required on the entire roof
when spaced or board sheathing with ANY gap exceeding one half inch exists. Sheathing and
mid -roofs may be called in at the same time, one hundred percent of the sheathing must be
complete and 25-75 percent of the mid -roof may be complete. Asphalt shingles are required
to be fastened to the roof deck with a minimum of 6 nails per shingle. Ice and water shield
is required. Eave and rake metal is required. A ladder extending 3 feet above the roof eave
and secured in place is required to be provided for all roof inspections. Roof ventilation
is required to comply with applicable codes and/or manufacturer installation instructions,
whichever is more stringent. In order to pass a final inspection of elastomeric or similar
type roof coverings, a letter of inspection and approval from the manufacturer technical
representative stating that "the application of the roof at (project address) has been
applied in accordance with the installation instruction for (roof material brand name)
roof covering" is required to be on site at the time of final inspection.
Roof inspections for ROOFS OVER 6/12 PITCH: 3rd party inspection will be required, the 3rd
party inspection report will be collected at final roof inspection performed by City of
Wheat Ridge. If report is not available the final inspection will not be completed.

Residential Roofing Permit Application
This application is exclusively for new permits for residential roofs and for licensed
contractors only. This type of permit is ONLY being processed online --do not come
to City Hall to submit an application in person. Permits are processed and issued in
the order they are received and due to the volume of requests, time to process
varies and is subject to change. YOU WILL BE CONTACTED WHEN YOUR
PERMIT IS READY FOR PICK-UP AND WILL BE GIVEN A SPECIFIC DATE
AND TIME WINDOW TO COMPLETE THE TRANSACTION. You will be notified if
your contractor's license or insurance has expired, and you may update those

This agreement is hereby made and entered on 8/7/2017 by and between John & Kristine Briganti hereafter called Homeowner,
and Global Roofing, hereafter called Contractor. The said parties, for the considerations hereinafter mentioned, hereby agree to
the following:
1. The Contractor will install new roof and/or other home repairs at Homeowner's property upon approval of insurance claim
by Homeowner's Insurance Company.
2. The Contractor agrees to provide all of the material and labor required to perform the following work described in this
estimate prepared by Contractor and provided to the Homeowner, which is identified by the signatures of the parties to this
agreement and which form a part of this agreement.
3. The Homeowner hereby agrees to pay the Contractor, for the aforesaid materials and labor, the sum 27,783.77 with initial
insurance check due as down payment prior to the commencement of work. Homeowner shall endorse over all insurance
proceed checks to Contractor, including any supplement or supplemental payments made by the Homeowner's Insurance
Company. Payments made by credit or debit card are subject to a 3% transaction fee. All checks should be made out to Global
Roofing Billing & Supply.
4. If Homeowner's Insurance Company does not approve a complete replacement value roof clairn, this Contract will be null
and void and Homeowner shall owe Contractor nothing. Contractor will consider partial roof replacements on an individual
basis. THE ONLY COST TO HOMEOWNER WILL BE THEIR DEDUCTIBLE, in addition to any non-recoverable
depreciation. Any code upgrades not covered by the Homeowners insurance policy that are required per local building code will
be paid by the homeowner upon job completion.
5. The Contractor agrees to provide and pay for all materials, tools and equipment required for the prosecution and timely
completion of the work. Unless otherwise specified, all materials shall be new and of good quality.
6. In the prosecution of the work, the Contractor shall employ a sufficient number of workers skilled in their trades to suitably
perform the work.
7. The Homeowner, Homeowner's representative, Contractor, and public authorities shall at all times have access to the work.
8. The Homeowner agrees to maintain full insurance on the above-described property during the progress of the work.
9. In the event the Contractor is delayed in the prosecution of the work by acts of God, fire, flood or any other unavoidable

casualties; or by labor strikes, late delivery of materials; or by neglect of the Homeowner; the time for completion of the work
shall be extended for the same period as the delay occasioned by any of the aforementioned causes.
10. The Contractor agrees to obtain insurance to protect himself against claims for property damage, bodily injury or death due
to his performance of this agreement.
11. Neither the Homeowner nor Contractor shall have the right to assign any rights or interest occurring under this agreement
without the written consent of the other.
12. This agreement shall be interpreted under laws of the State of Colorado.
13. Attorney's fees and court costs shall be paid by the defendant in the event that judgment must be, and is, obtained to
enforce this agreement or any breach thereof.
14. All work comes with a five year workmanship warranty upon completion of work. All materials shall be warranted per
manufacturer's guidelines.
15. Outstanding balances are due within 21 days of completion. Inspections are not required to be completed before payment
is due. All late payments are subject to a daily fee of $25. All returned checks will be charged a $50 fee in addition to any bank
charges resulting from returned check.
15. Any installed satellite dishes will need to be adjusted and calibrated by your service provider.

period of one (1) year from date of issue and may be renewed. All fees shall be in accordance with those fees
established by the Uniform Building Code or other applicable City adopted Resolutions or Ordinances.

MINOR EXCAVATION AND FILL PERMITS
1. 1-50 Cubic Yards: No permit is required for dumping or excavation of earth aterials, which do
not exceed 50 cubic yards, provided, however, that any fill deposited is on natural terrein of less
than three 131 horizontal to one (1) vertical slope, or such fill is less than three (3) f2et in depth and
is not intended to support permanent structures, and in addition, such fill or excavation does not
obstruct or otherwise adversely affect any drainageway. Should any of the above standards be
exceeded, or a drainage way be affected, a permit shall be required under the guidelines for No. 2.
2. 51-500 Cubic Yards: Dumping or excavation of earth materials not exceeding 500 cubic yards
may be allowed with a permit approved by the City Engineer. All applications are to be submitted
on the appropriate completed application form and shall be accompanied by the appropriate fee and
sketch plan indicating the following information before the permit will be issued.
A Location and dimensions of all property boundaries and structures on the site.
B Location and extent of areas to be filled and/or excavated.
C. Location of existing and proposed drainageways, irrigation ditches, etc., and indication of
how and where historic run-off will be maintained on and through the site.
D. Cross section area to be filled and/or excavated indicating original slope, new slope and
depth of fill.
E. Statement which indicates the proposed use or purpose for said fill or excavation.
F. Relative elevation of adjacent properties.
G. Erosion control plan showing placement of control devices such as hay bales, etc..

3. 501-20,000 Cubic Yards: Operations in which earth material fill or excavation exceeds 500 cubic
yards but does not exceed 20,000 cubic yards may be allowed by a permit issued by the City
Engineer after review of an application and supporting information. The following information shall
be submitted with the required application form:
A. A site plan, prepared and signed by a Colorado registered professional engineer, at a scale
of no less than 1 inch to twenty feet (1 :20) which illustrates the following:
1. Location an dimensions of all property boundaries and structures on the site.
2. Location and extent of areas to be filled and/or excavated.
3. Location of existing waterways and drainage courses indicating any changes. (for
a site containing an established irrigation ditch, a letter of approval from the
appropriate ditch company shall be required).
4. Location of existing and proposed points of ingress.
5. Location and extent of existing vegetation, proposed changes in such vegetation
and methods of rehabilitation on site vegetation after earthwork operations are
complete.
6. Erosion control plan.
7. Grading plan with existing (dashed lines) and proposed (solid Iines) ground contours
with contour intervals of 2 feet and spot elevations.
8. At least two cross sections (east to west and north to south) through the site
showing depth of fill and/or excavation.
9. A drainage report may be required if site runoff characteristics are changed.
10. Relative elevations of adjacent properties and structures.
11. Statement of purpose of intended fill and/or excavation.
4. Performance Standards: The following provisions shall apply to all Minor Excavation and Fill
Permits:
A. Rehabilitation: Within thirty(30) days after cessation of filling and/or excavation,
rehabilitation for the site shall have been completed in accordance with the approved
plans. Rehabilitation shall consist of leveling, grading, landscaping or any combination
thereof to minimize potential erosion and be acceptable to the City Engineer.
B. Debris: Debris and/or contaminants shali not be used except with the approval of the City
Engineer.
"For the purpose of this Section, the term debris shall have the same meaning as the
terms "garbage, tresh or junk" as defined in the Wheat Ridge Code of Laws, Section 20-
21.,"
In no case shall debris or contaminates identified or classified as hazardous waste by local,
state or federal agencies be used as fill in any fill areas within the City of Wheat Ridge.

C. Excavation and/or fili areas shall be graded to facilitate weed controi until final grades are
set and site rehabilitation and use occur (must be leveled with side slopes not to exceed
3 to 1).

Dear Mr. Carmosino:
As requested, we conducted a soil and foundation investigation at•the subject
site on June 15, 1998. The foundation investigation was performed by drilling
two test borings to depths of 25'-0" and 16'-0' within the planned
construction area. The locations of the test borings and the logs of subsurface
materials are enclosed. The discussion and recommendations presented
below are based on the results of data gathered during the site investigation,
observation of general field conditions, and previous experience in the area
with similar materials.
PROPOSED CnNSTRUCTION
As we understand, a conventional wood-frame residence will be built at the
site. The proposed structure is planned to contain a basement ]evel and an
attached garage. Accordingly, the foundation excavation will probably range
in depth from about 2 feet to about S feet below the ground surface.
Foundation loadings for the proposed structure should be rclatively light.
AGREEMENT OF PURPOSE AND DISCLAIMER
The parties specifically agree and contract that the purpose of this subsurface
investigation is to test, analyze, and report on the condition of the materials
encountered only as these tests pertain to the suitable design and construction
of an appropriate foundation for the proposed building and to determine the
load bearing criteria for the subsurface materials.

SITE AND SUBSOIL CONDITIONS
The site of the proposed construction is a slightly sloping lot in a residential
area.
The structure will be built ovcr the arca of our rivo foundation test borings,
whose locations are shown on Figure 1. Generally speaking, the ground
surface in the area of the structure slopes towards the northwest at about 0 to
3 percent. The existing ground cover consists of weeds and grasses.
Soil conditions in the area of the two test borings are variable with depth
below groundlevel. Foundation Boring #1, which was drilled in the
northwest area of the proposed structure, encountered stiff and moist clays
from groundlevel to a depth of 2'-6"(±); and hard and moist claystone bedrock
materials from 2'-6"(±) to at least 25'-0", the maximum depth explored.
Foundation Boring #2, which was drilled in the southeast area of the
proposed structure, encountered stiff and moist clays from groundlevel to a
depth of 2'-6 and hard and moist claystone bedrock materials from
2'-6"(±) to at least 16'-0". Free groundwater formed in Boring #1 on the date
of the investigation at a depth of 23'-10".
TEST RESULTS AND GEOTECHNICAL CONSIDERATIONS
The subsoils at the site were carefully inspected as the cuttings were recovered
from the test borings, and the resistance of the materials to the advancement
of the drilling augers was noted. In addition, Field Penetration Tests were
performed at selected depths to assist in evaluating the allowable bearing
value of the soils and to provide undisturbed samples for precise
examination and for testing in a one-dimensional consolidation unit.
Based on the results of the investigation combined with previous experience
with similar subsoil conditions, the most pertinent foundation engineering
characteristics and considerations at the site are as follows:
1. The investigation encountered stiff clay soils to a minimum
depth of 2'-6"(±) and to a maximum depth of 2'-6"(±). These
upper soils are low to moderate swelling materials.
2. Hard claystone bedrock materials were encountered immediately
below the upper soils. The geological and geotechnical
characteristics of the shallow claystone bedrock constitute a

serious and potentially damaging foundation condition for
residential construction.
3. As a part of the investigation, relatively undisturbed samples of
the subsurface materials were obtained and tested in the one
dimensiona] swel]-conso]idation device under an initial vertical
pressure of 500 pounds per square foot (psf). A sample of the
claystone bedrock from Boring #1 at a depth of 5'-0" swelled
about 7.7 percent and had a swelling pressure of about 13,000 psf.
Another sample of this material from Boring #1 at a depth of
9'-9" swelled about 9.7 percent and had a swelling pressure of
about 20,000 psf. The bedrock has a high swell rating and can be
very damaging to residential construction in the area unless
applicable countermeasures are used.
4. Whilc a grade beam and dri]]ed pier system can be used to
protect the foundation from the expansive materials at the site,
it will not protect concrete slabs and flatwork from cracking and
heaving if they are constructed as slabs-on-grade bearing on or
above the swelling materials. All floors in which movement
cannot be tolerated should be structurally supported on the
foundation system over an air space.
REGOMMENDATIONS FOR A GRADF BFAM
AND DRILLED PIER FOUNDATION SYSTEM
In view of the geotechnical considerations given above and in order to protect
against the adverse subsurface conditions at the site, we recommend that the
structure be founded on an adequately designed system of grade beams and
drilled piers. The piers should be designed for a maximum end pressure of
20,000 psf, for a side shear of 2,000 psf for the minimum specified penetration
of the piers in competent bedrock, and for a minimum dead load pressure of
20,000 psf based on the cross-sectional area of the piers. All piers should be a
minimum of 18 feet in length. In addition, al] piers should penetrate a
minimum distance of 15 feet into the underlying competent bedrock. Some
of the piers may need to be drilled longer than 18 feet in order to provide the
required bedrock penetration or resistance to uplift. In the event that the
designer has difficulty obtaining the minimum dead load pressure, he can
specify that the piers be drilled beyond the minimum bedrock penetration
given above and assume that 50 percent of the additiona] skin friction
provided acts in the direction to resist uplift. We recommend that the
drilling contractor have a rig with a hole depth capability of at least 25 feet.

The presence of free water in one of the foundation test borings indicates that
casing may be needed to prevent water infiltration into or caving of the pier
holes. If the contractor desires to avoid the use of casing in holes which are
found to contain less than 3 inches of water at the time of caisson drilling, it
may be feasible to do so if the concretc and reinforcement are placed
immediately after the drilling of each hole and if the bottom of each hole is
carefully observed to make sure that no disturbed materials are present, no
caving has occurred, and the concrete is not diluted as it is placed by the
presence of the water in the properly cleaned and prepared holes. If more
than 3 inches of free water is present in the bottoms of the properly cleaned
pier holes, the tremie method should be used for placement of the concrete to
avoid dilution.
Drilled pier foundations are very common in the Denvcr area and are
generally the safest foundation system for lightly loaded structures in
potentially heaving or compressible soils. This support system functions by
having the lower portions of the piers located in a zone of relatively stable
moisture content and by making it possible to load the support points
sufficiently to resist uplift movements.
The following design and construction details should be followed for the
foundation:
1. All piers should have a diameter of 10 inches and should be
reinforced longitudinally with one 5/8-inch rod for each 18
inches of pier perimeter (a minimum of three 5/8-inch Grade 60
rods per pier) to prevent breakagc of the piers due to uplift on
their sides by swelling materials. The upper portions of the piers
should be kept smooth. Care should be taken to avoid
mushrooms, or enlargements, of the piers at the tops.
2. A 6-inch minimum "air space" should be provided between the
portions of the grade beams that span the piers. Great care
should be taken to maintain the integrity of the void forming
material during construction, to prevent it from being damaged
by exposure to moisture or other harmful agents and to prevent
collapsing it during backfilling.
ACTIVE CASE LATERAL EARTH PRESSURES ON FOUNDATIONS
We do not recommend that clayey materials be used as backfill for foundation
walls since they can result in high lateral pressures if they are overcompacted

and if they are wetted and swel] after construction. Conversely, if clayey
materials are placed loosely to prevent them from expanding, thcy may setNe
after construction with associated undesirable consequences including
negative drainage away from foundations. We recommend the use of the
non expansive low permeability structural fill, known as 'granite sand.' As
an option, the most friab]e of the upper soils can be segregated, stockpiled, and
evaluated for use as structural fill behind foundation walls. If the fill is only
lightly to moderately compacted using hand equipment to the extent that it
does not settle after construction, the walls retaining the fill should be
designed for an equivalent active case fluid unit weight of at least 40 pounds
per cubic foot. Care must be taken not to overcompact the backfill or to
operate heavy equipment above the foundation wall backfill since this will
result in excessive earth pressure on foundation walls. Is it also possible that
sandy loam soils from other areas of the subdivision may be obtained and
used for wall backfill.
If the builder uses expansive clayey materials as backfill in spite of the risks,
then the materials should be placed so as to minimize the lateral pressures
that will be exerted on the foundation walls by compaction or subsequent
swelling. Hcavy compaction must not be performed since overcompaction
will not only result in initial excessive earth pressures but will cause the soils
to develop higher swelling pressures if they are wetted. The greatcr the
density of a clay material, the greater will be its swelling characteristics, other
factors bcing equal. For this reason, clay backfill behind foundation walls
should be only lightly compacted by hand equipment to about 85 percent of
standard Proctor density at optimum moisture content. While low densities
are desirable to ]essen lateral pressures on walls, if they are too low the
backfill may settle after construction. Therefore, the desired density is the
lowest density needed to prevent settlement of the backfill after construction.
Walls retaining clayey fill should be designed to withstand lateral forces based
on an equivalent active case fluid unit weight of at least 65 pcf. If swel]ing of
the backfill becomes a factor, extremely high pressures can result which equal
the swelling pressure of the material. Do not puddle the backfill since the
trapped moisture may penetrate underlying expansive materials with time
and result in long term heave of the subgrade.
FOUNDATION REINFORCING
All foundation grade beams must be well reinforced in accordance with the
structural requirements. Refer to the foundation design prepared by the
structural engineer.

As previously documented, the materials expected to be present at or shortly
below the anticipated basement level are expected to have a high swell rating.
Since it is not possible to concentrate enough dead load on floor slabs to
counteract the developed swelling pressures of underlying expansive
materials, we anticipate that any floors constructed as slabs-on-grade on the
natural materials at the site may experience post construction heaving and
cracking upon wetting of the subsoils. We estimate that the post construction
slab uplift could be as great as 4 inches, or more.
Our client should carefully consider the substantial risk that floors
constructed as slabs-on-grade will move and crack upon future wetting of the
subsoils. If slab-on-grade floor construction is used instead of the safe but
more expensive structurally supported floor system, all prospective
purchasers should be apprised of the risks inherent in the use of a slab-on-
grade floor at this site. Purchasers should also be provided with a copy of this
report and informed whether and to what extent the performance of slabs-on-
grade will be under warranty. The engineers will not be responsible for any
problems resulting from the use of slab-on-grade floor construction in lieu of
a structurally supported floor system.
If our client wishes to eliminate the possibility of floor heaving, then the only
reliable solution to our knowledge is the construction of a structural floor
with an air space below the tloor. We recommend that a11 areas which wilt be
finished living areas presently or in the future have a structurally supported
floor system. In addition, it is very desirable that exterior porches be
structura]ly supported over an air space if expansive materials are located
within 3 feet of the base of the porches.
If a structurally supported floor system over an air space is not used and if
slabs bearing on subgrade materials are used, we recommend that special
measures be considered to reduce the amount of total and differential slab
heave that may otherwise occur. One method of accomplishing this is to
p]ace at least 4 feet of properly compacted non expansive granular structural
fill materials be]ow all ]ocations where slabs-on-grade will be constructed. In
addition, the structural fill should be placed several feet beyond the perimeter
of slabs to help neutralize edge effects. The structural fill should be
compacted in 8-inch lifts to 95 percent of standard Proctor density. We
recommend the use of 'granite sand' for the structura] fill.

All floor slabs constructed above soil materials and under conditions where
some uplift could occur after construction must utilize the following details
and precautions. While these details will not necessarily prevent slab
movements, they will help prevent the slab movements that do occur from
affecting either the foundations or the superstructure of the building.
1. Separate the slabs from all bearing members and utility lines to
allow their independent movement--construct "floating" slabs.
Provide positive control joints at the junction of the slabs with
foundation walls, and provide frictionless sleeves for all
columns and utility lines which pass through slabs.
2. Joints should be scored in the slabs at maximum 200-square foot
areas.
3. If hot-water heat is used, the piping should not be placed beneath
the concrete slab. If a forced-air furnace is used, a minimum
6-inch collapsible connection should be provided between the
furnace and the heat ducts. Provide flexible connections for all
slab bearing mechanical equipment to allow for at least 6 inches
of vertical movement.
4. Construct a minimum 6-inch void space above or below all
partitions located immediately above concrete slabs-on-grade.
5. Great care should be taken to prevent the entrapment of free
water within any portion of the excavation during construction
since the moisture will tend to percolate into the underlying
materials with time resulting in long term swelling of the
subgrade.
In addition, good backfill and surface drainage should be provided, and lawn
irrigation minimized, as discussed later in this report.
BACKFILL AND SURFACE DRAINAGE
Due to the fact that expansive materials will heave only in the event that thcy
experience an increase in their moisture content, and the fact that excess
water will work to defeat the satisfactory performance of the foundation
system, the foundation soils should be prevented from being wetted after
construction. This can generally be assisted by using a low permeability
backfill and by compacting the backfill sufficiently so that it does not settle

following construction. The backfill should be free of debris and should be
moistened and compacted taking into account the considerations described in
the previous section on lateral earth pressures. Some water can be blended
with the backfill in the stockpile but away from foundation locations to
permit proper compaction; however, the backfill must not be puddled. If
compaction is not feasible, a berm may be constructed adjacent to the
foundation walls to allow for a good slope away from the building even if
some settlement should occur.
If any settlement should occur in the backfill, it could adversely affect utility
lines which transmit fluids and pass through the grade beam foundation
wa]]s. It is not uncommon for such piping to shear at the foundation walls
due to movements in the backfill. It is recommended that the pipes pass
through slotted openings in the foundation walls or that flexible connections
be used to compensate for shifting of the foundation wall backfill. It is also
recommended that al] water lines be carefully pressure tested prior to final
acceptance and that any leaks detected be repaired.
The final grade should be sloped well away from the structure on al( sides. A
minimum slope of 12 inches in the first 10 feet is recommended. All
downspouts should discharge into extensions which slope away from the
foundation walls and extend beyond the limits of all backfill. The point of
discharge should be at least 7 feet from the foundation walls and good
drainage should be maintained at and beyond this point.
All future owners of the structure should be advised of the presence of the
underlying potentially damaging expansive materials, their potential
detrimental effects to the structure, and the. need for keeping moisture away
from the foundation and slab-on-ground areas. In no event should an
automatic sprinkler system be installed next to the foundation walls. There
should be no watering or irrigation within 7 feet of d-ie foundation walls. The
ground surface in the area may be lined with a suitable geotextile fabric to
control plant growth. The area next to the structure may then be covered
with gravel, bark chips, or other materials requiring no rainfall or irrigation.
SUBSURFACE jJNDERDRAIN
The results of the investigation indicate that an underdrain system should be
placed during construction as a safety measure for all floor systems placed
below final exterior grades.

The underdrain system may consist of a layer of free-draining granular
material under the below-grade floor levels connected to perimeter and
lateral drains. The free-draining granular material used should contain less
than 5 percent passing the No. 200 sieve and more than 50 percent retained
on the No. 4 sieve.
The drain pipes should be at least 4 inches in diameter, should be placed at
least 8 inches below the floor level, should be surrounded by at least 12 inches
of free-draining granular material, and should be graded to sumps at a
minimum slope of 1 percent. Provisions should be made to remove collected
water from the sumps by pumping or by gravity flow to a suitable daylight
outlet. The drain system should be installed to prevent a build up of water in
the backfill behind foundation walls.
LIMITATIONS
The above recommendations are based on the exact location where the test
holes were drilled, the proposed construction, and the assumption that the
subsurface conditions do not vary greatly from those encountered in the test
borings. The investigation was performed and this report was prepared in
accordance with commonly accepted geotechnical engineering practice and
the standard of care common among soi] engineers in the Denver area, and
no other warranty, expressed or implied, is made.

Plcase let this letter serve as a follow-up to our conversation regarding the Distinctive Addresses
at Applewood Subdivision.
You have requcsted that I respond in writing regarding the trailsfer of a water tap from the
landscaping located behind the back of sidewalk along West 32nd Avenue to d1e house being
built on Lot 4.
My understanding of the situation is that the tap was originally used by the then existing house
(now demolished) on Lot 4. When the building was demolished you allowed the tap to be
transferred and used for the establislmient of landscaping along 32nd Avenue. A permit has
recently been issued for new construction on Lot 4 and the builder has requestcd that the tap
used for landscaping inigation be transCerred back to this lot for the new housc.
Although we are reluctant to ailow the transCer to occur, the City of Wheat Ridge has no
requirement that landscaping has to be irrigated with an automatic sprinkler system. However,
the City does require that once landscaping is installed, that it be maintained. According to the
information available; it appears that the majority of this landscaped area is a part of Lot 4.
Therefore, if the landscaping is not maintained or allowed to die, [he City can pursue code
enforcement action with the property owner.

the above referenced tap.
In June of 1997, APA Distinctive, Ltd. ("Developer"), made
application to transfer an existing water tap (Tap Number
328) from its previous location to serve as an irrigation tap
for the landscaped area. The irrigated area is a 21 foot-
wide strip of West 32nd Avenue right-of-way, lying south of
and contiguous to the south line of the Distinctive Addresses

We aze requesting that the water meter on 32nd and Nelson be transfeired back to lot 4 of our
development.
Last yeaz after it was required that we demolish the existing single family house known as 10701
W. 32nd Ave. we contacted Consolidated Water to have the water to the house tumed off.
Having done that we were not awaze that our initial ]andscaping attached w lot 4 would no longer
receive water. We requested of Consolidated Water to allow us to use our e)tisting water meter to
temporarily water our landscaping. It was our understanding ihat when lot 4 was finally developed
we would be able to transfer the water meter back to ffiat lot. As such we make this request.
If we had known at the time that transferring the meter had the potential of being pernianent, we
would have made di$erent azraignments. Lot 4's property line incorporates the ]andscaping in
ques6on and we have always maintained that this water meter remains with Lot 4.

Dear Mr. Koentges:
We are in receipt of your letter dated March 19, 1998. A
water tap on Consolidated's water system must have the
appropriate number of shares of Capital Stock assigned to it.
That stock represents the tap right for a specific property
for a given purpose. Consolidated's policy is that once a
tap is assigned to a specific property, it must remain with
that property unless the Board of Directors approves the
stock being transferred to another legal description.
The property being irrigated was part of the property
originally served, so it was your option to leave the tap
with Lot 4 or assign it to the landscaped area along West
32nd Avenue. Once you made that decision, the tap and stock
would be attached to a legally described parcel of land, in
this case, the right-of-way dedication for West 32nd Avenue.
This should have been explained to you and you should have
been aware that a new tap would need to be purchased for Lot
4.
The "Application for'"Water Tap" makes no reference to the
fact that this was to be a temporary arrangement. Had you
made it clear that this was to be temporary use, the
application would have reflected that desire. How you
developed an understanding that this tap could be moved
about, remains a bit of a mystery in this office.
At the meeting of the Board of Directors on March 23, 1498,
the Board approved the transfer of the stock back to Lot 4 as
shown on the plat of APA Distinctive Addresses of Applewood,
subject to confirmation from the City of Wheat Ridge that the

tap is not required for irrigation of the public right-of-way
and does not violate any agreements the City may have in
place. Once we hear from the City, we will provide you a
copy of the Resolution the Board passed and have you initiate
a new application.
Keep in mind that if the the tap in question is transferred
to Lot 4, then its use is exclusive to Lot 4. If the
landscaped area still requires irrigation, a new tap must be
purchased for that purpose.
Also, we will have to advise Denver Water of the pending
transfer. Whether they will require a system development
charge to be paid is a matter between you and Denver Water.
We will not be involved in that process other than to advise
Denver of our action. As soon as we receive confirmation
from Wheat Ridge, we will conclude this matter. If you have

MINOR EXCAVATION AND FILL PERMITS
1. 1-50 Cubic Yards: No permit is required for dumping or excavation of earth aterials, which do
not exceed 50 cubic yards, provided, however, that any fill deposited is on natural terrain of less
than three (3) horizontal to one (1) vertical slope, or such fill is less than three (3) feet in depth and
is not intended to support permanent structures, and in addition, such fill or excavation does not
obstruct or otherwise adversely affect any drainageway. Should any of the above standards be
exceeded, or a drainage way be affected, a permit shall be required under the guidelines for No. 2.
2. 51-500 Cubic Yards: Dumping or excavation of earth materiais not exceeding 500 cubic yards
may be allowed with a permit approved by the City Engineer. All applications are to be submitted
on the appropriate completed application form and shali be accompanied by the appropriate fee and
sketch plan indicating the following information before the permit will be issued.
A Location and dimensions of all property boundaries and structures on the site.
B Location and extent of areas to be filled and/or excavated.
C. Location of existing and proposed drainageways, irrigation ditches, etc., and indication of
how and where historic run-off will be maintained on and through the site.
D. Cross section area to be filled and/or excavated indicating original slope, new slope and
depth of fill.
E. Statement which indicates the proposed use or purpose for said fill or excavation.
F. Relative elevation of adjacent properties.
G. Erosion control plan showing placement of control devices such as hay bales, etc..

501-20,000 Cubic Yards: Operations in which earth material fill or excavation exceeds 500 cubic
yards but does not exceed 20,000 cubic yards may be allowed by a permit issued by the City
Engineer after review of an application and supporting intormation. The following information shall
be submitted with the required application form:
A. A site plan, prepared and signed by a Colorado registered professional engineer, at a scale
of no less than 1 inch to twenty feet (1:20) which illustrates the following:
1. Location an dimensions of ali property boundaries and structures on the site.
2. Location and extent of areas to be filled and/or excavated.
3. Location of existing waterways and drainage courses indicating any changes. (for
a site containing an established irrigation ditch, a Ietter of approval from the
appropriate ditch company shall be required).
4. Location of existing and proposed points of ingress.
5. Location and extent of existing vegetation, proposed changes in such vegetation
and methods of rehabilitation on site vegetation after earthwork operations are
complete.
6. Erosion control plan.
7. Grading plan with existing (dashed lines) and proposed (solid lines) ground contours
with contour intervals of 2 feet and spot elevations.
8. At least two cross sections (east to west and north to south) through the site
showing depth of fill and/or excavation.
9. A drainage report may be required if site runoff characteristics are changed.
10. Relative elevations of adjacent properties and structures.
11. Statement of purpose of intended fill and/or excavation.
4. Performance Standards: The following provisions shall apply to all Minor Excavation and Fill
Permits:
A. Rehabilitation: Within thircy(30) days after cessation of filling and/or excavation,
rehabilitation for the site shall have been completed in accordance with the approved
plans. Rehabilitation shali consist of leveling, greding, landscaping or any combination
thereof to minimize potential erosion and be acceptable to the City Engineer.
B. Debris: Debris and/or contaminants shall not be used except with the approval of the City
Engineer.
"For the purpose of this Section, the term debris shall have the same meaning as the
terms "garbage, trasFi or junk" as defined in the Wheat Ridge Code of Laws, Section 20-
21
in no case shall debris or contaminates identified or classified as hazardous waste by local,
state or federal agencies be used as fill in any fill areas within the City of Wheat Ridge.

and other penalties as prescribed by Wheat Ridge Code of Laws, Appendix A, Section 24.6. Any fill

DATE: January 21, 2002
Please find attached a copy of Section 109.1 of the 1997 Uniform Building Code relating to the cities liabiliTy
if violations aze discovered afrer a certificate of occupancy has been issued. The code states,
"Issuance of a certificate of occupancy shall not be construed as an approval of a violation ojthe
provisions of this code or of any other ordinance of the jurisdiction. Certificates presuming to give
authority to violate or cancel the provisions of this code or other ordinances of the jurisdiction shall
not be valid. "
I visited the site referenced above on January 21, 2002 in response to the concems and found the following,
1. Handrail for front steps - the temporary handrail installed at fina] inspection had been removed by
the owner while moving in, owner said they would have the handrail reinstalled by 1/23/2002.
2. East exterior sliding door - has been secured shut with a piece of angled metai and a block of
wood due to monies not being available at this time to complete the deck. As long as the door is
not operable this is not considered a violation. (see pictures attached)
3. Grading of the site - final grading wil] be completed as part of the ]andscaping that has been
escrowed to be completed not later than Apri130, 2002. The property currently has a+/-six inch
deep swale established along the south side of the structure that drains to the west to Oak Street.
(see pictures attached)
4. The dumpster currently located on the property was dropped on site at the request of the owner
afrer the certificate of occupancy was issued and is not located within the 25 foot vision triangle
and should be removed by the end of the week per the Owner. (see pictures attached)
5. Approval was given January 15, 2002 by the Public Works Deparhnent with no public
improvements damage being evident at the time of inspection.
6. The steps at the second exterior door on the east side of the building are temporary egress stairs
until the deck is complete due to the square footage of the house exceeding 3000 square feet.
Once a dwelling exceeds this square footage two means of egress is required.

SUBJECT: 3270 Oak Street - Certificate of Occupancy Concerns
DATE: January 21, 2002
Please find attached a copy of Section 109.1 of the 1997 Uniform Building Code relating to the cities liability
if violations are discovered after a certificate of occupancy has been issued. The code states,
"Issuance of a certificate of occupancy shall not be construed as an approval of a violation of the
provisions of this code or of any other ordinance of the jurisdiction. Certificates presuming to give
authoriry to violate or cancel the provisions of this code or other ordinances of the jurisdiction shall
not be valid. "
I visited the site referenced above on January 21, 2002 in response to the concems and found the following,
1. Handrail for front steps -the temporary handrail installed at fmal inspection had been removed by
the owner while moving in, owner said they would have the handrail reinstalled by 1/23/2002.
2. East exterior sliding door - has been secured shut with a piece of angled metal and a block of
wood due to monies not being available at this tune to complete the deck. As long as the door is
not operable this is not consideced a violation (see pictures attached)
3. Grading of the site - final grading will be completed as part of the landscaping that has been
escrowed to be completed not later than April 30, 2002. The property currently has a+/-six inch
deep swale established along the south side of the structure that drains to the west to Oak Street.
(see pictures attached)
4. The dumpster currently located on the property was dropped on site at the request of the owner
after the certificate of occupancy was issued and is not located within the 25 foot vision triangle
and should be removed by the end of the week per the Ownec (see pictures attached)
5. Approval was given January 15, 2002 by the Public Works Deparhnent with no public
improvements damage being evident at the time of inspection.
6. The steps at the second exterior door on the east side of the building are temporary egress stairs
until the deck is complete due to the square footage of the house exceeding 3000 square feet.
Once a dwelling exceeds this square footage two means of egress is required.
If any further clazification or concerns need to be addressed please let me know.

2. The address of the building.
3. The nazne and address of the owner.
4. A description of that portion of the building for which the
certiticate is issued.
5. A statement that the described portion of the building has
been inspected for compliance with the requirements of tlris code
for the group and division of occupancy and the use for which the
proposed occupancy is classified. 6. The name of the building official.
109.4 Temporary Certificate. If the building official finds that
no substan[ial hazazd will result from occupancy of a¢y building
or porflon thereof before the same is completed, a[emporary cer-
tificate of occupancy may be issued for the use of a portion or por-
tions of a building or s[ruc[ure prior to the completion of the eutire
building or structure.
109.5 Posting. 1'he certificate of occupancy shall be posted in a
conspicuous place on the premises and shall no[ be removed ex-
cept by the building official. 109.6 Revocation. The building official may, in writing, sus-
pend or revoke a certifica[e of occupancy issued undec the provi-

should 25,000 pounds each. The mason for this is ttiat the walls were conscructed with a framed
knea waU, instesd of being puured to full height with concrote. This creatad a hinge point which

This letter is a follow-up to our conversation of last week. It is my understanding that excavation
equipment will be at 10701 West 32"d Place early this week. The equipment is to fix the
foundation and to move the dirt from the sight distance triangle.
In our conversation, we agreed that the remediation of the sight distance triangle would have
priority over the foundation work. The sight distance triangie should be cleaz for a minimum
distance of 25 feet along both corners of the property line. The sight triangle work should be
completed no later than September 24, 2001 and ready for inspection.
