2. Issuance of this Certificate of Occupancy does not waive the requirements of a
Development Agreement signed by the land owner and dated Mazch 17, 1997. Said

3. In the event an application for a building permit for a principle structure is submitted to

The purpose of this letter is to provide my interpretation as Zoning Administrator of the use of
property at 4200 Parfet to construct a storage building for the purpose of storing vehicles. The
property in question is zoned A-1. This zoning permits private storage sheds, bams, animal
shelters or outbuildings as permitted accessory uses and buildings.
I have concluded that the request to construct an additional storage building on the property is a
permitted use and building. The owner may proceed with the necessary submittals for a building
permit.

SUBJECT: Building Permit Application for 4200 Parfet Street - Public Warks Review Comments
This memo is to advise you that the Public Works Department can not approve the building permit
application for the above referenced address until the following items have been addressed:
l. A final drainage report and drainage/grading plan(s), consistent with City standards, will need to be
submitted for review and approvaL
2. In conformance with those terms set forth (specifically paragraphs A B and C) of the Development
Agreement dated March 17, 1977 (attached) for Lot 3 of the DeVries Subdivision, notice is hereby given
by the City to conshuct those public improvements along the Parfet Street and West 42"d Avenue
frontages of said lot. Engineered plan and profile street construction plan(s) consistent with City standuds
will need to be submitted for the public improvements (curb, gutter, 4-foot wide sidewalk, and asphalt
paving as needed), and any traffic engineering related items that will be required along the Parfet Street
and West 42"d Avenue frontages of Lot 3.
3. An itemized engineer's estimate of the above requested public improvements will need to be
submitted for review and approval. Upon approval by the city of this estimate, a Letter of Credit will be
required as guarantee for the construction of the required public improvements.
4. An Application for Minor Dumping/Landfill Permit, and fees due will need to be submitted for review
and approval. For you information, I am providing a copy of this permit. In conjunction with this permit,
an erosion control/grading plan may need to be submitted for review and approval.
Please have the applicant(s) contact me at 235-2868 to discuss the details of the above listed items.

THIS DEVELOPMENT AGREEMENT, as authorized by the SUt3DIVISION RE6ULATIONS of
the CITY OF 41HEAT RIDGE, is entered into this 17 day of March ,
1977, between the City of Wheat Ridqe, a t•lunicipal Corporation, hereinafter
referred to as City, and Dale Dean DeVries 8 Betty M. DeUries ,
hereinafter referred to as wner.
WITNESSETH:
l. WHEREAS, the Owr.er is the titled Owncr of a t.rac(. of land in the City of
Wheat Ridge, County of Jefferson, State of Colorado, described as follows:
Lot 3❑f DeVries Subdivisian Recorded in Book 46 Page 33
2. IJHEREAS, the Owner desires to develop that tract of lanri as described in
Paragraph No. 1, and in fact, has been issued a Building Permit to do so;
and
3. WHEREAS, curb, gutter & sidewalk fronting on Parfet 5treet
boarding t at tract o an as escrI e in aragrap No. an t e
neighboring tracts of land are incomplete and below those standards as
set out in the SUBDIVISION REGULATIONS of the City; and
4. WHER[A5, to be uniform and consistant with the existing neighboring improve-
ments and completion or non-completion of those improvements as required by
SECTION FIVE: IMPROVEMENTS of the SUBDIVISION REGULATIONS will make no
significant change at the present in those streets fronting that tract of
land as described in Paragraph No. l, and the neiqhborinq tracts of land;
and
5. WHEREAS, in order to conform to those requirements as set out in the SUB-
DIVISION RE6ULATIONS of the City, this a9reement is hereby determined to
be proper. ~
NOW, THEREFORE, IT IS HEREBY AGREED, THAT:
A. The responsibility for meetinq, conforminq to and providing those require-
ments as set out in the SUBDIVISIOM REGiILATIONS o{ the City is hereby
recognized by Owner.
B. The Director of Public Works, upon the advice and consent of the Mayor,
shall direct the Owner or his assi9ns and successors to meet those require-
ments as set out in the SUBDIVISION REGULATIONS of the City.
C. Upon receipt of such notice to furnish or construct the public improvement
as required under the SU6DIVISIOfJ REGULATIONS of the City, Owner hereby
agrees to construct and furnish at Owner's cost, such improvements as are
required by the SUEDIVISION REGULATIONS of the City, and to do so in con-
formance with the design standards of the SUBDIVISION REGULATIONS of the City.
D. In the event an improvement district is created by the City to improve or
pravide those requirements as set out in the SUBDIVISION REGULATIONS for
those streets or streets fronting that tract of land as described in
Paragraph No. 1 above and the neighboring tracts of lands, the Owner or
his assigns and successors agree not to oppose its creation.
E. In the event an improvement district is created by the City to provide
the improvements as provided by the SUBDIVISION REGULATIONS, the costs
accessable against the property as described in Paragraph No. 1 shall not
be dispropor,tionate with costs accessable to other nearby and like properties.

F. Upon execution of this DEVELOPMENT AGREEMENT by the City andi0wners, the
City will waive the immediate guarantees for public improvements as set
out in the SUBDIVISION REGULATIONS of the City.
G. This agreement is executed by the Owner pursuant to the SUBDIVISION REGULA-
TIONS of the CITY OF WHE'1T RIDGE.
H. The Parties hereto agree that this DFVELOPMENT AGREEMEIJT, by its terms,
shall be binding upon the City and the Owner, and upon the assigns and
successors thereof; and shall constitute covena,nts runnina with the described
property.
This DEVELOPMENT AGREEt4E14T shall be recorded with the County Clerk and Recorder.
IN WITNESS WHEREOF, the parties have set their hands and seals on the date first
shown.

SUBJECT: Building Permit Application for 4200 Pazfet Street - Public Works Review Comments
This memo is to advise you that the Public Works Department can not approve the building permit
application for the above referenced address until the following items have been addressed:
~6tA final drainage report and drainagelgrading plan(s), consistent with City standards, will need to be
~bmitted for review and approval.
~2. In conformance with those terms set forth (specifically paragraphs A B and C) of the Development
Agreement dated March 17, 1977 (attached) for Lot 3 of the DeVries Subdivision, notice is hereby given
by the City to construct those public improvements along the Parfet Street and West 42"d Avenue
frontages ofsaid lot. Engineered plan and profile street construction plan(s) consistent with City standards
will need to be submitted for the public improvements (curb, gutter, 4foot wide sidewalk, and asphalt
paving as needed), and any traffic engineering related items that will be required along the Parfet Street
and West 42"d Avenue frontages of Lot 3.
~~3. An itemized engineer's estimate of the above requested public improvements wil] need to be
~~submitted for review and approval. Upon approval by the city of this estimate, a Letter of Credit will be
required as guazantee for the construction of the required public improvements.
4. An Application for Minor Dumping/Landfill Permit, and fees due will need to be submitted for review
~Z and approval. For you information, I am providing a copy of this permit. In conjunction with this permit,
10 an erosion control/grading plan may need to be submitted for review and approval.
