City of "' W heat -Midge MUNITy DEVELOPMENT Memorandum TO: Mayor and City Council THROUGH: Patrick Goff, City Manager FROM: Kenneth Johnstone, Community Development Director Scott Cutler, Planner II DATE: June 24, 2019 SUBJECT: Correction of Verifiable Zoning Errors (Section 26-119) ISSUE: A recent land use case for property located at 4586-4588 Parfet Street resulted in the need for Staff to verify the zoning classification being displayed on the City's official zoning map. Verifiable errors were found on 4586, 4588, and 4590 Parfet Street. Pursuant to Municipal Code Section 26-119.E.3.d, these verifiable errors may be corrected based upon the record of last rezoning action. This process requires notifying the owners of the subject properties of the proposed correction by certified mail, and notifying City Council by memorandum. The property owner has the right to protest the correction within 30 days of receipt of certified letter. Certified letters were sent to each property owner on March 8, 2019. Staff received the certified letter return receipt from USPS for two property owners on March 9, 2019. Staff was informed by one property owner that they were out of state and would not be able to receive the Certified letter. That letter was re -sent to the property owner on May 20, 2019. No objections were received. The three properties in question are located on Parfet Street north of W. 451" Avenue. The three properties each contain a single-family home and are aligned such that they share a single point of access onto Parfet Street. The current zoning map shows these properties as having split zoning; Agricultural -One (A-1) on the northern portion of the properties, and an approximately 30 -foot wide sliver of Residential -Two (R-2) zoning on the southern portion. PRIOR ACTIONS: On the original zoning map adopted by the City in 1972, the properties were zoned A-1. Zoning boundary designations matched the property lines, as is common practice. However, the legal descriptions for these properties were incorrect, resulting in property lines that were shown approximately 30 feet north of their intended location. Improvements such as fences were built along the perceived, rather than actual, property lines. This area was commonly referred to as the Robert Johnson Subdivision, although it was never approved by the City of Wheat Ridge. A Quiet Title Action performed in 2015 corrected the legal descriptions of the properties, shifting the property lines in the area approximately 30 feet south of the original placement. This action affected multiple parcels in the area that had incorrect legal descriptions, including the three subject properties. This action resulted in the zoning map showing split zoning on the three subject properties, with approximately 30 -foot slivers on the southern portion of the property shown as R-2. Despite the Quiet Title Action of 2015, the zoning maps were never updated to reflect the intended zoning for the three subject properties. The map was not updated because Staff were not informed of the Quiet Title Action until the property owners at 4586 and 4588 Parfet Street approached the City about an administrative lot line adjustment, now approved as the Gertrude Krantz Subdivision. Upon correction, each property will be indicated as showing A-1 zoning for the entire parcel, matching the new legal descriptions created by the Quiet Title Action. FINANCIAL IMPACT: No direct impact. NEXT STEPS: Staff has followed the protocol outlined in Section 26-119.E.3.d for correcting zoning map errors. The property owners were notified by certified letter on March 9, 2019 of the zoning discrepancy. City Council is now being notified of this action pursuant to the aforementioned Code section. No further or formal action is required by Council. The City's official zoning map will be corrected to A-1 for the respective properties as no objections were received from property owners. This Contract is subject to final approval by K&H Roofing & Restoration ("K&H") and, in conjunction with any additional change orders (collectively referred to as the "Contract"), represents the entire agreement and understanding of all parties. Any claim by the parties that arises out of or in connection with this Contract shall be barred unless such notice is provided. 15.
