The purpose of this letter is to provide a determination as to what land uses are permitted on the site. In 1986, the first of several land use applications was submitted by the business/property owner, At that time, the owner requested an interpretation of the zonin,c d to allow firewood sales in the A-] zone district which ® was not a pertnitted use. The property is within the corporate limits of the City of Wheat Ridge and is zoned Agricultural -One (A -1). This zone district was established to provide for a high quality, safe, quiet and stable residential estate living environment within a quasi -rural or agricultural setting. In addition to large lot, single - family residential and related uses, agricultural uses and activities will exist and be encouraged to continue. Based on business license records it appears that the Colorado Tree and Shrubbery Specialists, Inc. operated a business on the property at 4760 Parfet Street from December 1986 through November 30, 2012. Zoning approval was most recently renewed in 2009 for the nonconforming use, at which time the nature of business was described as "tree removal, trimming, shearing, insect control, root feeding, transplanting, and stump removal." This former business was considered a legal nonconforming use because a commercial tree service wouldnot be permitted under current A -1 standards. Section 26 -120 of the City Code provides for nonconforming uses, and states that when a nonconforming use is discontinued for a period of 12 consecutive months, the use loses nonconforming status and may not continue. Ultimately, a new business is allowed to use the property at 4760 Parfet Street for a commercial tree service if the new business is licensed before November 30, 2013. Similar businesses (such as landscape or building contracting) are not permitted the nature of the new business shall be consistent with the nature of the previous business as described above. Please note that the existing single family home on the property may only be used residentially; it does not meet commercial building code standards and may not be used for the business.
