I received your letter of December 15' requesting release of the $10,000.00 remaining in escrow
for the Cambridge project: I would be pleased to release this escrow, but I'm still waiting for the
drainage certification that was coming tomorrow six months ago.
The trail remains incomplete. Although it has been poured, the sides have not been backfiiled.
Disturbed areas have not been seeded.
You had agreed to provide the City with cash for five trees to be planted by the City along the
trail in lieu of stuubs that you were going to plant. For accounting purposes, this amount needs
to be provided by sepazate check. We cannot deduct it from the existing escrow.
When these items are completed, I will release the remaining escrow.

I was reviewing the file on the Cambridge project and read the letter agreement that we both
signed on November 25, 1998. That letter referred to the items that needed to be completed in
the project. To my knowledge, the drainage improvements, drainage certification, and
construction of the trail still need to be completed.
The expiration date of the letter of credit securing the trail construction was extended to May 3,
1999. While the expiration date is about two months away, I am concemed that there has been
no activity with the trail. The weather this winter has been extremely mild and it seems as
though the trail could have been completed by now.
An update on your schedule for completing these items would be appreciated.

An 8' cross pan needs to be inatalled at the firet
~ intersection north of the main alltrance. This pan is
nocessary do to changee in street qrades previously made by
the dnveloper.
2F. Perforated underdrain vas inatallad by the landscape
contractor to aid drainaqe. Thoae underdraina observed
appeared to be funetioninq. The discharge pointa of theee
drains should ba protected with a qrate and ~att cover.
3. Along the entire east/west drainage channel through the
site, rip rap installation needs to be Completed and
positive drainage from the rip rap to the edge of the
trickle channel needs to be obtained per the detaile Sn the
plans.
~ The cul-de-6ac from lot 87 to 91 does not drain. The curb
and gutter needs to be replaced to sffect positive drainage.
This may entail the replacement and/or overlay of some of
the asphalt pavinq.
5. The swale between lota 51 and 52 needa to be deepened and
extended to the street at the lront of the lots.

This is a follow up to Mr. White's letter dated September 29, 1998. Due to all of the items
stated in our August 4, 1998 letter not being completed by the dates stated in your schedule, we will
not issue Certificates of Occupancy for the following remaining lots:

Due to these items and some significant drainage issues related to phase II ofthe project, we

When all items have been completed and accepted, final inspections will be done and
Certificates of Occupancy will be issued for the lots referenced above. Please contact all scheduled
property buyers and selling agents related to the lots listed above and inform them that occupancy

off-site path required to be installed along the north property line of the Cambridge Park project.
Once the conshvction drawings have been submitted and reviewed, City staff will arrange a
meeting with all parties involved, including adjacent property owners to coordinate the

This letter is to confirm our understanding of the remaining items to be completed at the
Cambridge project in Wheat Ridge. The remaining items were sent to you by memo on April 28,
1998. This letter updates that memo.
Off Site Improvements:
1. Gate to recreation center
2. West side sidewalk (Miller Ct.)
3. Emergency entrance on west side (replace vertical curb)
4. Off site trail to 41st Avenue
5. Sidewallc on 38th Avenue at construction entrance
On Site Improvements:
1. Repair of road base
2. Second lift of asphalt on east side
3. French drain system in phases I and II
4. Landscaping throughout phase II
5. Phase II sidewalks
6. Drainage certifications by Cambridge engineer
7. Emergency controls on main entrance gate
8. Fence on 38th Avenue
Since Apri128th the internal trail has been completed. I have transmitted a letter to Holly
Hooker stating that the improvement has been completed in order for Amwest Surety to release
the bond for this improvement. The other security in the form of a letter of credit in the amount
of $24,000 is still being held by the City. This security will not be released until the off site
items are 100% complete.
As we discussed, C.O.'s will be issued without completion of landscaping and final grading.
Escrows will be established for lots for which C.O.'s are requested. Landscaping and final
grading will be completed in groups of houses. Half the escrow will be released upon
completion of the landscaping and the remaining half will be released upon receipt by the City of

grading certificates for those groups of lots. We will have to adjust our releases since the
Finance Department will not release half the escrows on lots. As we did last time, we will
release the entire escrows for a certain number of lots to account for the entire amount to be
released, with the understanding that grading certifications aze needed on those lots for which the
entire escrow has been released.
Issuance of the last few remaining C.O.'s for the project will be withheld until all of the items
listed above aze 100% complete.

This letter is in regazd to outstanding improvements for the Cambridge Park development at West
38th Avenue and Miller SVeet.
The public improvements, including the installation of cwb, gutter and sidewalk, have been installed
along the east side of Miller Court to the satisfaction of ihe CiTy's Public Works Deparhnent with the
exception oFthe sidewalk improvements which need to be extended azound the radius with 41st
Avenue. [t is also the responsibility of the developer to landscape the area between the back of
sidewalk and the 6' high screening fence along the reaz of the project. Pursuant to the approved final
development plan, a strip of landscaping must be installed with sprinklered sod and clumps of bushes
(four clumps of seven, 5-gallon sized bushes in each clump). Please refer to the attached, reduced
version of the approved Tinal development plan.
In regazd to the pazkland dedication requirement, the developer is responsible for a concrete walking
path along the north property line of the project extending east from the curve transition between
Miller Court and W. 41st Avenue a distance of 250', then tuming north and extending to West 41st
Avenue a distance of 150'. This path must be 10' wide, and 6" deep with a 2% mvcimum cross-
slope. Prior to the construction, the City Public Works Department and Pazks and Recrealion
Department shall review and approve the construction plans which must include a tie-in with a curb
ramp at Miller Court. They will also require an oversized radius where the path tums north.

Subject: Observation of Underdrain for House at Lot 7kambridge Park,

Dear Mr. Odean:
At the time of our visit on July 11, 1997, the underdrain had been installed.
The perforated underdrain was surrounded with gravel,the gravel covered drain was
underlain with a plastic membrane and was overlain with lapped roofing paper. The
top of the gravel was 41 to 52 inches below the top of the highest foundation wall. A
sump pit was located in the southeast corner of the lower level. The invert of the pipe
entering the sump pit was about 63 inches below the top of the foundation wall. The
pit was dry at the time of our observation.
The drain appeared to be installed substantially in accordance with our
recommendations.

This memorandum is to inform you that as of this date the
required letter of certification, confirming the satisfactory
construction of the project's drainage improvements, has not been
received by the Public Works Department.
It is critical that this letter be submitted while Triton
Development is still mobilized at the Cambridge Park site.
Therefore, please be aware that as of this date the Public Works
Department will not approve any requests for a temporary
certificate of occupancy, or certificate of occupancy for units
within Phase 2 of the Cambridge Park Development until such time
as the requested drainage certification letter has been received
and approved.

RE: Striping on West 38th Avenue, in Front of Cambridge Park
Deaz Mr. Lyons,
This letter serves as a request that Triton Development coordinate with its contractor to re-stripe
the above location due to the unsatisfactory work performed in November 1996. The previous
striping was not installed per plan and specification. In additioq the City was not notified for
inspection on the installation. We currently have a letter on file from In-Line Marking Co. dated
November 22, 1996 (attached) stating that the re-striping, with preform plastic material as required
by specification, would be performed this spring.
The City would like to see this work done as soon as possible since the wazm temperature days have
arrived and also to improve the visibility ofthe intersection channelization. Please contact me at 235-
2862 by June 13, 1997 to schedule the work. Please be advised that there will be delay in issuing
building permits for the above development if there is no response by the said date to complete the
striping.

On Mazch 31, 1997, I was informed that appliance installers were wuing the major appliances to a junction
box supplied by your electrician. On April 2, 1997, when I questioned the appliance installers to see if they
were licenced by the State of Colorado, their response was that they were not. I then contacted the State of
Colorado Electrical Boazd to inquire about this situation. Their response was that the appliance installer,
could not do the work in the junction box without being licenced. On April 3, 1997, I investigated the quality
of the work completed by the appliance installers and found it to be not in compliance with the NaUOnal
Electric code and a serious fire and a shock hazard.
Therefor the City of Wheat Ridge Building Department is requiring that Cambridge Ventwes have a licenced
electrical contractor return to all of the homes that the appliance installers installed the major appliances and
make such repairs as needed. When this is completed, the City of Wheat Ridge will require a random
selection of homes be made available for inspection.

Dear Mr. Lyons,
This letter is to remind you of Triton Development's
responsibility to consistently maintain West 38th Avenue and
Miller Street with respect to the removal of mud and/or dirt, and
debris as a result of construction equipment accessing the above
referenced project.
To date, Triton Development has not been responsive with respect
to this requirement, especially for West 38th Avenue, despite
several verbal requests from City representatives to various
Cambridge Park project managers.
The City requests that upon receipt of this letter, West 38th
Avenue and Miller Street shall be cleaned of all dirt or mud and
related construction debris within 48 hours. These streets must
be adequately and consistently maintained by Triton Development
thereafter. Please be aware that in the future, failure by
Triton Development to maintain West 38th Avenue and Miller Street
in a clean condition at all times, will result in the enforcement
of re,,lata4i City codes pertaining to this violation.

Barry Odean is the head construction foreman at Cambridge Ventures, a single family
housing development located at West 38th Avenue and Miller Street. This project
consists of approximately 107 single family units, with internal trails and common
azeas .
The intemal access drive serves as the primary fire lane for the project. On
approximately January 3, 1997, Barry was instructed to clear the fire access lane of
construction material and to maintain this lane as open in conformance with the
Uniform Fire Code. On January 10, 1997, the fire lane was being used as a staging
area for the brick laying crew with bundled loads of brick blocking the fire lane. On
January 21, 1997, it was being used as a parking lot.
This is an ongoing problem and Barry is either unable or unwilling to correct this
problem. This list does not represent every incident of violation of the fire lane
witnessed by this inspector
On January 6, 1997, I placed a stop work order on the house located at 4000 Miller
Street because the sheet rockers were attempting to cover building code violations
with sheet rock. On January 7, 1997, I returned to inspect the conections and found
the sheet rockers working with the stop work order still in place.
On January 16, 1997, stop work orders were placed on four house foundations because
the permits had not been issued. On January 17, 1997, foundation workers were found
working on one of the sites that had been issued a stop work order.
Under the administrative section 108.1 of the Uniform Building Code, Batry Odean
acting as an agent of the owner, is therfore responsible for the actions of the sub-
contractors under his control. Barry Odean has shown no regard for the safety of his
customers, his sub-contractors or the laws of the City of Wheat Ridge. I am
requesting that the court through fines and /or jail time make a strong statement that
the city will not tolerate this reckless endangerment .
