Looks like I interpreted the code incorrectly regarding the rear setback. The code reads as follows: "Porches, patios, decks and balconies which are open on at least two (2) sides may encroach into a front setback up to eight (8) feet or into a side or rear yard a maximum of ene-Mird the distance to the closest property line-. Instead of being allowed to encroach 2.66' into the 5' setback as I had previously stated, you'd actually calculate it by taking one third of the min setback and subtract that from the min setback to get the rnw required setback. W 5' - (5'13) = T rminsatback Looks like you are still okay from our standpoint, Hit is indeed a 5' rear setback (please confirm where you got that from as requested in my first e-mail below). Again, please contact the utility district to see if they would allow the deck W encroach into their easement.
