The section that I'm interested ui is along the border of lots 3 and 4 as I wish to do some remodeling of my carport. Currently, all of my utilities are coming from the West side of my property and there are no street lights on my side of the street near my house. This subdivision is about forty years old. I am not aware of any utility using tlvs easement. The purpose of this request is to obtain a setback variance on the north side of our property. As shown on the land survey, the north side of our home and carport is 16 feet from the property line. We wish to enclose the carport into a garage. Construction will be frame and brick. The north wall of the garage would extend two feet beyond the current wall, and would lie 14 feet from the north property line, thus encroaching on the setback by one foot. We anticipate no modification of the roof as the eve is currently a generous 32 inches wide. We have spoken with our neighbor, Bill Vickroy, 3255 Moore Ct, Wheat Ridge, CO 80033, the adjoining property owner. He stated to us that he has no objection to this proposed encroachment. This planned improvement will not only benefit us, but the neighborhood in general as the appearance of our home from the street will improve and our trash cans won't be sitting outside where they can be knocked over by raccoons that wander our area at night. We refinanced our home in 1993. At that time, an error was made in that the Southeast portion of lot 4 was not transferred with lot 3. This is being corrected. As you have requested, here is some fiuther detail about the utility easement on the north side of my property located at 10560 W 32nd Place in Wheat Ridge. I spoke with Paul Kellogg from Colorado Public Service about the easement. He reported to me that Public Service does not have record of an easement in this area and that his copy of the plat does not show this easement at all. He recommended that I verify with the surveyor and referred me back to the City of Wheat Ridge for clarification and vacation of any easements on this lot. I then called R. E. Port, the survey company. He said that there is merely a note on the plat identifying a 5 foot utility easement along all of the lot lines in this subdivision and his interpretation is that the easement is along the original lot line rather than the property line on the north side. This subdivision is more that forty years old. I honestly believe this easement will never be used. In the unlikely event that it becomes necessary to use any easements, I think the intention of the plat note is to place them along the property lines as opposed to the lot lines. The property is zoned Residential-One and located at 10560 West 32nd Place. As per Section 26.D.2.a., the request was administratively processed without the need of a public hearing. No written or verbal complaints were recorded. FINDINGS OF FACT 1. Can the property in question yield a reasonable return in use, service or income if permitted to be used only under the conditions allowed by the regulations for the district in which it is located? Yes. If denied the property may continue to be used as asingle-family residence and yield a reasonable return in use, service and income. Currently, there is an attached carport on the same side of the house where the applicant is proposing to construct the gazage. 2. Is the plight of the owner due to unique circumstances? No. There aren't any unique circumstances attributed to this request. 3. If the variation were granted, would it alter the essential character of the locality? No. The request for the 1' side yard setback variance will be a minimal impact to the neighborhood, as the applicant is planning to design the garage to comply with the existing materials of the existing structure. 4. Are there any particular physical surroundings, shape or topographical conditions of the property involved that would result in a particular hardship? Yes. The property is of irregulaz layout in that only the east and south property lines contain right angles. Any addition to the north portion of the property would require an engineered design. 5. Are the conditions upon which the petition for a variation is based be applicable, generally, to the other property within the same zone classification? Yes. However, each request is reviewed on a case by case basis. Therefore, each outcome may not be the same. 6. Is the purpose of the variation based exclusively upon a desire to make more money out of the properly? No. The purpose of the variation is based on the convenience of having enclosed parking. 7. Has the alleged difficulty or hardship been created by any person presently having an interest in the property? Yes. The applicant, who has interest in the property, has created his own hardship. 8. Will the granting of the variation be detrimental to the public welfare or injurious to other property or improvements in the neighborhood in which the property is located? No. Granting of this vaziance will have minimal impact to the properties or improvements in the surrounding neighborhood as attached gazages aze common in residential neighborhoods. 9, Will the proposed variation impair the adequate supply of light and air to adjacent property or substantially increase the congestion in the public streets or increase the danger of fire or endanger the public safety and substantially diminish or impair property values within the neighborhood? No. The proposed garage is designed to encroach the northern side yard setback by 1'. Therefore, approval of the request will allow for the adequate supply of light and air to the adjacent property. Also, because the garage is proposed to be located on the side of the house where there is currently an existing driveway and curb cut, there should not be any negative impact on the congestion in the public streets. 10. If it is found in criteria 8. And 9. Above the granting of the variation would not be detrimental or injurious to the other property or improvements in the neighborhood, and it is also found that public health and safety, public facilities and surrounding property values would not be diminished or impaired, then, would the granting of the variance result in a benefit or contribution to the neighborhood or the community, as distinguished from an individual benefit on the part of the applicant, or would granting of the variance result in a reasonable accommodation of a person with disabilities? Approval of this request is purely for individual benefit. However, it should be noted that approval of this request will allow for enclosed parking and storage.
