This is determined to be insignificant to surrounding properties and does not require a floodplain map revision. That is, properties currently unaffected by the floodplain wil] remain unaffected. Therefore, I recommend approval of the special exception. The floodplain ordinance further requires that a certification by a registered engineer be made to verify the elevation of the finished floor. I recommend that this certification be made at the time forms are placed and prior to the placement of concrete. A vote to that effect .should be placed on the building permit. BOARD OF ADJUSTMENT STAFF REPORT CASE NO. WF-94-1 Page 2 I. REQUEST The applicant is requesting approval of a Class II Special Exception to allow the construction of a single family residence located within the Lena Gulch 100-year floodplain. The subject site is located at approximately 3435 Simms Street and is currently zoned Residential-One A. The proposed residence will be approximately 2668 square feet and will meet all other requirements set forth under Section 26-11(F). As per the Flood Insurance Rate Map, the property is located within the Clear Creek 100-year floodplain. Referrals were sent to Bob Goebel, Director of Public Works and Mr. Bill DeGroot of Urban Drainage and Flood Control. It is the opinion of Mr. Goebel that the statements made by David Moore of Jehn & Associates, Inc., (a portion of the study is attached) are in accordance with the Floodplain Ordinance and therefore, recommend approval of the Special Exception to build in the 100-year floodplain. This recommendation is subject to the following condition: 1. Certification of the elevation of the finished floor be done by a registered engineer at the time foundation forms are put in place prior to placement of concrete. II. CONCLUSIONS AND RECOMMENDATIONS It is Staff's conclusion that construction of the proposed addition would have very little effect on the existing floodplain and that all other requirements of the Floodplain Ordinance have been met. Therefore a recommendation of APPROVAL is given for Case No. WF-94-1 subject to the following condition: 1. APPROVE THE ORDER OF THE AGENDA. Motion was made by Board Member BERNHART, seconded by Board Member CLARK, that the agenda be approved as printed. Motion carried 5-0. _ 3. PUBLIC FORUM (This is the time for anyone to speak on any subject not appearing on the agenda.) No one came forward to speak. 4. PUBLIC HEARING __ _:~ o.... F-~#-1":` An application by Jehn & Associates, Inc. for approval of a Special Exception to build in the Lena Gulch 100-Year Flood Plain. Greg Moberg presented the staff report. All pertinent documents were entered into record, which Chairman ROSSILLOId accepted. Chairman ROSSILLON asked Mr. Moberg to review the flood plain rules and wanted to know if the floor has to be built 1 foot above in the 100-Year flood plain, and Mr. Moberg replied yes, and added the other requirements deal more with what this structure will do to the flood plain in terms of raising the flood plain elevation. Any work done in a crawl space would have to be flood proofed. Public Works and Urban Drainage ensures that all requirements are met, but construction, setbacks, height, and lot coverage are all handled by the building code and has nothing to do with the flood plain. Board Member ABBOTT asked i£ the reason this doesn't come up in the insurance rate is because the property is in the flood storage area instead of the flood way. Mr. Moberg answered the City gets audited every year by Urban Drainage and FEMA to make sure we are complying with our ordinance. The fact the applicant is coming to the Board and asking for a Special Exception means we are complying with those regulations, and this in no means hurts our rating. Board Member BERNHART asked what the outcome was on a previous similar case and Mr. Moberg replied that case was for 'approval to build outside of the flood plain., No further questions were asked of staff. The applicants, Lester and Betty Zeiler, 6682 W. 44th Place, were sworn in. Mr. Zeller stated they bought the lot to build a home on and did not know the lot was in the flood plain. They have owned the lot for about a year, however they might. go ahead and sell it. WHEAT RIDGE BOARD OF ADJUSTMENT MINUTES OF MEETING: April 28, 1994 Page 4 Mr. Moore said the ordinance reads you cannot build in the floodway, but with special exception can build in the flood plain. This property is not in the floodway district, but if all construction is i.n accordance there should not be a problem. Board Member ABBOTT said with the question being raised regarding the structure having a damming effect on this lot and the flood waters are being constricted and excelerating around the proposed structure, from an engineering standpoint, how would you address that concern. Mr. Moore said ,they are out side of the floodway, which means its a storage area and the water backs up. The velocity is a couple feet per second, so basically the waters back up and move real slow, but there will not be a damming effect.- Board Member BERNHART wanted to know if this was the typical report given by Urban Drainage and Flood Control, and Mr. Moberg said this report was faxed quickly; a more formal letter will be follow. No further questions were asked. Motion was made by Board Member ABBOTT that Case No. WF-94- 1, an application by Jehn and Associates, be APPROVED for the following reasons: 1. Lot 12 of Valley Sub is located in the flood storage district and not in the floodway district. Building is permitted in the flood storage district with approval from the City of Wheat Ridge Board of Adjustment. 2. It is staff's contention; and based. on the Comprehensive Plan, that at some point this entire area will be developed under one development. Staff would rather keep improvements to a minimum because if and when the entire property is developed, there will be no problems with this middle property being incorporated into that, and there could be if a lot of improvements are: done on this site. He would like to continue to run his business in Wheat Ridge, and that is why the proposal on Kipling. They do about a million dollars worth of tax revenue for the City and feels this is one good reason this should be approved. Mr. Mallinson said they originally talked to the City about the rezoning process and he thought the long term use would be the best. However, because of the Comprehensive Plan and Kipling Activity Center, staff would not approve that, so at least we thought if a temporary use would allow a centralization of the business. Mr. Mallinson said the picture (slide) of the house makes it look much better than it actually does. He said they would only ask that the proposal for road base be a little less expensive as we might only be there for a 12 month period and we want to spend more money on the building itself. This report is required for submission to the City of Wheat Ridge Board of Adjustment to obtain a special exception to build in a 100-year flood plain. P12EVIQUS STUDIES' In 1975 the Urban Drainage and Flood Control District for the cities of Golden, Lakewood, and Wheat Ridge commissioned Wright-McLaughlin Engineers to conduct a master planning drainage study for Lena Gulch. Preliminary and conceptual drawings were produced and HEC-2 flood studies were produced. The existing topography, HEC-2 runs, and flood flows were utilized in this flood study. METHODOLOGY' Lot topography for Lot 12 of Valley Brook Subdivision was • obtained and derived from a bench mark provided by the City of Wheat Ridge being the top of a brass cap at Section corner in range box at 32nd and Simms with an elevation of 5451.658. This bench mark was confirmed by the City of Wheat Ridge as being on the same datum as the FEMA datum and the datum used for the preliminary plans and flood study performed by Wright- McLaughlin Engineers. Flood plain elevations for lot 12 were computed by the Army Corps of Engineers Hydrologic Engineering Model HEC-2 as manufactured by the Boss Corporation. The computer model was calibrated using the Wright-McLaughlin HEC-2 runs utilizing their cross-section locations and water surface elevations. The cross-sections were calibrated and the water surface elevations coincided with the Wright-McLaughlin elevations within several tenths of afoot. A section through lot 12 was then input to allow the 100-year water surface elevation for a flow of 2450 cfs to be found. Initially, the floodway for this reach of the Lena Gulch Waterway was calculated using Encroachment Method 5 in the HEC-2 model and specifying an equal conveyance for both sides of the channel and a maximum rise of 1.0 feet from the original 100-year water surface elevation. The encroachment stations were then refined using Encroachment Method 1. When • the one foot rise was reached the floodway was defined. FOOD STUDY MODELII~iG AND RESULTS • The flood plain study was modeled at 100 year flood flow of 2450 cfs. Cross sections were duplicated from the Wright McLaughlin Study except a section was taken through the Zeller residential lot. The 100 year flood elevation based upon existing conditions on the Zeller lot was found to be 5431.39. A floodway analysis, as previously described was performed and the floodway was found to be approximately 140' wide at the section through lot 12. The encroachment station for this section nearest lot 12 is approximately 130' from the channel, while the property line for lot 12 is approximately 150' from the channel. Therefore lot 12 is -in the flood storage district and is not in the floodway district, allowing construction on this lot if a special exception to build in a floodplain is approved by the Wheat Ridge Board of Adjustment. The rules and restrictions of Section 26-206 of the City of Wheat Ridge Flood Plain Zoning entitled "Flood Storage District" apply to construction on this lot. Please see the appendix of this report for Section 26-206 .rules and regulations. • CONCLUSIONS/SUMMARY Lot 12 of Valley Brook Subdivision is located in the Flood Storage District and not in the Floodway District. Building is permitted in the Flood Storage District with approval from the City of Wheat Ridge Board of Adjustments. The finished floor of any constructed building on the lot, if approved by the Board of Adjustments, must be one foot above the base flood elevation of 5431.39 or 5432.39. Construction must be in conformance with Section 26-206 of the City of Wheat Ridge Flood Plain Zoning Ordinance. The following summary print-out table lists the flood plain and floodway elevations for the cross-sections from the Wright-McLaughlin Study and the cross-section through the Zeller's lot.
