Effective December 1, 2014, asphalt shingle installations require an approved midroof
inspection, conducted when 25-75 percent of the roof covering is installed, prior to final
approval. Installation of roof sheathing (new or overlay) requires an approved inspection
prior to installation of ANY roof coverings and is require on the entire roof when spaced
or board sheathing with ANY gap exceeding one half inch exists. Asphalt shingles are
required to be fastened to the roof deck with a minimum of 6 nails per shingle. Ice and
water shield is required. Eave and rake metal is required. A ladder extending 3 feet above
the roof eave and secured in place is required to be provided for all roof inspections.
Roof ventilation is required to comply with applicable codes and/or manufacturer
installation instructions, whichever is more stringent. In order to pass a final inspection
of elastomeric or similar type roof coverings, a letter of inspection and approval from the
manufacturer technical representative stating that "the application of the roof at (project
address) has been applied in accordance with the installation instruction for (roof
material brand name) roof covering" is required to be on site at the time of final
inspection.
Roof inspections for ROOFS OVER 6/12 PITCH: 3rd party inspection will be required, the 3rd
party inspection report will be collected at final roof inspection performed by City of
Wheat Ridge. If report is not available the final inspection will not be completed.

2. This permit shall expire 365 days after the date of issuance regardless of activity. Requests for extension must be made in writing and
received prior to the date of expiration. An extension of no more than 180 days made be granted at the discretion of the Chief Building
Official and may be subject to a fee equal to one-half of the original permit fee.
3. If this permit expires, a new permit may be required to be obtained. Issuance of a new permit shall be subject to the standard
requirements, fees and procedures for approval of any new permit. Re -issuance or extension of expired permits is at the sole discretion of
the Chief Budding Official and is not guaranteed.

Residential Roofing Permit Application
This application is exclusively for new permits for residential roofs and for licensed
contractors only. This type of permit is ONLY being processed online --do not come
to City Hall to submit an application in person. Permits are processed and issued in
the order they are received. YOU WILL BE CONTACTED WHEN YOUR PERMIT
IS READY FOR PICK-UP AND WILL BE GIVEN A SPECIFIC DATE AND TIME
WINDOW TO COMPLETE THE TRANSACTION. You will be notified if your
contractor's license or insurance has expired, and you may update those
documents at the time you are issued your permit. Permits are currently being
processed within 5 business days, subject to change based on volume.
For all other requests:
Homeowners wishing to obtain a roofing permit must apply for the permit in person
at City Hall. Revisions to existing permits (for example, to add redecking) must be
completed in person at City Hall. All other non -roofing permits must be completed in
person at City Hall. The Building Division will be open from 7:30-10:30 a.m.,
Monday through Friday to process these types of requests.

WE HEREBY SUBMIT SCOPE OF WORK FOR
MAIN HOUSE:
1. Removal of all existing roofing and flashing membranes to the plywood deck surface.
Replacement of any damaged or deteriorated plywood decking at an additional cost of $40 per four foot by eight foot
sheet of plywood needed. Decking will be replaced in whole sheets only in accordance with recommendations by both
the National Roofing Contractors Association (NRCA) and the American Plywood Association (APA). New decking shall be
APA rated for structural use. Deck fastening will meet or exceed local building code requirements.
3. Replacement of following flashing materials: perimeter drip edge, step flashing and pipe jacks.
4. Ice and water protection membrane shall be installed along all eaves and valleys and shall extend past the interior wall
line a minimum.of 24 inches to provide protection against damage from ice dams.
5. Installation of one layer of #30 asphalt saturated roofing underlayment on deck surface not covered with ice and water
protection material. Felt will be fastened using staples or 1 % inch plastic -capped. Fasteners shall be at maximum of 12
inch centers along the side and end laps and at minimum 24 inch centers in two staggered rows in the center of the roll.
6. Installation of new algae -resistant shingles. Shingles will be installed in strict accordance with the manufacturer's
specifications and shall be fastened using six nails per shingle.
7. Paint all vent flashings, roof penetrations, and chimney flashings.
S. Ventilation of attic will be installed to code using ridge vent or mushroom vents.
9. Installation of manufacturer's pre -made hip and ridge material. Hip and ridge rows will be run straight and shall be
installed according to manufacturer's instructions.
10. Remove and replace 5" gutters and 2 x 3 downspouts.

Contract Terms and Conditions
Rise and Fall / Disclosure: The quotation is based on costs and statutory obligations current at the time of the quotation and is liable to
variation. Any variation in price either prior to or after conclusion of the contract may be added to or subtracted from the estimated price.
Grounds / Electrical Power: All grounds to be cleaned up on a daily basis. All bushes, shrubs, and flowers to be protected. Homeowner is
asked to supply electrical power if needed.
Insurance: Frailey Roofing is in compliance with all state and county requirements for general liability and workers compensation insurance.
Payment: Sixty percent (60%) of Total Estimated Cost is due prior to start. Remainder 40% of total estimated cost is due immediately upon
completion of project. Final payments exceeding two weeks will be subject to 3% late fee. Frailey Roofing shall hold in trust any payment from
the property owner until Frailey Roofing has delivered roofing materials to the jobsite or has performed a majority of the roofing work on the
property. If project is being completed due to home closing, Frailey Roofing can accept payment from Title company at time of closing.
Permit and Final Inspection: Frailey Roofing will pull re -roof permit. Frailey Roofing is responsible for calling in final inspection
Dates of Service: Frailey Roofing will notify contract holder of approximate dates of service, which are subject to change.
Failure to Pay: Failure to pay in full by contract holder shall entitle Frailey Roofing to recover the value of all goods supplied and work
performed to the date of release (including lien). Failure to pay also entitles Frailey Roofing reimbursement from property owners, for legal fees
associated with cost of recovery of goods supplied and work performed.
Insurance Claim Deductibles: If the property owner plans to pay for the roofing services through an insurance claim, Frailey Roofing cannot
pay, waive or rebate the homeowner's insurance deductible in part or in whole per SB38 - The Consumer Protection/Roofing Bill, effective
06/06/12.
Warranty: Labor performed hereunder will be free from defects on workmanship, in respect to leakage, for period of 5 years from date of
purchase. Warranty is non-transferrable. Warranty is not valid unless paid in full.
Cancellation: Cancellation of any order must be notified by the contract holder to Frailey Roofing, in writing, within 72 hours days of contract,
and prior to the first delivery. If an order is cancelled the contract holder / property owner undertakes to reimburse Frailey Roofing for any
expenses reasonably incurred in the preparation or the execution of the order. If property owner rescinds the contract for roofing services,
Frailey Roofing will issue a full refund of any deposit within 10 days after rescission of the contract.
This services contract is accepted under the specified cost, terms and conditions noted within.

SUBJECT: Legal Nonconforming Duplex
City and County parcel records recognize the address 6570 W. 44` Place; and as of April 5,
2012, Jefferson County Assessor records indicated this property was used as single family home.
The property owner was seeking to refinance the home and alleged that the structure was an up-
down duplex. Building permit records for 6570 W. 44` Place did not indicate the presence of a
duplex. The property is zoned Residential -Three (R -3), so a duplex is a permitted use, however
the lot is nonconforming at 8856 square feet, where 9000 square feet are required for a duplex.
To refinance, the bank needed to know the status of the duplex (illegal, legal, legal
nonconforming, etc). The property owner submitted information in preparation for a courtesy
variance to legitimize the second unit. The submitted documentation (attached) identified
addresses for both units (6560 and 6570 W. 44` Place).
With this information it became evident that a separate building permit file exists for the second
address (6560 W. 44` Place). Permit records in this file provide evidence that the City
recognizes the property as a duplex. With this information it became clear that no variance was
required to legitimize the second unit. The property owner has confirmed that there is no
internal stairway connecting the units, and each unit has separate front and back doors.
The Jefferson County Assessor has updated their records to indicate the property as a duplex. A
letter was sent to indicate that the property is considered legal nonconforming. All
documentation is attached and the building permit records have been combined under a single
file: "6560 -6570 W. 44 ` Place."

This letter is to inform you that the property located at 6570 W. 44` Place is located within the
corporate limits of the City of Wheat Ridge, Colorado. The property is part of the Powers
Subdivision, and has schedule number 025501 and parcel ID 39- 242 -24 -007 assigned by the
Jefferson County Assessor. The property is zoned Residential -Three (R -3).
Based on records from the Jefferson County Assessor, the residence on the property was
originally constructed in 1959. The home was constructed prior to the incorporation of the City
of Wheat Ridge which did not occur until 1969.
The Jefferson County Assessor recognizes the home as a two - family dwelling (see attached).
Futhermore, the City recognizes the structure as a two- family dwelling as evidenced by building
permit records. City records indicate building permits have been issued for both dwelling units:
6560 and 6570 W. 44' Place, respectively.
Under the City's zoning code, a two - family residence is a permitted use in the R -3 zone district.
Because the lot area is slightly below the current standard for a two - family dwelling, the
structure and use of the property at 6570 W. 44 Place are of legal nonconforming status. The
intent of the zoning code is such that the structure and two - family use may be continued so long
as it remains otherwise lawful, subject to section 26 -120 (Nonconforming lots, uses and
structures) of the municipal code.

Thank you for your assistance in my Variance Request. I have attached documents for the courtesy review. In
addition, the following narrative might be of use in this process.
To the Planning and Zoning Office
I am the owner of an up /down duplex at 6560 and 6570 West 44th Place in Wheat Ridge. I purchased
this in 2003 from Dorothy Blair. At the time, I was told she and her husband (then recently deceased)
had been the only owners of this duplex other than the developer. They had rented out the lower
level and lived in the property from their date of purchase until I purchased it from them.
I was represented by a Michael Zakhem, a licensed Realtor who is currently the President of Zakhem
and Company. An appraisal was conducted by Gerald Martin of Stanchion Appraisal Services for
Megastar Financial Corporation. I have this original appraisal, my stamped and notarized Jefferson
County Warranty Deed, and title insurance policy from Land Title Guarantee. The property was
listed and sold as a duplex. All the closing papers and both the Warranty Deed and title insurance
policy identify the property addresses as 6560 and 6570 West 44th Place Wheat Ridge, Colorado
80033.
Last month, Chase offered to refinance my current mortgage. (Chase was not the original lender but
has acquired it through customary buying and selling of mortgages and mortgage companies.) In the
appraisal process for the refinance, I learned that this property did not meet the Development
Standards for the City of Wheat Ridge nor was it recorded in the assessor /deed office as a duplex.
This was the first I had heard of this. In a conversation with the Deed office with the Jefferson County
assessor, I was told they would change it to a duplex. When I visited the Planning and Zoning Office,
I was told I would need to file a variance.
I have been trying to initiate contact with the Realtor, appraisal company, and financial corporation
with whom I worked in 2003. So far, I have not been successful in getting any response from them. I
am submitting this letter and responses to A- G of the Wheat Ridge Community Development
Variance Criteria for Review. I can present you with any of the documents I received for my purchase
in 2003.
I appreciate your assistance in conducing a courtesy review of this request of a variance so that this
property can be "grandfathered" and considered a duplex property for selling, using, financing, and
replacement.

A. The building on the property was built in 1959 as an up /down duplex. It would be impossible to sell this
property if it could not be used as a duplex. It would not be economically sound to convert the property to a
single family unit as they are the same floor plan and there is no internal staircase or any way to incorporate
an internal staircase.
B. The area is zoned R -3. To the best of my knowledge it has had R -3 zoning since Wheat Ridge incorporated
and zoned the area. Multi- family properties have been constructed in this area in the years since 1959 and,
to the best of my knowledge, are within the Wheat Ridge Development Standards.
C. I purchased this property in 2003 as an investment property. I do not live in either unit, but rent both units.
The appraisal conducted in 2003 did not identify any zoning issues. Had this been identified at the time, that
current owner would have had to apply for this variance. Had I known of this situation, I would not have
purchased the property until the owners applied for and received the variance.
D. If the variance is not granted, I will not be able to sell my investment. I bought this property in full faith
believing it was a valid duplex property with the addresses of 6560 and 6570 W 44th Place
• 1 paid for what I thought was an honest appraisal by Gerald Martin of Stanchion Appraisal Services.
• 1 have a Warranty Deed recorded in Jefferson County as Reception NO. F1690373 listing both these
addresses.
• 1 have documentation of land title insurance that lists both these addresses and in no way identifies
the property as not meeting zoning requirements.
E. The property contains 8856 square feet, which is only 144 square feet less than the current requirement of
9000 square feet. When this duplex was built in 1959, it is my understanding the current square footage
requirements were not in effect.
Apparently at some point after 1959 and before the current development standards were implemented, the
owner of record for Lot 7 sold all of Lot 6 except for 11.5 feet. A single family home was built on what
remained of Lot 6. This house has sold twice since 2003. Obviously, this has not interfered with the sale or
the development standards of the Lot 7 property.
i. As can be seen on the aerial and zoning maps, my property is within the R -3 zoning range.
There are multi - family units on both blocks of West 44th Place.

(1) This permit was issued in accordance with the provisions set forth in your application and is subject to the laws of the State of
Colorado and to the Zoning Regulations and Building Codes of Wheat Ridge, Colorado or any other applicable ordinances of
the City.
(2) This permit shall expire if (A) the work authorized is not commenced within sixty (60) days from issue date or (B) the building
authorized is suspended or abandoned for a period of 180 days.
(3) If this permit expires, a new permit may be acquired for a fee of one -half the amount normally required, provided no changes
have been orwill be made in the original plans and specifications and anysuspension or abandonment has not exceeded one
(1) year. If changes have been or if suspension or abandonment exceeds one (1) year, full fees shall be paid for anew permit.
(4) No work of any manner shall be done that will change the natural flow of water causing a drainage problem.
(5) Contractor shall notify the Building Inspector twenty-four (24) hours in advance for all inspections and shall receive written
approval on inspection card before proceeding with successive phases of the job.
(6) The issuance of a permit or the approval of drawings and specifications shall not be construed to be a permit for, nor an
approval of, any violation of the provisions of the building codes or any other ordinance, law, rule or regulation. All plan review
is subject to field inspections.
