It is on property zoned Residential -Three (R-3) which makes it a legally nonconforming use despite its longstanding presence in the community. The property to the north at 4124 Harlan Street is also zoned R-3 and currently contains a single-family home and a detached garage. If 4124 Harlan Street is purchased by Southwest Gardens, it could be used as additional parking for customers of Southwest Gardens provided no expansion of the business itself occurs on the property. Parking for adjacent commercial uses is a permitted use in R-3 if the use of the property is not residential. A Special Use Permit would be required if you wished to keep the house as a residential use while also using the property for customer parking. Parking areas must be paved and are subject to review by staff for compliance with the City's parking lot standards, accessibility standards, landscaping, and access. Expansion of the existing curb cut onto Harlan Street may be required, which would require a right-of-way permit. If Southwest Gardens wishes to expand its operations to 4124 Harlan Street beyond allowing parking, such as customer -facing retail space, a rezone would be required since the legal nonconforming status of 4114 Harlan Street does not apply to the adjacent lot. If a rezone is pursued, staff would recommend both lots be included in the rezone to keep the allowed uses consistent and eliminate the legal nonconforming status of the original Southwest Gardens lot. Expansion of the existing business on 4114 Harlan Street (such as a building addition) would also require a rezone. REGARDING ROOF VENTILATION: Roof ventilation shall comply with IBC Sec. 1203.2 or IRC Sec. R806. The installation of ridge venting requires the installation or existence of soffit venting. For calculation purposes, one hat or turtle vent equal to one-half of one square foot of opening. Effective December 1, 2014, asphalt shingle installations require an approved midroof inspection, conducted when 25-75 percent of the roof covering is installed, prior to final approval. Installation of roof sheathing (new or overlay) is required on the entire roof when spaced or board sheathing with ANY gap exceeding one half inch exists. Sheathing and mid -roofs may be called in at the same time, one hundred percent of the sheathing must be complete and 25-75 percent of the mid -roof may be complete.
