HomeMy WebLinkAboutWZ-99-05City of Wheat Ridge Planning and Development Department Memorandum TO: City Council FROM: Alan White, Planning and Development Director SUBJECT: Zoning Map Correction DATE: March 10, 1999 In 1988, City Council passed Ordinance No. 759 which rezoned a property located 4300 Newcombe Street, from Agricultural -One to Residential -Two. Following the approval of the request, the applicant constructed a two - family residential dwelling, which is permitted in the Residential -Two zone district, and not in the Agricultural -One zone district. However, following the approval of the rezoning, the maps were not amended to properly reflect the change of zone. Pursuant to Section 26 -3 (F) of the Wheat Ridge Code of Laws, it is staff's intention to correct the zoning maps to accurately reflect City Council's action. A certified letter has been sent to the owner in regard to the proposed map correction. If no protest is received from the owner and if City Council does not initiate a rezoning action within 30 days, the correction will be made. On February 10, 1999, legal notification was sent via certified letter to the affected property owner. To date, there have been no responses in opposition to the correction. V. The action requested was a change of zoning from Agricultural -One to Residential -Two, for the construction of a two - family residential dwelling. The request was approved, and the zone district should have been changed on the zoning maps. However, due to a change in personnel at that time, the map was never corrected and continues to show the property zoned as Agricultural - One. The Wheat Ridge Code of Laws requires staff to inform the property owner whose property was affected by the incorrect zone district, and notify them of the action that will be brought before the Wheat Ridge City Council as a map correction. This map correction simply reflects the rezoning action approved by the City Council in 1988.
