Site Location The site is located in Sections 19, 20, 29 and 30 in Township 3 South, Range 69 West of the sixth principal meridian, Jefferson County, Colorado. It is bounded on the north by the northern right-of-way of Colorado Hwy. 58, on the east by Interstate Hwy. 70, on the south by residential and commercial development, and on the west by property owned by Coors Brewing Co. The site is traversed by Clear Creek through the northern portion. Included in the above description are two parcels of land owned by Jefferson County and located along Clear Creek. Although these parcels are not part of this annexation, they are included in this study. B. Site Description The property is generally undeveloped ground with the exception of a private residential home located in the southeast corner, and the Jefferson County Animal Shelter (not part of the annexation) located along the east side, just south of Clear Creek. The Denver Water Moffat transmission conduits and sludge return line crosses the property from northwest to southeast. An access road and associated easement follows the transmission conduit alignment. The northern 20 acres of property is occupied by the State Highway 58 right-of way. The southern portion of the property, approximately 141 acres, generally slopes northward toward Clear Creek. The property north of Clear Creek (approximately 64 acres) generally slopes south toward Clear Creek. The natural topography of both areas has been significantly modified by sand and gravel mining in the past. Large mining pits remaining on the property receive most of the site's watershed runoff. C. Proposed Project Description Approximately 205 acres presently located in unincorporated Jefferson County will be annexed into the City of Wheat Ridge for future development. The property will be developed into commercial retail sites, a water storage pond for use by the Coors Brewing Company, possible open space, and possible land for use by non-profit agencies. The topography of the site will generally be restored to pre-mining conditions. Impacts to regional transportation and possible infrastructure improvements are currently being studied. Possible access locations include points at W. 32nd Ave. to the south, a tunnel under I-70 to the east and a connection to McIntyre to the northwest. D. Flood Hazard and Drainage Studies Relevant to Site Clear Creek crosses the property from west to east. A Flood Insurance Study (FIS) was prepared in 1979, by Gingery and Associates. This study represents the current technical analysis supporting the effective Flood Insurance Rate Map (FIRM) for this reach of Clear Creek. The 100-year floodplain shown on the Drainage Plan was digitized from r the effective FIRM. Development is not proposed on areas inside the 100-year flood plain with the exception of a bridge crossing of Clear Creek. The bridge abutments will be located in the floodplain fringe and the bottom chord of the bridge will be sufficiently above the regulated water surface elevation to provide necessary freeboard. Specific details of the bridge and its impact on the Clear Creek floodplain will be addressed under a separate report. Applewood Watershed Outfall Systems Planning Studies The site is also included in two studies; the Applewood Watershed Outfall Systems Planning Study Alternative Development and Evaluation Report, prepared by Kiowa Engineering Corporation, October 2001, and the Applewood Watershed Outfall Systems Planning Study Preliminary Design Report, prepared by Kiowa Engineering Corporation, November 2003 (OSP). Both studies cover a watershed that includes 2.36 square miles of property south of, and partially including the annexation property. The studies report that the watershed has no regulatory detention facilities, and that the storm sewer, ditches, and roadways are typically undersized to convey developed flows. There are four irrigation ditches that were ignored in the OSP's hydrology analysis. However, these ditches appear to capture most runoff from minor storm events and nuisance flows. Both studies indicate the watershed south of W. 32nd Avenue cumulates on the south side of 32nd Avenue at about Eldridge Street, across from the Applewood Golf, and then during major storm events, drain over W. 32nd Avenue into the Golf Course. The studies indicate stormwater flows across the golf course and enters the proposed annexation property at OSP design point 102 shown on the Drainage Plan. The existing 100-year flow is reported to be 637 cfs, and the future 100-year flow is reported to be 728 cfs. Future flows include final build-out of the OSP watershed area. Recommendations from the 2003 OSP study include piping the minor (2-year) storm events via a culvert along W. 32nd Ave. to the southeastern corner of the golf course, then north along the cast side of the golf course via a 66-inch pipe. This OSP also suggests conveyance of the minor storm flows through the proposed annexation property with storm piping. Martin/Martin Commentary on OSP's: Assumptions made in both the 2001 and 2003 OSP's regarding the routing of flows through the annexation property vary from observed drainage patterns. The routing schematic presented in both reports seems to indicate that runoff from basins located south of the annexation property and south of W. 32"d Ave. travels to the west of the annexation property (Eldridge St.) before crossing north to design point 102. Field observations indicate that runoff from basins south of W. 32"d Ave will travel across W. 32nd Ave. at low points located at approximately Alkire St. and Braun Court. Fairmount Area Outfall Systems Planning Study Drainage from properties north of Highway 58 right-of-way was analyzed in the Fairmount Outfall Systems Planning Study and preliminary Design Report, prepared by Moser & Associates Engineering, April 2004. Improvements proposed in this study include conveyance of the 100-year flows under US Hwy. 58, through proposed piping and a concrete box culvert. The approximate alignment and associated major storm flow rates conveyed by these improvements are shown on the Drainage plan. These flows should be passed through the property directly to Clear Creek. The construction schedule for these improvements is not known. II. HISTORIC DRAINAGE SYSTEM A. Major Basin Clear Creek divides the property into two major drainage basins, one to the north and one to the south. Both major basins generally drain toward Clear Creek; however mining pits accumulate runoff and do not have defined release points to Clear Creek. Adjacent properties are not affected by runoff from this site. There are multiple locations where run-off enters the site via overland flows or culverts, but an engineered storm sewer system does not exist. Property nearest Clear Creek is generally steeper and is vegetated with deciduous trees, bushes, and grasses. Property further from the creek is relatively barren with clusters of weedy deciduous trees, bushes and native grasses. Much of the area especially that on the north side of Clear Creek, has very little vegetation due to past mining activities. The soils are generally sand and gravel, have high percolation rates, and are subject to erosion by the watershed. A description of on-site soils in the 1980 Soil Survey of Golden Area, Colorado, by the USDA Soil Conservation Service, characterizes soils with a type AB runoff potential. Offsite properties to the south that contribute flows to the property generally have soils with a type C runoff potential. III. PROPOSED (DEVELOPED) DRAINAGE SYSTEM A. Criteria Techniques defined in the latest Urban Storm Drainage Criteria Manuals, Volumes 1-3, by the Urban Drainage Flood Control District, were used to prepare this Master Drainage Plan. On-site Hydrology was computed using the Rational Method. Off-site tributary watersheds were computed in the referenced Outfall System Plans using UDSWM. Runoff from off-site basins OS 1-OS 16 was also computed using the Rational method to check internal pass-through hydraulic conveyance elements. Both the initial and major storm frequencies were analyzed. The 5 and 100-year storms were used for the initial and major storms, respectively. B. Runoff The developed off-site watersheds are typically large and are routed independently through the site. Conveyance of the major storm runoff for both on-site and off-site basins is provided to Clear Creek. Adjacent properties are not affected by run-off from this site. C. Detention Due to the site's proximity to Clear Creek, no detention will be provided. It was agreed, through discussions with reviewing agencies, that it would be better to release the major storm, before a peak flow in Clear Creek reached this property. Water quality ponds are required for all developed properties on the site, per discussions with the reviewing agencies. Presently, individual water quality ponds for each parcel are proposed. However, these ponds can be combined as required for economy of scale and infrastructure. The preliminary location of these water quality ponds, their required volumes and tributary basins are shown on the Drainage Plan. Outlet structures and overflow structures will need to convey fully developed 100-year flows to Clear Creek. D. Streets Streets through the site are elevated above proposed grades for the site and therefore, will not be the primary conveyance for major storms. The streets will have inlets and storm piping that will convey their runoff to water quality ponds before being released to Clear Creek. E. Sub-Basin and Site Drainage Southern Basins Runoff from the Applewood Watershed, south of West 32nd Avenue is reported (in the 2003 OSP) to flow west along the south side of 32nd Ave. to Eldridge Street, before flowing over 32"d Ave. and into the Applewood Golf Course. However, there are two low points along 32nd Ave. (at Alkire Street and Braun Court) where this stormwater appears to overflow 32"d Ave. into basins OS1 and OS2. Future storm sewer construction, following the 2003 OSP Preliminary Design Report, may provide conveyance of the initial storm west toward Applewood Golf Course. In the interim, it is assumed (in this report) that the Applewood Watershed south of 32nd Avenue, (basins OS 11, OS 12, OS 15, and OS 16 which were delineated in both of the OSP's as basins 11, 12, 15, and 16, respectively) appear to flow into off-site basins OS 1 and OS2. These basins are generally comprised of medium density residential and commercial development. These basins drain north toward the southern property limit, through roads and storm sewer piping. Major storm runoff from these basins, as computed by the 2001 and 2003 Applewood OSP's, range from 130 to 179cfs, depending on how their tributary sub-basins were routed. An open channel is proposed along the southern property line to intercept major storm flows from these basins. This channel conveys the runoff west, and north around the proposed on-site "Coors Water Storage" pond. The proposed open channel is conservatively sized to convey flows based on cumulative routed rational computations. Basins OS16 and OS12 are routed through basin OS2, and develop a total flow at the upstream end of the channel (design point 2) of 178cfs. Basins OS 15 and OSI 1 are routed through basin OS1 to design point 1 (in the channel and just downstream of design point 2), where the cumulative flow is 395cfs. The Applewood Watershed OSP cumulates all of the southern off-site flows (including basins OSI-OS4, OS11-OS 16, proposed basins S1- S3, and part of proposed basins S4- S6) at the northeast corner of Applewood Golf Course (OSP design point 102). Through meetings with the Coors Brewing Company (also owners of the golf course property) it was agreed that this runoff historically drained north from design point 102, through the property where their water storage reservoirs are now located, and into Clear Creek. However, the berm forming the south side of their reservoir currently appears to divert this flow east and into basin S 1 of the annexation property. An improved berm is proposed along the western property line of the annexation property to maintain historic drainage patterns. The Coors Brewing Company is in agreement with the proposed berm and has agreed to accept major storm flow into their reservoir. Initial storm flows will be routed around their reservoir through the annexation property via an inlet and storm pipe proposed near design point 102. The inlet and storm pipe should be sized to accept only the initial storm and release it into the proposed interceptor channel. The 2001 Applewood OSP future 5-year (initial) storm flow at Design Point 102 is 203cfs. Also based on the 2001 OSP, approximately 46 cis of this 203cfs is already in the interceptor swale. The inlet and storm pipe will be sized to accept the remaining 157 cfs. The interceptor channel will convey runoff north and ultimately under the Denver Water Moffat transmission piping and new access road through a culvert at design point 12. This culvert will be routed under/along the roadway prism and will outfall to Clear Creek near/or through the proposed bridge abutment. An easement for construction and maintenance of the roadway and culvert will be provided by Jefferson County. Basin OS3 is primarily road pavement that will be routed through basin S6 and an on-site water quality pond in basin S4, at design point 8. Basin OS4 flows through a ditch along the western I-70 frontage road to Clear Creek. If the tunnel under I-70 is constructed, these flows will need to be piped in order to cross this proposed access point. Basin S 1 includes property to be developed as a water storage reservoir for the Adolf Coors Corporation. Water stored in this reservoir will be pumped in and out of the reservoir as needed. There will always be sufficient freeboard to contain rainfall landing on this basin, and there are no tributary watersheds to this basin. The basin is does not require any water quality or detention structures, and will not have a gravity driven release. Basin S3, the "Salter Residence", will also be annexed into the City of Wheat Ridge. This property will also be developed as commercial property in the future. The drainage plan indicates necessary water quality pond volumes required if the property is developed for commercial uses. If the property is developed in the future, the water quality pond should release into the eastern road side ditch of the western I-70 service road. The western portion of the Salter property is included as part of basin S2. Basins S2 and S5 are proposed as retail and commercial development, respectively. Water quality ponds are required on each property having the volumes shown on the Drainage Plan. Buildings constructed on these properties must be built above the hydraulic grade line of storm sewer conveying the major storm event out of the basins. The storm sewer outfall shall be routed to clear creek through basin S4. Basin S4 is a large, almost 50 acre basin that will be developed as retail. Multiple water quality ponds are anticipated to serve this property. However, their locations and site specific storm sewer is not definitively known. The cumulative water quality pond volume shown for basin S4 at design point 8 on the drainage plan, is sized to accommodate flows from roadway basins OS3, S8 and S6. As mentioned before, storm sewer capable of conveying the major storm from basins S2 and S5 must be routed through basin S6, under the access road and Denver Water transmission line, and into basin S4. These flows and the major storm release from design point 8 (basins OS3, S6, S8 and S4) will be routed east along the north line of basin S4 to the I-70 right-of-way. Once in the I-70 right-of-way, the sewer will turn north and will ultimately discharge into Clear Creek through an energy dissipater. Based on discussions with Jefferson County, CDOT, and the City of Wheat Ridge, as of the writing of this report the aforementioned storm sewer cannot be routed through Jefferson County property. In the future, the existing Jefferson county parcels (north & south of Clear Creek) are anticipated to be annexed into the City of Wheat Ridge. If annexation occurs, development of basin S4 may be expanded into the Jefferson County parcel located in Section 20 near where the Jefferson County Animal Shelter is presently located. The proposed water quality pond necessary for development of basin S4 may also be moved into this parcel. Basin S10 will also be annexed into the City of Wheat Ridge. The proposed access road and south abutment of the bridge crossing will be located at the east side of the basin. No further development of this parcel is anticipated and this basin will likely remain status quo. Northern Basins Basin NI is principally State Highway 58 right-of-way that will be annexed into the City of Wheat Ridge. Runoff from this basin is collected in the south roadside ditch and flows to the east. This runoff eventually flows south into the Jefferson County parcel near I-70. There is an inlet with piping located near the midpoint of the basin. This piping ostensibly directs runoff into the Coors Brewing Company property, but no outfall location was found. It is assumed that this pipe is buried/plugged and not functioning. It is anticipated that flyover connectivity from eastbound I-70 to west bound 58`" and from eastbound 58`h to westbound I-70 will be constructed in the future by CDOT. Due to the proximity of Clear creek, it is anticipated that drainage from this construction and any associated water quality enhancement can be accommodated in additional right-of- way must be acquired for the fly-over. Details of the construction are not known and associated drainage improvements must be defined by site specific drainage studies by CDOT. Northern basins N2 and N3 are properties owned by the Coors Brewing Company. Runoff from N2 will be routed east and into N3. Typically, these properties have been mined for sand and gravel and do not have defined outfalls to Clear Creek. It is anticipated that they also will be developed for commercial use. Like the southern basins, anticipated future imperviousness has been assumed, and required water quality pond volumes are shown on the drainage plan. Basin N4 includes primarily roadway drainage from the proposed access road connection to McIntyre. Future development of basin N4 has been included in the water quality volume for basin N3. F. Open Channel Flow The interceptor channel was designed to convey the major storm event from off-site Applewood Watershed basins around basins S2, S1, and S5. The channel was sized conservatively to convey major flows which were based on afore mentioned rational calculations. The channel will be grass lined and has a slope of 0.004 feet per foot. The channel flows in the subcritical regime with a Froude numbers around 0.62. It's velocity ranges around 5.5 fps is well within the stable operating conditions of Urban Drainage's Criteria. G. Storm Sewer Minimum storm sewer pipe sizes are shown on the drainage plan, where conveyance of the major storm through down stream basins is required. It is assumed that all piping will be class III reinforced concrete pipe. The pipes were sized based on tributary developed major storm runoff and full flow capacity of a pipe at 0.5% slope. Construction plans for any proposed storm sewer design must be accompanied by full hydraulic analysis of the sewer system which accounts for system headlosses and the backwater effects of pressurized pipes. It is anticipated that peak flows from the annexation site do not coincide with peak flows in Clear Creek. IV. CONCLUSIONS A. Impact of Improvement Presently, there are no known drainage problems on the site. Water quality enhancement commensurate with all development of is site is proposed to mitigate any adverse impacts. B. Compliance with Applicable Criteria As discussed before, attenuation of the developed watershed is not proposed using detention ponds. Streets are not proposed as conveyance elements for the major storm runoff so velocities and flow depths will not be excessive. Channel flow depths, velocities, and flow regimes are in compliance with Urban Drainage design guidelines. C. Wheat Ridge Zoning Ordinances The proposed development is in compliance with Wheat Ridge Zoning Ordinances. V. Properly installed tile drains below the foundation and minimal surface watering near the foundation help prevent seepage into basements and minimize the effects of shrinking and swelling. On the Kutch soil, the deep cuts needed to provide a sufficiently level building site can expose bedrock. Buildings and roads should be designed to offset the limited ability of the soils to support a load. The risk of settlement can be minimized by compacting the building site before construction begins. Because runoff on Urban land is rapid, storm drains, natural drainageways, and land grading must accommodate increased flows to prevent flooding downslope in areas that normally would not be subject to flooding. Special sewage systems must be installed because of the slope and slow permeability. Effluent from absorption fields can surface downslope and create a health hazard. Topsoil can be stockpiled and used to reclaim areas disturbed by cutting and filling. Cuts and fills should be seeded or mulched. TV ,nver and Kutch soils are in capability subclass Vie, in the Clayey Foothill range site, and in plant adaptability group F-1. Urban land is in capability class VIII. It is not assigned to a range site or to a plant adaptability group. 34-Denver-Urban land complex, 0 to 2 percent slopes. The areas of this complex are on high terraces, tablelands, and fans. The average annual precipitation is 13 to 17 inches, the average annual air temperature is 47° F, and the average frost-free season is 126 to 142 days. Elevation is 5,200 to 6,500 feet. Denver soil makes up 65 percent of this complex, and Urban land makes up 20 percent. The Denver soil and Urban land are so intricately intermingled that it was not practical to map them separately. Included in mapping are small areas of Englewood soils in small drainageways, Nunn soils in positions similar to those of the Denver soil, and Ulm soils on hill slopes. Urban land makes up more than 20 percent of some mapped areas. Also included are small areas that are less than 20 percent Urban land and are mainly parks, playgrounds, vacant lots, and small fields and pastures. I will attempt in this letter to address the concerns you have raised. The annexation ordinance and map have been recorded, so the annexation is official. On the annexation map, we changed the reference to Book Number 1955 to 1855. While the annexation creates an enclave and the Table Mountain Animal Shelter is located within the enclave, the Municipal Annexation Statute allows us to unilaterally annex an enclave only after the property has been surrounded for three years. Even though the statute enables us to annex the enclave, it doesn't require us to. Hopefully, there will be some resolution to the animal shelter and any land swap by then. In the interest of fostering good working relationships with other local governments, I would hope we wouldn't pursue annexation of the enclave without the County's consent. On a related matter, the list attached to your letter cites C.R.S. 31-12-107 (6) which prohibits the annexation of an area if an annexation election has been held within the previous twelve months. We are unaware of any annexation election affecting the properties involved. We are not sure how this portion of the annexation statute applies to the Jefferson County ownership. Traffic studies are on-going. FHU is compiling the information necessary for the 1601 process and I anticipate amendments to the traffic impact study will be submitted to the City as part of our zoning process. I will make sure you receive a copy when we do. The applicant continues to work with County Open Space staff to arrive at a good solution to the trail connection. The contractor performing the excavation and fill is required to obtain the appropriate permits from the State for air quality and stormwater runoff. We are setting up the process for neighbors to call in with complaints and they will be informed of the procedure at a meeting that is occurring on March l0a'. I believe the covenants have been recorded and apply to all of the Cabela's and Coors land that was annexed. Arguably the covenants you cite could apply to an animal shelter. I would offer that as part of your negotiations with Cabela's on the land trade, a condition of the trade be that the covenants would be amended so that they don't apply to the new site. The covenants would still apply even if we disconnected the site from the City, so an amendment to the covenants is probably the best course of action for the County. The floodplain review is being addressed as part of the temporary access crossing and the permanent creek crossing for Cabela Drive. Martin/Martin engineers, Tim Paranto, and Urban Drainage have been involved in these issues. Just to let you know, we are recommending that Cabela's obtain the easement across County property prior to approval of the plat so that we are assured that Cabela Drive is continuous and doesn't dead-end at the Creek. I am not certain what the time frame may be for the County to grant this easement. As a condition of approval, we will request that the applicant agree to contact the County Historical Commission to arrange for documentation of the Salter house. As I understand the arrangement with the Salter family, Cabela's will own the property, but a life estate will be placed on the property enabling Ms. Salter to live on the property until she passes away. It will then revert entirely to Cabela's ownership and demolition is planned. That would be the appropriate time to have the Historical Commission conduct the documentation. WHEREAS, pursuant to the laws of the State of Colorado, there was presented to the City Council of the City of Wheat Ridge, Colorado, a written petition for annexation to the City of that property described in attached Exhibit A, being contiguous unincorporated territory contiguous to the City and lying in the County of Jefferson, State of Colorado (the Property); and WHEREAS, the Property is further described on the Annexation Map attached hereto as Exhibit B; and WHEREAS, the Petitioners constitute more than fifty percent (50%) of the owners, and owning more than fifty percent (50%) of the Property; and WHEREAS, the City Council has conducted a public hearing following public notice as required by law to determine the eligibility for annexation of the Property; and WHEREAS, the City Council has satisfied itself concerning the eligibility for annexation of the Property, and concerning the conformance of the proposed annexation to the applicable law and the annexation policy of the City; and WHEREAS, the City Council hereby finds that the Property is eligible for annexation to the City and that the proposed annexation conforms with applicable law and the annexation policy of the City. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE, COLORADO: Section 1. The annexation to the City of Wheat Ridge, Colorado, of that Property described in attached Exhibit A, lying in the County of Jefferson, State of Colorado, meets all requirements of law and the annexation policy of the City of Wheat Ridge, and the same is hereby approved and made effective. Section 2. Zoning of the Property shall be accomplished within the time established by C.R.S. 31-12-115 and the procedures established by the Home Rule Charter and Code of Laws of the City of Wheat Ridge. Section 4. Immediately upon completion of the filing required by Section 6 hereof, the annexation shall be effective and the Property shall become subject to the laws of the State of Colorado pertaining to cities and to the Charter and all ordinances, resolutions, rules and regulations of the City of Wheat Ridge. Section 5. One copy of the Annexation Map, together with the original of this Ordinance, shall be filed in the office of the City Clerk. Section 6. The City Clerk shall file for recording three certified copies of this Ordinance and the Annexation Map with the Clerk and Recorder of the County of Jefferson, State of Colorado. Section 7. This Ordinance shall become effective upon adoption on second reading, as permitted by Section 5.11 of the Home Rule Charter. WHEREAS, an annexation petition was filed with the City requesting the annexation of certain unincorporated territory located in the County of Jefferson and State of Colorado, otherwise known as the Coors/Cabela's/Salter property, and hereafter described in Exhibit A which is attached hereto and made part hereof; and WHEREAS, said petition was forwarded to the City Council; and WHEREAS, the City Council of the City of Wheat Ridge, Colorado, found substantial compliance of said petition with C.R.S. Not less than one-sixth of the perimeter of the area proposed to be annexed as described on attached Exhibit A is contiguous with the existing boundaries of the City of Wheat Ridge as required by law. Section 3. A community of interest exists between the area proposed to be annexed as described on attached Exhibit A and the City of Wheat Ridge and the area will be urbanized in the near future. The limitations of the Municipal Annexation Act and the Constitution of the State of Colorado do not prevent the annexation of the subject property of any part thereof since: a. No land in the area to be annexed which is held in identical ownership and consists of either a single tract or parcel, or two or more contiguous tracts or parcels has been divided or any portion thereof excluded from the area to be annexed without the written consent of the owners thereof, b. No land in the area to be annexed which is held in identical ownership and comprises twenty (20) or more acres, having an assessed valuation for ad valorem tax purposes in excess of $200,000.00 in the year next preceding the annexation, has been included in the area to be annexed without the written consent of the landowners; c. No proceedings have been commenced by another municipality for the annexation of all or part of the area to be annexed by the City of Wheat Ridge; and d. The annexation will not result in the detachment of the area from the school district in which it is currently located. Section 6. The petition for the annexation of that real estate described on attached Exhibit A meets the requirements of law and is in proper order for annexation of the property proposed to be annexed as described in attached Exhibit A. Section 7. No election is required pursuant to C.R. S. Section 31-12-107(2) or any other law of the State of Colorado or the City of Wheat Ridge. Section 8. The proposed annexation will not have the effect of extending a municipal boundary more than three miles in any direction from any point of the City boundary in any one year. Section 9. The entire width of any street or alley to be annexed is included within the annexation. Section 10. The property described on the attached Exhibit A is eligible for annexation to the City of Wheat Ridge and all requirements of law have been met for such annexation, including the requirements of C.R.S. Alan White was sworn in by the Mayor and presented the staff report on Item 3A., 3B., and 3C. Representatives of the applicant were sworn in and testified before the Council Neil Jaquet, 17755 W. 32ntl Avenue (business address), Director of Water Resources and Real Estate, Coors Brewing Company, Golden, Colorado, was sworn in by the Mayor. Mr. Jaquet stated Coors' desire to be annexed to the City of Wheat Ridge. They are expecting that this project will bring jobs and tax dollars to the area. He described future plans for the reservoir and the development on the various parcels. Kevin Rhodes, Director of Real Estate for Cabela's, was sworn in by the Mayor and made a presentation describing the project. Cabela's wants to be a good neighbor and they understand about traffic and will address that at future meetings. They want to create a win-win situation for everybody. He announced that Cabela's welcomes comments on a community outreach line at (303) 376-8394. They also have the intent of putting up a website. Dennis Armstrong, Corporate Architect for Cabela's, was sworn in by the Mayor. He explained the traffic study process that has already taken place and will take place in the future. Their goal is to put a quality project in place. Mark Nienhueser, Construction Manager for Cabela's. He explained the reasons for the special use permit, such as to complete the mining and reclamation obligation that is outstanding on the property; to create the water storage facility for Coors; to grade the site in a manner consistent with the Wheat Ridge Comprehensive Development Plan. They will be lowering the elevation of the Denver Water Line that bissects the property. The critical issue is that this work has to be done between April 15 and May 15, which is the only period of time that Denver Water will allow for this line to be changed due to its critical nature of their system in keeping the water flowing from the mountains to their treatment facilities. They may have to work some Sundays to get this completed. This will only be for the one month not the length of the project. Mr. DiTullio asked staff and the City Attorney for the record if the applicant had followed all the relevant rules and regulations in regards to the annexation or if there was anything outstanding. City Attorney replied that they had followed and met the requirements pertaining to annexation. Mr. DiTullio asked the same question pertaining to the Special Use Permit. Answer was yes, they had followed the procedures. Mr. White will suggest some changes to conditions when we are ready to make a motion. Mr. DiTullio asked who will be enforcing the regulations once this is approved. Answer was there are some state permits involved, but it will primarily be the City of Wheat Ridge. Jack Hoopes, 14215 Crabapple Road, representing Clear Creek Valley Neighborhood Council, stated they are not opposed to the Cabela's project, but urged that the schedule be resolved to accommodate extensive collaboration, consultation and responsiveness to neighborhood issues. John Retrum, 13491 West 26th Avenue, Golden, Vice President of the Applewood Property Owners Association, stated the majority of his neighbors are against the annexation and would like to see the land remain undeveloped or improved as Open Space. However, they understand that this is private property and there are development rights that go with it. Their main concerns were increased traffic and preserving wildlife habitat. The process is moving too quickly, please slow down. Greg Stevinson, 1546 Cole Blvd., Lakewood, President and speaking on behalf of the Denver West Metropolitan District, is not opposed to Cabela's going into the City of Wheat Ridge. Engage all of the neighbors that are going to be impacted. Traffic is the number one concern and they would like to see all of the improvements in place before Cabela's opens. Kevin McCaskey, 2091 Braun Drive, Golden, Jefferson County Commissioner, wanted to make it clear that the Board of County Commissioners is ecstatic that Cabela's has decided to come to Jefferson County. We welcome Cabela's. He reaffirmed the County's commitment to be actively involved, to listen to and advocate for the citizens living in unincorporated Jefferson County, but those constituents that are mutual. They have a position on an acceptable traffic plan with the improvements being made prior to the opening of Cabela's. They expect the traffic analysis to include all reasonable alternatives for access to the site and future commercial development of the site. We will coordinate with the City of Wheat Ridge and Cabela's to ensure that our citizens' concerns are heard and we are only interested in constructive resolution to develop the best solution for our entire community. Philip Barru, 14385 Foothill Road, Golden, member of the board of Applewood Property Owners Association, speaking as a private citizen and future neighbor of Cabela's, requested to postpone the decision to get more information on the many issues presented here tonight. He is very concerned about cycling and pedestrian safety. Roxanne Runkel, 3415 Alkire Way, Golden, is concerned for her horses safety and her own; is also concerned about property values going down and taxes going up. Pleaded with Coors and Cabela's to work with Jeffco Open Space, Wheat Ridge Park & Rec. and the Prospect Recreation and Parks District to provide a private lakeside property owner walking trail. She also asked if they could be provided with resident status as far as using the Rec Center. CITY COUNCIL MINUTES: February 28, 2005 Page -8- Matt Ratterman, 2072 Coors Drive, Unincorporated Jefferson County, asked to table this item tonight until the plan is more fully developed. Amy Hodges, 13690 W. 31" Avenue, Golden, Treasurer of the Applewood Property Owners Association, is concerned about the impact to the environment. They don't oppose Cabela's, but slow down the process. Flora Andrus, Fairmont Recreation and Park District, restated that we need a traffic study that addresses the entire potential build-out of this area that is being included in the Comprehensive Plan. Janice Thompson, 12290 West 42"d Avenue, Wheat Ridge, feels this is an excellent opportunity for all of us to get together and get the Colorado State Highway Department to correct the traffic situation. Don't lose a wonderful, family oriented business. She is for the annexation. Dave DiGiacomo, 3275 Quail Street, Wheat Ridge, stated that he had submitted a letter with many questions, but had not received an answer. The people impacted by this have no voice and no vote. Michelle Majeune, 13081 West 29th Avenue, Golden, asked for consideration regarding the excavation, such as dust control, noise abatement, monitoring of permit compliance and maybe a more detailed survey map. There may not be enough money available for the best traffic solutions. Motion by Mrs. Rotola to proceed past 11:00 p.m.; seconded by Mr. Schulz; carried 7-1 with Mr. Gokey voting no. Teri Dalbec believes that a lot of Wheat Ridge citizens aren't here tonight because they don't know about it and don't know what the tax impact is going to be. This annexation needs to be postponed and looked at more carefully. Mr. White answered some of the questions that had been raised during the public hearing. He also entered into the record case files, packet materials and the visual presentations. Mr. Dahl stated that many people had sent cards, letters, notes, e-mails, various things, and those are all in the case file that Mr. White mentioned and are now part of the hearing record. They have been duplicated and have been provided to Council. He added that Council had previously enacted Ordinance 1316, which specifically amended the special use permitting process and eliminated the prior requirement for a planning commission hearing. Mrs. Anderson stated that Mr. Dean Munford, 13041 West 29th Avenue, had left 2 questions by her desk. Has the new highway interchange be considered? Who will be responsible for the increased sewage? CITY COUNCIL MINUTES: February28, 2005 Page -9 Mr. DiTullio asked what the liabilities are for the City if the annexation goes through and the Cabela's project falls through. Mr. Dahl stated if the development doesn't go forth, the City's obligations cease and the City is able to simply terminate that agreement. The City's obligations are exclusively dependent upon the performance and construction by Cabela's. Mr. Schulz asked that somebody explain more about how the 3% tax becomes a I% tax and for how long that will be. Tim Leonard, representing the City in the financial negotiations and analysis, testified regarding questions on the sales tax and the tax share agreement. Dennis Armstrong, of Cabela's, answered questions raised by testimony and Council members. Mark Nienhueser of Cabela's stated that as far the grading permit was concerned, they could live with the hours between 7:00 a.m. and 9:00 p.m. with a limitation of 6 days per week, except for that window of opportunity between April 15 and May 15, when they need the ability to work 7 days per week. They would commit to developing a process that allows the neighbors to report violations to the City. Kevin Rhodes of Cabela's concluded that there will be more public hearings, they have established the communications line; Cabela's has sent out acknowledgement letters to everybody who has contacted them and if they can be patient they will get the answers. The Municipal Annexation Act establishes the procedures for annexation of unincorporated territory by a municipality. The attached resolution establishes the findings of fact regarding the eligibility of this property for annexation. All of the requirements for annexation under the Municipal Annexation Act have been met. COMMISSION/BOARD RECOMMENDATION: None. Only the Council acts upon annexation petitions. STATEMENT OF THE ISSUES: Originally Cabela's and Coors intended to submit annexation petitions along with an Outline Development Plan and the required documentation for a rezoning request. These two requests were to be processed concurrently and scheduled for public hearings on the same night. While the City was processing the annexation and zoning requests, Cabela's and Coors were going to seek the necessary approvals from Jefferson County and the State to proceed with excavation and leveling of the property in question. It became apparent that it would be more efficient if Cabela's and Coors dealt with only one jurisdiction, the City of Wheat Ridge, with regard to development issues. Cabela's and Coors have elected to request annexation separately from the zoning request, and will submit an application for a Special Use Permit to undertake the excavation and leveling of the site. If City Council approves the annexation on February 28`", under the Municipal Annexation Act, the City is required to zone the property within 90 days. The zoning request and the Outline Development Plan will be submitted and reviewed such that this requirement will be met. It is also anticipated that at least two Final Development Plans and a final plat will be considered by Council at the same hearing as the Outline Development Plan. These plans will also be reviewed by Planning Commission. The decision to annex a property is a legislative decision of City Council. The 1/6 contiguity requirement is met. There is a plan in place for the area to be annexed. The petitioners represent more than 50% of the landowners owning more than 50% of the land proposed for annexation. There is a community of interest between the City and the land to be annexed, the area is surrounded by urban development and likely will be urban itself in the near future, and the area is capable of being integrated with the City. The annexation will not extend the boundary of the City more than three miles. The area meets the annexation eligibility requirements established in the Municipal Annexation Act. ALTERNATIVES CONSIDERED: The City Council has two options to consider: 1. Adopt a motion adopting the resolution. 2. Adopt a motion denying the resolution. FINANCIAL IMPACT: The annexation of the property will create an immediate responsibility of the City to provide police protection, thus incurring some financial impact which is unquantifiable at this time.. With development of the property, the City will receive sales and property tax revenues generated by the businesses and improvements on the property. The City will receive one-time use tax revenue on building materials and one-time fees for annexation, zoning, and engineering review. No land in the area to be annexed which is held in identical ownership and comprises twenty (20) or more acres, having an assessed valuation for ad valorem tax purposes in excess of $200,000.00 in the year next preceding the annexation, has been included in the area to be annexed without the written consent of the landowners; c. No proceedings have been commenced by another municipality for the annexation of all or part of the area to be annexed by the City of Wheat Ridge; and d. The annexation will not result in the detachment of the area from the school district in which it is currently located. Section 6. The petition for the annexation of that real estate described on attached Exhibit A meets the requirements of law and is in proper order for annexation of the property proposed to be annexed as described in attached Exhibit A. Section 7. No election is required pursuant to C.R. S. Section 31-12-107(2) or any other law of the State of Colorado or the City of Wheat Ridge. Section 8. The proposed annexation will not have the effect of extending a municipal boundary more than three miles in any direction from any point of the City boundary in any one year. Section 9. The entire width of any street or alley to be annexed is included within the annexation. Section 10. The property described on the attached Exhibit A is eligible for annexation to the City of Wheat Ridge and all requirements of law have been met for such annexation, including the requirements of C.R.S.
