HomeMy WebLinkAboutZOA-05-04INTRODUCED BY COUNCIL MEMBER SCHULZ Council Bill No. 05-2006 Ordinance No. 1355 Series of 2006 TITLE: AN ORDINANCE AMENDING CHAPTER 26 OF THE WHEAT RIDGE CODE OF LAWS PERTAINING TO REFERENCES TO THE STREETSCAPE AND ARCHITECTURAL DESIGN MANUAL WHEREAS, the City of Wheat Ridge has adopted legislation pertaining to the development standards for the commercial zone districts; WHEREAS, the City of Wheat Ridge has adopted legislation pertaining, to streetseape and architectural` design guidelines; WHEREAS, there are no cross references between the two different sets of standards; BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE, COLORADO THAT- Section ) 1. Section 26-216. Neighborhood Commercial District (NC) of the Wheat Ridge Code of Laws is hereby amended as follows: A. Intent and purpose: This districtis established to provide for a reasonably compatible transition between residential and more intensive commercial land uses. It provides for residential scale; neighborhood-oriented professional offices and services which, by their nature and through design limitation, will promote neighborhood stability and protect neighborhood values and character. The district also provides limited neighborhood-oriented retail uses by special use approval. This district was fonnerly titled the "Restricted Commercial One (RC-1) District," is hereby renamed, and the title of said district is hereby changed on the official zoning map. B. Development standards: 12. Streetscape and Architectural Design Guidelines. See Streetscape and Architectural Design Manual, as may be amended from time to time. 1 Section 2. Section 26-217. Restricted Commercial District (RC) of the Wheat Ridge Code of Laws is hereby, amended as follows: A. Intent and purpose. This district is established to accommodate various types of office uses performing administrative, professional and personal services, and to provide for a limited range of retail uses which are neighborhood oriented. It is the intent that general retail uses that serve the community or region, wholesaling, warehousing, industrial, and uses which require outside storage or display be prohibited, since these uses are incompatible with other uses in this district. B. Development standards. 12. Streetscape and Architectural Design Guidelines: See Streetscape and Architectural Design Manual, as may be amended from time to time. Section 3. Section 26-218. Commercial-One District (C-1) of the Wheat Ridge Code of Laws is hereby amended as follows: A. Intent and purpose. This district is established to provide for areas with a wide range of commercial land uses which include office, general business, and retail sales and service establishments. This district is supported by the community and/or entire region. ` B. Development standards. 12. Streetseape and Architectural Design Guidelines. See Streetscape and Architectural Design Manual, as may be amended from time to time. Section 4. Section 26-219. Commercial= Two District (C-2) of the Wheat Ridge Code of Laws is hereby amended as follows: A. Intent and purpose. This district is established to provide for areas with a wide range of commercial land uses which include office, general business, more intensive retail sales, wholesale businesses, and fight manufacturing.; This district generally depends on the entire region for the market area. Light Industrial District (1). of the Wheat Ridge Code of Laws is hereby amended as follows; A. Intent and purpose. The intent of this district is to permit the use of previous Industrial (I)-zoned property for commercial and Iight industrial uses. Rezoning to Industrial (I) Zone District classification shall not be permitted; however, existing Industrial (I)-zoned property. may be developed and used in accordance with provisions set forth herein. B. Development standards. 12. Streetscape and Architectural Design Guidelines: See Streetseape and Architectural Design Manual, as may be amended from time to time. Section 6. Safety Clause. The Cityi of Wheat Ridge hereby finds, determines, and declares that this ordinance is promulgated under the general police power of the City of Wheat Ridge, that it is promulgated for the health, safety, and welfare of the public and that this ordinance is necessary for the preservation or health and safety and for the protection of public convenience and welfare. The City Council further determines that the ordinance bears a rational relation to the proper legislative object sought to be attained. Section 7. Severability. If any clause, sentence, paragraph, or part of this Zoning code or the application thereof to any person or circumstances shall for any reason be adjusted by a court of competent jurisdiction invalid, such judgment shall not affect application to other persons or circumstances. Section! 8. Supersession Clause. If any provision, requirements or standard established by this Ordinance is found to conflict with similar provisions, requirements! or standards found elsewhere in the Code of Laws of the City of Wheat Ridge, which are in existence as of the date of adoption of this Ordinance, the provisions, requirements and standards here shall supersede and prevail. 3 Section 9. Effective Date. This ordinance shall take effect 15 days after final publication. Section 2.0 of the manual relates specifically to architectural standards in the City of Wheat Ridge which pertain to requirements regarding fagade design, screening of mechanical equipment and acceptable architectural materials. These architectural standards are required to be met for the development of any property within the Architectural Design Overlay District which is defined as all properties with NC, RC, C-1 C-2, I and PD zoning. The individual zone district development standards in Chapter 26 do not reference the required streetscape and architectural standards. The proposed ordinance adds a reference to the Streetscape and Architectural Manual in each of the affected zoning district development standards. Planning Commission reviewed the proposed ordinance at a public hearing held on December 1, 2005. A recommendation of approval was given. The proposed ordinance assists in achieving the Council's goal of being prepared for growth by providing clearly defined development standards and guidelines. COMMISSION/BOARD RECOMMENDATION: Planning Commission reviewed this case at public hearing held on December 1, 2005. A recommendation of approval was made for the following reasons: 1. The City of Wheat Ridge has adopted legislation pertaining to the development standards for the commercial zone districts; 2. The City of Wheat Ridge has adopted legislation pertaining to streetscape and architectural design guidelines; 3. There are no cross references between the two different sets of standards. With the following condition: That the following language be added behind reference to architectural and streetscape standards as follows: "as may be amended". There was no testimony from the audience given regarding this code amendment. Planning Commission's recommended modifications have been incorporated into the proposed ordinance. STATEMENT OF THE ISSUES: Staff is trying to improve customer service by providing cross-references between the zoning and development code zone district standards and the Streetscape and Architectural Design Manual. There are no outstanding issues. ALTERNATIVES CONSIDERED: Do not modify the regulations. FINANCIAL IMPACT: There is no financial impact to the City if these code changes are approved. RECOMMENDED MOTION: Option A: "I move to approve Council Bill. Alan White stated that the city has not yet heard from the applicant and noted that City Council is considering the suspension of acceptance or review for applications in this area until the sub-area plan is completed. He also stated that a meeting was held with business owners regarding the sub-area plan and, according to an RTD representative present at the meeting, the Gold Line and transit station near Ward Road seems to be a reality. He will inform Planning Commission of the next meeting for the sub-area. 9.
