(Case No. MS-01-02) (Mike Jones) Item 2 was introduced by Mr. DiTullio, who also read the title, summary and background Michael Jones, applicant, was sworn in by the Mayor. He explained that he will build his own personal residence on the largest of the three lots and 2 duplexes on the other two. Meredith Reckert was sworn in by the Mayor and presented the staff report. Mr. DiTullio asked two questions of Ms. Reckert: Has the applicant has met all the conditions required by the current zoning laws for Wheat Ridge? The answer was yes. Are there any current outstanding issues on this project? The answer was no. Mr. DiTullio asked the applicant if he understands all the conditions that have been required by the Planning Department and City Council. The answer was yes. Motion by Mr. DiTullio to approve Case No. MS-01-02, a request for approval of a final subdivision plat for property located at 6745 West 32nd Avenue for the following reasons: 1. All requirements of the City's Subdivision regulations have been met. 2. Fax # 235-2949 Per my phone message yesterday, your parkland dedication may be tied into the subdivision improvement agreement, and handled at time of building permit. The subdivision improvement agreement will secure all required public improvements, e.g. curb, gutter and walkway adjacent to your subdivision. Your parkland dedication for Lot 1 will be $502.50. This number is arrived by taking the number of dwelling units (1) and multiplying it by 0.016. This figure is multiplied by the assessed valuation of the lot. A price per square foot is determined for the lot by taking the assessed valuation of the subdivision ($64,800) and dividing it by the square footage of Lot 1 (55,229), giving Lot 1 a price per square foot of $1.1733. This price per square foot is then multiplied by the square footage of Lot 1 (55,229) and the valuation of Lot I is determined to be $31,405.72. REQUEST The property in question is located at 6745 Pierce Street and is currently zoned Residential-Two (R-2) (Exhibit 1, Zoning Map). Until very recently, the property had several operational greenhouses and accessory structures. The applicant has since applied for and received a demolition permit to remove those structures. The applicant requests approval of this minor subdivision for the purpose of constructing a single family dwelling on Otis Street, and two duplexes on Pierce Street (Exhibit 2, Applicant Letter, Exhibit 3, Application with deed). II. NEIGHBORHOOD MEETING A neighborhood meeting was held on July 17, 2001 at the Municipal Building located at 7500 W. 29`h Avenue. There were about fifteen attendees, and most everyone had a very positive response to this development. All of the attendees were excited to see this parcel developed. There were questions about building material, character and orientation of the structures, and if the units would be rentals or owner occupied. There were questions about the landscaping on each of the lots as well. A synopsis of the meeting and a sign-in sheet have been included for review (Exhibit 4, Synopsis and Exhibit 5, Sign-in Sheet). III. SUBDIVISION PLAT This minor subdivision will create three lots (Exhibit 6, Subdivision Plat). The first lot (Lot 1) will face Otis Street, and will contain a single family residence. Lot 1 is 26,767 square feet and is 119 feet in width. The R-2 zone district requires a minimum lot size of 9,000 square feet and 75 feet in width for a single family residence. The remaining two lots (Lots 2 and 3) will face Pierce Street, and each lot will contain a duplex. Since this property is zoned R-2, there is no rezoning process necessary. Both of these lots meet the minimum lot standards as defined in Section 26-209, in respect to lot width (100 feet) and minimum lot area (12,500 square feet) required for a two-family dwelling. Lot 3 is 14,256 square feet and 129 feet in width. Lot 2 is 14,206 square feet and is 122 feet in width along Pierce Street, and is 94 feet in width along West 32nd Avenue. Chapter 26 requires any corner lot which is zoned R-2 to have a minimum lot width of 80 feet on each frontage. All other development standards, such as landscaping, building coverage and setbacks will be addressed at the time of building permit. Each lot will have the standard utility easements required by Xcel Energy around the perimeter of the property. These easements will be reserved for utility and drainage only. Note number 9 on the Plat contains the City's standard language for these easements. The City Traffic Engineer has indicated that it is undesirable to allow any new driveways along West 32"d Avenue at this location. Note number 8 on the Plat will restrict any access from West 32nd Avenue for any of the lots. There will be a five foot dedication required for the length of the property along Pierce Street. This dedication is shown on the plat. City Council will be accepting this dedication if the plat is approved. An environmental assessment was submitted for review by Staff. According to the assessment, no contaminates were found for this specific site. An environmental assessment documents all contaminants within a certain radius of the subject property, as well as indicating possible contaminants on the subject property. City CounciVMS-01-03 Last Greenhouse 2 IV. AGENCY REFERRAL All required agencies have been referred and a few have responded with comments. Any improvements will occur at the expense of the owner. Xcel Energy commented that each lot should contain their standard utility easement. The Public Works Department will require the construction of a small section of curb, gutter and sidewalk along Pierce Street to replace the driveway cut used for the greehouse. As referenced above, a plat note will restrict any vehicular access from West 32nd Avenue. Drainage will be reviewed and addressed at the time of building permit application. The Streetscape and Architectural Design Manual indicates Pierce Street and 32"d Avenue as `Neighborhood Residential Collectors'. Section 1.3.6.5 of the Manual states that detached sidewalks are preferred where feasible. New curb, gutter, an attached walk and pedestrian lighting were installed by the City along 32"d Avenue approximately 4 years ago. Removal of the existing attached walk and reconstruction with a new detached walk would provide a detached walk for only the portion of 32"d Avenue and Pierce Street fronting the property. It is likely that these would be the only sections of detached walk in this neighborhood for many years. It is recommended that detached walks not be required as part of this subdivision process. Consolidated Mutual Water has indicated that each structure must be served by a separate water tap, and each unit in the duplexes must have a separate water tap. The cost for these taps will be incurred by the owner. Wheat Ridge Sanitation has indicated that any cost for extension of the sewer main will be incurred by the owner. The applicant will be required to provide cash in lieu of land dedication for park purposes per the request of the Parks & Recreation Department. V. PLANNING COMMISSION ACTION Planning Commission heard this case on December 20, 2001, and recommended approval with one condition. The condition was a recommendation from Staff requiring the City's standard dedicatory language on the plat. This item has since been addressed, and need not be a condition of Council approval. VI. STAFF CONCLUSIONS AND RECOMMENDATION The requirements of the Subdivision Regulations have been met and the parcels meet the lot area and lot width requirements of the R-2 zoning district. Although the design is not yet complete, the home would be of Mediterranean style and approximately 3500 square feet in size. The remaining lots 14,904 and 14,799 square feet and are to be used for the construction of duplex homes. Each of these approximately 2,500 square foot homes will face Pierce street - currently a balanced mix of single family and duplex residences. In order to present a unified approach and harmonious look to the neighborhood, comparable design styles and material will be employed on all three buildings. I am in partnership with Hillcrest Builders of Arvada who has substantial experience in developments of this nature and specifically in Wheat Ridge. Issues discussed: The initial response to the proposal was very positive. There were some general questions about building materials, the orientation of the buildings, parking and drainage. There was a question about the buildings being owner occupied, or if they would be rentals. There was a question raised about the utilities for the property, and if they would need to be upgraded. A few different people seemed to be concerned about the landscaping for the new lots. It seemed that everyone was fairly pleased about this subdivision and development of the property because they thought it would enhance the neighborhood. PUBLIC FORUM There was no one to appear before the Commission. PUBLIC HEARING A. Case No. MS-01-02: Application by John Michael Jones for approval of a three-lot minor subdivision plat on property zoned Residential-Two and located at 6745 West 32"d Avenue. This case was presented by Travis Crane. He reviewed the staff report, entered all pertinent documents into the record and advised the Commission there was jurisdiction to hear the case. He presented slides and overheads of the subject application. Staff recommended approval of the application for reasons as outlined in the staff report. Commissioner McNAMEE expressed concern about possible ground contamination at the site from chemicals such as DDT since the area had been used for greenhouses for many years. John Michael Jones 1585 Leyden, Denver Mr. Jones, the applicant, was sworn in by Chair THOMPSON and entertained questions from the Commission. In response to Commissioner McNAMEE's concerns about possible ground contamination, Mr. Jones stated that an EPA study performed before he purchased the property revealed there were no hazardous materials on the property. Commissioner WEISZ asked if the proposed duplexes would be rented or sold. Mr. Jones replied that he understood the units would be sold. I. REQUEST The property in question is located at 6745 Pierce Street and is currently zoned Residential-Two (R- 2)(Exhibit 1, Zoning Map). Until very recently, the property had several operational greenhouses and accessory structures. The applicant has since applied for and received a demolition permit to remove those structures. The applicant requests approval of this minor subdivision for the purpose of constructing a single family dwelling on Otis Street, and two duplexes on Pierce Street (Exhibit 2, Applicant Letter, Exhibit 3, Application with deed). II. NEIGHBORHOOD MEETING A neighborhood meeting was held on July 17, 2001 at the Municipal Building located at 7500 W. 29' Avenue. There were about fifteen attendees, and most everyone had a very positive response to this development. All of the attendees were excited to see this parcel developed. There were questions about building material, character and orientation of the structures, and if the units would be rentals or owner occupied. There were questions about the landscaping on each of the lots as well. A synopsis of the meeting and a sign-in sheet have been included for review (Exhibit 4, Synopsis and Exhibit 5, Sign-in Sheet). III. SUBDIVISION PLAT This minor subdivision will create three lots (Exhibit 6, Subdivision Plat). The first lot (Lot 1) will face Otis Street, and will contain a single family residence. Lot 1 is 26,767 square feet and is 119 feet in width. The R-2 zone district requires a minimum lot size of 9,000 square feet and 75 feet in width for a single family residence. The remaining two lots (Lots 2 and 3) will face Pierce Street, and each lot will contain a duplex. Since this property is zoned R-2, there is no rezoning process necessary. Both of these lots meet the minimum lot standards as defined in Section 26-209, in respect to lot width (100 feet) and minimum lot area (12,500 square feet) required for a two-family dwelling. Lot 3 is 14,256 square feet and 129 feet in width. Lot 2 is 14,206 square feet and is 122 feet in width along Pierce Street, and is 94 feet in width along West 32"d Avenue. Chapter 26 requires any comer lot which is zoned R-2 to have a minimum of lot width of 80 feet on each frontage. All development standards, such as landscaping, building coverage and setbacks will be addressed at the time of building permit. Each lot will have the standard utility easements required by Xcel Energy around the perimeter of the property. These easements will be reserved for utility and drainage only. Note number 9 on the Plat contains the City's standard language for these easements. The City Traffic Engineer has indicated that it is undesirable to allow any new driveways along West 32"d Avenue at this location. Note number 8 on the Plat will restrict any access from West 32"d Avenue for any of the lots. There will be a five foot dedication required for the length of the property along Pierce Street. This dedication is shown on the Plat, and must be accepted by City Council. IV. AGENCY REFERRAL All required agencies have been referred and a few have responded with comments. Any improvements will occur at the expense of the owner. Xcel Energy commented that each lot should contain their standard utility easement. Planning Commission/MS-01-03 Last Greenhouse The Public Works Department will require the construction of curb, gutter and sidewalk along Pierce Street. A sidewalk intersection will be required at 32"d Avenue and Pierce Street. As referenced above, a plat note will restrict any access from West 32"d Avenue. Drainage will be reviewed and addressed at the time of building permit application. Consolidated Mutual Water has indicated that each structure must be served by a separate water tap, and each unit in the duplexes must have a separate water tap. The cost for these taps will be incurred by the owner. Wheat Ridge Sanitation has indicated that any cost for extension of the sewer main will be incurred by the owner. The applicant will be required to provide cash in lieu of land dedication for park purposes per the request of the Parks & Recreation Department. V. STAFF CONCLUSIONS AND RECOMMENDATION The requirements of the Subdivision Regulations have been met and the parcels meet the lot area and lot width requirements of the R-2 zoning district. Therefore, staff recommends APPROVAL for the following reasons: 1. All requirements of the City's Subdivision Regulations have been met. 2. The minimum lot size and lot width requirements of the R-2 zoning district have been met. VI. RECOMMENDED MOTIONS "I move that Case No. MS-01-02, a request for a three lot minor subdivision for property located at 6745 W. 32nd Avenue be APPROVED for the following reasons: 1. The ESA was performed according to the "Standard Practice for Environmental Site Assessments: Phase I Environmental Site Assessment Process" (American Society for Testing Materials 1527 - 94, 1994). The following environmental conditions are not included in the ASTM standard, and were not included in the project scope: ® Radon and radioactive materials survey Wetlands delineation Historical information preceding 1948 was not readily available, and was not used in the assessment. The ESA consisted of a review of historical information derived from: federal, state, and local records; interviews with persons knowledgeable of the property; and a site reconnaissance. The target property predominately consists of a 39,500 square foot greenhouse facility. Historically, the property and surrounding area have been agricultural land or residential developments along the front range urban corridor. Adjoining land is residential to the north, south, east, and west. The property is located on the northeast comer of the intersection of West 32"d Avenue and Pierce Street. Federal and state records indicate that there is one (1) site within a one-mile radius of the property that may be associated with recognized environmental conditions. During the site inspection, the following environmental conditions were observed: storage of small quantities of chemical fertilizers; aboveground diesel storage tank (500 gallons); underground cisterns used for non-potable water; and fiberglass aboveibelow ground storage tank used for irrigation water. All hazardous products and substances observed appear to be stored, used, and otherwise managed responsibly. Considering these observations and the information contained in this ESA, potential for significant environmental conditions appear to be minimal. . Phase I Environmental Site Assessment it AS 4CO111-715 6745 West 32nd Avenue Wheat Ridge, Colorado 2.0 INTRODUCTION A Phase I ESA was conducted on the property located at 6745 West 32"d Avenue, Wheat Ridge, Colorado. The property and vicinity are shown on the Site Location Map (Figure 1). This report presents the findings and conclusions of the ESA. This report is organized into six sections and four appendices. Following this introduction, the Site Description section provides basic characteristics about the property and vicinity. The Records Review section describes the information collected during the review of publicly available information. The Site Reconnaissance section describes the information obtained during the site visit. The Findings and Conclusions section summarizes the findings of the Phase I ESA. 2.1 Purpose The ESA was conducted to investigate the potential for recognized environmental conditions associated with the property. Recognized environmental conditions may exist when any hazardous substances or petroleum products are present, or likely to be present on a property under conditions that indicate an existing release, past release, or threat of material release into structures on the property or the ground, ground water, or surface water of the property. While no ESA can wholly eliminate uncertainty regarding the potential for recognized environmental conditions in connection with a property, the environmental conditions of the property have been investigated in accordance with ASTM E 1527 - 94. However, historical information preceding 1948 was not readily available, and was not used in the ESA. The ASTM standard was developed as a guideline for Phase I ESAs. One purpose of this ESA is to satisfy the "innocent land owner requirements" under the Comprehensive Environmental Response, Compensation and Liability Act as defined in 42 USC Section 9601(35)(B). WHEATRIDGE, COLORADO C01 11-A i 2.2 Site Description The property is located at 6745 West 32"d Avenue in the SW/4 of the NW'/<, Section 25, Township 3 South, Range 69 West in Jefferson County. The property is owned by Euser Greenhouses, Inc., 6745 West 32nd Avenue, Wheat Ridge, Colorado. The property is bounded to the south by West 32nd Avenue, to the west by Pierce Street, and to the east by Otis Street. The surrounding area consists of predominately residential land. The greenhouse facility consists of three agricultural sections, a common work area, and offices (Figure 2). Two boilers (natural gas/fuel oil) are used to heat the facility. The facility has one 50-kilowatt diesel-powered generator. Potable water is supplied by the local municipality. The facility utilizes one cistern (6 feet in diameter) for groundwater appropriation for use in irrigation, 18 feet in depth. In addition to the cistern, a water drainage/recovery system within the greenhouse is another source of non-potable water for irrigation. 2.3 Physical Setting Surface geology in the area is characterized by gravels and alluviums. Depth to the water table for the property and vicinity is commonly at a depth of 10 to 25 feet below ground surface. According to topographic information from the US Geological Service (USGS) 7.5 minute quadrangle map, the Clear Creek Tributary is located approximately 200 feet south of the property and Ashland Reservior is located approximately 3000 feet due southeast of the property. The USGS topographical map indicates that the property slopes to the east and that groundwater flow direction in the vicinity is expected to be east by northeast. PROJECT: FIGURE: WHEAT RIDGE, COLORADO C0111-A 2 2.4 Current and Past Land Uses The following sources were used to evaluate current and past uses of the property and adjoining properties: Aerial photographs search from 1948 to present USGS 7.5 minute quadrangle maps ® Interviews with the. property owner,, property operations manager, a nd Jefferson County Assessors Office. 2.5 The Property and Surrounding Area According to the above sources, the property and surrounding area historically has been agricultural, residential, or undeveloped land. The current owner purchased the property in 1959. At that time the property consisted of a 15,000 square foot greenhouse facility. The actual initial construction date is unknown at this time. Construction materials observed during site include: concrete, dirt, dynaglass, aspenite, wood, celotek, and steel. Heat system insulation that was observed appeared to be comprised of wrap fiberglass insulation. Although observations made during the site walk indicated no asbestos containing materials (ACM) or other hazards were present, given the age of the facility (over 30 years) there is potential that the fluorescent light ballasts may contain polychlorinated biphenyls (PCB). The surrounding properties are predominately residential. Properties to the north, south, east, and west are single family residential developments. 'Findings of the review are included in the discussion below. A summary is included in `Table 1. The environmental database is included in Appendix A. LUST 2 REGISTERED UST I Federal National Priorities List. The National Priority List (NPL) consists of properties with the highest priority for cleanup pursuant to EPA's Hazard Ranking System. According to the list, no NPL sites are located within a 1-mile radius of the property. Federal Comprehensive Environmental Response, Compensation and Liability Information System (CERCLIS). There are no CERCLIS-listed properties within a''/z-mile radius of the property. Federal Resource Conservation and Recovery System (RCRIS). The Resource Conservation and Recovery Information System includes two lists: (1) facilities on which treatment, storage, and/or disposal (TSD) of hazardous wastes occur, and (2) persons or entities that generate hazardous waste as defined and regulated by the Resource Conservation and Recovery Act _ (RCRA). There are no RCRIS TSD facilities located within a 1-mile radius of the property, and no hazardous waste generators are located on the property or adjoining properties. Federal Corrective Action Report (CORRACTS). The Corrective- Action Report identifies hazardous waste handlers with RCRA corrective action activity. `There were no CORRACTS properties listed within a 1-mile radius of the property. State Emergency Response and Notification System (ERNS). The State Emergency Response and Notification System includes reported hazardous substance releases and spills in quantities greater than the reportable quantity as defined and regulated by Comprehensive Environmental Response, Compensation and Liability Act (CERCLA). The Federal ERNS list indicates there have been no releases on the property. State List of Hazardous Waste Sites. According to the Colorado Department of Public Health and Environment there are no hazardous waste sites within 1-mile of the property. State Landfill and Solid Waste Disposal Sites. According to the Colorado Department of Public Health and the Environment there are no active or closed landfills or other solid waste disposal sites within '/2-mile of the property. Leaking Underground Storage Tanks (LUST). The Oil Inspection Section, Colorado Division of Labor and Employment lists two LUST sites located within a V2-mile radius of the property. State Registered Underground Storage Tank List. The Oil Inspection Section, Colorado Division of Labor lists one registered underground storage tank within 0.375 miles of the property. This site is Associated Florists located at 6475 West 29" Avenue.' 3.2 Local Records Local inquiry about the environmental conditions of the property and vicinity included an interview with personnel at the Wheat Ridge Fire Department, Jefferson County Hazardous Materials (Hazmat), and the Jefferson County Assessors. According to the Wheat Ridge Fire Department and Jefferson County Ha=at, no incidents involving hazardous substances or petroleum products have occurred on or near the property. Access to the property was obtained via Otis Street. The target property consists of a 39,500 square foot greenhouse facility. The following indications of recognized environmental conditions were observed on the property: • Chemical substances and petroleum products • One above ground storage tank • Cistern used for non-potable water 4.2 Hazardous Substances Hazardous substances observed on the property consisted of small quantities of fertilizers. A 35- gallon drum of Chem-Aqua 585 (contains sodium hydroxide and sodium nitrite) used for the treatment of boiler water was also observed. All of the chemicals, except for chemicals in the 35-gallon drum, were stored in the garage area on the northeast comer of the facility (Figure 2). A tapered or conical-shaped cistern located in the southwest corner of the property is approximately six (6) feet square and 18 feet in depth and is used as a rainwater and irrigation run-off collection system. The property has one water reservoir with approximate dimensions of 10 feet in diameter by 15 feet in depth which is located in the center of the facility just west of cooler #5. A pit approximately four (4) feet square by six (6) feet deep located in the northwest portion of the property collects air conditioning water from a ditch along the west side of the building and recirculates the water through a transfer pump back to the air conditioning system. The target property consisted of •a 39,500 square foot greenhouse facility. The areas adjoining and surrounding the property are comprised of residential properties. Based on a review of publicly available information, the property and surrounding properties historically were agricultural and residential. Federal, state, and local records` were reviewed. These records indicate that five (5) sites at an equal or higher elevation, within a 1-mile radius of the property may be associated with recognized environmental conditions. A summary of the environmental record search is located in Appendix B. The site reconnaissance consisted of a visual inspection of the property. The property is level with West 32"d Avenue and Otis Street. Plants/ Landscape immediately next to the building should be low-growing ground cover, not to exceed 18" mature height to allow for maximum natural visual observation and eliminate concealment for potential offenders. 4. Ground cover should not include rock material. Rocks can be used to break windows in the buildings and cars. Consider using natural products such as bark or mulch. BUILDINGS: 1. The building finish should be with an anti-graffiti paint or sealant. FENCING: 1. Consider using wrought iron fence instead of cedar. By putting up a wrought iron fencing around the property, you will minimize the chance of vandalism, graffiti and climbing. The initial investment in the fence will be higher, however the long term pay of by not having to repair the fence will be greater. SITE: 1. During construction, the property should be clearly posted with "No Trespassing" Page 1 of 1 signs. This may help deter trespasses, and allow the Police Department to cite offenders with the crime along with any others offenses that may be committed by trespassers. LIGHTING: 1. Exterior lighting around the buildings and in parking lots should be a minimum of 1.5 candle minimum maintained. This will provide for brightly lit areas that discourages criminal activity due to the illusion/ perception of observation and recognition.
