John and I met with Brian Monday afternoon at 4:00, 11/17/08
This was in regards to the ceilings on the 2"d floor being installed with %" drywall that is
not ceiling rated or sag resistant.
When John and I went upstairs the entire ceiling of the second floor (and the rest of the
house) were completely finished and painted. There was a young man actually installing
doors and they were ready to trim out.
John asked why everything was already done without an inspection or an approval from
the building department and Brian said that they have a time line to meet, and that the
engineer should have called John about it. John explained the conversation with the
engineer and Brian made no comment.
Brian kept flip flopping on the coatings issue and would first say that they sealed the
drywall first and than textured, and than they sealed after they textured, they mixed the
sealer into the drywall mud,etc... John asked what product they used and he said he got
it from a friend who owns a roof coating company (Pro Roof coatings) I think. Where all
three of us were standing there was six empty 5 gallon buckets of Glidden PRV primer
and sealer stacked up and no where on site was there any 5 gallon buckets or one gallon
cans of a product that possibly would come close to what data was provided to John.
We went to the basement and again all painting was done and we couldn't determine if
the green board drywall was removed from the ceiling.
Brian began to start blaming me for not telling him what type of drywall to us and John
showed him the inspection notice stating that they needed 5/8" drywall or %" sag
resistant drywall so Brian shifts to; I'm a homeowner and I should inform him of what he
needs to do. I told him, that from the beginning of his project when I first met him that if
he had any questions or needed me to come over to not hesitate to do so. (There are
numerous inspection stops to his place that were consultations.) Brian didn't respond.
John wrote up a correction notice for him and told him that he would be waiting to hear
back.

RE: Final Landscape Inspection
Dear Mr. Baillie,

A landscape final inspection for the property addressed above was conducted. Based on the inspection
the Planning Division is unable to sign off on the landscaping final. Below is a list of comments that
were generated as result of the inspection.
For properties with existing development, landscaping in addition to the existing
landscaping is required. One (1) street tree per seventy (70) feet of street frontage must be
placed within the front setback prior to the issuance of the certificate of occupancy.
According to the survey that was submitted with your building permit; the frontage your
property has along Wadsworth Blvd is over 200 feet long which requires two (2) street
trees.
Your property is addressed off of Wadsworth Boulevard; therefore the front setback is also
along Wadsworth Blvd. One tree already exists within the front setback area along the
east side of the home. An additional tree will be required to be placed within the first 30
feet back from the eastern property line.
2. The southern portion of the property adjacent to W. 48th Ave. is currently dirt. In all zone
districts, any area not covered by building, parking, sidewalks, or driveways must be
landscaped. This area of the property will need to receive some sort of landscape
treatment to fulfill this landscaping requirement.
Landscaping is defined in the City of Wheat Ridge code as a combination of living plants,
such as tress, shrubs, vines, groundcover, flowers, sod, or grass; and may include natural
features, such as rock, stone, and bark; and structural features, including but not limited to
fountains, reflecting pools, art work, screen walls, fences, and benches
Since there are extenuating circumstances due to the weather that prevent landscaping to be completed at
the time, an escrow account will be required to be set up with the City of Wheat Ridge to guarantee the
completion of the landscaping when conditions are better. The escrow will be for one and one-fourth
(1'/4) times the cost of the landscaping. A cost estimate for the landscaping not installed will need to be
presented to the Community Development Department to determine the escrow amount. The escrow will
not be released until all the landscaping is installed. If landscaping is not installed by the date of the
expiration of the escrow the city reserves the right to use such funds to have the required landscaping
placed on the property.
3. Currently, the property has access to W. 486 Ave via a dirt driveway. All driveway

connections with the public street must be paved between the property line and the existing
edge of asphalt of the street. In addition, the first twenty-five (25) feet of the driveway
from the property line back into site must be surfaced with concrete, asphalt, brick pavers,
or other hard surface.
The items listed above will be required to be addressed in order to receive a Certificate of Occupancy.

4.2 The Manufacturer will, upon request and pre-approval, provide 100% financing for the complete
installation of the window film to the end-user customer in either an installment purchase or lease
purchase format to be decided upon by customer.
5.0 Application
5.1 Examination: Examine glass surfaces to receive new film and verify that they are free from
defects and imperfections, which will affect the final appearance. Correct all such deficiencies
before starting film application.
5.2 Preparation:
a The window and window framing will be cleaned thoroughly with a neutral cleaning
solution. The inside surface of the window glass shall be bladed with industrial razors to
insure the removal of any foreign contaminants.
b Toweling or other absorbent material shall be placed on the window sill or sash to absorb
moisture accumulation generated by the film application.
5.3 Installation: The film shall be applied as to the specifications of the Manufacturer by an ADA.
Materials will be delivered to the job site with the manufacturer's labels intact and legible.
b. To minimize waste, the film will be cut to specification utilizing a vertical dispenser
designed for that purpose. Film edges shall be cut neatly and square at a uniform distance
of 1/8" (3 mm) to 1/16" (1.6 mm) of the window-sealing device.
C. Clear, clean water will be used to remove the water soluble overcoat that protects the
pressure sensitive adhesive. Water and film slip solution only will be used on the window
glass to facilitate the proper positioning of the film.
d. To insure efficient removal of excess water from the underside of the film and to maximize
bonding of the pressure sensitive adhesive, polyplastic bladed squeegees will be utilized.
e. Upon completion, the film shall have a dimpled appearance from residual moisture. Said
moisture shall, under reasonable weather conditions, dry flat with no moisture dimples
within a period of 30 calendar days when viewed under normal viewing conditions.
f. After installation, any left over material will be removed and the work area will be returned
to original condition. Use-all necessary means to protect the film before, during and after
the installation.
6.0 Cleaning
6.1 The film may be washed using common window cleaning solutions, including ammonia solutions,
30 days after application. Abrasive type cleaning agents and bristle brushes, which could scratch
the film, must not be used. Synthetic sponges or soft cloths are recommended.
7.0 Warranty
7.1 In that the film will maintain solar reflective properties without cracking, crazing, delaminating,
peeling, or discoloration. In the event that the product is found to be defective under warranty, the
film manufacturer (3M) will replace such quantity of the film proved to be defective. The
application shall be warranted by the film manufacturer (3M) for a period of five (5) years
additionally provide the removal and reapplication labor free of charge.
2.4 Transmission - Ultraviolet Light: When applied to 1/4" (6mm) clear glass, the total transmission of
solar ultraviolet radiation of air mass = 2 over the spectral range of 3000 to 3800 angstroms shall
not exceed when measured with an integrating sphere spectrophotometer as referenced by
ASTM E-903.
2.5 Shading Coefficient: When applied to 1/4" (6mm) clear glass, the shading coefficient and energy
transmittance and reflection are measured per ASTM E-903 and the shading coefficient is
computed in accordance with the established procedures defined by The ASH RAE Handbook of
Fundamentals.
2.6 Adhesive System: The film shall be supplied with a high mass pressure sensitive weatherable
acrylate adhesive applied uniformly over the surface opposite the abrasion resistant coated
surface. The adhesive shall be essentially optically flat and shall meet the following criteria: a.
Viewing the film from a distance of ten feet at angles up to 45 degrees from either side of the
glass, the film itself shall not appear distorted. b. It shall not be necessary to seal around the
edges of the applied film system with a lacquer or other substance in order to prevent moisture or
free water from penetrating under the film system.
2.7. Abrasion Resistance: The Manufacturer shall provide independent test data showing that the film
shall have a surface coating that is resistant to abrasion such that, less than 5% increase of
transmitted light haze will result in accordance with ASTM D-1044 using 100 cycles, 500 grams
weight, and the CS1OF Calbrase Wheel.
2.8. Safety Glazing: The film, when applied to either side of the window glass, shall pass a 100 ft/lb.
impact when tested according to ANSI Z97.
2.9. Tensile Strength: The film shall have an average tensile strength of 28,500 PSI when tested in
accordance with ASTM D882-95a.
2.10 Elongation: The film shall have an average elongation of 125% when tested in accordance with
ASTM D-2582-95a.
211 Break Strength (1 inch per width): The film shall have average break strength of 28 lbs. per mil of
film thickness.
3.0 Requirements of the Authorized Dealer/Applicator (ADA)
3.1 The ADA shall provide documentation that the ADA is certified by the Manufacturer of the window
film to install said window film as per the Manufacturer's specifications and in accordance with
specific requests as to be determined and agreed to by the customer.
3.2 Authorization of dealership may be verified through the company's 3M ID Number.
3.3 The ADA will provide a commercial building reference list of ten (10) properties where the ADA
has installed window film. This list will include the following information: * Name of building * The
name and telephone number of a management contact * Type of glass * Type of film * Amount of
film installed * Date of completion
3.4 Upon request, the ADA will provide a Glass Stress Analysis of the existing glass and proposed
glass/film combination as recommended by the film Manufacturer.
4.0 Requirements of the Manufacturer
4.1 The Manufacturer will insure proper quality control during production, shipping and inventory,
clearly identify and label each film core with the product designation and run number.

1.0 Scope This specification is for a shatter resistant and abrasion resistant window film which when applied
to the exterior window surface will help hold broken glass together and reduce the ultra-violet light that
normally would enter through the window. The film shall be called 3MTm ScotchshieldTm Safety and
Security Window Film.

2.0 Requirements of the Film
Film Material - Clear: The film material shall consist of an optically clear polyester film, with a durable
acrylic abrasion resistant coating over the surface. The film color is clear.
The Polyester film shall have a nominal thickness of 4 mils (0.004 inches).
There shall be no evidence of coating voids.
The film shall be identified as to Manufacturer of Origin (hereafter to be called Manufacturer).
2.1 U Value: The U Value of the film applied to 1/4" (6mm) clear glass shall be measured in
accordance with test procedures described in 3.2 for Emissivity.
2.2 Transmission - Visible: When applied to 1/4" (6mm) clear glass, the luminous transmittance shall
be nominal when measured with an integrating sphere spectrophotometer as referenced by
ASTM E-903 and calculated per ASTM E-308 using Standard Source "C" for average daylight.
2.3 Reflection - Visible: When applied to 1/4" (6mm) clear glass, the total luminous reflection from the
glass surface shall be nominal when measured with an integrating sphere spectrophotometer as

ceiling does not sag between rafters.
This is acceptable.

This letter is submitted in response to my on site meeting with Mr. Baillee on November 17, 2008, and our subsequent phone
conversation.
On November 13, 2008, Mr. Baillee submitted, via e-mail, a request to the Building Division, copied to Community Development
Director Kenneth Johnstone, for review and comment on the use of Pittsburgh Paints UC 80101 low-permeability primer as an
alternative method of compliance to Section R702.3.5 of the 2003 International Residential Code.
Mr. Baillee was contacted by me on November 14" to arrange an onsite meeting, which was scheduled for, and occurred on, November
17t°. At that meeting, I informed Mr. Baillee that a review of the submitted product had been conducted and, based on the submitted
product information, conversation with the product manufacturer concerning composition and application of the product, and the intent
of Section R702.3.5 of the 2003 International Residential Code, the product had been deemed as unacceptable for use as an alternative
method of compliance as set forth in Section R104.11 of the 2003 International Residential Code. Mr. Baillee and I discussed that the
finishing and painting of the wallboard was complete, and that it was no longer possible to verify the existing condition of the wallboard
or the method of application used for the primer proposed for use in your request of November 13`x. It was also discussed that
previously noted incomplete or incorrect drywall installation could not be verified as having been properly completed or corrected due
to the fact that the work had been completed.
As stated at our meeting, although it is not normally permissible for an engineer or design professional to prescribe a lessening or
violation of a specific code section, in an attempt to resolve this matter, I am willing to review and consider a wet-stamped letter from a
Registered Structural Engineer indicating that in his/her opinion, the wallboard is compliant with all applicable aspects of the 2003
International Residential Code. In lieu of such engineering letter, compliance with the requirements of the adopted codes will be
required. No further inspections will be performed until a resolution to this matter is achieved.
I respectfully request that you call to discuss this matter or in some manner inform me of your intended action no later than December
12, 2008. Your prompt attention to this matter would be greatly appreciated.

I have reviewed your request for approval of an alternative method in lieu of compliance with Section R702.3.5
of the 2003 International Residential Code, and, based on the submitted documents, am unable to approve your
request. The 2003 IRC Section R104.10 states that "the building official shall have the authority to grant
modifications for individual cases, provided the building official shall first find that special individual reason
makes the strict letter of this code impractical and the modification is in compliance with the intent and purpose
of this code and that such modification does not lessen health, life and fire safety and structural: " The intent of
Section R7023.5 is to prescribe the requirements for spacing of framing, attachment of gypsum wall board, and
application of water-based texture, and to address the need for increased thickness of panels when penetrating
products are applied. Based on my review of the Seal Krete product literature submitted, it is a penetrating
product, which under the intent of Section R702.3.5 requires compliance with footnote (d) of Table 7023.5. It is
my official determination that this product is not an acceptable alternative to compliance with the applicable code
sections.
You may appeal this decision to the Building Code Advisory Boazd in writing within ten (10) days of the date of
this decision. Your appeal must be based on a claim that the true intent of this code or the rules legally adopted
thereunder have been incorrectly interpreted, the provisions of this code do not fully apply, or an equally good or
better form of construction is proposed. Upon receipt of your appeal by the Building Division, your appeal wi1T
be forwarded to the board for consideration. If approved by the Board, a date and time for hearing shall be set.

4825 Wadsworth Boulevard talkina points
1. The permit for this project was initially issued on August 2, 2007. It ha been
extended twice, without fee, and the project has currently been underway for
almost 15 months.
2. To date, the project has required 31 inspections, 13 of which have failed (42%)
3. The Baillee's, through a contractor, requested permission to install a spray-
foam type of insulation that is not permissible under current code. While
permissible under an exception to the soon-to-be adopted 2006 energy code,
their contractor was unable to demonstrate compliance with the exception
requirements in that code. The spray-foam insulation was instalied by the
contractor anyway.
4. The Baillee's had a 15 item list of corrections on the drywall inspection
perFormed for them on 10/16/08, including item #15, which states "All ceilings to
be ceiling rock or 5/8"." On 10/20/08, a re-inspection of the drywall was
pertormed, and 4 items, including item #15 from the previous inspection, were
not addressed.
5. On 10/21/08, Mr. Baillee visited the Building Division office to present
information on a proposed alternative, the use of Seal Krete primer/sealer, in lieu
of correcting the noted code violations. The material was reviewed with him
present, and he was informed that the product would not be an acceptable
alternative. He requested that the material be reviewed further and that he be
informed if there was a change in determination of the acceptability of the
product.
The information provided by Mr. Baillee indicates that the product proposed for
use is a water-based binding agent that penetrates surfaces to assist in the
binding of paint to various surfaces. The International Residential Code clearly
indicates that water-based products applied to drywall ceilings require that the
drywall be upgraded to 5/8" in lieu of the'h" installed by the Baillee's.
Additionally, on page 3 of the information provided by Mr. Baillee, under product
limitations, it is states that this product is to be used on "verticai surfaces only."
6. On 10/28/08, an additional re-inspection of the drywall was requested. Despite
the previous inspections indicating the need to correct the ceiling drywall and the
improper use of water-resistant drywali, the Baillee's had taped and finished the
drywall in anticipation of texture without having addressed the previously noted
correction items.
Mr. and Mrs. Baillee have balked at or disputed virtually every correction noted,
and have threatened litigation if forced to renew their permit at a fee. They have
requested exceptions to the code for their stucco appiication, insulation
instaliation, and now for their drywall installation. In both the insulation and
drywali incidents, they have proceeded with work despite notation of violation of
code. Every attempt has been made to communicate with the Baillee's, but they
have not been receptive to any communication that was contrary to their desires.

ON VEHTICAL SUHFACES, SEAL-KRETE Original

spreatl rate, increasas coverage and cuts application time.
• PREPS piaster and drywall so wallcoverings adhere. Primes
vinyl siding so paint adheres. Binds chalky surfaces.
• BUFFERS pH in hat cement, piaster and stucco, allowing surface
to be painted during the curing period (usually within 10 days).
ON HORIZONTAL SURFACES, SERL-KRE7E Odpinal
• PRIMES for pafnts, stains and textured coatings.
Imporfanf: Read all directions thoroughty. Wear ploves and eye protec8on.
SUHFACE PflEP: Surtace must be clean and dry. Remove loose paint
and excesslve chalk. Repair cracks and surface breaks. Cover
wiadows, doors, etc. and usa caution when applying on windy days.
APPLICATION: Read "LIMITATIONS" section before use. This sealer
is ready to use; do not dilute. Apply with a brush, rolier or sprayer
(garden or alrless). Backroll spray applications to ensure penetration.
Apply at least two coats, allowing two hours dry time between coats.
Remove any overspray immediately wfth water. Note: Sealerappears
milky wh(te durinp application but dries to a cleat (nish.
COVEHAGE: 80-300 sq.ft. per gal., dependinp on surface
porosiry. Second coat application is 50% greater.
DRY TIME: 2-4 hours, depending on temperature and humidity.
TOPCOATiNG: May be topcoated with latex, oil-based or
elastomeric coating when dry.
TINTING: May be tinted wiffi universal coloranGs (up to 4 oz./ gal.).
LIMITATIONS: Use on above grade vertical surfaces or as a
primer on horizontal surfaces - not for below grade use. Do not
apply if rain is expected within 12 hours or if temperatures fall
below 50°F within 24 hours of application. Do not use on
swimming pools, bird baths, water features, cedar, redwood or
in areas where hydrostatic pressure is likely to develop. Do not
use on very porous substrates like iow density, decorative hlock
(use SEAL-KRETE Heavy Duty instead). Keep from ireezing.
CAUTION: KEEP OUT OF HEACH OP CHILDREN.
FIHST AID: For Eye Contact Flush with water tor 15 minutes.
For Skin CaMacl: Prolonged contact may cause irritation. Wash
affected area with soap and water. fl Swallowed: Induce
vomiting and seek immediate medical attention. If Inhaled: If
headache or nausea is experienced, remove the individual to

Seal-Krete Original Waterproofing Sealer is a water based acrylic applieation designed to
protect vertical concrete and masonry surfaces against masture penetration.
The sealer penetrates deep into the pores of concrete, binding sand and cement particles to form
a tough, flexible yet breathable film. IYs excellent for binding chalky surfaces to improve paint
adhesion on either painted or unpainted substrates. Seal-Krete strengthens mortar joints, reduces
efflorescence on brick and acts as a color rejuvenator on older painted or colored surfaces (such
as aged vinyl siding and stucco). Use Seal-Krete Onginat on s including conuete
block, brick, stucco, synthetic stucco, plaster, masonile, drywall, galvanized metal, aluminum
siding, adobe, wood fencing, stone and more.
