According to our records and the county the azea mazked with an "X" is not part of 4110 Upham Street. Taking this into account the "open lot area" for 4110 Upham is 10,784 sq ft which would a(low one horse. The "bpen lot azea" for 4100 Upham is 19,833 sq ft which would allow two horses. Each residence will be required to have completely separate corrals and will not be allowed to use another properties squaze footage to accommodate more horses. Let me know if you need anything else. p 100 200 Fee A In To: Darin Morgan <darinm@ci.wheatridge.co.us> Subject: Use of Adjoining Property Issue at 4100 Upham St. Cc: alanwa,ci.wheatridge.co.us, Jack Chism <jchism@ci.wheatridge.co.us>/ Page 1 of 1 Darin, I spoke with you a couple of months ago regarding a complaint about e keeping of horses at 4100 Upham St. The complainant Rolly Sorentino at 4175 Teller St, is c plaining that the residents at 4100 Upham St. do not have enough square footage to keep the number f horses that they have. Upon our initial investigation into this complaint in May of 2001 The Wh ey's the residents at 4100 Upham St. advised us that they had permission From the neighbor to the north to use part of their property to keep (3) harses. Officer Karres checked the assessor's records and with my review we determined that with use of the adjoining neighbor's property the Whaley's at 4100 Upham St had enough space to keep the horses. I met with Sonentino at his house in early November and his concerns were regarding the amount of square footage each property had. Sorrentino wants an all or nothing solution to this problem. Sorrentino does not want any horses in the neighborhood and advised that if a Zoning Interpretation found that use of adjoining property was legal that he would drop his complaint and did not want any more enforcement action pursued in the case. Have you and Alan discussed this issue? At the time I talked with you, I was told that you would get back to me with an answer, after speaking with Alan. I haven't heard anything and would just like a decision made so I can get back to Sorrentino with something, and close our case regarding the complaint either way.
