Development Director have reviewed your request and responded to you in the
attached letter dated May 30, 2003. As stated in the May 30`h letter, the fence

The City has received your May 12, 2003 letter conceming the new fence at 4422
Teller Street. Our review indicates that the fence has been constructed in
conformance with the Wheat Ridge Code of Laws. While you may have less visibility
than you had prior to construction of the new fence, there is.sufficient sight distance to
safety exit your driveway with a vehicle without endangering pedestrians, bicyclists
and other motorists.
We understand that you are not pleased with your neighbor's decision to construct a
fence along the rear of his property, but please understand that he has a right to tence
his property in accordance with the City Code. While you may disagree, we also wish
to emphasize that tfie presenoe of the ience has noi created an unsafe condition on
your street.

Re: Erection of fencing at 4422 Teller St.
Recently, through the Wheat Ridge Building and Zoning department,
the construction of a 6-foot high solid fence, was permitted to be erected
outside the 15-foot setback that is required for all frontage property, in
residential areas. This violation had been brought to your attention
previously and I was informed that because it is the owners back, that they
are not held to the frontage requirement. Although with the construction of
this fence, next to my driveway, at the front of my home, (as well as every
other property on the street) this fence now poses a hazard. My ability to
judge both pedestrian and vehicle traffic is severely impaired. Moreover, the
ability of pedestrian, bicycle and autos to see me backing out of my drive is
severely limited. With this hazard in place, I fear there will be an accident
or possibly even tragedy. I don't understand this increased risk being
permitted and even sanctioned by the building and zoning departments as
well as the Mayor's office. I have no power to enforce the already in place
zoning law (frontage visibility requirements). Therefore, I certify that the
Wheat Ridge building and zoning departments as well as the Mayor's office,
to be 100% responsible for any accident resulting in this, avoidable,
visibility hazard.
If an accident does occur, the parties involved will be given a copy of
this letter, enabling them to pursue the responsible parties involved in the
creation of such a known hazard.
I have taken the opportunity to contact the Jefferson County, City of
Arvada, City of Edgewater, Lakewood and Denver Building and Zoning
Departments regarding the existence of such a hazard. All of these
municipalities informed me that they would not allow such a situation, due
to the access as still being considered as frontage, visibility problems would
still exist.
I have also notified my neighbors of the hazard, and I pray that they
will be more cautious or even avoid the area next to my home. However, the
neighborhood does have additional outside foot and bike trafftc along the
sidewalks, and street. I can only pray that nothing will happen, but fear that

Mareover, I view your inaction on this issue of this problem as a gross
dereliction of duty in helping to maintain the safety of the citizens of Wheat
Ridge. Perhaps after an accident, you will then be forced to justify your lack
of concern and action in the legal realm.
I challenge any of you to pull into my drive and back out, if there is
no additional risk please provide a written statement to that fact confirming
your assessment of the situation.
Once again, let me make myself perfectly clear, that I assume no
responsibility for any damage to any party involved in an accident caused by
the visibility problem that has been created by the allowance of a fence
outside the frontage requirements. I am giving you 10-days in which to
pravide me with written confirmation that the location of this fence does not
violate the visibility requirement, thus, creating no additional risk of
accident or injury.
Since you have maintained that no additional risk exists due to the
lack of visibility, I ask you again to provide me with a written conformation
as to your assessment.
