Installation of roof sheathing (new or overlay) is required on the entire roof when spaced or board sheathing with ANY gap exceeding one half inch exists. The company is not responsible for any damage below the roof, due to ice dams, hail or preexisting construction defects during the period of the warranty. This includes but is not limited to faulty AC lines, supply lines, and water lines, installed along the rafters or attached to the underside of the roof decking. These lines are to be installed a minimum of 4 inches below roof -lines to prevent roof nails from penetrating the lines, therefore Company cannot be responsible if damage occurs to the AC lines, or any other water lines, during the roof construction, or any other damages caused by a penetration to one of these lines. If roofing and sheet metal work is involved, the customer understand s and agrees to that the company's our standard roof guarantee shall be acceptable and that all terms and provisions therein shall prevail, unless otherwise specifically agreed to in writing prior to the commencement of the work. If this agreement is breached or canceled by customer after insurance company approval and prior to materials arriving, customer will be liable for and agrees to pay and inspection fee of $2000 paid to contractor as liquidated damages. If materials have been dropped at the site customer will be liable for and agrees to pay $4000 for material charges. This agreement constitutes the entire agreement between the parties. It may be changed only by written instrument by both parties. If any provision of this agreement should be held to be invalid or unenforceable, the validity and enforceability of the remaining provisions of this agreement shall not be affected thereby. Any representation, statements or other communications, not written in this agreement are agreed to be immaterial, and not relied on by either party, and do not survive the execution of this agreement. During the duration of the work the customer's homeowners insurance will be responsible for any interior damage as long as th a Company has taken appropriate action to protect the roof during the repair of the roof. The company will provide the customer with a one (2) year limited warranty, which warranty shall be limited to repair or replacement of defective material or defective workmanship, company shall not be liable for any consequential damages and any damages shall be limited to the return of the agreement price. The agreement and warranty shall not be assigned and is non- transferable. For the warranty to be valid the agreement must be paid in full. Lien Laws. Any person or company supplying labor or materials for this improvement to your property may file a lien against your property if that person or company is not paid for the contributions. In the event of default by the property owner, the property owner agrees to pay all expenses incurred in collection including reducing to judgment this obligation including a 33% attorney's fee. The proper venue for all legal proceedings arising from this contract shall be in Colorado. The company has the right to order excess. These materials will not be charged above the agreed upon price. All excess materials belong to the company. The company is not responsible for evaluating your home venting and circulation system status. We will install roof vents in accordance with local building codes. Mold is common occurrence in US homes and any question about the dangers from mold can be determined by contacting the centers for Disease Control and US Department of Health. Customer agrees that the company will not be responsible for any damage caused by mold or any other fungus or biological material, regardless of whether it may be associated with defects in the Company's construction or services, including but not limited to property damage, personal injury, loss of income, emotional distress, death, loss of use, loss of value, adverse health effects or any special consequential, punitive or other damages. These conditions shall be considered a part of any agreement entered into or authorized to proceed, the same as if they were included therein. "Default "— If customer defaults in any of the terms and conditions contained herein, the Company may terminate this agreement and payments made hereunder may be retained by Company as liquidated damages. If customer owes payments to the company, customer agrees to pay attorney's fees, cost, disbursements, and interest (at maximum rate allowed by law) for the cost incurred by the company to enforce its rights under this agreement to collect such payments from customer. "Permits and licenses" -Customer hereby appoints Company as agent to procure all necessary or appropriate permits and licenses to complete the project. "Change Orders and Allowances" — Any changes in the agreement, including all changes that affect the price, must be approved in writing by both parties, indicating the change and any increase or decrease in the price. Unless otherwise agreed to in writing, all adjustments to the agreement price shall be payable upon completion of the work. However, the company reverses the right to require additional monies for any increases in the agreement price prior to completion of the work without written approval if deemed necessary to complete the work contracted.
