This lett er is to inform you that I can no longer be your General Contractor. I was hired to build a new addition as per architectural and structural plans. The latest change by the homeowners at the mid-point of construction was to hire a structural engineer other then the engineer of record. We advised against this when we first heard of it. The new structural engineer was hired to remove the main support post of the ridge beam. This is something I do not recommend and do not feel comfortable doing. I am responsible for the work product and don't feel I can stand behind such a major structural change to this building. Northland Construction will not be responsible for any work done beyond this date with the exception of the fireplace install which is scheduled for Tuesday the 29th between 2-4 pm. We feel the project can completed by another contractor without accessing the greenbelt which Northland still holds the bond for and is responsible for any damage. We will contact the city of Wheatridge and have Northland Construction removed as the contractor of record and close out our greenbelt access by returning their key. This is unfortunate but we feel it is best for both parties if we part here. The project can continue and you can finish it in a way that you feel is acceptable. This is in respond to the posting of the Stop Work Order posted at our address: 3263 Taft Court Wheat Ridge, CO You requested in writing our intent to finish the room addition attached to the back of our home. We hired a contractor in 1999 that was issued a permit by Wheat Ridge. The contractor did not finish the project. He filed bankruptcy. We were not the only client that was taken by Gary Matthis, Classic Additions during that time. We hired a lawyer and have been in legal actions with his insurance company since 1999. We settled in 2005. I bave requested our Attomey's office to provide a copy of the final settlement. They were not able to immediately give me a copy. I have attached the final statement we had received from their office with the dates of the mediation between the Insurance company and the 7AG office in Denver. We received a check at the end of 2005 after the attorney fees were taken out. The next year we had several contractors come out to give us estimates. They either were not interested or simply wanted to do fast job with siding that would not have looked good. Based oi1 the conclusious with structural engineers and the arbitrator of this action, the existing structure would not pass inspection. It is does meet engineenng requirements. I have attached our expert witness report of the incorrect procedures that we followed causing us the problem of not being able to complete thejob and very long drawn out legal action. lt ~is our intent is to have the addition done in the best way possible to have it be safe and enhance the value of our home. We do not want to go through the same experience of hiring incapable contractors that are able to get permits and do a lousy job. Today we would not be able to sell our house in the condition that the addiCions is. We plan on doing brick to match the house. This will require a difference set of standards for brick. We have had several contractors since the court decision telling us we need to have the casion to bedrock requiring slant drilling or even just tearing down the whole structure. We have spent a lot of money so far with an extreme flooring R control Stmtural Building Panel that we are hoping to salvage. The windows are Pella window that we want to salvage. According to the engineer we may have to give up one of the windows so the corners support the rest of the roam properly. Because of the action taken by the buiLding department based on [he complaints from our neighbors, I will be providing you with a copy of each contractors that come to our property to give us an estimate and the time it should take to complete. This will show that we are in the process of selecting a good contractor that will do the job correctly. Based on the contractor's schedule we hope to see a completion this year. We have several appoints already lined up with contractors for this week. I will send you a signed copy of the contractors that I have coming so you know we are serious about completing this project. Dear Mr. & Mrs. Hutchcroft: GEORGE ALAN HOLLEY (1925 - 2002) Enclosed herewith, please find the most recent Motion filed on your behalf. As you can see, a recent Colorado case suggests that this matter may be properly remanded back to the arbitrator to clarify under which theory of recovery the damage award was based. The Court could decide this issue either way, however, it is good to have this , motion pending before the Court going into the settlement discussions, since Safeco does not want this matter going back to the arbitrator. Please allow this letter to serve as your reminder of the mediation scheduled for December 22, 2004 at 9:00 a.m. at the JAG offices in Denver, located at 1601 Blake Street. Meditations are typically a very slow processes so we will have plenry of time to discuss your position and strategies on the day of the mediation. However, the two of you should consider what your limits are in terms of settlement numbers so that you can provide Dennis with that information before the negotiations begin. Typically the mediator will meet with everyone together in one room to start, then we will be divided into two rooms. The Mediator will then go back and forth, from room to room discussing the settlement offers. Please try to arrive around 8:45 so that we can chat for a few moments before the mediation begins. The purpose of this report is to provide a factual review of available administrative information as well as a review of the actual construction process completed-to-date including the presentation of structural integrity concerns of the room addition. Included in the report are reviews of the following information and tasks: 1) the original contract executed to complete the outlined work; 2) the building permit issued by and subsequent inspections conducted by the City of Wheat Ridge; 3) issues related to the quality of construction of the completed- to-date work; and 4) concerns related to the structural integrity of the addition after the completed work. This report was prepared based upon field investigations, meetings with knowledgeable structural and material subcontractors and engineers as well as meetings with the City of Wheat Ridge building department officials regarding this project and the permit application process. The 1997 Uniform Building Code volume 1 was also used as a reference for building code clarification purposes. Recommendations for future repairs are presented at the end of the report. page 1 Original Construction Contract - Classic Additions, Inc./Hutchcrofts On May 14, 1999, a construction contract (hereinafter referred to as "the contract", Exhibit A) between Classic Additions, Inc. (hereinafter referred to as "the Contractor") and Jay and Sandy Hutchcroft (hereinafter referred to as "the Homeowners") was signed. The contract was based upon proposal # 2034 (Exhibit B) and was executed by both parties for the completion of a room addition (hereinafter referred to as "the projecY'). Total price for completion to be paid at final inspection approval was to be $39,591.00. On October 6, 1999, proposal #2040 (Exhibit C) for additional work beyond the scope of the original contract was signed for an additional $3,033.00. Items of note regarding the above mentioned documents are as follows: Engineered Foundation Design Proposal #2034, prepared by the contractor, states that "foundatitions" (foundations) as per code and Jackson Engineering, as well as engineered drawings. It is implied by proposal #2034 that engineered drawings will be prepared and used. However, neither the homeowners or the City of Wheat Ridge Building Department have any documentation of a stamped engineered foundation plan or stamped engineered construction drawings. The contractor page 2 provided two sheets of drawings specifically without an engineering stamp (hereinafter referred to as "the plans", Exhibits D and E) labeled 0010-2 dated March 10, 1999, and 0010-3 dated March 9, 1999. Tom Jackson at Jackson Engineering (telephone number 303-337-8888) was unable to find any information in reference to the project by address. Classification of Building Type In paragraph 1 of the contract, as well as in proposal #2034, it is stated that the project is a room addition. Also, in paragraph 9, it is stated that the said "residence" (room addition) will be constructed in accordance with all building codes, plans, and specifications. Timeframe of Construction In paragraph S, there are no commence or completion dates. It is stated, however, in additional proposal #2040, that all work is to be completed three weeks from the frame inspection. Furthermore, it is stated that a penalty of $50.00 per day will be assessed in the event of non-completion. Building Permit Building permit #9124 (hereinafter referred to as "the permiY", Exhibit G) was obtained by the contractor from the City of Wheat Ridge Building Department on page 3 June 30, 1999. The description of the project on the permit states that the permit is for a"sun room addition". The City of Wheat Ridge interprets a sunroom as the following: "If 65% of the area of the enclosure's walls are glass and the enclosure is not heated or freely communicating with the existing house via removed windows or doors, it is considered non- habitable space" (D. Morgan, Exhibit H). This statement, along with design loads and foundation criteria is reiterated in the 1997 Uniform Building Code Volume 1, Appendix 31, Division III Patio Covers, sections 3117 and 3119. In addition, if a space is considered non-habitable, (examples: a detached garage, a sun room) the foundation does not need to be designed by an engineer or architect, according to the City of Wheat Ridge. Most building municipalities have handouts available regarding acceptable types of foundations for these particular types of non-habitable structures. However, habitable additions in the City of Wheat Ridge require a building permit and an engineered foundation. In proposal #2034 and in the contract, the structure is referred to as a room addition to be constructed and should, according to the City of Wheat Ridge as per stated in proposal #2034, have "foundatitions (foundations) as per code and Jackson Engineering" (structurally engineered). As previously stated, a building permit in the City of Wheat Ridge for an page 4 unheated, non-communicating, non-habitable sun room does not require an engineered foundation. By submitting this inaccurate description of the work to be completed at the site, the contractor was able to obtain a building permit without foundation drawings stamped by an engineer or architect. It should be further noted that the contractoPs license in the City of Wheat Ridge has been deleted from their database due to insufficient funds, regarding this project, submitted in the form of a check. This information is on file regarding the permit. In further support that the contractor knew the addition was going to be habitable space, there is also another statement made in proposal #2034. The statement is as follows "floor of room addition to be made of 901b per sq. "(inch) structure foam insulated with heat and electrical runs". As per code in the City of Wheat Ridge, sun rooms are not to be heated; if the sunroom is heated, it is considered habitable space and technically defined as a"habitable room addition". Permit Related Building Inspections A caisson (pier) inspection wa's performed by a City of Wheat Ridge building inspector on August 9, 1999. The inspection was based on the non-engineered drawings submitted by the contractor for a sun room addition. Although the page 5 caisson configuration was not "as per supplied drawings" stated in proposal #2034, the drilling and construction of the individually inspected caisson was approved by the inspector. As per code in the City of Wheat Ridge, a sun room addition does not require an engineered foundation. According to the building inspector's interpretation of this being a sun room, no foundation engineering was required. A rough frame inspection was performed by a City of Wheat Ridge building inspector on October 26, 1999. This inspection was conditionally approved. A note was observed in the project file requiring additional framing for the skylight light wells, but if completed, the inspection would be approved (it should be noted that this inspection is not documented in the file regarding the project). Foundation Construction As previously discussed, the foundation for a habitable room addition, in the City of Wheat Ridge, needs to be designed by a structural engineer or architect. This design is based upon the characteristics of the soil that the structure is to be built upon. On December 10, 1982, a soils and foundation investigation report was prepared by CTL/Thompson, inc. Qob # 8695) for Lot 17, Rancho del Sol Subdivision. This legal description pertains to the homeowners project address page 6 of 3263 Taft Court, Wheat Ridge, Colorado 80033. The report recommends that a straight-shaft drilled friction pier foundation system be utilized, and that the piers be designed to bottom 18 to 20 feet below existing site grades. The report also presents design and construction criteria for these piers. it is also recommended on page 4 of this report that the installation of these piers should be observed by a representative (engineer) to confirm the subsurface conditions and to identify the proper bearing strata as presented in the report. The caisson inspection that was perforrned by the City of Wheat Ridge building inspector for the proposed room addition on August 9, 1999, indicated approval of a caisson that terminated approximately 3 feet below the existing site grade(refer to Exhibits I and J). When a caisson foundation for residentiaonstruction is utilized, the ~ structural loads are transferred to the caissons by a grade beam or foundation wall as per the foundation engineer's requirements. This ailows the structural loads to be transferred to the caissons in a uniform manner. As indicated in Exhibits E and J, the contractor poured a concrete slab directly on top of the newly installed 3 feet deep caissons, as well as the existing grade beneath the room addition, which was at the same elevation. This newly poured slab was then connected to the bottom of the structure by (6) 4" x 4" page 7 posts. This presents a condition that structurally is not the same connection as reinforced concrete grade beam, which continuously supports floor, wall, and roof loading conditions. It is inconsistent with the structural requirements of a pier and grade beam foundation system. In addition, it should be noted that this structural condition is a significant variation from what was depicted in the plans. Attachment to Existing Structure Although there are no construction details provided in the plans regarding the new room addition attachment to the existing structure, photographs taken at the project (Exhibits K and L) show the method utilized for a portion ( 9' 2") of attachment starting from the east wall. A 2" x 12" ledger board was attached to the existing brick veneer by 1/2" diameter wedge anchors. Brick veneer is a non-bearing member structure. Ledgers must be attached to existing members capable of supporting the added loads. The correct method of attachment would be determined by the results of the structural engineers or architect's site investigation and existing members capabilities. The remaining portion of attachment (12' 1/2" of 2" x 12" ledger) is attached to the existing residence cantilever by 1/2" diameter lag bolts (Exhibit M). Since cantilevered floors are designed and engineered only to withstand the loads incurred at that time on the existing cantilevered area, this method of attachment page 8 appears to impose additional loading that may or may not be designed for. To further illustrate this situation, see exhibit N. Framing Structural Floor Panel Construction Floor framing and sheathing was achieved by using R-Control brand structural insulated panels attached to 11 7/8" wood I-joists. According to the manufacturer, for these panels to perform as designed, proper installation is critical. This particular application requires the use of splines, edge plating material, and adhesive. These details are outlined on pages 7 and 16 of the R-Control Structural Building Panel Construction Details Manual (Exhibit O). The section/plan on page 7 of the Construction Details manual shows the proper installation of surface splines. According to the homeowners, the surface splines were not installed originally. The contractor was notified by the homeowners of the need for the installation a\per the installation manual and, subsequently, surface splines were retrofitted. Based upon installation procedures outlined in the Construction Details Manual and discussions with John Quist of Advanced Foam Products (the supplier), the retrofit is unacceptable. The purpose of the surface spline is to "lock" the panels together. In order to retrofit the surface splines, the panels need to be sawcut. These new sawcuts, however, produce more joints that are page 9 not "locked". The proper way to retrofit the surface splines properly would be to disassemble the floor in the reverse order of which it was installed. Based upon construction completed -to-date, this option would require significant costs to repair due to the fact that the frame structure that has already been built and attached to the floor would need to be removed before disassembly could take place. Regarding edge plating material, the isometric plan on page 16 shows the proper installation of edge plating material. As of the preparation of this report, edge plating material on the north wall of the addition has not been installed (Exhibit R). Exterior Walls Exterior wall framing was achieved by using 2" x 4" lumber for the top and bottom plates, as well as the veRical members. Beams (doubled 11 7/8" microlams) were place on top of the three ne~y constructed walls. The beam on the east wall was observed to be leaning inward (towards the interior of the addition) causing a 3/8" total midpoint deflection (Exhibit S) vertically in the 10' high wall. The majority of the deflection is located in the upper 2 feet, due to the leaning beam. The current deflection would still be visible after interior wall finishes such as drywall, texture and painting are added. Another concern with the noted deflection is the installation and operation of page 10 the exterior windows. Due to the fact that drywall shimming more than 1/8" would require jamb extensions and additional window trim labor, drywall shimming is not a desirable option. The north wall measures 23 feet in length and comprised almost entirely of window units. See Exhibit T. A minimum of 2 window units need to be removed, and shear panels installed as per 1997 Uniform Building Code Volume 1 Appendix Chapter 23 section 2337.5.6. When a lateral force (wind) is applied to the northeast or northwest corners of the addition, it needs to be transferred through the north wall to the foundation. This keeps the structure from "racking". This transference is normally achieved through a structural stud wall. The majority\pf lateral force transference through the north wall at this time would transfer through the window units. The window units are not structural members. Therefore, "racking" could occur under lateral forces. This "racking" could result in broken windows, as well as cracks on the interior wall finishes. It should also be noted that the glazing in the new awning window glazing must be replaced with tempered glazing as per 1997 Uniform Building Code Volume 1 Chapter 24 section 2406.4 item 7.2. Proposal #2040 states a$600.00 upcharge regarding "additional for brick". Due to the absence of a foundation wall, angle iron would need to be attached to the new walls, providing support for the brick. Due to the significant weight of brick and mortar, this angle iron needs to be correctly sized by a structural engineer or architect. The structural engineer or architect would also need to determine the method of attachment. page 11 Roof System The roof framing is comprised of a truss system over the floor area and overframing where the new roof overlays the existing roof. As per code in the City of Wheat Ridge, roof truss systems must be properly engineered with documentation to verify this. This is critical to the safe support and performance of the roof system. Neither the homeowners or the City of Wheat Ridge Building Department have any documentation of a stamped, engineered roof truss plan. . First and foremost, a stamped, engineered set of construction drawings would need to be obtained. These drawings would contain a properly engineered foundation plan, which needs to be installed as soon as possible. The drawings should also address the situations that will be encountered when retrofitting the new foundation. Areas of concern would be supporting the new frame structure possibly by either temporary posts and beams, or possibly by crane. During the new foundation construction, the newly installed concrete slab and structural insulated panel floor system and I-joists will need to be removed and discarded. New caissons may be able to be installed using a difficult access caisson rig. Another option would be the use of helical piers. After the new foundation is in place, the new floor system could be installed. Upon installation of the floor system, the new frame structure could then be attached. Once page 12 attached, the north wall could be modified. From that point forward, the addition would be completed as per the new construction drawings. This assessment was undertaken to address the effects of the events that have occurred in relation to construction of the addition. The information that has been used within this report is based upon the review of numerous site investigations.-By using information contained in these existing documents to evaluate the construction of the addition is both factual and accurate. In any construction related assessment, it is necessary to make reasonable assumptions based upon the field observations and construction practices accepted and used in this field. It is our opinion that the opinions presented herein meet the standard of care for the field of single family residential addition construction. No other warranty for this assessment is implied or expressed. In the event that the information used as the basis for the assessment is found to be inaccurate, incorrect, or otherwise represent a discrepancy or should additional information become available, we should be notified and determine the impact the information has on the overall report conclusions. page 13 As additional information is made available, we would like the opportunity to review the information and determine the impact that the new information may have on the conclusions presented in this report. This is in respond to the posting of the Stop Work Order posted at our address: 3263 Taft Court Wheat Ridge, CO You requested in writing our intent to finish the room addition attached to the back of our home. We hired a contractor in 1999 that was issued a permit by Wheat Ridge. The contractor did not fiiiish the project. He filed bankruptcy. We were not the only client that was taken by Gary Matthis, Classic Additions during that time. We hired a lawyer and have been in legal actions with his insurance company since 1999. We settled in 2005. I have requested our Attorney's office to provide a copy of the final settlement. They were not able to immediately give me a copy. I have attached the final statement we had received from their office with the dates of the mediation between the Insurance company and the JAG office in Denver. We received a check at the end of 2005 after the attomey fees were taken out. The next year we had several contractors come out to give us estimates. They either were not interested or simply wanted fo do fast job with siding that would not have looked good. Based on the conclusions with structural engineers and the arbitrator of this action, the existing structure would not pass inspection. It is does meet engineering requirements. I have attached our expert witness reporf of the incorrect procedures that we followed causing us the problem of not being able to complete the job and very long drawn out legal action. It is our intent is to have the addition done in the best way possible to have it be safe and enhance the value of our home. We do not want to go through the same experience of hiring incapable contractors that are able to get permits and do a lousy job. Today we would not be able to sell our house in the condition that the additions is. We plan on doing brick to match the house. This will require a difference set of standards for brick. We have had severa] contractors since the court decision telling us we need to have the casion to bedrock requiring slant drilling or even just tearing down the whole structure. We have spent a lot of money so far with an extreme flooring R control Strutural Building Panel that we are hoping to salvage. The windows are Pella window that we want to salvage. According to the engineer we may have to give up one of the windows so the corners support the rest of the room properly. Because of the action taken by the building department based on the complaints from our neighbors, I will be providing you with a copy of each contractors that come to our property to give us an estimate and the time it should take to complete. This will show that we are in the process of selecting a good contractor that will do the job correctly. Based on the contractor's schedule we hope to see a completion this year. We have several appoints already lined up with contractors for this week. I will send you a signed copy of the contractors that I have coming so you know we are serious about completing this proj ect. Please let me know if there is anything else you need. Also, in paragraph 9, it is stated that the said "residence° (room addition) will be constructed in accordance with all building codes, plans, and specifications. Timeframe of Construction In paragraph 8, there are no commence or completion dates. It is stated, however, in additional proposal #2040, that all work is to be completed three weeks from the frame inspection. Furthermore, it is stated that a penalty of $50.00 per day will be assessed in the event of non-completion. Building Permit Building permit #9124 (hereinafter referred to as "the permit", Exhibit G) was obtained by the contractor from the City of Wheat Ridge Building Department on page 3 June 30, 1999. The description of the project on the permit states that the permit is for a"sun room addition". The City of Wheat Ridge interprets a sunroom as the foilowing: "If 65% of the area of the enclosure's walis are glass and the enclosure is not heated or freely communicating with the existing house via removed windows or doors, it is considered non- habitable space" (D. It should be further noted that the contractor's license in the City of Wheat Ridge has been deleted from their database due to insufficient funds, regarding this project, submitted in the form of a check. This information is on file regarding the permit. In further support that the contractor knew the addition was going to be habitable space, there is also another statement made in proposal #2034. The statement is as follows "floor of room addition to be made of 901b per sq. "(inch) structure foam insulated with heat and electrical runs". As per code in the City of Wheat Ridge, sun rooms are not to be heated; if the sunroom is heated, it is considered habitable space and technically defined as a"habitabie room addition". Permit Related Building Inspections A caisson (pier) inspection was performed by a City of Wheat Ridge building inspector on August 9, 1999. The caisson inspection that was performed by the City of Wheat Ridge building inspector for the proposed room addition on August 9, 1999, indicated approval of a caisson that terminated approximately 3 feet below the existing site grade(refer to Exhibits I and J). When a caisson foundation for residentialconstruction is utilized, the structural loads are transferred to the caissons by a grade beam or foundation wall as per the foundation engineer's requirements. This allows the structural loads to be transferred to the caissons in a uniform manner. The c:arrect method of attachment would be determined by the results of the structural engineer's or architecYs site investigation and existing members capabilities. The contractor was notified by the homeowners of the need for the installation as per the installation manual and, subsequently, surface splines were retrofitted. Exterior Walls Exterior wall framing was achieved by using 2" x 4" lumber for the top and bottom plates, as well as the vertical members. Beams (doubled 11 7/8" microlams) were place on top of the three ne~w~y constructed walls. The beam on the east wall was observed to be leaning inward (towards the interior of the addition) causing a 3/8" total midpoint deflection (Exhibit S) vertically in the 10' high wall. The majority of the deflection is located in the upper 2 feet, due to the leaning beam. The current defleotion would still be visible after interior wall finishes such as drywall, texture and painting are added. The majority,pf lateral force transference through the north wall at this time would transfer through the window units. Neither the homeowners or the Ciry of Wheat Ridge Building Department have any documentation of a stamped, engineered roof truss plan. The information that has been used within this report is based upon the review of numerous site investigatior]s---By using information contained in these existing documents to evaluate the construction of the addition is both factual and accurate. The average cost for new construction of habitable space, Type V- wood frame construction is $69.90 per squaze foot or 276 sq ft x$69.90 =$19,292.00. The City does not have a cost per square foot for non-habitable space and generally relies on the contactor or owner to provide us with a cost of construction to base permit fees. In my professional opinion the repair cost proposed by Scott-Bilt, Inc for $110,800.00 is extremely elevated. If this cost was used it would assume a construction cost for the space to be $340.00 per square foot. The highest national average cost per square foot indicated in Building Standazds Magazine for a Hospital of Type I, fire resistive construction for our area is $129.60 per square foot, Scott-Bilt Inc. is stating it would cost almost three times this amount per square foot, which I feel is unreasonable.
