For the following reasons: 1. The home is currently in possession of an attached single car garage on the west side. 2. Approval of this request could potentially alter the essential character of the neighborhood. As evidence, there is one known front yard setback encroachment in this neighborhood, a variance of 18 feet into the front yard setback was approved by the Board of Adjustment in 1997 for the property at 6150 West 42nd Avenue. That property, as such, was subject to a 30-foot setback on rivo sides and had no garage. The visual impact as a result of an 18-foot variance is considerable causing significant impact upon the neighborhood view plane. 3. The placement of a permanent structure within 8 feet of the property line for an interior lot in a single family residential neighborhood could potentially have an impact on adjacent property values. 4. Construction of a detached garage would not produce significant benefit or contribution to the neighborhood or community. 5. Approval of this request would not result in a reasonable accommodation of a handicapped person. 6. The plight of the owner is not due to significantly unique circumstances. 7. Alternatives to the mitigation of traffic hazards created by the curve in West 42nd Avenue may be possible. The motion to deny passed by a vote of 7-0. Chair HOWARD advised the applicant that the request for a vaziance had been denied. D. Case No. WA-Ol-OS: An application filed by Paul Mintken for approval of a 12- foot side yazd setback vaziance from the 30-foot side yard setback requirement Board of Adjus[ment Page 7 04/26/O l when abutting a public street, resulting in a proposed 18-foot side yazd setback, for the purpose of constructing a garage addition for property located at 3071 Union Street and zoned Residential-One. The case was presented by Mary Austin. She reviewed the staff report, presented slides and overheads of the subject property, and reviewed variance request evaluation criteria. All pertinent documents were entered into the record and accepted by Chair HOWARD. She advised the Board that there was jurisdiction to hear the case. Staff recommended approval for reasons outlined in the staff report. In response to a question from Board Member DRDA, Ms. Austin e;cplained that her visual inspection of the site revealed an extremely steep driveway on the north side. The neighbor across the street from the applicant's driveway expressed concern about vehicles running into her home from the driveway. Paul Mintken 3071 Union Street Mr. Mintken was swom in by Chair HOWARD. He stated that several options have been discussed with designers. The steep driveway facing north is extremely hazardous during the winter and they would like to improve this situation. He contacted all of the neighbors and gave them opporiunity to review the blueprints. The neighbors are highly in favor of the application. Board Member ABBOTT inquired about the adjacent neighbor who lives within Lakewood city limits. Mr. Mintken replied that he has contacted this neighbor, also, and he is also in favor of the application. Chair HOWARD inquired about plans for the front yazd if the application is approved. Mr. Mintken replied that, once the present driveway is removed, he would build a sidewalk down the side of the house to the proposed garage and build steps down to West 31" Place. Mr. Mintken indicated that he would have no problem with a condition which would require removal of the preser.t driveway within 90 days oF receivine a certificate uf occupancy for the new gazage. In response to an eazlier question by Boazd Member ABBOTT concerning the neighbor's view if the variance is granted, she explained that the gazage would face the neighbor's garage. She lives directly across from the applicant and expressed her support of the application which would alleviate her concem about the possibility of cars rolling down the present driveway into her home. She also expressed her delight about the change in lanclscaping that would improve the view from her living room. For the foilowing reasons: 1. Since the lot is a corner lot, the encroachment would not impair adequate light and air to adjacentproperties. It should have no negative affect on public safety. The proposed encroachmer.t will not impact the required sight distance triangle at the corner of West 3111 Place and Union Street. 2. The construction of the gazage addition and relocation of the driveway is sought to conect a potentially unsafe condition which could be beneficial to the neighborhood. The sunounding neighbors have expressed their support in writing for relocating the driveway and garage. 3. The view from the dwelling across Union to the east would be gazage to garage. 4. The neighbor at 3101 Union testified to her agreement as to the safety issue and the desirability of removing the existing driveway. 5. Dear Mr. & Mrs. Mintken: As requested, we conducted a subsurface exploration to develop recommendations for foundation design at the subject site on May 14, 2001. The subsurface exploration was performed by drilling one test boring to a depth of 25'-0" very near the planned construction area. The location of the test boring and the log of subsurface materials are enclosed. The discussion and recommendations presented below are based on the results of data gathered during the exploration, observation of general field conditions, and previous experience in the area with similar materials. PROPOSED CONSTRUCTION As we understand, a new garage (22' X 24') will be constructed to adjoin the east side of the existing attached garage. In order to lessen the grade of the driveway, we understand that the floor of the new garage will be constructed about 3.5 feet below the elevation of the existing garage. The new driveway will connect to Union Street, not 31st Place. Foundation loadings for the proposed addition should be relatively light. SITE AND SUBSOIL CONDITIONS The site of the proposed construction is a variably sloping developed property in a mature residential area. The location of the addition and the location of our test boring are shown on Figure 1. The ground surface in the proposed construction area slopes to the east at about 10 to 20 percent and the ground cover consists of decorative rock. Mr. Mintken -2- May 22, 2001 Soil Analytics Job #3978 Because of the steep slope and other obstacles including trees, it was impractical to drill more than one exploratory boring. Since the ground elevation in the proposed construction area varies by several feet, the depth to bedrock may vary a few feet over the site from the depth at which our boring encountered bedrock. Subsurface conditions at the location of the test boring are variable with depth below groundlevel. Foundation Boring #1, which was drilled at the location shown on Figure #1, encountered medium to stiff and moist sand-clays from groundlevel to a depth of 4'-0"; hard and moist to medium moist sandy claystone bedrock materials from 4'-0" to 15'-0"(±); and hard to very hard and medium moist claystone bedrock materials from 15'-0"(±) to at least 25-0", the maximum depth explored. Free groundwater formed in the boring at a depth of 22'-0" while we were at the site performing the exploration. One source of this water is believed to be a water bearing seam which was encountered at a depth of about 7-6". We expect the water level in the hole will conrinue to rise to a depth of 7-6", or less, over time. TEST RESULTS AND GEOTECHNICAL CON IDERATION The subsoils at the site were carefully inspected as the cuttings were recovered from the test boring, and the resistance of the materials to the advancement of the drilling augers was noted. In addition, Field Penetration Tests were performed at selected depths to assist in evaluating the allowable bearing value of the soils and to provide undisturbed samples for precise examination and for testing in a one-dimensional consolidation unit. Test results are attached. Based on the results of the exploration combined with previous experience with similar subsoil conditions, the most pertinent foundation engineering characteristics and considerations at the site are as follows: 1. Portions of the area of the addition contain about 4'-0" of sand- clay soil, some of which may be compressible landscape fill. The lower portion of this layer may be a natural deposit with a low swell rating. Because of the potenrial variability of this layer, we believe that it is not a reliable bearing layer for the proposed garage. 2. Sandy claystone bedrock with a relatively high bearing capacity was encountered in the boring at a depth of 4.0 feet below the existing ground surface. The underlying bedrock has a moderate Mr. Mintken -3- May 22, 2001 Soil Analyfics Job #3978 swell rating. The underlying bedrock is suitable for properly designed and constructed deep drilled pier foundations. 3. While a grade beam and drilled pier system can be used to protect the foundation trom both compressible upper soils and expansive bedrock materials at the site, it will not protect concrete slabs and flatwork from cracking and moving if they are constructed as slabs-on-grade bearing on or above unstable materials. All floors in which movement cannot be tolerated should be structurally supported on the foundation system over an air space. RECQMMENDATIONS FOR A GRADE BEAM AND DRILLED PIER FOUNDATION SYSTEM In view of the geotechnical considerations given above and in order to provide a reliable foundation system for the proposed addition, we recommend that the addition be founded on an adequately designed system of grade beams and drilled piers. The piers should be designed for a maximum end pressure of 15,000 psf, for a side shear of 1,500 psf for the minimum specified penetration of the piers in competent bedrock, and for a minimum dead load pressure of 15,000 psf based on the cross-sectional area of the piers. The piers should be at least 18 feet in length or longer as needed. In addition, all piers should penetrate a minimum distance of 15 feet into the underlying competent bedrock. Some of the piers may need to be drilled longer than 15 feet in order to provide the required bedrock penetration or resistance to upiift. In the event that the designer has difficulty obtaining the minimum dead load pressure, he can specify that the piers be drilled beyond the minimum bedrock penetration given above and assume that 50 percent of the additional skin friction provided acts in the direction to resist uplift. We recommend that the drilling contractor have a rig with a hole depth capability of at least 23 feet. The presence of water bearing seams in the bedrock and the formation of water in the foundation test boring indicates that casing may be needed to prevent water infiltration into or caving of the pier holes. If the contractor desires to avoid the use of casing in holes which are found to contain less than 3 inches of water at the time of caisson drilling, it may be feasible to do so if the conerete and reinforcement are placed immediately after the drilling of each hole and if the bottom of each hole is carefully observed to make sure that no disturbed materials are present, no caving has occurred, and the concrete is not diluted as it is placed by the presence of the water in the Mr. Mintken -4- May 22, 2001 Soil Analyrics Job l13978 properly cleaned and prepared holes. In view of the site conditions, it will be necessary to place the concrete using a concrete pumper truck and a tremie pipe. Each hole should be backfilled with concrete as soon as it is drilled to prevent degradation from the inward seeping water. The concrete should be delivered to the bottom of each hole with the tremie pipe so that the collected water is displaced upward on top of the heavier concrete and completely removed from the hole to avoid diluting and weakening the concrete. Drilled pier foundations are very common in the Denver area and are generally the safest foundation system for lightly loaded structures in potentially heaving or compressible soils. This support system functions by having the lower portions of the piers anchored in a zone of relative stability and by loading the support points sufficiently to help resist uplift movements. The following design and construction details should be followed for the foundation: 1. All piers should have a diameter of 10 to 12 inches and should be reinforced longitudinally with one 5/8-inch rod for each 12 inches of pier perimeter (a minimum of three 5/8-inch Grade 60 rods per pier) to prevent breakage of the piers due to uplift on their sides by swelling materials. The upper portions of the piers should be kept smooth. Care should be taken to avoid mushrooms, or enlargements, of the piers at the tops. 2. A 4-inch minimum "air space" should be provided between the portions of the grade beams that span the piers. Care must be taken to maintain the integrity of the void forming material and to prevent it from being damaged by exposure to water and other harmful substances. Care must also be taken to prevent the void forming material from being crushed during backfilling operations. LATERAL EARTH PRESSURE CONSIDERATIONS We do not recommend that expansive materials or heavy cloddy clays be used as backfill for foundation walls if it will result in unbalanced lateral pressures. Good materials for structural backfill include recycled concrete and granite sand. We also recommend tfiat walls retaining the non expansive backfill be designed for an equivalent fluid unit weight of at least 50 pcf. The backfill should be moderately compacted to the extent dtat it does not settle Mr. Mintken -5- May 22, 2001 Soil Analytics Job #3978 after construction, and a target density of about 90 per cent of standard Proctor maximum density at optimum moisture content is recommended. FOUNDATION REINFORCING All foundation grade beams must be well reinforced in accordance with the structural requirements. Refer to the foundation design prepared by the structural engineer. FLOOR CONSTRUCTION Subsurface conditions are not favorable for slab-on-grade floor construction. The presence of expansive materials can result in post construction slab heave and cracking. To prevent floor heave, use a structurally supported floor which is constructed over an air space. To lessen the severity of slab heave, but not entirely eliminate the threat, remove at least 3 feet of the subgrade materials from below slab grade and replace these materials with an equal thickness of structural fill (such as recycled concrete) which is compacted in S inch thick lifts to at least 95 percent of standard Proctor maximum densiry. If the owner wishes to use a slab-on-grade floor and assume the risk of movement and cracking of the floor, the following details and precautions must be followed. While these details will not necessarily prevent slab movements, they will help prevent the slab movements that do occur from affecting either the foundations or the superstructure of the building. 1. Separate the slabs from all bearing members and utility lines to allow their independent movement--construct "floating" slabs. Provide positive control joints at the junction of the slabs with foundation walls, and provide frictionless sleeves for all coluinns and utility lines which pass through slabs. 2. Joints should be scored in the slabs at maximum 200-square foot areas. 3. Provide flexible connections for all slab bearing mechanical equipment to allow for at least 3 inches of vertical movement. 4. Construct a minimum 3-inch slip joint above or below all partitions located immediately above concrete slabs-on-grade. Mr. Mintken -6- May 22, 2001 Soil Analytics Job q3978 5. If any materials are placed as fill beneath floor slab areas, they should be non expansive recycled concrete or equal structural fill materials which are properly compacted. 6. Do not use rigid floor coverings which will easily reflect even minor slab movement. Rather, any floor coverings which might be installed should be flexible and such that they are not damaged by movement of the floor slab. In addition, good backfill and surface drainage should be provided, and lawn irrigation minimized, as discussed later in this report. BACKFILL AND SURFACE DRAINA E Water is the catalyst which causes expansive materials to swell. Therefore, the foundation soils should be protected from being excessively wetted after construction. This can generally be assisted by using a low permeability backfill and by.compacting the backfill sufficiently so that it does not settle following construction. The backfill should be free of debris and should be moistened and compacted taking into account the considerations described in the previous section on lateral earth pressures. Sufficient water can be blended with the backfill in the stockpile but away from foundation locations to permit proper compaction; however, the backfill must not be puddled since the trapped moisture may result in long term heave of underlying expansive materials. If any settlement should occur in the backfill, it could adversely affect utility lines which transmit fluids and pass through the grade beam foundation walls. It is not uncommon for such piping to shear at the foundation walls due to movements in the backfill. It is recommended that the pipes pass through slotted openings in the foundation walls or that flexible connections be used to compensate for shifting of the foundation wall backfill. It is also recommended that all water lines be carefully pressure tested prior to final acceptance and that any leaks detected be repaired. The final grade should be sloped well away from the addition on all sides. A minimum slope of 12 inches in the first 10 feet is recommended. All downspouts should discharge into extensions which slope away from the foundation walls and extend beyond the limits of al] backfill. The points of discharge should be at least 5 feet from the foundation walls and good drainage should be maintained at and beyond these points. Mr. Mintken -7- May 22, 2001 Soil Analytlcs Job A3978 SUBSURFACE UNDERDRAIN The results of the exploration indicate that an underdrain system should be installed for any floors constructed below final exterior grades. It appears that portions of the floor will be below exterior grade and will require a perimeter drain which can be daylighted onto the lower sloping ground to the east. LIMITATIONS The above recommendations are based on the exact locarion where the test hole was drilled, the proposed construction, and the assumption that the subsurface conditions do not vary greatly from those encountered in the test boring. The exploration was conducted and this report has been prepared in accordance with commonly accepted geotechnical engineering practice in the Denver azea, and no other warranty, expressed or implied, is made. FOR THE FOLLOWING REASONS: 1. Since the lot is a comer lot, the encroachment would not impair adequate light and air to adjacent properties. It should have no negative effect on public safery. The proposed encroachment will not impact the required sight distance triangle at the comer of West 31" Place and Union Street. 2. The construction of the garage addition and relocation of the driveway is sought to correct a potentially unsafe condition which could be beneficial to the neighborhood. The sunounding neighbors have expressed their support in writing for relocating the driveway and garage. 3. The view from the dwelling across Union to ihe east would be gazage to gazage. 4. The neighbor at 3101 Union testified to her agreement as to the safery issue and the des'vability of removing the existing driveway. 5. The plight of the owner is due to somewhat unique cirwmstances in the considerable sloped conditions of the property. 6. It would not negativety alter the essentia] character of the surrounding neighborhood. 7.
