Dear Mr. Frisk:
As you aze aware, the Colorado Clean Indoor Air Act (C.R.S. 25-14-201) was signed into law by
the Governor last year banning smoking in public places, including bars and restaurants. In
response to the restrictions of this new law, many establishments have made provisions to
accommodate smokers outdoors.
You were issued a building permit from the City Building Division authorizing the construction of
certain improvements at your business for this purpose. This letter is being provided to inform you
that the perxnit was reviewed and issued according to the zoning and building codes of the City.
Issuance of the permit and subsequent inspections do not imply the construction authorized by the
permit is in conformance with the Clean Indoor Air Act. The owner or tenant is responsible for
compliance with the provisions of the Act.

sides of the enclosure, one ornamental street tree installed in the landscaped buffer along W. 44`h
Avenue and installation of bushes along the eastern property line for a distance of 50'.
The original landscape escrow agreement was signed Apri129, 2003 and extended until July 29,
2003. A visua] inspection conducted last week revealed that the landscape improvements have
still not been completed.
There are several options for the city to ensure completion of the landscaping. We can hire a
landscape contractor and pay them from the funds in escrow. If the cost of the job exceeds the
amount of the funds in escrow, all additional costs will be billed to you as the registered property
owner and a lien will be filed against your property. Another altemative is to pursue code
enforcement action through the Wheat Ridge Municipal Court.

Wheat Ridge and James Frish (contractor/developer/owner). Escrow in the amount of
one thousand one hundred & eightv one DOLLARS ($1181.00) is being held until all ,p
landscaping improvements are completed at,
4400 Ward Rd., Wheat RidQe, CO 80033
In the event that landscaping required by Wheat Ridge Code of Laws, Section 26-502
and/or as shown on an approved landscape plan is not installed by June 29. 2003, the
City of Wheat Ridge or its designee shall have the right to enter upon said property to
construct and/or install such improvements or do other such work to accomplish that
purpose as may be necessary, provided that the City of Wheat Ridge shall first give
notice in writing to the contractor, developer or owner of its intent to do so.
If the City of Wheat Ridge exercises its right to perform work of any nature, including
labor, materials and use of equipment either by force account or contract, the City shall
have the absolute right to withdraw the escrow funds to complete said landscape
improvements. The only precondition to the City's right to withdraw the escrow funds
for this purpose shall be a letter from the Planning and Development Director, stating that
the landscape improvements have not been completed or provided and that the
compliance date of June 29, 2003 has expired.
