Section 5-37 of the Wheat Ridge Code of Laws states: Every permit shall expire if the work authorized by such permit is not commenced within sixty (60) days from the issue date of such permit. Before such work can be commenced or resumed, a new permit shall be obtained and the fee therefor shall be one-half the amount required for the original permit, provided that no changes have been made in the original drawings and specifzcations for such work; and provided further, thcit such suspension or abandonment has not exceeded one year. Pursuant to Section 2 of Ordinance #1205, the City issued a building permit for the above referenced property on November 6, 2000. This permit was originally approved in July 1999. The City held this permit at your request for more than fifteen months in an effort to accommodate your schedule. The moratorium in effect did not apply to the permit at that time. A new permit is required since permit #11458 expired because work did not commence within 60 days from November 6, 2000. Section 5-37 of the Code of Laws does not authorize the re- issuance of a permit simply by paying one-half of the original fee. The provision clearly states that a new permit is required. Because a new permit is required, the project is affected by the moratorium and a new permit cannot be issued until the moratorium has expired. Please find enclosed checks numbered 1098 and 1099 that are being returned to you. You may apply for a new permit when the moratorium has expired and when any new requirements resulting from the moratorium have been addressed. We are responding to each set of comments and in a matching format. A copy of each letter of review is attached for reference. Wheat Ridge Fire Department letter of comments dated May 6 1999 1. Completed plans and cut sheets of the fire alarm system will be submitted by the responsible subcontractor for the fire departments review and acceptance, prior to commencing with that work. We also require that this set of drawings be first submitted for our review and comment. The contractor is hereby directed to perform this action. 2. The sub-contractor pertorming the installation will submit complete underground tank installation plans, for approval. 3. The contractor is hereby directed to obtain a Knox Box application from the Fire Marshalis office, and to provide and install a Knox Box at the location directed by the Fire Department. 4. The laundromat backflow preventer is located in the laundromat mechanical room, see sheet P1.2. 3. Accessible clean-outs for all combination waste and vent applications will be provided, refer to plumbing sheets. 4. Neither door is equipped with a closer. Both doors are equipped with double keyed deadbolts in order that only attendants with a key will be able to lock or unlock the doors. The restrooms are equipped with motion sensor light switches, which have "pilot lights" visible from the cashier counters in both the c-store and laundry. Telephones are also located within the vestibule area outside the toilets in the unlikely event that someone does become "locked in". Signage will be provided on both sides of both doors stating "NOT AN EXIT" on the vestibule side when door is closed, and "DOOR TO REMAIN UNLOCKED DURING BUSINESS HOURS" on the store/laundry side when the door is closed. 8. Please be aware of the following items regarding the construction of the project: 1. The proposed drainage facilities shall be constructed and approved by the City of Wheat Ridge prior to issuance of the Certificate of Occupancy. 2. Erosion control for the project shall be placed in conformance with the approved drainage/erosion control plan and shall be maintained as needed during the course of construction. 3. All drainage improvements shall be constructed in conformance with the approved drainage report and plan. 4. Upon completion of the drainage improvements the engineer, Mr. David A. Guetig, P.E., Galloway, Romero & Associates shall provide to the City of Wheat Ridge a letter of certification stating that the various improvements, as defined in the drainage report and plan, have been accurately surveyed to confirm that their construction is in accordance with these documents. Unless otherwise designated, all referenced specificarions, standards or policies shall be the latest edition as revised or updated by approved supplements published and issued prior to the date of the building permit. Materials testing technicians shall furnish copies of failed test results to the inspector promptly as the results become available. On a weekly basis when testing is being performed, the developer shall furnish the inspector with copies of all test results taken during the prior week and a cover letter, signed by the supervising registered professional engineer, which summarizes the results and discusses any failed tests or inconsistencies. The City materials testing requirements are provided in Table 720-1. All testing procedures, point of verification and central lab requirements shall be as specified in the Frequency Guide Schedule of the Colorado Department of Transportation Field Materials Manual. One test is required for any fraction of the specified frequency. The 3/4" crushed granite adjacent to the drive lane at the rear of the building is there for landscaping purposes The owner has been notified that this azea cannot be used for any commercial use and that it will be monitored for compliance. 6. Shrubbery has been added as a landscaping buffer to the north side of the western-most parking area. 7. The amount of cobble has been reduced to less than 20% of the landscape area, as per city code. 8. The intended hours of use will be decided, based upon the demands of the business, by the lessees for the convenience store and laundromat.
